WASHINGTON - A scandal has been emerging in the trial lawyer industry. It points to a potentially cancerous growth in our economy that is killing jobs and hampering prosperity at a time when families are being pummeled by the rising cost of living. What are Democrats in Congress planning to do about it? So far, the answer has been: nothing.

On May 19, trial lawyer William Lerach is expected to report to federal prison to begin serving the sentence he received after pleading guilty to charges of criminal conspiracy in conjunction with a class-action scheme involving his law firm, formerly known as Milberg Weiss.

According to federal investigators, Milberg Weiss officials masterminded a $250 million illegal kickback scheme involving their clients, and then lied in court about their actions. “The scope and the breadth of this conspiracy was breathtaking,” said U.S. District Judge John Walter, who sentenced Mr. Lerach, adding that the crimes involved go “to the core of our judicial system.”

More disturbingly, Mr. Lerach himself told The Wall Street Journal his illegal conduct and that of his law partners was an “industry practice.” At his sentencing, one of his supporting letters quoted Mr. Lerach as saying, “Everybody was paying plaintiffs so they could bring their cases.”

If in fact Mr. Lerach’s crimes are an “industry practice,” then the Milberg Weiss scandal has revealed a clear and present threat to our nation’s prosperity. Congress has an obligation to take action — by holding hearings to determine the extent of the scandal and the threat, identifying appropriate remedies and sending them to the president.

Nearly three months have passed since Mr. Lerach was sentenced, but Democrats in Congress have yet to conduct a single hearing to determine the extent to which crimes such as his are occurring in the rest of the industry.

The trial lawyer industry is, of course, a major source of campaign cash for the Democratic majority, which has happily accommodated the industry’s agenda. At the behest of the trial lawyer lobby, Speaker Nancy Pelosi, D-Calif., has stonewalled a bipartisan national security bill needed to allow U.S. intelligence personnel to listen in on conversations involving al Qaeda terrorist operatives.

The bill passed the Senate with a lopsided bipartisan vote and appeared destined for the president’s desk. But then the trial lawyer industry — which opposes the bipartisan bill because it prevents patriotic companies from being sued after cooperating with the government’s terrorist surveillance efforts — called in its chits. House Democratic leaders have subsequently refused to allow the bipartisan bill to see the light of day.

The relationship manifested itself again this week when housing legislation was considered by Congress. Tucked into the housing bill was a $35 million taxpayer-funded slush fund for trial lawyers seeking to cash in on the housing downturn. The bill, if enacted into law, would “require that [$35] million ... be used for grants to state and local legal organizations with experience in foreclosure law.” A bill portrayed as an effort to help struggling homeowners was used to line the pockets of the Democratic majority’s trial lawyer allies, courtesy of American taxpayers and homeowners truly in need of help.

Last week, Rep. Lamar Smith, R-Texas, and I asked the chairman of the House Judiciary Committee, Rep. John Conyers Jr., D-Mich., to schedule a hearing on the Milberg Weiss trial lawyer scandal by May 19, the date on which Mr. Lerach is expected to report to federal prison. A copy of our letter to Chairman Conyers was also sent to Speaker Pelosi. To date, there has been no response.

A complete investigation of the trial lawyer scandal is needed to examine the scope of the threat to our economy. But a recent analysis by Congressional Quarterly observed that “[t]he majority Democrats in Congress, so many of whom are beholden to the financial largesse of trial lawyers, are unlikely to undertake that investigation.”

I hope that independent prediction proves wrong. Inaction in the face of a clear and present danger to our economy is negligence. But inaction for the purpose of protecting major campaign donors is corruption — the very scourge the current congressional leadership pledged to obliterate when it asked Americans to put it in charge.

I remain hopeful Chairman Conyers will put politics aside and schedule a hearing by May 19 that will allow the facts in the Milberg Weiss trial lawyer scandal to be examined in an appropriate and bipartisan way.

Grand Theft Auto: IV?
You mean to tell me congress is wasting it's time investigating a dumb video game? I thought they had more important things to do, like investigate whether any athelete has ever taken a performance enhancing substance, or investigating Rush Limbaughs latest joke told on the airwaves. How out of touch is this Boehner character if he thinks corruption and purchasing influence are subjects of sufficient importance for our elected officials.

