With Jobs Disappearing, Congress Determined to Admit More Foreign Workers

Congress adjourned for a month-long recess on Aug. 1, the same day that the Bureau of Labor Statistics released distressing news about unemployment. The July economic news was not good. The official unemployment rate hit a four-year high of 5.7 percent, as the economy shed 51,000 jobs last month, bringing the total of lost jobs for 2008 to 463,000.

Seemingly oblivious to what is happening back in their states and districts, the House Immigration Subcommittee finished up business for the rest of the summer by approving legislation that, if enacted, would “recapture” some 557,000 visas that were not used during the years they were made available, going back as far as 1992. The bill, H.R. 5882, was introduced by Subcommittee Chairwoman Zoe Lofgren (D-Calif.).

More than half of these wily visas-that-got-away would be employment-based, while the rest would be recaptured for family-based immigrants. Since immigrants who are admitted under family preference categories are also likely to need a way to support themselves, most of them would also likely enter a tightening labor market.

Aside from the fact that our slumping labor market does not require lots of new workers right now, Rep. Lofgren’s bill treats the issuance of green cards as an entitlement, rather than a privilege. Current laws set a ceiling the number of visas that can be issued in a given year; Rep. Lofgren’s bill would turn a ceiling into a floor and allow immigrants to claim those green cards years later.

While the House is acting to recapture visas in a free-standing bill, Sen. Robert Menendez (D-N.J.) is spearheading the Senate effort to corral those elusive little devils. Rather than recovering visas from the 1990s in a stand-alone bill like the House, Sen. Menendez is attempting to amend legislation to reauthorize E-Verify, a successful program that allows employers to access the Social Security Administration’s database to screen out illegal aliens. Reauthorization has already been approved by the House by a vote of 407-2, but is being blocked in the Senate by Mr. Menendez.

Without reauthorization, E-Verify will expire in November (only a short time away on a very abbreviated legislative calendar). Thus, the price that Sen. Menendez is asking to continue a program that protects thousands of Americans from losing their jobs to illegal aliens is the admission of hundreds of thousands of new workers to compete with them in a recessionary economy.

Now, if Congress could only write legislation to recapture those lost American jobs!

The push for admission of hundreds of thousands of new foreign workers is a graphic reminder of why Congress is held in such low esteem by the American public. At a time when 8.8 million Americans are officially unemployed, when our economy is losing more jobs than are being created, and when people’s paychecks are not keeping up with the soaring costs of food and energy, the agendas of the business and ethnic lobbies still takes precedence.

With the election just three months away, every member of Congress will spend their summer vacation feeling the pain of the folks back home and assuring constituents that they are doing everything in the power to protect the jobs and wages of American workers. In reality, back in Washington, many are doing just the opposite.

Given the complexity of the economic problems confronting this country there may be very little that Congress can do in the near term to bring back lost jobs – especially those that pay high wages and offer benefits. However, there is a lot they can do to make the situation worse for American workers. Failing to reauthorize E-Verify would be one of them. Flooding the already distressed labor market with hundreds of thousands of new workers by dusting off visas long past their expiration dates would be another.

Even if they can’t shake the economy out of the doldrums, Congress can cushion things a bit for American workers as the economy heads into recession. E-Verify already exists and is being used by some 75,000 employers. Eleven states already require or encourage contractors to use the system to verify the work eligibility of their employees. A vote by the full Senate is all that stands in the way of an additional five years of protection for thousands of American workers against losing jobs to illegal aliens.

All that is required in order not to flood the labor market with hundreds of thousands of new workers during a recession is for Congress to do what Congress does best. This is one time when a do-nothing Congress would be wise to do nothing. If there is one thing that American workers don’t need right now it is a congressionally mandated search-and-rescue mission for immigration visas that, for one reason or another, went unclaimed 15 years ago.

