Accountability From Wall Street Needed To Earn Back Trust from Main Street

In recent weeks, as the American people have continued to grapple with a slowing economy and instability on Wall Street, the response to calls for a sweeping economic stabilization plan has understandably been one of anger and frustration. I share that anger.

I’ve personally heard from thousands of Texans, and the complaints have come from all walks of life – retirees on a fixed income, middle-aged men and women working two jobs, small business owners, and thousands of others who have much to lose if the economy continues to slide. I’ve even heard similar frustrations from those who have much to gain if the economic stabilization proposal is passed and credit remains available for economic necessities such as home loans and small business growth.

But who can blame them? The vast majority of Americans play by the rules – they pay their bills on time, file their taxes every April, and budget-and-save for their families accordingly. So they are understandably outraged with the idea that their hard-earned tax dollars, even if ultimately recouped, should go to aid those who engaged in irresponsible, risky, and perhaps even illegal conduct.

And let’s also not overlook the fact that this proposal is being put forward at a time when Congress’ approval rating is already at an all-time low.

So it should serve as a wake up call to every Member of Congress when nearly every major political and economic leader in the country -- the President, the Vice President, the Treasury Secretary, the Chairman of the Federal Reserve, the Chairman of the Securities and Exchange Commission, the Democratic and Republican leadership of the House and Senate, and the Democratic and Republican nominees for President – supports this economic stabilization plan and yet, the majority of the American people continue to have deep concerns.

Clearly, the American public’s confidence in their government and financial institutions is broken. They watch as the political parties put partisan brinksmanship and political infighting above the many important issues facing our country. And they watch as Wall Street insiders put their bank accounts over the savings and retirements of their clients, with few consequences.

Many have not forgotten that just two years ago, in 2006, Fannie Mae was found to have intentionally overstated its earnings by $10.6 billion to meet their projected targets. Yet, top executives simply received civil fines, and no criminal charges were ever pursued.

Clearly, the federal government, on a number of levels, needs to start earning back the faith and confidence of the American people. I for one believe the current economic stabilization debate before the Congress is a good place to start.

That is why I recently sent a letter to U.S. Attorney General Mukasey asking for a full investigation into what happened – to find out how Fannie Mae and Freddie Mac, which were so central to the issuances of mortgages in the United States, could have been so poorly managed that they had to be bailed out by the federal government. I’m pleased to see that the FBI is investigating and Grand Jury subpoenas have been issued to both companies this week. But more than just investigating, we must hold accountable all those responsible for any malfeasance.

If corrupt or fraudulent practices have led to this crisis, it is our responsibility to pursue anyone involved with the full force of the law. Reckless Wall Street gamblers and crooked CEO’s should pay the price for their actions, and legal repercussions should follow any criminal activity.

More than that, CEO’s and Wall Street insiders who put their bank accounts over the savings and retirements of their clients don’t deserve more money from taxpayers. I am pleased to see that both parties agree that the final proposal must include reasonable limits on executive pay for any company requesting taxpayer assistance. CEO’s who failed their companies and its investors to the point where the federal government needs to step in do not deserve golden parachutes. This is one of the many improvements that were made to the Administration’s initial stabilization proposal.

The bipartisan proposal that the Senate will vote on, though not perfect, includes a number of substantial improvements in the areas of oversight, transparency, and protecting taxpayers across my home state of Texas and America as well. Republicans were also successful in batting down proposals that would have resulted in more spending on special pet projects and higher taxes.

However, more must be done to bring those accountable to justice. I believe the federal government must immediately devote substantial new resources such as additional FBI investigators and federal prosecutors to focus on unearthing criminal behavior in every aspect of this mess -- from the mortgage application to the securitization of toxic mortgages. Congress should also pass legislation that requires bailout participants to fully cooperate – by turning over certain documents and making certain witnesses available -- in securities and mortgage fraud investigations related to the assets they are selling to the government.

I believe Congress and the federal government must send a clear and unmistakable message that those responsible for this mess will be held accountable. In doing so, we will be taking much-needed steps toward rebuilding the American people’s confidence in their government and restoring accountability in this great country of ours.

