eHarmony Caves to Intimidation Litigation

New Jersey resident Eric McKinley, 46, a self-described homosexual, decided to sign up for the California-based eHarmony.com online dating service in 2005. He says he couldn’t get past the first screen, “because the pull-down menus had categories only for a man seeking a woman or a woman seeking a man.”

So naturally the aggrieved McKinley ignored the plethora of “gay” on-line dating Web sites and filed a complaint with the New Jersey Division of Civil Rights (NJDCR).

The claim makes as much legal sense as if McKinley had sued Victoria’s Secret because it doesn’t sell jockstraps. But after three years of litigation, the Christian-owned dating service caved, announcing on Nov. 20 that it would establish a same-sex dating service early next year. In the face of intimidation litigation, eHarmony chose to settle, rather than defend its rights under the U.S. Constitution or cease doing business in New Jersey.

The surrender followed a finding by the NJDCR of probable cause to believe that McKinley was unlawfully discriminated against because eHarmony didn’t provide same-sex matches. If McKinley’s intimidation litigation continues its trajectory, New Jersey may have the first Victor/Victoria’s Secret.

It wasn’t that eHarmony refused to do business with McKinley because of his homosexual “orientation.” eHarmony founded its business model on traditional man-woman marriage as explained on its Web site:

Based on his 35 years of marriage counseling and studies of thousands of married couples, eHarmony founder Dr. Neil Clark Warren exhaustively researched what makes marriages succeed and fail. His findings? Chemistry is not enough. Almost all marriages start out with good chemistry, yet 3 out of 4 couples end up unhappy or divorced.

Bear in mind that NJDCR never ruled on the actual merits of McKinley’s claim, but here’s the deal:  In addition to paying New Jersey $50,000 and McKinley $5,000, eHarmony will provide same-sex relationship matching services called “Compatible Partners” by March 31, 2009, and give the first 10,000 same-sex registrants a free six-month subscription.

According to a statement issued by eHarmony, “Under the settlement agreement, the company reserves the right to inform those using the new same-sex matching service that the Compatibility Matching System™ developed by eHarmony is solely based on research involving married heterosexual couples.”

Theodore Olsen, attorney for eHarmony, issued a statement claiming that eHarmony “did not agree to offer gay matches willingly. Even though we believed that the complaint resulted from an unfair characterization of our business, we ultimately decided it was best to settle this case with the attorney general since litigation outcomes can be unpredictable.”

Apparently the certainty of losing is more compatible than the possibility of winning. Contrary to some media, eHarmony wasn’t “forced” or “compelled” to comply with McKinley’s demands; eHarmony surrendered to his demands.

Jim Campbell, an attorney with the Alliance Defense Fund, a religious liberty legal organization, told Baptist Press. “Unfortunately, in this case, eHarmony surrendered to their demands. We feel they could have had a valid argument and could have taken a stand against this.”

Since married people are expressly prohibited from using or registering to use eHarmony’s singles service and the (LAD) prohibits discrimination based on marital status, how long will it be before some budding adulterer sues because eHarmony doesn’t facilitate that swinging option? Will it expand its new “Compatible Partners” to include  ménage á trois types, spouse swappers, sadomasochists, cross-dressers and transgenders?

Intimidation litigation is what’s happening to privately owned businesses, especially Christian-owned businesses, churches, and para-church organizations when state anti-discrimination laws, which were meant to end discrimination based on immutable characteristics like race, are amended to include “sexual orientation” and “gender identity.” For example:

  • March 2006: After 100 years of finding homes for special needs children, Catholic Charities in Massachusetts announced it would no longer provide adoptions rather than place children in same-sex households, as “required” by state law in order to be licensed. The Massachusetts legislature failed to enact a religious exemption that would have allowed Catholic Charities to continue providing adoptions in keeping with its religious beliefs even though it was willing to forgo any state funding.
  • July 2007: A New Jersey lesbian couple filed a civil rights complaint against a United Methodist Church retreat that refused to rent its boardwalk pavilion to facilitate their “civil union” ceremony. The state revoked the tax exemption for the pavilion. The church has appealed and filed a federal countersuit claiming “that the state of New Jersey has no right to dictate to a religious group how they use their own privately-owned facilities.”
  • January 2008: Two girls and their parents had sued California Lutheran High School in 2005 claiming that the school unlawfully discriminated against the girls when it expelled them because of their perceived “sexual orientation.”  A judge dismissed the suit, rejecting the claim that the school was a business that must abide by the state’s anti-discrimination law. He reasoned that Christian schools have the right to make admissions and disciplinary decisions consistent with their Christian beliefs.

·       April 2008: The New Mexico Human Rights Commission fined Christian photographer Elaine Huguenin $6,000 for declining to take photos of a lesbian commitment ceremony.

  • July 2008: A homosexual man sued two Christian publishers for $70 million “for emotional distress and mental instability he received during the past 20 years from their versions of the Bible that refer to homosexuality as a sin.”

·       July 2008: Two homosexuals filed a discrimination complaint with the New York Attorney General’s office claiming they were barred from posting their online adoptive parent profile by Arizona-based Adoption Profiles, LLC and Adoption Media, LLC solely because they are a same-sex couple in violation of New York antidiscrimination laws. The company ceased doing business in California in 2007 after a federal judge ruled against it in a similar suit brought by two California homosexuals.

·       August 2008: The California Supreme Court extended the state’s anti-discrimination law to the medical profession. The court ruled unanimously that two Christian fertility doctors who refused to artificially inseminate a lesbian couple could not claim a free speech or religious exemption from the California law.

·       November 2008: The California Fair Political Practices Commission announced that it will investigate a complaint by homosexuals that the Mormon church did not accurately describe its role in the campaign to pass Prop. 8 defining marriage as the union of one man and one woman.

On its Web site, eHarmony says that “the most important areas of life – like values, character” matter to the success of long-term relationships. But its surrender to intimidation litigation says loudly that its corporate bottom line matters more.

Worse yet is the demoralizing effect that eHarmony’s capitulation is likely to have on those defending similar suits – and the emboldening effect on the bullies who file them.

OK, give us the numbers:

What percentage of all observed animal behavior (excluding humans)is homosexual? Probably too low to even measure.

What % of all known animals exhibit homosexual behavior? Also, probably too low to measure.

What percentage of observed homosexual behavior amoung the animal kingdom is positive for the propitiation of that species: ZERO

There are animals that eat their young, kill their mates, physically fight for their mates, eat excrement, eat-vomit and eat their food, smell each other's behinds, lick each other's... I hope you get the point to the error of your logic.
If homosexuality is biological, then it is a MUTATION or DEFECT. Because we have a conflict within the genetic code. Some genes are saying "you're a male and have the equipment to be a male" and others are saying, "you should mate with males" yet you're not equipped to MATE with males. Therefore, the genetic code is messed up and NOT NORMAL.
This is all common sense and doesn't take a "peer-reviewed" bovine scattology propaganda piece to prove otherwise.

...little Johnny comes home and asks, "How do I know if I'm gay?" I can't imagine how confusing this is to children and the conflict that will be created when they teach this deviate behavior is normal in your local schools. Outside the moral questions, there are the health issues. It's shocking how many diseases and infections arise from these practices. Read what doctors, who treat these problems, have to say. Smoking is constantly condemned as a "killer", but nothing like the risks of practicing homosexuality. Apparently many just dont' care and it's a confirmed fact that multiple partners is part of the lifestyle, even when people have a "committed" partner. You see the mental aberrations and problems emerge in practices. Many, which are just weird.

BTW, most heterosexual men are born with a desire to have as many women as possible as often as possible. Being one's self is not wise. There are all type of behaviors and desires that have to be controlled or a price will be exacted. Homosexuality is no different. Nature always puts a penalty on deviating from the normal.

I'm not "religious" but nature tells me the act and lifestyle are wrong. Logic says the same.