By any estimation, Americans workers are going to be in for a tough few years. The least people can expect from Congress is that they not make things worse by eliminating protections for workers and adding lots of new workers to compete for a dwindling number of jobs.

Whose Country Is It?


We the People of the United States of America have the right to have our borders and our laws respected and enforced.

Citizens of other countries illegally in our country have no right to demand anything from our government. They most certainly have the right to petition the governments of their home countries for change if they are unhappy with their home country. If they want to be Americans, we have a path to citizenship, more generous than any other nation, and it starts in their home country.

We need to insist on the equal protection, application and enforcement of the law or devolve into anarchy. Our Republic only functions if everyone follows the same rules. We should not change the laws to accomodate those breaking them.

If America annouces to the world "We can't stop you, so come on in" with another amnesty, the deluge will be overwhelming. If 3,000 a day didn't get your attention, then wait until it's 10,000 a day. We cannot sustain this influx and survive as a nation. We must speak up and speak to each other about this and not let false claims of racism or bigotry be used to intimidate us into silent assent. America is not Congress' to give away. America belongs to We the People. Speak to your neighbors, speak to your coworkers, but please speak up to your Congressmen and Senators. It's O.K. for us to enforce our laws, no really, it is.

Someone please tell Sen. McCain.

Many of us see another amnesty as the end of the Republic, the stampede it will set off will be overwhelming. If we don't stop the inundation none of the rest matters. We'll be a banana republic before the jihadis can get us. There will never be another GOP president or Congressional majority. Importing voters for the socialists is as stupid as it gets.


McCain keeps saying "Secure the border first". We know that he means amnesty next. The plan is to get the border state Gov's to declare the border secure. Conveniently, they are all on board the cheap labor express. Then his good friend Ted Kennedy will bring back McCain/Kennedy and McCain can provide his good friends across the aisle with their new permanent majority.

I will not vote for amnesty.

Pandering to citizens of other countries illegally in our country while telling us we must be vigilantes if we object to illegal aliens ignoring our borders and laws. If McCain were serious about securing the border. He'd simply tell us how he would do it, what it would cost, and how he would fund it. But he doesn't. That says it all. At the same time, he will not deport the illegals here. And the failure to do that, guarantees only that in another 30 years, hispanics will make up in excess of 25% of the US population, non-Europeons will make up 50%, and the entire SW, to include California, Arizona, Nevada, New Mexico and Texas will be at least 50% hispanic. The hispanic vote has fixated both parties - and both will do little meaningful - other than talk - to deal with these issues. We have crossed the tipping point. We have chosen a different track than that of our predecessors. Ironically, it only took 30 years to get here.

At the same time, if the parties do nothing now - just what do you think they will do in the future as they become increasingly fixated on the votes of hispanics. Let alone the votes of the other immigrants whose entry over the last 20 years, when combined with those of the hispanics, has taken us to this point?

Have no illusions. Hispanics will support increased and continuing immigration from their country of origin, as will Indians, Pakistanis, Asians, etc.

It will not now be reversed.

Why would any sane person in Wash DC advocate for more foreigners be allowed here when we are losing jobs? Because liberalism is a mental disorder, that's why. Liberals on the left and on the right (Bush and McCain).

The obsession with "the other". Worrying about "the other" and how to raise their standard of living is what is behind much of the loss of US sovereignty and independence, via the loss of manufacturing and heavy industry.

Obsession over Mexico, most of all.

Labor Based Visas are a Special Catagory
Certainly, with a 5.7% unemployment rate, we don't need to import the "generic worker." What goes lacking, in some businesses, is the specialty or knowledge worker who has an advanced engineering degree or some other high degree of specialization. These are the high value workers, many of whom are employed in jobs that can be readily outsourced. We run the risk of increasing the outsourcing of jobs, and the attendant income and payroll tax revenue, if we don't allow for more of these more skilled workers to be hired in the United States. Generally it is "hell's own task" to get an H1(b) visa because there are requirements that the position must be advertised for a number of weeks or months and filled with an overseas candidate only when it has gone unfilled for a prescribed time.