Yes, lets make sure we rebuild confidence in Wall Street. Then maybe you in Congress and try doing something about your crisis of confidence. If I had to bet, Wall Street is still more respected than Congress and that was before the Fannie and Freddie enablers in Congress were being exposed as the cheerleaders of much of this Wall Street crisis.
Cut the nice speeches on the floor and call out the culprits. Grow a set and bring down the thunder on the floor by calling out Dodd and Frank and Obama for their roles in all of this.

I have been reading everything I can get my hands on. No one has explained to me clearly why this bailout is necessary. How it would be carried out and why poor people were given mortgages. Or unqualified people qualified for loans outside of their ability to pay. And most importantly what is the percentage of bad loans out there compared to good loans? The government must stop hand outs. THe government is destroying the character and humanity of the people it is promising to help. This is not about helping the poor it is about greed for money and power. It's ridiculous and must stop now. There are people out there that think the government is there to take care of them. That is not American. STOP the stupidity now. I'm afraid this bailout will be used to put more people into homes they cannot afford. The reason I am afraid of this is because I heard those very words promised on the radio while I was listening to the news. UGG!

Joycey, I read and heard on the news and talk radio 5% of mortgages are causing the mortgage crisis. It has to do with how they were all packaged in with fair and good loans.

I don't understand all the details myself, but as the article said, why does the Majority have to pay for the Minority.

As one of your constituents, Mr. Cornyn, I am pleased to see you step up on this. However, I notice that you failed to address the part of this that has far more impact on the entire problem, and is the most disturbing. That part is the apparent corruption on the part of certain members of (c)ongress (okay, specifically, Spittle Franks, Chris Dodd and B. Hussein Obama)in aiding and abetting the Wall Street crooks. It actually looks like something that a good community organizer would cook up, doesn't it?

Let's make sure the FBI also addresses their, and any others,' contributing actions (including, I might add, any Republican who has been involved).

I say it is time to clean out (c)ongress, making sure that their last act is to pass a limitation on terms for future members of (c)ongress.

Barney Frank was ranking member (2000-2006) and then Chair (2007-present) of the House committee that was supposed to oversee Fannie and Freddie. Instead of investigating accounting fraud he spent the whole time denying a new regulator was needed and defending the GSEs safety and soundness.

Congressional oversight committees were charged with overseeing these GSEs. Instead they used them as a means to redistribute wealth, all the while denying there was an implicit government guarantee of their debts.

Now we need a multi-billion dollar bailout and the people that are selling the proposal are the same clowns who failed to oversee the GSE's in the first place.

WHERE IS THE ACCOUNTABILITY OF CONGRESS??

Why do Frank and Dodd not resign their charmanships in disgrace?

Why are you even spending two sentences talking about CEO severance pay? It amounts to a total of perhaps $70 million in these two companies, when the bailout is 700 billion. You're focusing a 1/10th of 1% of the problem to obfuscate. That's called a red frigging herring. Disgusting!

The place to start regaining Congress isn't by just doing a better job in overseeing Wall Street. No, Senator, this Texan says the best place to start is for those in Congress to police themselves, demand resignations from the corrupt committee chairs who (over the years) pillaged Fannie & Freddie and then ran cover for them. All you good-old-boys up there need to start calling a spade a spade, and start naming names. Expose your Dodd, Frank, Pelosi, and the rest of them for what they've done. Demand prosecution. Frog-march them in cuffs in front of the cameras, then go to prosecute the CEOs who ran Fannie & Freddie and do the same.

Then, next month, we voters can do our duty to vote the bums out.

Frank and Dodd don't have to resign. All that needs to be done is for their constituents to vote them out. How many people think that's going to happen? Those idiots who elected them, can watch them lie through their teeth on national television and go right to the polls and vote for them again.

My only recent memory of a crook being thrown out of Congress was Tom Dashle. Even William Jefferson and Ted Stevens are still there. We need lobby reform. Lobbyists have a right to lobby, but they shouldn't have a right to finance a campaign. How many people think that's going to happen.

The only thing they understand is their own personal unemployment and until we begin throwing some of them out, they'll continue to screw us for the sake of their thirst for power and money.

