Will the Dems' health care Christmas Present to America be an improvement or detriment to our health care system?


After 18 years of a law practice devoted to counseling landowners, home builders and commercial interests affected by the long arm and severe penalties of the Endangered Species Act, I am used to incredulous looks and outraged oaths from clients coming to grips with the Act's incredible burdens on impacted private citizens.

"Are you telling me I can't build my Burger King because a Delhi Sands flower-loving fly that has never been seen and is above ground only a few days a year might be near-by?"

"I can't build a connector road because the noise from construction might damage the hearing of the Stephens' kangaroo rat thus impairing its reproduction?"

"All construction in San Diego involving impacts to road ruts which might contain Vernal Pool Fairy Shrimp is enjoined? All construction?"

Yes, yes, and yes. The list of situations in which the ESA has stopped otherwise legal and fully permitted projects from proceeding is extraordinarily long and getting longer. With Wednesday's decision to list the polar bear as "threatened" the burden on the American economy brought about by the ESA grew exponentially.

I have written here and here on the polar bear controversy. Those columns delineated how the advocates of the polar bear listing planned on using the bear to impose vast new controls on the emissions of greenhouse gases across the United States. When Secretary of the Interior Dirk Kempthorne announced the listing, he also made a bold statement that the new status of the polar bear would not lead to such consequences.

To which the environmental activists replied immediately: "Says who?" The law is the law, they correctly noted, and it cannot be cabined by "guidance" issued by the executive branch. Here's one example of the reality of the listing's aftermath from the pages of USA Today:

Kassie Siegel, a lawyer with the Center for Biological Diversity, said the group does not accept Kempthorne's view.

The act requires federal agencies to take steps to reduce or eliminate those impacts on threatened species, she said. "There is no exemption for greenhouse gas emissions."

If the government fails to address global warming, "we can and will go to court to enforce the law," she said.

The industries most likely to be pummeled by the polar bear are energy production, aggregates extraction, transportation, and commercial building because each can be shown quite easily to result in increased emissions of greenhouse gases and each routinely requires federal permits to go about some aspect of their business. (The coal industry may be target number one, followed by oil drilling in the lower 48.)

The Act operates simply. Once an animal is listed, it becomes a felony to harm or harass it without the permission of the feds.

Harm or harassment has been defined to include destruction or impairment of the habitat the species actually occupies. (Some more radical views argue that harm to habitat that could be occupied in the future should also be a felony under the Act, but that view has not yet been upheld by a court of appeals.)

Because the polar bear has been listed as threatened due to alleged deterioration of its ice habitat, and because the alleged loss of the ice habitat has occurred because of global warming caused at least in part by the emission of greenhouse gases, environmental activists will argue that all emissions of greenhouse gases that flow as a consequence of the grant of a federal permit of any sort are now subject to review under the ESA and, crucially, that those permits cannot be issued unless and until the United States Fish & Wildlife Service reviews and approves of the requested permit under Section 7 of the ESA, a process which takes at a minimum months and which can cost millions of dollars even if it is successful.

Because of the generous "citizen standing" provisions of the ESA, expect dozens of "60-day" letters to begin to arrive in the offices of Secretary Kempthorne very soon, announcing that unless the Department and the Service act to invoke Section 7 vis-a-vis this or that federal permit, a lawsuit will be filed to force compliance. Expect most of those suits to be filed in the Ninth Circuit, where the appeals court has been very expansive in applying the ESA.

What ought the industries likely to be burdened by this legal blitzkrieg from the left to do?

First, industry lawyers must intervene in every polar bear suit brought by every environmental group. Trade associations must file and refile FOIA requests for all 60-day notices, and they or their members must force their way into every courtroom where the reach of the polar bear listing is argued and a decision rendered. Incredibly, not one of the industries likely to be impacted by the listing intervened in the court proceeding that imposed a deadline on Secretary Kempthorne. Not one.

Some will no doubt urge that the listing itself be challenged, but not only will proceeding that takes years, it is likely to be unsuccessful because the courts rightly defer to the exercise of scientific discretion by the agencies charged with protecting the species protected by the Act. It is not a hopeless effort, but it is also not likely to succeed.

