Last May, three U.S. troops were kidnapped in Iraq, south of Baghdad, by al Qaeda terrorists. The U.S. military immediately launched a search and rescue operation.

What happened next is extremely disturbing. Within hours, a new source of information was discovered that required electronic surveillance of phone conversations. Then, a maze of complicated U.S. laws kicked in, stopping progress on the new lead for nearly 10 long hours.

Weeks later, the body of one missing American was found in the Euphrates River. The terrorists claimed the other two had been executed. No one knows whether they would have been found if the intelligence lead had been immediately followed.

We do know that restrictions in an outdated federal law seriously complicated rescue efforts while government lawyers back in the U.S. sorted through a legal quagmire to develop “probable cause” for electronic surveillance. A Texas soldier, Cpl. Ryan Collins of Vernon, was killed while participating in the unsuccessful attempt to find the missing troops.

There is no dispute that laws must be followed. That is what our American soldiers did that day in Iraq. It’s also clear, however, that existing law can prevent immediate use of our latest and best intelligence technology, when quick action is critical to the lives of Americans. When this is the case, it’s up to Congress to change the law.

We must do better in fulfilling this duty. At the time of this Iraq incident, electronic surveillance for intelligence and military use was subject to the 1978 Foreign Intelligence Surveillance Act (FISA). Last year, Congress approved a temporary update, the Protect America Act. In early February, a bipartisan majority of the Senate voted overwhelmingly to extend key parts of the Protect America Act for six years.

But instead of approving the Senate bill, House leaders left for a 10-day recess. This meant the Protect America Act expired on Feb. 16. Now our troops and intelligence community are again operating under legal constraints that delay tracking terrorists who use Internet and cell phone devices that did not exist when FISA was enacted.

America leads the world in electronic technology. Some 98 percent of it is owned by private companies, and their cooperation is necessary in preventing terrorist attacks. But trial lawyers have filed lawsuits seeking billions of dollars from telecommunications firms that have helped our government stop another 9/11.

The Senate-passed bill provides protection against lawsuits for firms acting in good faith on government requests for help. This lawsuit protection is necessary to make certain they can protect their shareholders from legal expense even while they do their part to keep Americans safe.

Top U.S. intelligence officials have confirmed that in the week after Congress allowed the Protect America Act to expire, our country lost significant national security information. We are asking our troops and intelligence officials to operate with one hand tied behind their back. We are less safe than we were before Feb. 16.

National defense is the first duty of our federal government. Good intelligence helps protect our troops and win wars. Undercutting it hampers our efforts to defend ourselves, and endangers the lives of Americans. Our nation is grateful to Cpl. Ryan Collins, his family and the sacrifices of those who help protect our country. I will fight to reverse the recent lapse in judgment by Congress, and ensure our intelligence community and security forces have every tool available to keep us safe. We owe that to our citizens, and to the memory of Cpl. Collins.

Strong case for Security
Democrats are using the safety of this nation, as a politicaly tactic to simply satisfy their political anit-war base, but at the same time gravely jeopardizing several months of sensitive national safety /security , information/data loss up to date.
This hamstringing by the left, should be plainly explained, that only calls from suspected Al Qaeda suspects are under surveillance, and others need to have judges approval and oversee.
This is not a Pro or Against war issue, it is war on terror, a war we did not ask, but have to defend ourselves, simply our security depends on it, before loss of any life, we should act now.

Protect America--Texas Primary
For all of you voting in the Texas primary, here's your chance to further protect America:

Proposition 1 - Immigration: Federal, state and local officials should be required to enforce U.S. immigration laws in order to secure our borders.

Proposition 2 - Photo ID: The Texas Legislature should make it a priority to protect the integrity of our election process by enacting legislation that requires voters to provide valid photo identification in order to cast a ballot in any and all elections conducted in the State of Texas.

The Big Lie
If Cornyn weren't stupid he'd be lying. But since he doesn't know anything about the "Internets" then let's do a quick review.

Awhile back the NSA set up a program to snoop everyone. More accurately, to sample emails and IM's using keywords like "bomb".

The government asked the big telcoms to set up the snooping and they complied for the most part (Qualcomm and a few others opted out on the fact that doing so constitutes an illegal wiretap.)

The government put a protocol in place that they *claim* meets the 4th amendment standards.

When the telcom's sample something that matches a phrase of interest they forward the messages to the NSA. If the NSA thinks a message is one of interest they then get a warrant to have the phone companies release the phone number of the party paying for the ISP service.

The problem is, of course, is that this is tatamount to reading physical mail sans the envelope. It is definitely illegal.

Now, the propaganda going around is that the Protect America act simply allows spying on foreign parties who use US servers like "Yahoo!". Of course the big lie here is that FISA already allowed spying on foreign entities using American infrastructure.

Lawsuits currently pending against the telcomms are not by US server companies like Yahoo!, nor are the lawsuits by the foreigners having the IM's siffed. No, the lawsuits are by Americans who had their emails wiretapped and read without a warrant. Despite Bush's claims about "trial" lawyers, the only one's suing are the ACLU and the EFF, two agencies that make no money when they win on any of the pending cases.