Previous posts ahve been right on the money. Those who caused this mess are looking to scapegoat Wall Street. Congress IS the culprit here. Those who had their campaign coffers filled by Fannie and Freddie are at fault along with those members of this supposed august who do not have the will to call them out on it. Sen Cornyn, McCain, et. al. who can not see the forest for the trees are giving the Republican brand a bad name. Vote out those who profit from government service and replace them with true citizen politicians as the Founders envisioned. TERM LIMITS NOW!!

As another of your constituents, I have written to you a few times on this subject. I just finished reading the proposed bill as well.

As I have stated to you in the past, I want to part of a bailout plan that does not.

1) Eliminate government meddling in the credit industry (Repeal CRA!).

2) Allow American business to compete (get rid of capital gains!)

3) Prosecute the guilty (That includes government officials as well as buiness!)

I see many of my fellow Texans share my views. I expect you should carefully consider what you will support, as we will be voting for, or against you very soon.

Discredit where discredit is due
"Wall Street" and its CEOs didn't create this mess: Democrats in Congress did, and Democrats in Congress perpetuated it. Adhering to the requirements of the Community Reinvestment Act of 1977 (as amended in 1993), banks wrote mortgages for people that they never would have been stupid enough to lend to had they been using their own money. People who were paying attention, like Greg Mankiw and John McCain, warned years ago that if real estate values dropped, the "sub-prime" borrowers would be "upside-down" in a big way, and that through Fannie Mae and Freddie Mac, the US taxpayers would ultimately be left holding the bag. They should be commended for their foresight, and John McCain should be elected president.

Meanwhile, no one who was supposed to exercise oversight should be permitted to continue to exercise oversight: Dodd, Frank, Clay, Waters, and any of the other Democrats who demagogued Republican warnings about the dangerous situation at Fan & Fred and who covered for the miscreants running those GSEs -- fellow-Democrats Raines, Johnson, Gorelick et alia -- should all resign their seats immediately, and the Justice Department should pursue them to the full extent of the law.

Act now to improve the liquidity of lending institutions -- repeal Sarbanes-Oxley, end the artificial "mark-to-market" travesty, attract capital into the U.S. market by abolishing the corporate income and capital gains taxes -- and you will have gone a long way toward making this problem go away.

But to change nothing and solve this paper problem by throwing my money at it?? If that's your plan, then as one of your constituents, Senator, I'd have just two more words for you, and the second one is "you".


Where's McCain?
If MCCain REFUSES to FIGHT on this issue, why would he fight for us on ANY issue? He has SO MUCH AMMUNITION... and he REFUSES to use it! This could not be set up any better for him, yet he sits silent, allows Frank & Dodd to remain in Congress UNCHALLENGED, never mentions the bill he put out in 2005 or the fact that Dodd and Democrats stopped it from even coming to the floor. Doesn't try to shut down Fannie or Freddie, the chief causes of the mess. Names must be named or the Dems will have everyone thinking this whole mess is the Republicans fault. McCain isn't fighting for us, like he promised. If he doesn't pick up this fight he will lose and we are all DOOMED!

Another Texas voter weighs in
I have also just finished wading through the Senate version of the bailout plan. The bill is 451 pages long, but the bailout plans only occupy the first 113 pages. That means there is 338 pages of Bovine Excrement tossed in.

I invite all commenters to come on over to my blog and see what is in this mess of a bill. It took me a couple of hours, and quite a few TUMS, to make this long blog post. It is sure to outrage even the veteran political junkies.

Accountability?
Mr. Cornyn we dont need an investigation, all of America by now should have heard the c-span recordings of the administration(clinton)and the democrats who attacked the people who tried to do something about this train wreck before the tracks ran out. We want these people from the clintons, dodd, reid, pelosi, frank and yes even to, but not limited to obama put out of office and prosecuted to the fullest extent of the law. How about some accountability from those actually responsible?

Unfortunately (or fortunately, if having a job is indeed fortunate) I'm getting ready for work soon, and won't have time to read the bill myself. However, I plan to spend as much time as it takes to read it in it's entirety before I sleep, and will be better armed tomorrow to foil the attempts to defend this crap.

