Was the Copenhagen Global Warming Summit Walk-Out a Win for the U.S.?


“It is a small state, and yet there are those who love it.” Sen. Daniel Webster, arguing the Dartmouth case before the Supreme Court, actually said “college,” not “state.” But the paraphrase is apropos for my state and yours alike in a summer when the nomination of Sonia Sotomayor has everyone talking about Senators and justices.

We in Colorado do love this smallish state of ours, and folks probably have similar feelings in your state , whatever its size. Jealousy for each state's prerogatives of self-government is in order as Justice Souter departs and federal power metastasizes. “Don’t tread on me,” the defiant flag of the founding era, has made a comeback at this year’s Tea Parties. Does Sotomayor get that? Not that I can tell, which means she’s wrong for the court.

Of the three federal branches, claimed Alexander Hamilton in the Federalist, “the judiciary will always be the least dangerous to the Constitution,” as it has neither “the sword nor the purse.” Decades of judicial imperialism have left that prediction as devalued as Hamilton’s $10 bill.

More accurate was his rival Robert Yates, who wrote in the Anti-Federalist that history had never seen “a court of justice invested with such immense powers, and yet placed in a situation so little responsible.” He worried that the Supreme Court would “be able to extend the limits of the general government gradually” and at last “to melt down the states into one entire government for every purpose.”

Did Yates exaggerate? Not much. From FDR’s time to Obama’s, regardless of which party appointed them, the robed priesthood of the bench has overseen more and more of American governance gravitating from state capitals to Washington and from the elected branches to themselves.

Is there blame to go around? Yes; every part of our body politic has helped weaken liberty. We’re now getting the government we deserve. Does history hinge on Sotomayor’s confirmation or defeat? No; “wise Latina woman” or not, she’s just one judge. We the people must initiate the needed constitutional rebirth.

It’s dismaying, though, how oblivious most politicians are to the high court’s part in turning free citizens into docile “sheeple” (Pravda’s mocking word). Seeking some comprehension of the crisis, I asked Colorado’s senators, Michael Bennet and Mark Udall, what our smaller state with its commitment to participative self-government should constitutionally expect from the Supreme Court. The answers came back bland as sand.

“Coloradans want judges who are fair, impartial, and faithfully apply the law,” said Bennet, adding that he hopes for a sensitivity to “our special concerns in the West” about water rights, public lands, and the role of government. Udall told me the qualities he’s looking for include “moderation, an ability to listen and bridge ideological divides, and above all, a deep understanding of the constitution.” Unlike Bennet, who came out for Sotomayor after a brief meeting, Udall is uncommitted though leaning favorably.

The danger of senators rubber-stamping a president’s judicial nominees, predicted by Oliver Ellsworth at the 1787 convention, seems borne out by these two in relation to fellow Democrat Barack Obama. They need remediation from University of Colorado law professor Robert Nagel, author of “Unrestrained: Judicial Excess and the Mind of the American Lawyer.” Nagel says legal groupthink has made the whole country politically timid and “slavish in believing we need to be saved by the Supreme Court” from the messiness of democracy.

Former Colorado Supreme Court Justice Jean Dubofsky, another Democrat and the first woman on that bench, supports Sotomayor but said she too wishes for a high court with more “out in the world experience” and fewer Ivy-trained Easterners with appellate resumes like this nominee.

Very true, and by that yardstick I’d prefer Dubofsky herself, or Bennet or Udall, or Colorado Gov. Bill Ritter, or or even Pat Schroeder our awful former congressperson, to Judge Sonia. Liberals all – but any of them would be less susceptible to the seductive superstition of Supremes as Saviors.

I asked Michael Bennet, US Senator for Colorado what sort of Government do we have today?

I know we do not have a Republic united under the Constitution any longer, so what sort of Government do we have Senator?

I have not heard back from him, yet

For the 99th time Joel,it doesn't make any difference what the Constitution SAYS,it doesn't make any difference what the founding fathers MEAN'T.We have to live in our own times,and that means the Constitution says what five or more members of the Supreme Court says that it says,and it doesn't say anything else!The occupants of the executive and legislative branches will enforce it,whether it is a Governor standing in a schoolhouse door or a state legislature trying to over ride a Supreme Court decision,and Federal Marshals will enforce it!

So if you want to know what the Constitution says,the last thing you should do is read the Constitution.Instead,you would be better off if you read Supreme Court decisions.You don't have to like that state of affairs (in many cases,I don't either),but that is the way it IS!

Sotomayor The Stake
This self-professed "wise Latina woman" is merely a tool of the Murderer-Of-Freedom now occupying the Offal/Awful/Oaf-full Office, none other than the Stealth Muslim Mulatto Usurper, Barry Obama/Dunham/Soetoro.

Sotomayor is just one of many stakes oBUMa is driving into the heart of the Republic, by which he hopes that through quantity and persistence, to kill off as quickly as possible.

All 9 Judges swear an Oath to THAT document, and that REQUIRES them to uphold it.

When they break this oath, that is a CRIME.

The Supreme Court does not hold or control either one.

Used to be the US Congress controlled the purse as they did the sword.

All that means is that they were ideologically driven decisions that were overridden by judges with a different ideology. The problem is that our judges have replaced the golden mete-wand of the law with the crooked cord of their own discretion.

When the Framers added the Bill of Rights, Marbury v. Madison became a practical necessity. Law exists to protect our rights from the depredations of the majority; how could a court protect us from the government if the government had the power to override its decisions?

