5 Big Problems With The Senate's Amnesty Bill

The amnesty bill in the Senate looks as if it's going to be around a thousand pages, it didn't go through normal channels in the Senate, and it was just recently released, so there are sure to be dozens of serious problems with it that either haven't been discovered or widely publicized yet. Then, once the amendment process gets started, a whole new host of issues will be created. But in the interim, here are 5 huge problems with the bill that should lead conservatives to oppose it.

1) Security doesn't come first in this bill. If there's one lesson people who have followed the immigration issue have had burned into us over and over again, it's that if you agree to an immigration bill that has amnesty and enforcement provisions in it, the amnesty happens but the enforcement provisions are never enacted.

This bill would immediately legalize illegal aliens that are currently in the country and then it would put in place triggers to be completed in order to get a guest worker program going. The problem with this is that Congress is like a five year old at dinner when it comes to immigration. The only way you can get the kid to eat his green beans is by telling him that he can't eat his ice cream until he's finished -- and the only way Congress will actually see to it that the border security and enforcement provisions in the bill will be implemented is if they have to do them before they even consider an amnesty for the people who are here.

2) Illegal aliens won't have to pay back taxes -- where do we get the same deal? The whole idea that illegals shouldn't have to pay the taxes they already owe for working in the United States is utterly and completely offensive because it actually gives them a privilege that American citizens aren't getting: forgiveness for taxes owed to the IRS.

The rationale behind this is supposed to be that it will be difficult to figure out how much the illegal aliens owe. Of course, the same could probably be said for most Americans who have been audited by the IRS. It's also worth noting that if our government doesn't believe they can make heads or tales of the paperwork that will allow them to collect money they're owed, how can we possibly be confident that they can figure out which of these illegals have criminal records or arrived before the deadline to receive amnesty?

The truth is that when you consider that most of these people aren't in the country legally, don't respect our laws, have no qualms about document fraud, and combine that with the practically non-functional bureaucracy we have in place to deal with immigration problems, you'll have everyone from rapists to terrorists to murderers given a tax amnesty and legal status in the United States because the bureaucrats won't have a clue who's who.

3) Free legal services, on the taxpayer's dime, for illegal aliens -- where do we get the same deal?: Have you ever needed a lawyer? They're not cheap, are they? In fact, you might have forgone collecting money that you were owed or fighting an unfair allegation made against you because you couldn't afford a lawyer. But, that won't be a problem for illegal aliens because this bill would provide lawyers for them and YOU would be one of the people paying for it. From the Heritage Foundation,

"The Senate's bill would force taxpayers to foot the bill for many illegal aliens' lawyers. Under current law, illegal aliens are not eligible for federally funded legal services. Section 622(m) of the bill would allow millions of illegal aliens who work in agriculture to receive free legal services. Every illegal alien working in the agricultural sector would have access to an immigration attorney to argue his case through the immigration courts and federal courts of appeals—all at taxpayer expense. This provision alone could cost hundreds of millions of dollars each year."

Why should American citizens be asked to pick up the tab for the legal bills of foreigners who don’t obey our laws? This is like demanding that a citizen of a town contribute to a legal defense fund for a cat burglar who has been breaking into houses all over town or in the case of illegal aliens, using our hospitals and schools for free while collecting welfare and food stamps for the anchor baby that they had here.

4) This bill rewards illegal aliens for breaking our laws. As anyone who has a friend or relative who has tried to go through our legal immigration process can tell you, our system is a hopelessly tangled ball of red tape that takes many years, thousands of dollars, and almost countless hours of frustration to maneuver through. That's why we have tens of millions of people who respect our laws and our country, waiting patiently, in line, often in their home countries, to get a chance to come here.

But, what about the people who don't respect our laws or our country and just wandered across the border one day, bought fake documents, and used our schools and hospitals for free? The Senate is giving those people a sweetheart deal.

They'll be immediately eligible for a "Z Visa" which allows them to work, go to school, and -- this is important -- stay here for the rest of their lives if they so choose because there is no limit on the number of times it can be renewed. Some of them, as has already been mentioned, will be given free legal services and none of them will have to pay the back taxes they owe. This bill also allows colleges to give illegal aliens in-state tuition rates, which isn't only a better deal than legal immigrants get, it's a better deal than American citizens get. For example, an illegal alien from Saudi Arabia could potentially get to pay a cheaper rate to go to a college in California than an American citizen from Oregon. Keep in mind that all these privileges and benefits will even be given to illegal aliens who are gang members or have directly violated orders of the US Immigration Court to leave the country.