They need it to hide what the bill actually does, and their going to need one to avoid the sh!tstorm that will follow if they pass this turkey.
I fully understand the ramifications if the fed doesn't do anything at all to try to help the honest taxpayers who got drawn into this mess through the clever manipulations of DC insiders in collusion with corrupt Wall Street insiders, but this is indeed a bubble that is deflating rapidly, and simply blowing more air into it is simplistic, and the bubble will STILL pop in the end.
The structure as it is will fail, period.
Senator, you would better serve your constituents by listening to them, and reading what the posters on this sight have to say. If you were the one to blow the whistle and halt the congress in it's attempt to distract us long enough for the lowest 50% of voters to forget how we got here, you just might find yourself in line to be President yourself. (After we peel off the scum leadership in place now).

Get Tough or Get Out
Thank God that Texas is represented better than most of the country in Congress. There is plenty of room for improvement: where is Sen. Huthchinson on this? We have some standout congressmen that need to be honored.
What we the people would like to experience is less government. To Congress: Stop trying to manipulate every aspect of our lives. Less is more. When the government steps in so does corruption due to a concentration of power; freedom and prosperity exit.
John Adams described the Constitution and our government as incapable of governing a people who were not restrained by morality and true religion. If we cannot be self regulating with a fear of God then we will be ruled by tyrants. The choice always lies with the citizen. Contrary to what the government wants you to belive, we are not helpless victims.
My challenge to every voter is to take a hard look at the consequences of Socialism. Unless the voters behave differently the Congress will continue to be filled with self serving do-gooders who will sacrifice the Constitution to be elite, life long politbureau officials. The culprits are buying off their constituents with pork. Voters must say no to being a "ward of the State", start trusting God again, and stop looking to the government as if it was God.

"...even if ultimately recouped...", by who? Does that mean I start getting dividend checks from the Fed once the Fed starts making money from all this? Of course not.

will be watching how you and Sen Hutchinson vote on this bill Senator. And if I remember correctly, you're the one with his name on the ballot in a month. This bill is still laden with pork and doesn't even go to the root of the problem...namely the CRA and the mark-to-market rules.

So quit trying to muddy the waters with hyperbole about 'greedy Wall Street' and start working on a bill that will allow the financial industry to work their own way out of this mess. NO MORE TAXPAYER FUNDED HANDOUTS TO ANYBODY...individuals, corporations, or entire industries.

"NO" does take 451 pages of hasty political writing to say. The "improved" version of this "rescue" (otherwise known as a bailout) is still a big loser. Something is just not right (beyond the obvious).

Bernanke flooded the market with about a trillion dollars last week. On Monday, 650 billion more. He doesn't NEED the bailout legislation to cause massive inflation of our currency. So why all the fear tactics they're using about the legislation???? The only thing I could come up with is this is a major power grab. I still believe that, but then I saw this. I heard a guy on CNBC last night, stating clearly what he thought was the reason. When looking for that video, I found this one. He shows the Kudlow clip and puts the case forward. This bill is not for Main Street , or even for Wall Street; it is to bail out FOREIGN investors.

Please watch this. I"m not vouching for this at all, because I don't know. But, it sounds very plausible.

We're just not so sure about this socialistic Bill. I blame the Democrats for blocking any progress for reform all of these years. But, that is water under the bridge now that our economy is in crisis. I am sick of watching my 401K disappear right before my very eyes.

I know that this is a tough choice for you, Senator Cornyn. Thanks for always fighting the good fight. I know that you have always had Texans/Americans best interest at heart. Thanks for being honest about the situation.

Something is just not right (beyond the obvious).

Bernanke flooded the market with about a trillion dollars last week. On Monday, 650 billion more. He doesn't NEED the bailout legislation to cause massive inflation of our currency. So why all the fear tactics they're using about the legislation???? The only thing I could come up with is this is a major power grab. I still believe that, but then I saw this. I heard a guy on CNBC last night, stating clearly what he thought was the reason. When looking for that video, I found this one. He shows the Kudlow clip and puts the case forward. This bill is not for Main Street , or even for Wall Street; it is to bail out FOREIGN investors.

Please watch this. I"m not vouching for this at all, because I don't know. But, it sounds very plausible.