If someone forced me to set up something I didn't want to do for any reason, I'm afraid they might not like the results. For instance, in this case, I'd be happy to position the most vocal and annoying customers with either each other, or with ex-cons just leaving prison. It might not be the best pairings, but, hey, I'm doing what they demanded. Right?

Great question! And given eHarmony's Minnesota Multiphasic Personality Inventory type of "criteria" for perfect matches, makes you wonder if there will be any "matches" even made. They'll have to completely revise everything about how their "system" works. But I hope they don't and all the flamers find their service completely worthless.
But of course they will, as it appears the decision is being driven by $$. Either way, hopefully their product is doomed and their current conservative users find an alternative that stands on principles. I say "hopefully" because I think them cowards. Nothing wrong with $$ driven motives in and of themselves, but their decision flies in the face of their mission statement and the founder's so-called core beliefs. And the percentage of flamers that want a "lasting relationship" I'm sure is quite small. Of course the number of initial signups by these deviants will be significant by their standards (they're probably recruiting right now), and used as a way to say, "we are just like everyone else, normal."

Let's see. Mother of one beautiful daughter, spouse of a hard working man who caters to her every desire, goes on e Harmony and seeks out men. She then proceeds to meet her "findings" in hotels near the airport, telling her husband and daughter that "mommy is just having another night out with her gal friends".
E harmony is just another place for predators.
Oh, and the predators? A wealthy banker from Indiana, and a wealthy businessman form Canada. The woman in question is bi-polar, in denial, and in need of treatment.

I have found this case puzzling. New Jersey affirmed the right of the boy scouts to discriminate, so it is hard to see them denying the right of eHarmony to discriminate. And the "penalties" being assessed all happen to be reasonable business practices by eHarmony if they want to tap into the gay dating market. You need a big base of perspective singles in order to attract paying singles, and this free offer gets the ball rolling.

As far as the persecution goes, I am a bit suspicious. I remember when the New Jersey church case got attention. It turned out that the church had received a state tax break that is given out to groups that allow their private land to be used as public accomodations. That church decided it wasn't willing to let its land be used as a public accomodation if it meant accomodating a lesbian couple. So it lost a tax break based on its not wanting to meet the terms of the tax break. The nuisance law suit there would seem to be on the part of the church.

I suspect that looking into the other examples would find that many of them are similar.

Look at it another way
There are good arguments on both sides of thie issue, and I can understand the outrage over how it was resolved. But we shouldn't blame the gay community -- after all, it was eHarmony that caved, when they probably would have eventually prevailed.
Someone wrote, "How can the State dictate to a private business who their clientele are?" Actually, governments and courts do that all the time, because they have an interest in the civil rights of their citizens. Can you imagine the trouble eHarmony would have brought on itself if it had advertised its service for "whites only"?

We need to start removing judges when they clearly make decisions contrary to logic and the constitution. So called "conservatives" all over the media have staked out the principal they are going to defend. It was hand carved for them by the Gay Rights movement. This is it: "The WORD "marriage" can only be used for heterosexual unions, but homosexual couples have a right to an EXACTLY IDENTICAL institution so long as they use a different word." This whole lawsuit
is a great illustration of the gay movement attack on the 1st Amendment.

I wish they had not caved and settled. However, I understand that a jury damage award could bankrupt the company.

So my question is this. Since the founder of the company is Christian. Did the State trounce his freedom of religion and his beliefs to come to this conclusion of discrimination?

Has the State created a law that abridges the freedom of religion in New Jersey? If so, what happened to the separation of church and state?

How can the State dictate to a private business who their clientel are?

How can the State dictate to a business who they must serve? Is the State going to pay this business to prepare a separate site? No.

Will the State sue me because I'm heterosexual and do not involve myself with gay men? Is that also discrimination?

What kind of country has this become?