Free lawyers, no back taxes, breaks on tuition, and getting immediate legal status in the United States? Where do American citizens sign up for this deal and why would any foreigners want to bother with following our laws when they'd be better off if they just ignored them, entered our country illegally, and bought some fake documents that show that they were here in December of 2006? When you reward people for breaking the law and punish people for respecting it, don't be surprised if you get a lot more law breaking. That's why this amnesty is expected to cover 12-20 million people when the one in 1986 covered less than 3 million illegals. It's also why the next amnesty, if this bill passes, will probably apply to 30-40 million illegals a couple of decades hence.

5) The price tag for the American taxpayers from this bill will top two trillion dollars! Senator Jim Bunning, step up to the plate and tell us about the cost of "low skill immigrant households,"

"Each of these households pays about $10,000 annually in taxes. That is less than almost every other American household. What is more alarming is how much they are receiving. Each of these households receives an average of $30,000 a year in immediate benefits. That means each low-skilled amnesty household costs the American taxpayer nearly $20,000 each year—twice what they are paying in.

If we look at a breakdown in what they are receiving, that’s $30,000 a year in Social Security, Medicare, transfer programs, cash, food, housing, social services, medical care, public education, and population-based services like police and fire protection. $30,000 seems like a pretty hefty welcome basket just for crossing our border.

Most American families are taxpayers during their working years and tax takers during retirement. Not the low skill amnesty family. The low skill amnesty household takes more from the government than it pays in at every level. Therefore, claims that we can save Social Security and other programs by importing young immigrant workers are simply myths.

The most expensive group, of course, is the 65 and older crowd. They cost the American taxpayer, on average, almost $32,000 per year, every year. If we consider only the illegals given amnesty, those costs will add up to over two trillion dollars – that’s trillion with a “T” – over their lifetime."

In other words, the price for that "cheap foreign labor" that businesses will get out of this deal, aside from lost jobs and depressed wages for American workers, is more than two trillion dollars in debt for the rest of us. That's why anyone who supports this bill has lost the right, now and forever, to call himself a fiscal conservative or claim that he cares about the size of the deficit.

There are over 20,000 gun control laws on the books already. A coupla years ago when I checked the bills pending before congress, I counted over 250 gun bills and wasn't even halfway through the list of bills.

The gun control freaks in congress just keep submitting them.

Questions for illegal apologists

Why does The National Council of the Race(la raza in spanish) and the Chamber of Commerce get to negotiate a "Comprehensive Shafting of The American Citizens" behind closed doors? Since when does an organization representing foreign nationals breaking our laws get to rewrite our immigration laws to suit the lawbreakers? Isn't this akin to allowing NAMBLA to rewrite our laws regarding child predators? Or allowing organized crime syndicates to rewrite racketeering, gambling, prostitution, and extortion laws? We The People are being told by our representatives that we should sit down and shut up while they invite in the entire world. We The People should get some say in this matter. Another amnesty will set off a stampede like we have never seen before. There is not much time to save our country. All the money and power are on the side of shoving this amnesty down our throats. We must keep the volume growing, they still cannot or will not hear us. If they do succeed in getting this through, do not despair. Any act of Congress can be undone by another act of the next Congress. Some may not remember the Catostrophic Health Act that was so disastrous, it was repealed the next term. First we must remove from office all those who surrender to the demands of the cheap labor/illegal alien lobby.

Enforce laws!
While I CANNOT speak for anyone else, as a LEGAL immigrant, I RESENT the notion that people like me who oppose amnesty are anti-immigrant. I am simply anti-ILLEGAL immigration. If we are NOT going to enforce our immigration laws, then let's make it fair: let's remove the laws from the books and inform the world that EVERYONE is welcomed -- NOT just those from countries that border the USA, which geographical location make it EASIER for them to swim or trek to here!

You have to understand that Senator Kennedy's responsibility for enforcement is null. That is, his only responsibility is to create legislation that furthers his agenda. Congress has no jurisdiction for law enforcement.

Should you ask Senator Kennedy why he hasn't enforced existing laws, he will simply direct you to President Bush with the instructions to ask him why existing laws are not enforced.

Get it now? Congress doesn't care what you and I say, they can hide behind the Constitutional separation of powers to absolve themselves for nonenforcement.

I'm afraid you are right. I think this bill - at least in its current form - will quietly disappear for a while, but I think they will keep coming back to the table again and again until people get worn down with fighting it. The press will keep hammering the "zenophobe, bigot" card, and the politicians who are supposed to represent us will say "one has to compromise, this is the best we can hope to get with a Democratic majority".