The key will be to cabin the reach of the polar bear listing's impact by pushing for court decisions on the limits of where Section 7 reaches, and to do so in federal circuits much more cautious about the ESA's intent when passed by Congress and signed by Richard Nixon. In addition to the obvious constitutional arguments about whether the Interstate Commerce power was ever intended to support such far reaching claims of federal regulatory power, and statutory construction arguments on whether the ESA was ever intended to reach future habitat destruction based on predictive models (as well as the obligatory non-delegation arguments which are highly unlikely to be persuasive) the key will be to force the courts to early on confront the limits of causation when it comes to harm to the ice that the act can support. Courts must establish that it is absurd for the federal government to ever argue that project-by-project review of greenhouse gas emissions is required by the ESA or could in any way prevent ice formation or destruction.

Test cases should be brought by industry that argue that various federal permits --import/export permits, private jet landing permits, conservation banking permits-- all have greenhouse gas impacts, no matter how small, and thus that they must be subject to Section 7 review. Courts ought to be forced to the far reaches of Section 7 immediately rather than over years so that the agencies do not develop a practice of automatically referring for review just the projects they want to stop. It is vital that affected industries not trust the executive branch to practice restraint or to push back against the most ambitious of the claims of environmental activist plaintiffs.

One caller to my radio show yesterday suggested targeting imports from China entering via federally-regulated ports as an opportunity to argue that the PRC is the real culprit behind skyrocketing global emissions.

Another urged a focus on the private jets that Al Gore and other activists are so fond of using to carry their climate change gospel around the globe.

An e-mailer asked whether the new Yankee Stadium is depending upon federal money or federal permits in any way as surely the traffic to and from the ball games will punch up the plight of the polar bear.

While there will be a long list of targets for test cases, the key is that industry not react to suits brought by the very accomplished lawyers of the left but that they force the tempo and choses at least some of the battlegrounds.

Swarming the courts has long been a tactic of the left, but private sector firms and sectors threatened by the threatened polar bears need to do more than sit back and wait for bills to come do and projects to be canceled. Congress under Speaker Pelosi and Majority Leader Reid will not be offering legislative relief no matter how absurd the consequences of the listing. The best hope to cut-off the imposition of Kyoto through the rulings of the U.S. Fish & Wildlife Service is through the federal courts, and the time to act is now.

Is it just me...
...or do others feel absolutely no comcern for species disappearing on this planet?Never have and never will.I have lost exactly NO sleep with the disappearence of the passenger pidgeon at the end of the 19th century, or the dinosour millions of years ago,or any species in between.If others disagree,please explain to me just how it has affected your life.

Three things that should be part of a presidents' oath of office:

1.Never draw to an inside straight.
2.Never get involved in a land war in Asia.

3. Never, ever put ANYTHING on the endangered species list!

The War Against Humans

Once again the Bush Administration gets easily bullied by the Left and they roll over and take it with barely a fight. The polar bear being listed on the endangered species list will obviously be a tailor-made propaganda tool for global-warming nuts to stifle virtually every aspect of American life. Yet Bush does it anyway.... What is wrong with this President? He and his administration seem to miss even the obvious stuff!

There is no real threat of polar bears becoming extinct anytime soon, but they sure look real 'cute' in the news and are perfect for tugging at heartstrings. Besides, Algore already planted the polar bear seed with his lame and untrue political documentary. This is a natural extension of the big lie that he started on a national level!

Clearly this is simply a ploy to give power to the environmentalists who want to stop progress in the United States. If they really wanted to make a difference, they should be taking a hard look at China. If fact, I think they should all move to China, never to be heard from again.

Darwinism?
If indeed we are just another animal, then it would seem to me that any actions of ours which cause another species to become extinct is just an indication that we were the fittest, and we out-competed them. Yet the worshippers at the altar of Big Evolution don't see it that way. I don't think they understand the basic tenets of their religion. Then again, the same could be said of most Christians.

Elevator Music
Al Gore Industries has announced a government funded contract with all Elevator Operations in the United States. Human flatulence collectors will be placed in elevators by mid-term of the Obama administration.

American citizens will be required under the "Change We Can Believe in Act" to hold all human emissions until fully entered in the elevator and the door is closed and then they can expell the gas.


Why is gas so high?
If you have ever asked why the cost of energy is so high here is your answer. Guess what, It's headed higher when the anti-capitalist, anti-technology environmental Luddites' lawyers start their attack on business and regular people.
The Republicans wonder why they are getting their butts kicked. For the RNC leadership in the wheel house of the Titanic here is your answer. You have Bush, at 22% approval, surging to be a demican/republicrat and McLite running for Pres as a moderate democrat.