Many posts above lament eHarmony's lack of fight. I can sympathize with them, litigation can't be much fun. Evidently they will be able to offer a disclaimer that they have not researched what successful homosexual bonding indicators are necessary for stable, long term relationships. That assumes that homosexual men, well known for their penchant for multiple partners, really want "eHarmony" instead of just "eHookup." The point of the article, however, is that there is a slippery slope for all of us that may start a business as a painter, but be sued for not hanging wallpaper. I don't really know about the crass and craven operators on Wall Street, but making a profit for offering a good service seems to be the only crime here. Doubtless, they are pragmatists. No doubt the tremendous angst felt by the litigant, accompanied by the financial recompense to alleviate the suffering, has cheered the homosexual community that indeed, they now have hope for the lasting relationships they have craved and have heretofore been denied by that "crass and craven" bunch of Christians. eHarmony could well do any of the things you suggest, but because they choose to stay in business rather than fight the 'good' fight, they didn't.

One can look at it in a couple of ways.

Either they are pragmatists who realize that they must make uncomfortable compromises in order to continue with their mission.

Or, for all its' marketing under the imprimatur of Christian values, eHarmony has shown itself to be as devoid of its' supposed convictions as the most crass and craven operators on Wall Street.

Theser are amoung the worst of .. . . .
times for the devotees of sexual perversion. There is nothing left that can appeal to their conscience. They appear as condemned persons blissful for a little while with their last smoke.

Here is a reason people have problems with homosexuality, and homosexual adoption, etc. This is an example of homosexual values in just one city. Just think of how many more cities this could take place in.

Street fairs in San Francisco are held every year. Tens of thousands turn out, and Miller Brewing, and other major corporations sponsor the fairs.

Every year withour fail,citizens in San Francisco try to stop the fairs. They are rebuffed, with spokespeople claiming that the religious right is interfering with homosexual values. Andy Copper this year was just one of many who said so.

Were you there David? Is this something you approve of? No heterosexuals engage in this kind of public behavior, anywhere.

Homosexuals are a certain percentage of the population. Why then are homosexuals dramatically over represented, by percentages in jails, mental health clinics, and suicides ???

Homosexuals were also in the last century overrepresented in mass killers, especially of minors.

You never addressed my comments concerning homosexual behavior. It is in fact a behavior, and nothing ties it to anything biological. Any attempt to do so has been discredited.

Homosexuality does happen in nature. So do three headed frogs. Both are aberrations.

If you simply quote California law and expect everyone to "connect the dots" that are obviously in your own thinking, your post is incomplete. You could have said, "Since California law prohibits eharmony-like businesses to exist, New Jersey must capitulate, as well as everyone else who disagrees with California law." That seems to be what you are implying. There may still be a state or two that don't toe the California line. And, as a side note, the Obama "landslide" is only one percent more than the California rejection of what the definition of marriage will be in the California constitution.
But, there will probably be a judge that thinks he/she can overturn a constitutional amendment ratified by a majority in one of the most liberal states.
Lastly, do you suppose that eharmony will soon be required to provide for trans-sexuals too?

Here is a link: Born Gay ProCon.org of peer reviewed research since 1990. Two peer reviewed articles were "con" while 11 were "pro." Two were neutral. Your claim is not true. Fuss about it all you want and claim that "11" trumps "2". But, you said, "It is most certainly true that ALL of the published and peer reviewed research concludes that sexual orientation is biological." Of course if that's what you want to believe, you'll have to do that in the face of facts that are contrary.
Religion has nothing to do with this. I took five minutes to search this out, and only used the one site. I'm sure that inquiring minds like yours can do more, unless you have an agenda.

First off, please cite the source of your characterization of homosexuality as 'abnormal' pschology, because it certainly didn't come from APA or any recognized publisher of peer reviewed science.

Secondly, it wasn't the lawyers in the eHarmony case it was the circular logic of their argument. To exclude gays from their research base and then refuse to serve homosexuals because they are not part of that research base does not even begin to pass the sniff test.

There is no such thing as a "published peer review."