The Dems know the majority of the people oppose it so it is to their advantage to press while there is still a Republican president in office to absorb and deflect some of the anger and criticism.

Sad to say , but I think the Repubs supporting this bill and the Pres are being played as the "useful idiots" here.

This is a letter sent to me about the immigration bill that Phil sent out in protest to lawmakers.



As a registered Republican who is also livid at the sell out being orchestrated by the traitors who call themselves representatives of the people. The US legislative branch has been disconnected from the electorate on the issue of illegal aliens and unlawful immigration for years. I had the pleasure of listening to Rep. Dana Rohrabacher on CSPAN last night where he went over the details of S 1348 with a critical eye. He and many like him can see this sell out for what it is. I am curious if the CofC and moneyed interests have influenced your judgment as they have many on the hill. If you spent some time with D.A. King of The Dustin Inman Society, I am sure that you will change your tune. Let's be honest. This is all about cheap labor and money being preferred over the American middle class and to further the integration of the USA with Mexico and Canada. What that happens America will no longer exist. I would hope that you would be able to see that. NAU, SPP, CAFTA, FTAA, LOST, etc. are obviously cogs in the wheel to establish the NWO. There is sufficient information in the public domain by the likes of Robert Pastor and his ilk at the CFR on the CFR web page, to make obvious to whomever wants to learn, our national sovereignty is being threatened and S 1348, if passed, would create a third world banana republic where the United States of America used to be. Wake up sir.

Be afraid-- be VERY AFRAID! Congress, pushed relentlessly by the Conpiracy Of Evil, is poised to create a path to Scamnesty for 12-20 million ILLEGAL aliens. With "chain migration," that will mean MANY MORE millions of indigent poor-- and the permanent morphing of America into an entitlement government welfare state. The public trough will become a voracious, inexorable black hole devouring all that has made America great as we morph into a bilingual barrio.

If you listen to the pro-ILLEGAL alien arguments by members of the Conspiracy Of Evil, they are like low-hangin' fruit to refute... let's demythologize a couple of the most unctuous:

1) Disingenuous premises:
The "undocumented workers" are generally hard working, good people who simply want to feed their families and do those jobs that Americans won't do that America must have done... on balance, they give America more than they take... indeed, we MUST have their labors.

Reality Check:
ILLEGALS are too often both poor and undereducated-- a formula for socio-economic DISASTER if they are allowed to naturalize. We are simply allowing corrupt Mexico to dump its welfare problems on America. ILLEGALS drive down wages, and they ARE taking good jobs-- America does not save at all! A relative few hoteliers, contractors, meat processors, and other law-breaking employers milk them for lesser wages, then the TAXPAYERS GET STUCK with the crimes, barrio blight, drugs, gangs, sullied schools, ethnocentricity, and welfare costs. Bilingual education is a scam and an abysmal failure. ILLEGALS are at least 3x as likely as legal residents to be incarcerated for serious crimes:

2) We should respect their "rights" and put those who have a job on a path to citizenship and require the payment of back taxes, learning English, and paying a $2,000 fine. They have a right to come here because "our immigration system is broken."

Truth Check--
HOGWASH! We owe them NOTHING! NO THING! It is NOT our immigration system which is broken-- it is the nonfeasance of the national pols to enforce existing laws which has precipitated this crisis. We need to require a tamper-proof I.D. card ASAP for ANY non-citizen to function here period-- to work, get a license, attend school, rent an apt., pass go, etc. They will not really build the wall or otherwise crack down on employers-- the I.D. card radiates the cancer at its starting point. Make ILLEGALS repatriate to apply for it, then vet them thoroughly to see who might come back on an INTERIM basis to work.

There should be NO CONNECTION WHATSOEVER between having been here ILLEGALLY and later gaining citizenship. Token fines and back taxes are a farce! Some would charge them a $2,000 fee when their ANNUAL cost to taxpayers (per Heritage) will be $22k just in net govt. services used alone for a family headed by an uneducated, poor ILLEGAL?!?!

Why is this such a vexing problem? Because different powerful users with ulterior agendas salivate over ILLEGALS --> the PC "elite" left sees poor, malleable voters (40 acres and a mule redux) who will assure big entitlement government for the Big Brother elites to control; miscreant employers see cheap labor that the taxpayers are forced to subsidize; the scandal-plagued Catholic Church sees replacement contributors; self-serving national pols see hispanic votes in key states; the well-heeled like their cheap domestic help-- and THEIR children will not have their private schools ruined by them; finally the latino groups quite simply indubitably seek the Reconquista-- the morphing of America into Mexicomerica.