So the fact that democrats are bought and paid for is news? And the fact that trial lawyers are the proud owners of their very own Congressional Representatives comes as a shock to anybody? Sorry, I don't mean to make light of a very serious matter but the fact is that the for sale sign has been up out front of DNC headquarters since LBJ's day. One of the most heartbreaking and fascinating things about our government is that the Democratic Party while having so completely sold out to Anti-American special interests manages to convince American citizens that it can represent them. Yet every term the Democrats sell out their constituants for as little as a few thousand dollars. Giving the money made by the people these political vultures are supposed to represent to anybody who'll kick back a couple of grand. Just one of those very sad things.

This particular mess should be running 24x7 on Fox News as it points directly to the corruption in our nation's capitol.

Lawyers protecting lawyers,

Now they are out of power, they start with the griping, where were they when we needed them and they ignored us? And where were they when they had the chance to place Jeff Flake on that committee, instead put a RINO in. Methinks Mr Boehner protests too much, the corruption ain't just
with the DemonRats, its just that they are better crooks.

A New Way
America's manner of dispute resolution is being fixed now. Slowly and surely trial lawyers are being phased out, but we don't know it.

America is devolving into a backward Third World country. We've opened our borders to the huddle masses yearning to live free in our safety net. Rather than lift them up to advanced nation status, America has chosen to come down to their level so that they don't call us insensitive and xenophobes. We'd rather be conquered and enslaved rather than hurt their feelings.

We subsidized their existence, tax legal citizens to pay for those coming here illegally to bankrupt our local governments and hospitals and take our jobs. We allow them to live by their rules and force native born Americans to not only tolerate foreign customs, but to embrace them.

One of the customs of the Third World is to segregate by clans, families and religions and to settle disputes with violence and brute force. No need for lawyers. Go to your local warlord, register a complaint and he'll dispatch armed gunmen to get vengeance.

It's very effective. The matter is resolved conclusively, for a while, and there's no messy, lengthy and costly appeals. Done. Fini.

Actually, there's some merit to this method. Our officeholders ignore us. They bleed us with high taxation, then turn their backs on us. Real needs go unmet while our money goes to things we disagree with. At least local chieftains and warlords have to produce.

And who can point to American jurisprudence with any pride? Injured parties win awards, but see little or none of the proceeds. Frankly, I think the risk of death would be a better determent than some lien, some piece of paper filed in a county courthouse, but which has no meaning.

Lawyers and their money
There is only one thing more dangerous than getting between a mama grizzly and her cubs -- and that is getting in between a lawyer and his/her fees. What parasites they are on our society and our economy! They pretend to be on the side of the little guy and the American consumer. Remember when the Calif Trial Lawyers renamed themselves the Calif Consumer Lawyers because their old name had become a pejorative term? What a load of BS. Lawyers are in it for the money, BIG money. And they will lie, cheat and steal for their share of the payola. Plaintiffs lie or grossly exaggerate all the time. Expert witnesses lie or grossly exaggerate all the time. Lawyers and judges ignore the lies and the judicial system keeps turning in a downward spiral greased by dirty money. And the plaintiffs lawyers justify their fraudulent methods by accusing the other side (corporations, insurance companies, etc) of similar conduct. Wonderful. So you and I end up paying an annual tort tax of $9,800 per year in the form of higher prices for insurance and just about everything else we buy. Now do you understand why the founding fathers said that morality was an indispensable part of our government and society? Without it, we get . . . trial lawyers like Lerach, Scruggs and many thousands just like them.

Term limits.....
Vince Flynn style is the only solution. Anything else is a wasted attempt.

Case in Point
A few years ago, I defended against a claim where a pizza delivery lady was bumped on the rear fender at 2 miles per hour (according to the police report). Most people walk faster than that. Because she was working at the time (delivering pizzas), all of her "medical bills" were covered by workers compensation insurance. But she hired a lawyer anyway and sued the owner of the vehicle that hit her. She had NO legitimate physical injuries. Damage to her car was less than $500. But she and her lawyer demanded $30,000 to settle the case. During mediation I looked her lawyer in the eye and said the case was fraudulent and he was less than professional for taking the case. Needless to say, we did not become friends . . .

Unfortunately, cases like this are no longer the exception; they are the rule.