Unbelievable
Well, when we're all starving to death while freezing in the dark, at least we can have warm fuzzy feelings for the polar bears and kangaroo rats and red-winged doodlebugs or whatever.

Absolute insanity is what
this is. it was obvious from the very start of this court case that the entire thing was a fraud. So how do you win a case that is an absolute fraud? The target of the fraud "surrenders" unilaterally. The question is...was this case a secret deal by the Bush admin? A way for them to get AGW on the map without more anger fromthe base. A case they can say "see we didn't want to surrender to AGW but the court made us do it".

This is evidence that this law not only has gone far beyond it's original iuntent, but that it is beiong actively abused. It should never have been passed and should now be repealed.

We need to start a "repeal this law" movement.

I'd Go Further . . .
. . . if I were among these companies who are in the process of being negatively affected by this insane ruling. I'd immediately launch a countersuit against every single radical enviro-extremist group - and go after them under RICO statutes. Because what the enviro-nuts have done to our economic development over the past three decades in the name of things like the polar bears would certainly fit the definition of RICO.

We'd better find out
Why the left in general and the enviros in particular are so intent on destroying our way of life in this country. I guess because most of them are living on money begged in the name of the environment they aren't actually paying for fuel out of their own pockets.

Increasing power of democrats
will mean more and more defense of radical environmentalists and less drilling and exloration of our domestic supply of oil. The polar bear caper is just another step in that direction.

I received a communication from my Senator Stabenow in answer to my request she support Mitch McConnel's bill. The reply was long but never addressed her position on the bill. Instead she empahsized her role in careful monitoring of drilling for safety. Given the record of safety here and elsewhere, I replied she could better use her time supporting drilling and building of nuclear power plants.

Earlier, I received a communication from my other Senator Levin about the speech he gave in the senate regarding the high price of gas. He stressed his postion in going after big bad oil, permitting a holiday from gas taxes etc. I replied back since democrats were guilty of blocking our domestic supply of energy, what he had said was just window dressing to make it look to the public like democrats were doing something positive and as such was hypocracy and not worth much. I suggested he facilitate finding energy sources in our own country. I pointed out how misleading were his comments regarding alternative fuel in that it suggested it was just around the corner.

The Fed Gov't can do anything
it can get away with on Federal land. However, They have no authority over private land, thus no one should have to get Fed licensing to build refineries, Nuke plants, etc.

My country, that I should have volunteered to serve for, is fading away in my lifetime. Sadly and regretably, getting it back on track to the land of the free and the home of the brave will be a violent affair. Some can be pushed farther without uprising, some, like me, can tolerate a little more, some are already past that point.

Btw - Congratulations Canada. We will now buy more of your carbon emitting oil so that we don't produce it ourselves. Same impact on polar bears but since we aren't drilling it ourselves, all is well.

I daydream about having to be on the wrong side of the law in order to stand on my Constitutional rights. I'll be looking for a state to cecede from the USA and if they do it for the reasons I agree with, there will be one more home on the market as my wife, my schnauzers, and myself will pay any price to leave this nation that left me in 2008.

Oh Loco - these are two of the worst of all time. Which, of course guarantees they will be reelected many more times.

Schumer is still #1 on my most despicable list but so many others are vying for the top spot. Levin is making his move but Schumer still has the inside track by trying to nationalize all banking operations.

Now that the D's are on the cust of supermajorities in both houses, they should be able to what they have been drooling over for 40+ years - a new constitutional ammendment that basically says all previous ammendments are null & void, along with the Declaration of Independence and Conservatives.


Kill the Polar Bears
Forget legislative action. Here's the simple solution: kill all the polar bears. No more polar bears, no more threatened species.

I know it sounds crass, but if America was confronted with the worst case scenario, all construction comes to a screeching halt because of emmissions constrictions, the American public will respond by taking up arms and declaring a private war on the polar bears.

How do I get
on the Endangered Species list? As a conservative, I truly believe I should be.

Simple Strategy
Every time a project is killed or companies are forced to raise their prices for their services they should publicly announce that their actions are a result of the Polar Bear ruling, or other suitable ESA or EPA provision so people begin to understand the full impact of these regulations. So few people speak up because they have no clue how these rulings affect their daily lives. How many people blame Congress for current high gas prices instead of theoil companies? Not many because most are unaware of the stifling regulation imposed on industry that has led to the current situation.
A perfect example of this strategy would be to raise electric rates. I'd hike them by 10% and tell the public that is the cost of complying with Federal regulations and if they didn't like it they can elect responsible legislators. In today's WSJ the CEO of Exxon is groaning about Bush's second visit to Saudi Arabia to beg for more oil. Why doesn't he find a microphone and tell the American people just why gas prices are high? Stop letting the eco-Marxists and the Dems dominate the bully pulpit. The truth needs to find a way to come out.