Kennedy's Add-on to bill
GUN CONTROL IN THE IMMIGRATION BILL

Senator Ted Kennedy and the anti-gun zealots who wrote the bill just couldn't resist the temptation to get their hands on our guns. They
have included language that GOA has been able to defeat in the past.

When Senator Orrin Hatch (R-UT) introduced these anti-gun provisions in 1998, the GOA grassroots were able to convince seven senator cosponsors to pull their names from Hatch's bill.

At the time, The Hill newspaper credited GOA with having "generated a significant number of postcards" into Senate offices. "The defecting
[seven] senators, echoing the concerns of the GOA, are apprehensive about the violation of Second Amendment rights," reported The Hill.

The current language in the amnesty bill is only slightly different from Hatch's original language almost 10 years ago, but it would
essentially do the same thing -- threaten every gun store in America.

In Section 205, for example, all it takes for the employees of a gun shop (of five or more persons) to become a "criminal gang" is:

* For them to commit two or more violations of ANY federal felony gun offense -- which includes virtually all gun offenses, including paperwork violations; and

* For the anti-gunners to find that violating gun laws was a "primary purpose" of the group.

So let's say your local gun store sells two or three firearms to Mayor Bloomberg's thuggish agents under New York City's extraterritorial "sting" operations. Your gun shop is now a "criminal gang."

This provision could even be used against a family of five who drives by two schools on the way to a movie with a gun in the glove compartment. Certainly under a Hillary administration, it would not be surprising to see them treat this infraction as a "felony" under the weird language of Gun Free School Zones Act. Thus, you and your family would become a "criminal gang."

OTHER PROBLEMS IN THE IMMIGRATION BILL

There is still no official immigration bill -- that is, the working draft does not have an official senate number. The draft was concocted by senators who put it together behind closed doors, all the while bypassing the normal committee process.

While this unofficial draft has been "the buzz" around the country this past week, several things have been overlooked. One thing, to
be sure, is the threat to gun owners' rights mentioned above. But also ignored is the fact that the negotiating draft imposes draconian
penalties for those who live in states that have the audacity to veto the National ID card (which passed as part of the REAL ID Act of 2005).

If you live in a state such as Montana, Maine, Idaho, etc. which has passed legislation opposing the government's efforts to turn your
driver's license into a National ID card, YOU COULD BE DENIED EMPLOYMENT OF ANY SORT.

Gun Owners was already concerned about this law -- which has yet to be implemented -- because of the threat it poses to gun owners' privacy. But now the immigration bill will go even further by
requiring all present and future private sector employees to be screened by the Electronic Employee Verification System (EEVS).

And in Section 1(a)(4)(i) of the draft legislation, the bill allows for EEVS approval of your continued employment only if your private
employer meets "strict standards for identification documents that must be presented in the hiring process, including the use of secure documentation that contains a photograph, biometrics and/or complies with the requirements [of the] REAL ID Act...."

Hence, no National ID card... no job.

Dear Senator:

Why does the Congress seem bent on pushing gun control every chance
it gets? First, there was the McCarthy-Dingell bill in the House (HR
297) that would greatly expand the Brady Law. We don't need more gun
control as a response to Virginia Tech shootings. We need to repeal
the gun free zones that turn people into mandatory victims!

Now, the Senate wants to sneak gun control past us in the form of an
immigration bill. The Senate immigration package is a horrid piece
of legislation in such a wide variety of respects.

But, in addition to everything else, section 205 could, in the hands
of an anti-gun administration, PUT EVERY MAJOR GUN SHOP OUT OF
BUSINESS.

All it would take is for the shop to commit two felony paperwork
violations -- and an anti-gun administration willing to find that
this was a "primary purpose."

Similarly, a family driving to church or to the movies -- with a gun
in the glove compartment -- could be a "criminal gang" if it passed
two schools, and an anti-gun administration determined that
protecting his family was one of the father's "primary purposes."

Again, I urge you to OPPOSE the immigration package as long as this
anti-gun language remains in the bill.