Accountability by congress should be first. Just look at congress' current failure to even complete any of the 13 yearly appropriations bills for 2009 by September 30th. The Continuing Resolution to fund the federal government through March of 2009 was signed into law yesterday. Where was the congress when it should have been taking care of the routine business? Oh, yeah. Passing resolutions naming court houses, post offices, and special days. Really useful work!

Vote wisely, Senator. As I will be looking to see how you and Senator Hutchinson vote on this monster!

You won't hear this on the mainstream, but the reason the market had its biggest point gain ever yesterday was because the SEC reconsidered its position on mark-to-market accounting, and word got out on Wall Street. Yesterday afternoon, the SEC formally suspended the mark-to-market provision. The market stabilized. The market was stable today, too. The market will continue to be stable. Nothing further is required at this point; the market can heal itself from this point. Crisis over.

The bailout bill is poison and will destroy the market's newfound stabilization. You cannot misallocate $700+ billion in capital and not expect the crisis not to resume. The MSM and the Democrats do not want you to know all this because they want to continue to blame the free market, not the government's interference in the accounting profession, for this crisis. They hope word does not get out on what really happened. They want to use this occasion to redistribute wealth for their social engineering schemes, and they want the crisis to resume so they can continue to blame free market capitalism and permanently secure Obama's lead over McCain. I am no McCain fan, but this bill is pure treason.

I urge everyone to call their Representatives and keep up the pressure to resist a bailout bill. Apparently, the "no" calls from constituents are lessening in number, so many of the pols feel comfortable that they can pass this bill without political fallout. I urge you to continue to fight for our country. Make the politicians who are considering selling out too scared to do so.

Dear Congress, How Stupid of Us
To think that you were passing a Wall Street Bailout Bill when you really meant to pass a Middle Class Bailout Bill. Well, today our family met at the kitchen table and drafted a Middle Class Bailout Bill of our own:

Congress shall give $100,000 to every legal, U. S. family who needs extra cash or has bills to pay. Credit crisis solved.

Congress shall pay for college loans for those with degrees in Science, Engineering and Technology. Student loan debt is reduced and the economy is stimulated.

Congress shall allow Senior Citizens to withdraw from their IRAs without penalty to pay off a house, help their kids or grandkids or just spend it. Liquidity problem solved.

Congress shall immediately dissolve Freddie and Fannie and we won't press charges.

Congress shall agree that no member of the House or Senate can oversee expending government funds if they are a member of or chair of the following committees or subcommittees: Freddie and Fannie, AMTRAK, U.S. Postal Service, VA Hospitals, Medicare/Medicaid, Social Security, National Park Systems, Ethanol or Education.

If a congressional member fails to manage taxpayer funds, they will be fitted with a lead parachute and dropped off of the Washington Monument.

There is only one Earmark. For any city that has ACORN workers hustling to commit fraud, the bill will provide $100,000 for the Prosecuting Attorney of each city to hire additional help to prosecute fraudulent practices by ACORN.

All Middle Classers in favor, say aye; those opposed say no, the ayes have it.





Bailout in terms we can understand

In 2007. Americans used 390 million gallons of gasoline per day.

The Federal gasoline tax is 18.4 cents per gallon.

That amounts to $26,198,000,000 (26.2 Billion dollars per year).

The $700 Billion dollar bailout, will take approximately 26 years 8 months, using all of the Federal Gasoline tax money.

If you use $100 a month worth of gasoline - YOU will pay $18.40 per month to bail others out - helping them for 26 years 8 months.

Does that sound like a 'Fair Share' for you to pay?

Barack Obama says that if you buy a tire gauge, your part per month, might not be quite that much per month - you will just pay more years.

When you are gassing up your auto, while thanking the Democrats for NOT drilling and causing your high gas prices and while you are on your knees checking your tire pressure so that you can pay more years - you can thank Barney Frank and Chris Dodd for your 26 year 8 month payments to help others - you know 'Sacrifice for the Common Good' - Barack Obama says that makes YOU a Patriot.