Dems against Surveillance
Why are Dems against it? Simple. Follow the money.

They don't want anyone "listening" into their conversations/emails/etc with their foreign "operatives."

Now that we're temporarily blinded, I'm sure the foreign money is flowing into Dhimmicrat coffers....unofficially, of course.

The good senator's article lays the blame at the feet of Madame Speaker, but there's plenty of political blame to go around. Much of it belongs to American voters for not demanding more from the political monster they repeatedly feed. I'm optimistic enough to think the underlying fabric of our country can serve as the foundation for a better tomorrow, but we must collectively stop the political games (by all sides) played in Washington, D.C. It borders on madness to expect law enforcement and intelligence agencies to protect us without modern capabilities such as real-time communication interception. It's a difficult balancing act between privacy rights and national security, and we should be careful before reducing either. But it's imprudent to leave communication companies exposed to liability for facilitating the common defense. The courts are still available for redress should the government abuse the process.

If this indeed is what happened then everyone in that chain of command should be fired they didn't know the law and it cost their men. As usual though I suspect that it is drama queen Cornyn lying to the crowd.

Sorry, thought this was going to be about that nonexistent fence. I guess millions of unidentified people coming across our borders is no threat to America, though.

Wake up, people. This isn't just about calls from overseas to the U.S., or calls from the U.S. to foreign countries, being surveilled. The program also involved illegal disclosure of the records of millions of Americans making calls WITHIN the U.S.

House Representative Heather Wilson (R) Introduced new Version Act ( 5825) which would work without approval from the Secret Court Authorization. RFID is an uninformed and bad solution. I didn't read enough about it, in fact it would make things worse for the troops if someone decided to get them out. They are easily detected.

You can not tell me an army can not use any means necessary to go after a kidnapped soldier in a time of war just because of some law.

Doesn’t FISA allow tapping as long as you submit paper work before a judge within 72 hours to get authorization and if it is denied, you simply end the tapping?

Here is where we disagree. Today the Iqaq Governemnt tossed the provencial election bill to have greater Sunni involvement. One of our own flag officers was hit hard by an IED near Basra, the Turks are in Kurdistan these are all indications it is coming unraveled. My guess is we can keep it all together until about 90 to 180 into the new administration then chaos. Locking ourselves into a position of staying 1000 years or leaving tomorrow is bad and dumb.

I disagree strongly Al Q and Afghanistan are glowing examples of US impotence. But here is the huge difference -- nucs. I flew a bit with the Paki AF and been there on business in a civilian life the terrorities remind me of what the US was post 1860. Only now it is changing to what the Roman Empire must have been like in the 400s. There is a real danger of destabilizing the entire country. This is the Indian nightmare. We should do what the Brits and Romans would have done set up a puppet regime and get out of dodge (sorry for all the era confusion lol)

I am a Democrat but I also know and like many Republicans but mostly those you would likely call RINOs. I have a completely different philosopy but I knew, as they knew, when push came to shove we both loved the country although the other was "seriously" deluded. I am really convinced that this crowd would be calling Reagan a RINO if he were around today.

That has happened over and over at least Korea and Vietnam were battlefields in the Cold War. Iraq is a battlefield in no war. That problen stays and will have to be addressed

We go to dinner often and discuss politics.
I know that they are patriotic...but I do think that they do NOT make any attempt to inform themselves, but rely on what they hear peripherally as they work hard to better themselves and can not spend the time necessary to sort thru the BS and get the facts.

This usually results in my paying for diner and apologizing :)

If you want to stabilize Iraq, you will have to allow a functioning government or governments to form.

That's going to produce a lot of disorder and violence for an interim period, but you cannot prop up a government that is not politically consolidated and expect to get a functioning police force or army.

The current policy simply extends the period of time over which Iraq will be a failed state.

I appreciate that. And to tell you the truth, one of the reasons we continue "helping" the people in Iraq is becuase Americans are extremely commpassionate and they do not like the thought of war.

But our well-intentioned efforts will create more deaths -- not less. And by prolonging the period during which Iraq is a failed state, we are hurting our national security.

Training an Army and Police force is of NO value when the troops are loyal to their own groups and not the government. In fact, the training and weaponizing of such forces simply enbables the militias to fight a bloodier war than they would otherwise fight.

This business of the Sunnis, Shiites and Kurds holding hands and singing Kumbayah together has got to stop.

There is no "deal" of any kind that can be made among those three parties that will bring stability and order in Iraq, even temporarily.

The cross-referencing of information is astonishing. I can buy a purse on the internet and within an hour I have advertisements from other businesses selling purses and then they trickle in for days.

If I use my phone or turn on my computer wHen I get home, within minutes the phone is ringing and It's a telemarketer. I have a record of all calls and it's quiet until we start using our technology. I don't get it, but it exists.

Surveillance for prophet happens everyday and we don't even notice, but if we put it to good use to protect our soldiers or ourselves it's breaking the law.