Well said. How is it that the GOP never did a thing about this for all those years? In fact, not much was done. Some temporary tax cuts and a few judicial appointments. Real bang-up work. And we are supposed to try to get you guys back in power why? Will you put Flake on the Appropiations Cmte then or are you completely full of shite?

OK, so maybe you had to be there, but trust me, I've gotten mileage out of it. (I state this w/o animus toward lawyers, as most of my family & extended family are lawyers--even federal prosecutors.)

Perhaps our outrage is most properly focused on democrats, however, who protect & defend these predators at our expense. Illegal behavior should not be protected by our elected officials, especially in the Milburg Weiss case, given the fact that our national security is at risk here.

somebody has got to do something about this problem,or do we just keep paying for this with our insurance company. dont forget congress also has to talk to the NFL about some funny bussness with how they use the cameras. For the majority of the past thirty years, a Democrat congress had the chance to tackle oil prices, but all they could do is hold hearings and conduct needless investigations on the oil companies.

Now that their lawyer friends (Big Bar) are the ones needing hearings and investigations, they look the other way like a WWE referee.

Tea Party
If you are too young to remember the 1994 "Contract with America", maybe we can cut you a little slack; otherwise, do your research before stating unfounded assumptions. In the contract, Congressional Republicans committed to passing the "Private Securities Litigation Reform Act of 1995" which raised the bar in advancing litigation into the critical discovery phase which by itself places a big burden on a defendant regardless of the outcome of the case. After being vetoed by Clinton, it became one of only 2 vetoes among 37 that were successfully overrode by Congress and enacted into law (68-30 in the Senate and 319-100 in the house). Ironically, 4 Republicans including John McCain voted against it while Harry Reid and Nancy Pelosi voted for it. Even some other prominent liberals like Ted Kennedy voted for it. Either way, this reform would have never happened without the 1994 Republican landslide thanks to the voters. A big factor this law was reining in William Lerach himself with his abuse of Tech companies with volatile stock prices. My company was sued several times by Lerach costing us ten's of millions to make him go away until the next time our stock price would go down. It's a shame that our justice system took so long to even start to deal with this corruption of such lawyers who abused their privilege in serving the public trust. Lerach's punishment is long overdue, and unfortunately it is only a slap on the wrist given the damage he has wrecked upon the economy. Business executives from Enron and Worldcom received much worse punishment.

Revolving door
I think a big problem in our system is the revolving door between lawyers and judges which creates conflicts of interest because so many lawyers and judges are so chummy with each other. We may be better served if these were treated as separate professions like they do in Britain. We should also tilt the balance toward more loser pays or fines to law firms found to be suing in bad faith.

Hang them ALL
I don't care for Shakespear and don't care if his reference to hang all the lawyers actually meant the opposite or whatever...

I think if we start hanging these scum from the nearest tree when they are caught with their crooked hands in our pockets we will solve most of our problems. Think of it, no trial lawyers or ACLU scum to worry about...America would be a better place in a few hours!

Libs, don't give me platitudes or excuses for these leeches, it will be like water off a ducks back.

There is No longer a Justice System
AND, by the way, America no longer has a Justice System, we have a "Legal System", of, by and FOR the Lawyers.

How is it they have basically taken over our entire govt.? If they had guns/swords we'd have killed them as invaders but they have slick suits, shined shoes and paperwork and it's OK...as I said above, Hang them ALL, we can start over and do much better!

Don't call the telecoms "patriotic companies." If they were asked to break the law, they should not have done it, as Qwest chose not to do. If they did not do anything illegal, let them go to trial and prove it. Patriotism has to do with the Constitution, not the whoever the current President is. The Republicans are heavily supported by the telecoms, so they don't want their money to go away.

Tort reform, anyone?
What about loser pays?

Dems and lobbyists say that it would discourage legitimate lawsuits, but I disagree...

If someone has a legitimate claim that would hold up in court, bring it on! The loser would have to pay court costs and lawyer fees for both sides.


I bet there'd be quite a few less jackasses suing for spilling McDognalds coffee in their lap, and it would clear out the court system. I don't know how we could take care of inmates suing for ppv channels and air conditioners though, since they're indigent to begin with.