Sen. Cornyn, let's talk about accountability on Capitol Hill instead of Wall Street. Why are you shilling for a bill that contains a provision, the "Mental Health Parity" provision, which would require private health insurers to cover mental illness equally with physical illness. Now, I am sure that as a Republican, you know full well that such a law would cause the health insurance industry to completely implode. Why are you cooperating with efforts to involve government in medicine?

I'm going to make a prediction
All the people here calling for accountability from the people that are responsible for this mess are going to be real disappointed. For one thing if too many are held accountable then some are going to talk about Mr. B.H. Oblamma, and you know they aren't going to let that happen. The MSM would call it a travesty of justice and say he was framed. The more radical of the Dems would riot in the streets. You know it and I know it. Call for it all you want, but if it happens, you better buy a glock to defend yourself.

Bail all you want, it's still probably going to sink, especially with a $700B hole in it. This will just make things worse starting with weakening the dollar. Perhaps this will actually show the public how congress really does need the enima I have been calling for. I guess it's just like addiction, perhaps rock bottom needs to be achieved before rehabilitation is possible. I believed that republicans hated the idea of welfare. The arguement I continually hear at Townhall goes something like: You hand someone something for nothing then you take away their incentive to look after temselves.

Well $700 Billion (for a start) is one heck of a welfare hand-out. And to people who have chefs for their cats, for pity's sake.

Take THEIR money, not the small taxpayer's, and send theme to Guantanamo as they are more of a threat to the survival of the USA than some crazy Muslim fanatics.

This is unacceptable. Supporting this bailout plan is nothing more than turning a blind eye yet again while Wall Street takes advantage of the taxpayers. I can’t believe you would think we would accept this. There are no assurances this bailout plan will work. There is no way to value these assets. I have no confidence that the government would recoup a significant portion of the money. Based on what I have seen we will have many more foreclosures before this is over and the real-estate market hits bottom. The best think you could do is lower taxes and eliminate the mark to market accounting regulations. Let the market take it from there. The only thing you said with which I agree is that those responsible should be investigated. Of course, that means Washington too.

The American people aren't concerned about Wall Street, they are concerned about Congress! Lawmakers strong-arm lenders into making bad loans to ensure every American the 'right to home ownership' and look what happens. It is pretty clear that members of Congress can't perform simple math operations. That, I presume, is a function of our public education system which Congress also has a heavy hand in. Members of Congress cannot read, either, since there is no constitutional 'right' to home ownership. The Democrats sold the American economy down the drain in order to garner votes from the underclass and now the Republicans have helped pass this bill to bail out their congressional cohorts. And they have added earmarks to this bill, too! Both parties are now screaming, 'Screw you, taxpayers! And don't blame us!' Well, you are to blame. I would like to see every last one of the cretins who voted for Fannie and Freddie to be prosecuted and then sued for congressional malpractice, starting with Barney 'Wh***house' Frank and Chris Dodd. The way to stop this type of travesty is severely restricted term limits and voter reform, and, of course, throwing these bums out.

Government Accountability
I'm all for prosecuting Raines, Johnson, Gorelick, and whoever else violated laws at Fannie Mae and Freddie Mac. But what I want to know is who is going to hold our senators and representatives accountable? These same people who demand more oversight over and accountability from others continue to promote themselves and their own interests over the interests of the country and its citizens. It's a little too much like putting the fox in charge of the hen house for me.

What About Accountability From CONGRESS?
If McCain & Palin want to win they have to successfully focus public angst where it most belongs on the Democrats in Congress.

Sure there was corporate greed, but that greed was largely encouraged and facilitated by the Democrats in Congress who advocated socialized "affordable" housing, and pressured those like-minded Carter and Clinton Adminstration officials who ran Fannie and Freddie, and other financial institutions to make more and more risky loans for low income housing. These people (crooks!) had to know that many folks would never be able to pay those loans, but I would argue they not only ignored the possibility of a systemic collapse, and hoped for it but quite possibly engineered it that way so that the Gov't would have to come and step in and take over. Clearly Nancy Pelosi hoped the Bailout wouldn't pass, and one could also argue she engineered it's failure because that would open the door for even more socialist intervention.

This election is really coming down to a choice between a Free America and a Socialist Amerika. We all decide.