My freedom isn't gone
Let's see when was the last time I received a call from my terrorist friends out side of the US borders---Never. I didn't lose any freedom; wish I could say I was sorry you lost yours but don't worry the democrats want another attack so they can blame Bush - this should help open that door. It is also good for the campaign coffers with their ties to the attornys, well gosh how can they turn down all that money and this kind of decision is a way to get even more. Ny honey, I am not paranoid and, yes, at this point I am pretty sure the govenment has little interest in listening to me discuss my grocery list. I do not have "unlimited" trust in government but I also am not in a closet quaking that they are out to get me. Besides, they are taking care of the really big problems like the investigation of major league baseball; it will be a while before they get to my shopping list.

Finally someone on this thread "gets" it.

For all you ninnys thinking that your gubmint is listening to your phone calls, do a little more research. They don't "listen" to anything because there isn't enough people much less computer capacity to "listen" to the billions of calls made everyday. The technology keys on certain key words and phrases on calls made to or from OUTSIDE the US, and if it meets specific criteria and guidelines, clicks it over for a human t0 put an eyeball on.

We're only aware of a tiny fraction of what they can actually do, for a reason. If loony libs were able to expose and blow up any of our capabilities, they would because they're anti-American at their core, selfish, silly and hateful.

If you don't feel you can trust this gubmint, you need to go find another. Don't undermine ours. Poor as it is sometimes, it's the best we've got and far above anyone else's.

We need to be prudent and practical, not paranoid.

Communications intelligence is a major part of warfighting and has been since the first letter was intercepted over 4000 years ago. It was vital in the defeat of both Hitler's Germany and Tojo's Japan (we broke the Enigma and JN-25 codes). It was vital to our performance in the Cold War, when we tapped into Soviet communication cables under the Barents Sea and listened in to as much of their radio traffic as we could (they did the same thing..witness the Walker spy ring). Our history includes CommInt all the way back to the Revolution, when Major Andre was caught with Benedict Arnold's plans.

The main sticking point is Publically owned companies doing the Governments work and wanting the same protections as the Government so as to not be sued. Why? MONEY!!!!!

We no longer have any privacy, sure the Constitution provides for it but when has the Constitution been strictly enforced in the past 30 years-Rarely and never for the past 7 (Bush).

I don't know why the government can't take over the part of telecommunications companys that do the monitoring of these phone calls so that we can be protected. These terrorist and their willing accomplices might have a hard time trying to sue the government. I'm not usually for more government but I believe something must be done.

Be aware that they have one of the largest most powerful lobby's in DC.

As to the small not rich firm....wake up! they want to be a big rich firm and one giant lawsuit will see to that.

NSA does not even have enough personnel to keep with the terrorists let alone average American citizens.

Have as yet to see anyone who has proven that their rights have been violated.

A Plague on Our Society
All of the posts claiming that the Dems are not harming our security since FISA is still in effect and surveillance will indeed continue are probably correct. But the real issue is the Dems dedication to rewarding their Trial Lawyer friends with a law that will allow endless court cases against ATT and Verizon. There are $ billions at stake here; far too much for Pelosi, Reid and other political slaves to the Trial Lawyers to give-up. This is a very good deal for the lawyers, since there are no true plaintiffs and the awards will go only to the lawyers - a REAL WINDFALL (maybe we could tax it). The Dems do not wish to harm this country; they just want to reward one of their most powerful special interest groups. The Dems are bought and paid for by the Trial Lawyers, the Teacher's Unions, etc. As usual, these pols make thjeir decisions based on supporting their Special Interest allies rather than for the good of the country.

Trial Lawyers are the most despicable group in our society and a threat to our economy and free market system. These people are the most selfish among us; they create nothing of value, they only destroy and then pocket huge sums of money by stealing from productive members of our society. Indeed, the trial lawyers may destroy this country from within before Islamic terrorism does. At last Lerach, Scruggs and a few others in this criminal class are being brought to justice. One reason for voting-in a GOP dominated government is the selection of judges who are not "in the pocket" of these crooks, and a government not beholding to this very rich special interest.

It is AQ hope? Robert, a stable government in Iraq, the result of civil war, is not good for AQ. Therefore, the current Unity government is not bothersome for them. They wouldn't mind if it continued indefinitely.

Terrorist organizations put out press releases taking credit for things they do not cause and claiming that certain developments mean they will benefit.

That does not mean that you or our commander-in chief need to be their enablers by pushing the same falsehood.

A civil war is the likely outcome of our invasion. It is not a "defeat" for our troops, or a "victory" for Al Qaeda -- though this will arguably the biggest strategic mistake in the history of our country for reasons unrelated to Al Qaeda which is the real reason certain politicians want to maintain the status quo.

You must have missed the report from the NSA Director and the General Maples on CSPAN. They emphatically claim that our intelligence capabilities are being severly handicapped because Ms. Pelosi didn't allow the PAA to come to the floor for a vote. The Senate passed it overwhelmingly and the House subcommittee passed it 13 to 2. Pelosi et al knew it would pass the House too IF she had allowed it to the floor for a vote. Therefore, Ms. Pelosi must shoulder 100% of the responsibity for the weakening of our national defense.

I agree with you 100% that she did so just as a favor to the trial lawyers. To me, that makes her actions even more reprehensible.