Credible research is published in peer reviewed scientific journals. Peer review is also known as the referee process. It ensures that published research meets scientific standards and that observations are properly associated with experimentation.

Whack jobs like Paul Cameron (FRI) have NEVER had their "research" published in scientific journals. It wouldn't stand up to the requirements of a high school chemistry experiment. Another pseudo scientist is Whitehead. His "publication" is limited to the Internet.

The credible research (PUBLISHED and PEER REVIEWED) has determined that sexual orientation is biological. 99% of the alternative "science" is directly or indirectly the product of the Christian right - attempting to preserve biblical consistency.

Of course not. Religion is protected by the First Amendment. My Rabbi cannot be compelled to marry two Catholics (who have more legal protection than gays). This is just a scare tactic. In fact, my Rabbi cannot be compelled to accept a religious conversion.

I cannot figure out exactly why people are so terrified of gay men and women. It's not contagious. With men, some homophobia reflects insecurity. They need to get over it.

You have got to be kidding. Totally discredited and one of the founders of NARTH. By the way, for someone who claimed (in contradiction to medical science) that he could "cure" homosexuality, he didn't succeed with his own son. Richard Socarides is openly gay and was Bill Clinton's Senior Advisor for Public Liaison for gay and lesbian issues.

Nevertheless, the statistics are pretty consistently at 5% to 7%. In fact, if you look at the CNN exit polls from the last election, 4% claimed to be gay.

Most of the rest of your screed is right out of the Christian Right playbook down to the myths about the APA and "indoctrination." You'll change if and when you have a gay son or daughter. Then you will opt for science over superstition.

However, what is likely going to happen (at some point) is "hate speech" prosecution (or loss of tax exempt status).

There is no way that a gay dating service would ever be compelled to have straight dating. Yet, if we follow history -- we will see where things will go. 40 years ago, nobody ever thought quotas or preferential treatment would be a result of civil rights. Even those who thought they were good things would have conceded the need for an end date (maybe 10 years, 20 years -- not 40 years). Yet quotas are stronger than ever (and not going away in my lifetime).

The example of a universe age is irrelevant to homosexuality.

It is most certainly true that ALL of the published and peer reviewed research concludes that sexual orientation is biological.

The counterpoint that I frequently hear is the lack of discovery of a gay gene. Biology does not depend upon genetics and absence of evidence is not evidence of absence.

Bottom line: You have no more control over your sexual orientation (or your children's) than you have over eye color.

The alternative pseudo science exists to provide scriptural consistency. It is about as reliable as the "research" that "proves" that the universe is 6,000 years old in contrast to 4.5 billion years.

Boycott eHarmony
Probably the only way to make these WFJs (Wimps For Jesus) like the eHarmony owner see sense is to boycott them. I.e. make them realize that it's far more costly to offend their base than to stand up to the Gay-stapo.

The low end is about 3% (Hunter College); The high end about 12%. The general consensus is 5% to 7%. I am also Jewish - that's only about 2.5%. Families with a gay immeidate family member is greater than 30%.

However, the numbers are irrelevant. Were there 100 gay people in the US they deserve equal protection under the law. No more - no less.

Blacks, gays, asians all have a right to drink from one water fountain. Imagine me making a "pure spring water fountain" and charging people to drink. It is Easy to Blame EHarmony
It is easy to blame EHarmony for caving in. But litigational harassment is a serious problem. They ran the risk of a losing a long, costly court battle and being slapped with a ridiculous fine or monetary judgment.

Perhaps the only way this kind of thing will stop is if we fight fire with fire, and go after businesses that don't offer services WE want to use, forcing them to cater to us even if they lose money doing so.

I agree that what he needed to do was to stand up to the homosexual bullies and their lawyers. It's more than crazy, it's absolutely pathetic!! Was he a man or a mouse? It seems to me that they value opinion and money (perhaps the bottom line) more than defending themselves. Their intent was obviously not discriminatory - so to "pay off" someone merely to "close the discussion" is the beginning of their demise in my opinion.