Do we want to put ourselves in a position where we educate these "overseas" employees (generally without taxpayer support) and then let them take their skill sets back to their countries of origin performing outsourced jobs from the US? This, of course, begs the question of why our native population shuns the challenging fields of engineering, accounting, and the sciences so that they can focus on the softer fields of the liberal arts. Do we need more "home grown" engineers and scientists? Of course we do, but until our native population is willing to take more challenging courses in college and graduate with those more difficult to get degrees, we will need a visa program to import the more technically skilled workers that we will need in order to keep the United States at the forefront of technological innovation.

Great...I chide liberal arts majors and then misspell "category." Oh well...

So John, you are saying that accounting, engineering, nursing, software (IT) are jobs that Americans "shun", i.e. won't do?

Are you serious? The H-1B visa program is a scam from top to bottom. How do I know this? I've been in the software development field for some twenty years. Originally designed to bring new Einsteins to our country, it has devolved into nothing but a subsidy for India and Indian companies based in the US (as a way to faciliate the bringing of more Indians to the USA).

You are correct that there has been a small downward trend in younger Americans entering the fields mentioned above but many people like me, attribute that to the fact that young Americans in college can see that those jobs go to "foreigners" here from China and India, that the abundance of them have suppressesd the salaries of those careers and thus shy away from those careers.

Stop the H-1B madness. It only enriches a few at the expense of the national good.

Yup - Serious
Please note that I did not mention nursing, because that is a job that cannot be outsourced, though MRI and X-Ray interpretation can and are being outsourced. Yes, Chinese and Indian engineers are a cheaper labor pool, but the software industry and many engineering tasks in general can and are being outsourced because of the ability to transmit huge amounts of data at light speed. We can either accept that we compete in a world labor market for engineering labor or keep US pay scales high and let the work move quickly overseas.

So, we are left with either bringing labor here, again with rising demand for engineering and a downward trend in graduation rates for engineering and sciences, or outsourcing the jobs. The work is going to be done regardless and companies will seek the lowest cost to accomplish the work. The question we need to ask is whether we want the income and payroll taxes paid here or there.

As for that downward trend, it is not because students are flocking to higher paying liberal arts jobs, just look at the starting payscales, and unemployment rates. English majors make dramatically less than engineering majors. Math, science and engineering majors make much more than their counterparts. Come on...read the salary surveys.

I have been in engineering and engineering management for over 20 years - like you - but my take is if we eliminate the H1(b) we will see the trend for outsourcing turn into a flood.

ILLEGAL aliens are concentrated in 4 industries (landscaping/agricultural, restaurant/hotel service, construction, food processing) but predominate in none-- which gives lie to the artful canard: just doing jobs Americans won't
do. When the government makes a show raid on a meat plant, e.g., previously displaced Americans refill those jobs immediately-- for a bit more money. With unemployment rising toward 6%, this is particularly noteworthy.

Americans cost more on the surface, but only to the miscreant employers who pocket the "savings" when they instead hire ILLEGALS. Your hotel room, or hot dog, or produce is no cheaper to YOU... and Middle America is forced to bear the egregious and pernicious socio-economic burdens and plethora of social pathologies that ILLEGALS foist upon us. The all-in costs of ILLEGALS to American society are STAGGERING, SNOWBALLING, and perhaps soon to be irreversible.

The truth is, guest worker programs rarely work as intended anywhere in the world... a positive example were the true migrant workers who returned home to Mexico seasonally, but the current plague of ILLEGALS is a totally
different scenario.

We MUST DEMAND that out pols listen to the 75%+ majority and begin to stanch and reverse the ILLEGAL alien malignancy. The way to do that is with workplace and social service enforcement requiring REAL I.D.-- no jobs or freebies without proof of a right to be here. Americans have to show good I.D. every day-- it is not a burden-- unless you have something to HIDE.