We deliberately made one species extinct
....I recall in the last century, there was some celebration over the fact that smallpox had been declared extinct. This was the result of a deliberate, relentless, global program.

It's a good thing no one managed to get the smallpox virus put on the Endangered Species List.

(And I'm sure there are samples in weapons labs scattered around the world. It may not be too late.)

I stopped by yesterday to see how the polar bears were doing.

They were all sunning and jumping in the water making huge splashes. A lot of people were watching.

One came over and took a big dump, watch it I yelled. He started laughing. Since we're endangered we can do whatever we want,when we want to, and to whoever we want to.

We call ourselves democraps. Come a little closer I want to tell you a secret. Watch it, you just want to try and maul me and eat me.

My intimate experience
with the Endangered Species Act has marked with abuse of taxpayers, impairing or eliminating private property rights and compromising the health of people living in affected areas. One would think the government would be required to compensate landowners and property tenants for the loss of their rights.

Spotted Owl Totalinarianism
You know, before the polar bear listing issue hit the news, I had compared probable CO2 abatement programs to the Endangered Species Act, used as a bludgeon to enact almost any leftist policy, e.g. the nonendangered spotted owl used as a proxy to shut down the logging industry. Was I prescient? "Climate change" dogma can be used as an open-ended tool to control almost every aspect of our lives & economy, which is the real reason the lefties & elite want it.

I like Hugh's idea tho. In fact I'd thought of the same sort of thing with respect to the Clean Air Act suits, in which courts are forever ordering tighter standards for emissions of soot & whatnot, that make city life harder & more expensive. I'd thought maybe a group should sue to argue that these alowed levels should be reduced to ZERO since arguably any emissions AT ALL would be bad. Zero is of course impossible. The courts would either find some limit in the CAA to this nonsense, or so order, which would force the CAA to be modified & be made reasonable.

I do notice this deference to the "exercise of scientific discretion" only seems to go one way; I seldom see the courts act shy about prodding agencies to be MORE stringent based on the court's reading of the science.

If the Bush admin hadn't once again treacherously wussed out, we could have forced THEM to file a suit &, for the 1st time EVER in this debate, forced them to actually demonstrate all these wild assertions about which they've been spouting propaganda & armwaving. Suppose scientists had to testify under oath? Suppose alleged evidence had to actually be examined under court supervision?

The warmies should have welcomed such an opportunity, because if they could have pulled it off they could have verified, tested facts and analyses with which to convince the skeptics. Instead, once again, they get to dance around having to ever actually put up.

People don't realize
Most people think this ruling is nutty, silly, and stupid. Some even think it is great. What most people don't realise just how disastorus this rulling really is. This ruling is going to destroy what little there is left of the U.S., the west, and it will even starve the third world worse than it is already starving. They don't understand how far reaching this ruling is, or what the ramifications will be. It is going to destroy the left, the right, and everyone in between.

The children have had their tantrum and got their way. The white flag of surrender has been firmly planted. It's all over and even they are going to be trampled by their own foolishness. After they have been trampled they still will not understand why.

If there was ever a time, or an election to vote thrid party or None Of The Above it is this coming election. I would urge everyone to vote. Staying home and not voting is almost the worse thing to do. Voting for either an R or a D is the worse thing.

None of the R or D candidates are going to help us. All of them are the problems. They will only make things worse. If you are a republican and you vote third party, and a Dem wins. It doesn't matter. If you are a democrat and you vote third party and a republican wins. It doesn't matter. They are all one and the same. What is important is for whoever wins to have won by a very small percentage of the total votes cast. What they need to know is the vast majority of this country does not support them, and will not back them. Impeachment backed by a majority of the population is a clear and real threat to them.

This Polar Bear rulling is a horrible far-reaching disaster. It may be possible to save ourselves, but right now it dosn't look promising.

This should show the industries where CSR wimpiness gets them. But then, they're run by guys who want to cash in big next quarter & bail, so, whatever. Why put up with mau-mauing in the meantime?