The Lawyer & The Brothers & The Father
A tale of morals & ethics.
During the Sexual Abuse Case against a Catholic Priest in my corner of the world, a trial lawyer suing the Archdiocese in Boston put an ad in the newspaper soliciting clients.

Several young men showed up at the attorney's office to 'tell & sell' their tale of woe. A couple of brothers "claiming" to be part of the abuse had brought an older sister with them and while there the lawyer tried every way possible to convince the young women that she too had been molested (by a gay priest) but had "suppressed the horrible memory" of the event.

To her credit the girl refused to allow the lawyer to file on her behalf, though BOTH brothers got their piece of the pie (and let me guarantee you, IF the Priest had made a 'move' on either of them they would have beaten him to death)...
The Catholic Church paid a lot of people just like these brothers (though many young men who probably should have sued for justice didn't) to make the case disappear as quickly as possible.

The Priest WAS DEFINATELY guilty and eventually paid for his crimes with his life while in prison BUT the brothers & many others are still enjoying their booty, just like the lawyer who placed the ad!

Most of the brothers' ill-gotten gains have gone up in smoke (literally) along with their lives as they were busted for drug trafficking. While another young man who it is assumed jumped aboard the moving gravy train without a REAL case eventually OD'd on the crap he purchased with the cash.
A True Story. Devise your own moral.

Thumper makes a good point and there were some achievements from the gang of 1994 but, without term limits the lawyers quickly became corrupted even conservative republican ones.

How many of your colleagues support investigating the snake pit? I suppose a good many don't really want to shine a light down that hole either.

Doing what the democrats do but less of it is not a very persuasive argument for a political party. I suggest you get your colleagues to agree on some basic conservative principles that transcend party lines and then enforce them. Don't be dismayed by liberal soundbites and the media's fascination with blood.

Your strategy of following the democratic party left and vacuuming up the votes of those Reagan(read conservative) democrats left behind may keep you in power for a while but, dooms the country.

At least McCain realizes this is a republic and not a democracy. Unfortunately, he is batting for the opposing team. Reagan understood this also and held conservative values that he communicated. It really is that simple. Most of the country wants that. Why can't we have it?

We don't like having communists in control but, they are the only alternative to punish you for your transgressions. You still don't get it though. Democrats were not put back in Congress because they have better ideas, it was simply a rejection of the corrupt rule both parties are guilty of. I guess we keep going back and forth until the end comes or another Reagan type conservative is elected POTUS and actually gets a grip on the party . Maybe Jindal or Palin in 2012 after Obama's or McCain's reign of terror ends.


Democracy sold out
We may be witnessing the refutation of the proverb that Democracies last only until the citizens learn how to vote benefits unto themselves.
The trial lawyers have beaten them to the treasury.

It's been decades now, and....
...both congress and the Senate has continually failed to:

Drill for oil and natural gas on our country's known deposits which are considerable.

Allow new refineries to be built.

Allow for wind energy to be established (because it will ruin some money-bagged potentate's view of the ocean).

STOP THE TRAVESTIES SUCH AS THIS TRIAL LAWYER FIASCO TO GO ON FOR YEARS.

Stop the deluge of socially-parasitic illegals from crossing our borders.

Build one lousy border fence.

Establish English as our national language.

Face it, folks. The politicians, left or right, are not truly representing anyone but themselves, and they bicker like children.

The Republicans had their chance when in the majority, but they ignored all of the above and spent tax money like lottery winners.

The Democrats are limo-socialists and thus would quite naturally sell out a citizen in a hot second so they're not expected to reform anything.

I am puzzled, Mr. Boehner.
Why is there a need for Congress to investigate it, when, as I assume, there are laws on the books concerning these acts, and it is the US Attorneys' jobs to investigate and prosecute the violators?

Wouldn't everyone's time be better spent if the President were to instruct the US Attorneys to get tough on the violations?

It seems about 99% of Congressional Hearings are meant for individual Congressmen to grandstand, and very little is accomplished that could not have been done through the appropriate bureaucratic channels or private interests.

For instance, what was it the Congress business to have hearings on steroid use in baseball? What in the Constitution comes even close to authorizing Congress to deal with that?