If there is a shortage........?
If there is a shortage in career "X", then economics tells us there should be an increase in salaries for people in career "X".

Salaries in engineering, IT, nursing, accounting are all either stagnate or are going down, therefore the "shortage" cry of industry lobbies is nothing but rubbish.

Furthermore John, are you an American? By that I mean, is our country nothing to you but a market? An economy? Don't you see the big picture of what emptying out of our country is doing to our independence and sovereignty or are you a "citizen of the world"? Surely you'ren not that young and foolish. What did our grandparents fight and bleed for?

Comprehensive Immigration Enforcement

We need Comprehensive Immigration Enforcement, not reform. We need to restore respect for the law and the faith of the American people that their government is not selling them out. Amnesty for the illegal aliens is also amnesty for the corrupt companies who have been employing them. Money trumps everything, including love of country. Multi-nationals have no loyalty to country by definition, they see us as a market, not a nation. They see people as workers, documented or undocumented, no difference. If they can't send the work to where the labor is cheaper, then they want to bring the cheap labor here. Citizenship is meaningless.

If we love our Constitution and our representative Republic and we intend to keep it we must not surrender our sovereignty or abandon the rule of law. Profits must not supercede security. We should not create a new path to citizenship. We have a path to citizenship, more generous than any other country, illegal aliens have ignored it and bad choices do have consequences.

Since 2000 an estimated 10 to 12 million immigrants have arrived, representing the highest seven-year period of immigration in U.S. history BY FAR. If immigration were to continue at this rate, the nation's population would increase from 301 million today to 468 million in 2060, a 56% increase.

One in eight U.S. residents is now an ILLEGAL or legal immigrant.

Research on the impact this is having on the U.S. economy reveals that Americans are spending between $11 and $22 billion on welfare to ILLEGAL aliens each year by state governments. Of this, $2.2 billion a year is spent on food assistance programs such as food stamps and free school lunches.

An estimated $2.5 billion a year is spent on Medicaid for ILLEGALS. The demands on American hospitals have forced some to close emergency rooms as ILLEGAL ALIENS crowd them and the law requires their care despite their inability to pay for it.

Approximately $12 billion is spent on primary and secondary school education for children that are here ILLEGALLY, many of whom cannot speak English.

It costs Americans $3 million a day to incarcerate illegal aliens, and 30% of all federal prison inmates are ILLEGAL ALIENS. The crime rates of ILLEGAL aliens are estimated to be 2.5x higher than native-born Americans for crimes that include illicit drugs, rape and murder.

Native-born Americans are losing an estimated $200 billion in wages that have been driven down by the influx of ILLEGAL aliens. This particularly hurts minorities and the young seeking employment.

Meanwhile over the past five years ILLEGAL aliens sent home remittances estimated to be between $25 and $45 billion to their countries of origin.

We are arguably at a critical moment in our nation's history when a moratorium on virtually all immigration is needed. We have had such a moratorium in the past following the vast immigration of the late 1800s and early 1900s.

At that earlier time America needed immigrants to help build the nation's infrastructure and participate in its industrial growth, and we could absorb the ignorant and poor.

Things are very different today, as we have progressed to an advanced service economy calling mainly for educated, skilled workers-- NOT the ignorant, indigent, culturally disparate flooding across the border and willfully overstaying visas-- ALL committing felonies to work here and seek social services.

What America needs now is a period of stabilization and a period in which to
reduce the population of ILLEGAL aliens through attritive repatriation, and to temper the entry of legal immigrants to confirm desirable assimilation, lest the melting pot go into meltdown.

If we do not, we risk so overburdening our economy, our schools, and our health and justice systems that we do grievous harm to present and future generations of all Americans.

* By a 63% to 28% margin, voters continue to believe it is more important to gain control of the border than to resolve the status of those who are already in the country ILLEGALLY.