The Constitution provides remedies

You're obviously not trained as a lawyer. Judges only follow the law when it takes them where they wanted to go in the first place, and the RATS wing of the Court is every bit as odious on this score as the Warren Court.

The states are irrelevant

The power of the states themselves as a check on abuses of federal power was for the most part eliminated by the Fourteenth Amendment. If there is any legal power left, it resides in the individual.

Incorporation of powers
Is why we see the abuse of power from Congress, the President and the Supreme Court.

They do not watch one another to keep each branch subservient to the Constitution, but work together to ignore the Constitution.

Been going on a long time and now its so strong, many think this is the way its supposed to be.

Article III spells out the duty for the SC.

They have no Jurisdiction over any Law made by a State the Constitution does not specifically address.

Like Marriage, sodomy, abortion, death penalty, Military Tribunals, Military Prisoners.
Yet the Court has taken over without law and authority these very subjects.


Problem is, the Court has has been allowed to do this by the corrupt US Congress itself.

That could impeach everyone of those people who break their oath of office.

As Stevens and Ginsburg have recently done in citing FOREIGN LAW.

That is a CRIME against their VERY OWN OATH OF OFFICE

As I briefly mentioned,I don't like a lot of it either,but that is the way it IS.What has the Executive and Legislative branches done to rein in the Supreme Court decisions?They have that authority,you know,starting with appointments,and moving on to amendments.I don't see it happening.

Balance of responsibility
For this country to run effectively there is a balance of power, that can never be compromised by anyone, any political party, nor any union, nor association, nor advocacy group. There is defined responsibilities that protect all men. In the beginning of the country there was a definition problem with the meaning of the word men. Once this was resolved not by the courts but the President, Congress and the people of the United States. Later it would become the opinions and judgement of the court to define the laws of Congress signed by the President.

her decision in the firefighter case says it all, no matter how good you are at what you do, if there are enough minorities in the final cut, you lose. the decision should have been decided on how many minorities had the opportunity to take the test not how many passed. white males were descriminated against, just because of the color of their skin.

Bork Sotomayor
Judge Sonia Sotomayor is unfit to serve on the Supreme Court of the United States because she sees herself as a political activist first and a jurist second. In a speech in California in 2001 she disparaged white male judges, saying, "I would hope that a wise Latino woman with the richness of her experiences would more often than not reach a better conclusion (as a judge) than a white male who hasn't lived that life."

In a current case from the New Haven, Connecticut, fire department, Sotomayor has ruled from the appellant court that job applicants' loss of promotion after succeeding on a test designed to be race neutral was "thorough, thoughtful, and well reasoned," because no black applicant had achieved an acceptable score. That seventeen (17) "white" test takers had succeeded, including ONE HISPANICS, the test was thrown out by the officials in New Haven and no promotions granted to anyone. Such activism shows Sotomayor is less interest in minority success than enforcing that success by any means FROM THE BENCH.

On the Second Amendment, Sotomayor is anti-gun as revealed in "the right to possess a gun is clearly not a fundamental right" (US v Sanchez-Villar, 2004). This opinion is exactly opposite of the recent US Court ruling supporting an earlier verdict in Washington,, DC, that affirmed the right to bear arms as fundamental as any rights enumerated in any other amendment in the Bill of Rights.

Sotomayor was only following her own philosophy that appellant courts are where "policy is made", which she claimed at Duke University in 2005.

This Obama nominee, as with many others, is out of step with Main Street America, out of step with Supreme Court rulings, and not qualified on her legal history or personal beliefs to be a Supreme Court justice. That she is of Puerto Rican descent and struggled to make her position in life is immaterial.

For all I'm tempted to subscribe to cynical Will's rally cry of whites against the rest of'em I'm constrained by the admonition of our archbishop, Archbishop Charles Chaput of Denver, to avoid racism.

Even pro-abortion Leftists will have difficulty in labeling Archbishop Chaput as a racist, because he's an American Injun, a Potawatomi.

Udall Has Absolutely No Excuse!
As the best information and evidence was discovered and came in, I passed it on to him....he has no excuse. In fact, I remember sending Udall her activist decisions against our Second Amendment and only a few days later hearing the media report his statement that Sotomayor's decisions were not anti-Constitutional. Of course, Udall has a long history of the exact same disloyalty.

Translating his Liberal speak in trepidation of "undecided but leaning" is both painfully transparent and predictable with his having no desire to take a small fraction of the flak he has received to date for even thinking about confirming Sotomayor. She's not fit to sit the bench she's on....Clearly then, Udall ( or Bennett ) isn't fit to be in his position either.

My loyal coutrymen, the worst the ACLU can produce is about to be seated at the highest court of the land unless we step up and shout out as one.

Well researched post. I, too, thought the Supreme Court was designed to be the "Court of last resort"...i.e. the court of final appeal. NOT the interpreter of the Constitution. Ah, well.

Simply wished to inject a little humor and convey some of the things I enjoy about Colorado. If I offended you in my comment sincere apologies to you. Sadly, though I am accurate that unless Ms. Sonia has a complete melt down there is little anyone can do about her eventual confirmation to the Supreme Court.

I get scared when impartial justice gets touchy feely. Has anyone on the Federal Bench read that elusive document called the Constitution? It appears to be over Ms. Sotomeyer's head.

And.......has anyone read those racist questions on the firefighters exam? I'd just LOVE to see all those racist questions! Of course I don't expect I ever will. Damn the facts, full speed ahead with the AGENDA!