Trial lawyers now have an oligarchy
The more society devolves into disarray, the more they profit. Obscenely so. There is no indignant outrage over the need for national legal care, though. Many of the kids I work with have or have had involvement with the police and courts, and I have never met a lawyer that wasn't both stupid and destructive when it comes to managing teen cases, as well as wildly expensive for their dreadful "services".

Businesses I used to turn to for training and employment for kids no longer take risks such as hiring older teens for fear of litigation. Summer programs have been drastically reduced in numbers and inflated in cost due to litigation risks. Its a bit unnerving knowing that I can one day be sued for bad advice if someone decides what I told them ruined their life.

We have a growing society of victims and parasites, and the lawyers are more than happy to be the fertilizer in the mix. Scum bags one and all.

Seriously, the reason our government is so screwed up is because too many law makers are lawyers. If we had regular people running the government, we would be a heck of a lot better off. And now we have a lawyer running for POTUS. If BO wins we're really screwed.

outstanding idea. Health care is not very conducive to nationalization if you like high quality products and services at a reasonable price but, law, not that seems to lend itself to socialization.

I believe I should start haranguing my representatives to introduce legislation effectively rendering the entire legal profession a public good. All lawyers will be civil servants starting out about the GS7 level and topping out about GS12. Been hurt? Take a number and your government provided attorney will contact you eventually and you can go before the other attorneys and see who is best that day.

Brilliant suggestion.

Health care is way too diverse in terms of providers and services and medical devices and technology, pharmaceuticals, etc. The law is the law. Why should a rich guilty man get off with a good lawyer and a poor innocent man go to jail. Make it all random chance. Make the prosecutors and defenders switch places periodically to keep them honest. Civil suits would first be looked at by a judge to determine merit, and only then be assigned a government provided advocate to pursue the litigation.

Lawyers as civil servants,
now that is the most brilliant idea I have ever heard. Just kind about the impact. All those blood sucking, ambulance chasers stuck in dead end government jobs. That is total genius, why didn't I ever think of that? Smiling!!!

Hey, I am not saying there wasn't some good
that came out of the '94 election, however my main point is, they betrayed our trust in the ensuing years. They lost in '06 because they refused to hear us, and we weren't whispering, we were screaming and yelling and they turned their backs on us, preferring to be like submissive dogs, rolling over and piddling on themselves whenever a demonRat barked. And especially during Bush's tenure. We didn't hire them to carry any liberals water and that included Bush's. Much of the chaos we have domestically is due to their refusal to cross swords with the President; where were/are they when the fix was in to get McCain? Now we have the spectre of McCain's schmoozing with LaRaza, having Juan Smirkin'Jack Hernandes as his immigrant advisor (My mom was an immigrant, LEGAL
these he defends are illegal aliens). And Boehner is as much at fault as the rest, there wasn't any push to encourage conservatives when Jeff Flake wasn't appointed to the Appropriations committee. It was business as usual, the American wage slave is the money tree, shake us and money rattles into their pockets and the pockets of those who won't work.

I have never been a member of the Republican Party, but you know what, I'm going to join now. Do you know why? Because I am sick of how the party has lost its' sense of direction. I have decided that rather than sit around a gripe, that the only way to change the party is from within. So I'm joining, and I plan to be the biggest pain in the rear they have ever met. I hope to get others to join me, and drive them crazy until they stop wasting our money, and get the message that we're ticked off, and we're not going to take it anymore.

This is clearly a revoltingly corrupt piece of legislation. VETO, VETO, VETO.

Please also VETO the Farm Bill which has INCREASED the subsidy for ethanol and which is CLEARLY one of the factors that impacted food prices in the passed two years.



Minority hearings?
As I remember, there were numerous hearings held by the minority when the Democrats were in the minority. There is also legal recourse through the courts.

If the practice is as prevalent and as corrupt as Mr. Boehner suggests, and the Democrats do not want to investigate it, there are other ways, albeit more difficult.

Mr. Boehner, the problem with the Republican party is that it has lost its way in terms of being an effective "other party" to challenge the party in power. Until you figure out what you stand FOR, it is NOT enough to stand against stuff on a piecemeal basis. You will not become Speaker by that approach. As Karl Rove says, get your platform out and get it known. It does not have to be John McCain's platform; in fact, it would be better if it weren't the collection of mush which John calls his conservative principles.