Charlie is exactly right.
But what everyone is missing is what the REAL reason is that most of those detestable, rats in Washington wont fix our borders. On the surface it is disgustingly clear that one side is in it for the votes, and they very well are for that in the short term. On the other side the RHINO's are backing big business. But people dont understand that government is like a big onion, with hundreds of layers. They may be the biggest collection of theives and lyers in the world but they are not fools. They are doing exactly what they know will keep the people at war with eachother and deflect attention from the bigger picture. Anyone who has followed politics knows that this bill will never be passed the way it is. The scum who authored it, on both sides of the swamp know it too. I mean really, think about it. They are ALL lawyers and any lawyer will tell you that when you are trying to get a deal you almost always demand more than you expect to get. But look down the road 10, 20, 50 years if any thing in this bill remotely resembling amnesty is passed without complete border and immigration controll and you will find a huge percentage of people living among us who really dont see America as their heartfelt motherland because they are so cemented together by their culture. That culture to them IS their identity. That culture is MEXICO. That culture is the bottom line. Now put that block of people into the mix with the Proposed Partnership and Prosperity agreement signed by that traitor Bush and the presidents of Mexico and Canada and we are on the fast track to a borderless North American Union. The Dems and the Pubs that are supporting this slap in the American peoples face of rotten legislation are looking way down that road ahead of 99% of American people. That is the road to socialism and the tyrants in the District of Corruption are filling up their political gas tanks with as many third world supporters as they can because they will be the majority of the people who really dont care about America's soveringty. This debate on Immigration is the critical mass that will end America as a sovergn nation as we know it.

Problem #6: ANCHOR BABY
No "comprehensive" immigration reform is complete without fixing the anchor baby loophole. Anyone here on a "temporary guestworker" program who has a baby, the baby is a "U.S. Citizen." If the parents overstay the temporary visa, they run to churches and complain "The U.S. is trying to separate us from our children! Our children are Americans!"

Yes it takes a constitutional amendment to fix this. But Congress has considered amending the constitution to resolve the flag burning crisis, so why not this crisis?

I'd written letters to my senators and representative protesting the proposed immigration bill. When I showed a copy to my son, he exclaimed, "This could apply to just about any bill they try to pass!" He then took my letter, and came up with the following all-purpose prototype:

Dear _____________________,

Any serious attempt at ________________________ reform must address the basic realities, which include ____________________________________________________, ______________________________, and of course, _____________________________. The question of what to do about _____________________________________ is secondary.

The proposed ___________________________ bill is a sham attempt to deal with the consequences of failed policies, not the causes of those failures. Its provisions for _______________________________ are woefully inadequate. Its complexities are quite beyond the abilities of ________________________ as that agency is currently staffed and configured, providing exponentially greater potential for fraud and abuse.

Please do NOT vote for this bill.

John Hawkins deserves kudos for homing in on some major egregious aspects of the pending Scamnesty legislation, but then it is like pickin' low-hangin' fruit!

I agree with Dangerous Dave-- some things have a necessary guilt by association... Martinez is latino first, then American, which seems to be the norm... Presidente Jorge and Sen. Juan McQuisling are simply traitors on this issue--> vote and power whores... I really do not want to know what motivates the besotted manslaughter perpetrator Teddy. I need look no further than the supporters here to retch at the prospects of what this travesty legislation would mean for America.

supporting ILLEGAL aliens will be the death knell for Republicans! There is so much disinformation being perpetrated by apologists for ILLEGALS that the xxxx is getting piled higher and deeper! When ILLEGALS are allowed to vote, they will break at least 9:1 for the left-- for big entitlement government. The fear of a backlash among native-born latino voters is misdirected-- about half of them in Az. recently approved tough new anti-ILLEGAL alien referenda issues in the state most immediately burdened by them.

Vote buying

Is this bill is comprehensive vote buying.
What is vote buying????
Is it legal or a crime????
Is there a punishment for it????

I guess I should ask Congress for the new definition. But laws are for us. They are above the law. Just ask Kennedy and crew.

If this scamnasty is passed, it will be the end of republicans. But do not fear a third party will be take its place.(LA RAZA) That's a poke in the eye of the dummycrats. They can forget about being in charge of anything forever.Teddy and other commie hate America first ones, will be out of a job.

You forgot two other BIG problem....
1) LEGAL CHALLENGES- Once they get their amnesty, their lobby groups will challenge all new laws and rules they don't like in the Courts (which we will pay for) and get them overturned. Just like they overturned Prop 187 in CA after the voters unanimously voted for it.

2) REPUBLICAN SUICIDE- Amnesty will be suicide for the Republican party, since all these people will vote Democrat. We will be left with one party only and that will lead to America becoming a Marxist Socialist Republic.

I haven't even read the article. But I can give you the five problems with this amnesty bill:

1. Ted Kennedy took part in it.

2. John McCain took part in it (and is now trying to shove it down our throats)

3. George W. Bush backs it

4. Mel Martinez backs it

5. Arlen Specter backs it.