* 73% say police should check to see if traffic violators are in the country illegally... 62% believe that such violators should then be deported.

* 77% of American adults do NOT think ILLEGAL immigrants should be allowed to receive a driver's license.

* Survey data have consistently shown that on immigration reform voters are PRIMARILY concerned with enforcing the border and reducing the future flow of ILLEGAL immigrants.

The "comprehensive" reform considered in the
Senate last year was very unpopular precisely because voters did NOT believe it would reduce ILLEGAL immigration. (in fact, a plurality of voters thought the legislation would lead to an increase in ILLEGAL immigration).

More recently, voters opposed another Senate legislative proposal, the Dream Act (which would have given college tuition assistance to ILLEGALS, and then led to citizenship), and believed it would attract more ILLEGAL immigrants in the future.

Collectively, these data suggest that the desire of most Americans to gain control of the border is part of a broader desire to protect American culture.

why sanctuary cities exist

When the ILLEGAL alien employer lobbies buy the right pols, we end up with sanctuary cities: polities willfully violating federal and state laws, and common sense and decency, so taxpayers/citizens can subsidize the employers with "cheap" labor whose all-in costs to society will prove staggering and enervating/crippling.

The ILLEGAL aliens come like bugs to a light-- it makes sense from their perspective when they can earn 10x what they can in Mexico, whose corrupt govt. instructs them on how to exploit America... how to tap into welfare, especially upon pushing out an "anchor baby"-- the magic ticket.

When the citizens become aware of the scams at hand, as with Kennedy-McAmnesty or the Dream Act (which would have given ILLEGALS college

But the Conspiracy Of Evil represents moneyed forces which want to use ILLEGALS for different self-aggrandizing ends though they are inimical to the best socio-economic interests of the great majority, and to America as a nation.

My first day at the corporate offices of the largest wireless communications' provider in the U.S. I noticed there were more Indian H1bs in the halls than Americans. This is the way of the future: imported cheap labor, whether brought here legally or illegally. These companies don't care - they're concerned about global competitiveness - not American economic vitality. It's interesting to note the statistics that small business creates all of the new jobs in the country, yet small business is over-taxed. On a net basis, global corporations have created no jobs in the past decade. They not only create no jobs, but are responsible for job shrinkage from outsourcing, offshoring and onshoring - for which they receive generous tax breaks from our illustrious congress.

Until there are concrete repercussions for importing Indians, Mexicans, Chinese and other workers, these practices will continue - and Congress, enamored of dropout billionaires like Bill Gates, will continue to concede to corporate donors. Our own Labor Dept. is pushing for more visas - against the wishes of American citizens.

One aspect of more visas and imported workers rarely discussed is that they don't share the connections with historic "immigrants". These people don't care about America, American values or culture - they care about money and making as much of it as they can. They will always be divided in their loyalty.

Finally, as a woman I am disturbed that so many of these imported workers have such dismal views of women and come from male-dominated cultures that demean, disparage and oppress women. Is this what we want to import? You don't have to be a feminist to realize that women have come a long way in this country and I don't want to fight the same battles over and over and over! I've got my hands full, thanks Congress.

John, You're Soooooooo Wrong
Fact is, these so-called "highly skilled workers" are not on a par with our home-grown workers. They're just more attractive to behemoth corporations because they're much cheaper. You got it wrong: it isn't about quality, it's about economy. You cite the issue of educating these workers, then having them go back to their country of origin with an outsourced job. That is an illusion. First, they are most-often educated in their home country - not here and receive their education for free, unlike American students who graduate with student loan debt in ever increasing numbers yes, that includes Engineering and Sciences grads. They come here because they can make more money; there is little to no incentive to return to their home country for a much lower-paying outsourced job.

I don't know where you come up with the fantasies you scribble, but Americans are not stupid and are not inclined to take on debt when there is little hope of a job at the end of their education.