If the Farm Bill is signed

If the Farm Bill is signed by Bush he becomes complicite in the deaths of potentially millions of people.

This Farm Bill covers the next tens years of pork. It is beyond irresponsible and Republicans should be beyond sick about this.

So, we have a fall in integrity in this nation. That's to be expected as so many in our nation are God haters. We need a Christian revival which would establish integrity.

Boehner's No Leader ...
... and his whining about House Democrat political moves doesn't bode well for Republicans. Boehner has been ineffective in combating Pelosi's increase in power, and has allowed House Republicans to adopt a "go along to get along" attitude that will be fatal in the November elections.

Under his "leadership" House Republicans have staunchly supported earmarks, and the GOP is dependent on Bush vetoes (never a sure thing) because the House Republicans won't block spending.

Boehner and McConnell are poster boys for the lack of capable leaders in the Republican party, and offer no hope of change to GOP voters in November.

lawyers protecting lawyers
Whats's new Boehner, both parties are complicit in not restraining lawyers. Lawyers and politicians that are also lawyers are simply protecting their own. Add to that the institutional victimhood and entitlement mentalities of a segment of the population and you have one of our huge current problems.

The legal profession is similar to the world's oldest profession. Everything is for sale and nothing is off limits. Tort reform is long overdue.

Lawyers should not be allowed into public office. It's a total conflict of interest.

I was convinced that a large part of the reason that the Republican majority would not seriously address tort reform was that Trent Lott was Dickie Scruggs' brother-in-law. Now Trent has (thank the Lord!) retired. There may be other such relationships, but I'm not aware of them.

Maybe if the Republicans had another chance?

Well, at least maybe they could increase their share of the Trial Lawyers' donations. Sigh.


Class actions (not so very classy)
Several years ago, another one of my tech companies was sued in a class action (I have a large file folder filled with my notices of class action). I decided to exercise my right to protest the proposed settlement.

I sent certified letters to all the necessary parties (plaintiff, defendant, Court). I even called defendant's lawyer to confirm the suit was a bunch of doo doo.

Soon I began receiving letters and phone calls from plaintiffs' attorney, wondering if there weren't some way to settle my concerns. I know I could have been paid off if I'd been so inclined.

I had intended to drive or fly from Indiana to Huston to present my arguments, but a confluence of events--including reality overcoming principle; that Clinton-appointed judge would NOT succumb to my measly arguments--caused me to sit home and fret.

Adding insult to injury, my portion of the settlement was too small; they would not be sending me a check. The plaintiffs' attorneys made $millions.

I wonder what would happen if ALL stockholders (or customers, in the case of Blockbusters et al.) protested these cowardly "proposed settlements," which are obviously cheaper than actual litigation. Not likely to happen, as most people actually HAVE lives, but it would be interesting.

I believe most lawyers have proved by their actions that they are traitors to this country. For example the cigarette, hot coffee, step ladder lawyers, and Edwards who has stolen over $1,000,000,000 from the Health Care Industry, and put many doctors out of business.

Isn’t his wife lucky that her cancer doctor was not put out of business by the actions of her husband.

Mr. Boehner, we already know that the trial lawyers and the unions have the Dems in their pocket. The question I have is what to do about it.

I don't want to infringe on free speech by limiting contributions. To my mind, the best strategy is to get average people to begin donating. Did you know that only about .35% of 300 million Americans bother to make any political donations at all? That's pathetic. If apathy would subside and just 10% started donating just $50.00 a year, imagine how the politicians would begin responding to the people instead of to the special interest! It's our country. Let's take it back!

Illegal immigration
Most of those in Congress are ignoring the growing problem of illegal immigration. Poll after poll shows Americans are fed up with our open borders. Bush and his cronies and the dems ALL see a profit in allowing this to continue. So thanks Mr Boehner for allowing this defeat of the USA to continue . This country is on the way OUT!

After reading Steyn's new book, "America Alone" I am reconsidering my position on immigration.

If we don't start making babies a lot more than we do now, then increased immigration from FRIENDLY countries (Non-Moslem) will be needed to fund our entitlement programs and provide labor. Otherwise, we are going to be overrun by Moslems that do not share American values due to their skyhigh birthrates.

Let's secure the borders first and then have a debate about how much LEGAL immigration is good for America.