If this is how egregiously the Bush admin sells us out, how bad do you think a McCain admin might be? What good is his alleged military cred, when he lets the real enemy eat us alive from within?

Trust me, enacting Mack's "cap & trade" will not make one iota's difference to the ESA Sect 7 actions, unless the C&T law preempts ESA Sect 7, which it won't because Mack & pals would never try to insist on such. BOTH laws will bite us in tandem.

Look at North Korea or old East Germany, because it's coming to us, courtesy of the "maverick" we 'have no other choice' but to support!

I suppose manditory abortion is the natural progression of this idiotic ruling! As long as the myth that carbon dioxide is a greenhouse gas is embraced by politicians and judges, no animal on this planet is safe... Maybe we should kill all of the plankton in the sea... That would definately reduce Co2 in the atmosphere. It will however, not reduce the temperature one iota. Anything short of exploding the sun will do nothing to change our global temporatures.

Evolutionary Biologist and Paleozoologist Dr. Susan Crockford of University of Victoria in Canada has published a number of papers in peer-reviewed academic journals.
“Polar bears, for example, survived several episodes of much warmer climate over the last 10,000 years than exists today,” Crockford wrote. “There is no evidence to suggest that the polar bear or its food supply is in danger of disappearing entirely with increased Arctic warming, regardless of the dire fairy-tale scenarios predicted by computer models.”

Internationally known forecasting pioneer Dr. Scott Armstrong of the Wharton School at the Ivy League University of Pennsylvania and his colleague, forecasting expert Dr. Kesten Green of Monash University in Australia, co-authored a January 27, 2008 paper with Harvard astrophysicist Dr. Willie Soon which found that polar bear extinction predictions violate “scientific forecasting procedures.” Excerpt: The study analyzed the methodology behind key polar bear population prediction and found that one of the two key reports in support of listing the bears had “extrapolated nearly 100 years into the future on the basis of only five years data - and data for these years were of doubtful validity.”

Since CO2 emmissions cause Global Warming, and we can point to not only the automobile, but also power consumption, the cities of the bay area and adjacent areas should be sued for at least $100 billion dollars. This would also include all the firms of Silicon Valley and San Jose.

2)Using the same logic, Malibu and LA and Orange County can also be sued, but since they have more people and industry, the damages should be set to $500 billion. Especially Malibu, which has one of the highest concentrations of multi-millionaires in the world.

3)A $50,000 surcharge should be levied on each flight for private jets. Luxury Hotels should also be given a $15,000 surcharge for every guest.

During growing ice mass, there was a decrease in the number of polar bears.

Maybe the shrinking land mass means that it makes it easier for polar bears to find a mate and get busy?

I can't site any evidence right off hand, but I have seen where the eco-terrorists have cited children as a cause of global warming, have advocated population control to reduce global warming, and even advocate the extermination of the human race altogether! Unfortunately, they don't lead by example (but that's to be expected from them).

Truly Endangered
Its time we put humans on the endangered species list. Lets start with the radical reduction in white male Christian Conservatives, as their numbers are in obvious decline.

Perhaps we can find a way to mete out punitive measures to other species for the destructive activities in which they participate, so detrimental to humans. Right off the bat, I think several species of sharks and bears might be targeted for attacks. Then there are the rats and rodentia that threaten health and welfare of humans from the rural destructive Beavers and Groundhogs, to the disease ridden wharf rats of our cities. Since we cannot tax or regulate their activities, perhaps we should label them for the terrorist groups that they are, and defeat them as enemy combatants through extended hunting seasons and less restrictive gun regulations. The best solution might be the establishment of an agricultural market for their meat and pelts. Fake fur creates greenhouse gases, after all.

I was confronted by the Jehovah Witnesses and they wanted to explain to me how we are going back to the Garden of Eden and we need to get MAN, not Women but Man to stop destroying the EARTH. Polar Bears/Children
What is really sad is these LIBERAL teachers trying to scare my 8 year old granddaughter by telling her that her grandpa is mainly to blame.
I confronted the school Principle and the teacher and the Principle wasnt to happy with the situation that I brought a law suit against the school. I explained that I didnt send my tax dollare to their school for them to blame me for something totally false. I went on the internet at the school and had to show them that POLAR BEARS are thriving more today than ever. They seem to not have a problem in discipling the teacher who scared 8 year olds into believing that the childrens parents and grandparents where responsible for the POOR POLARE BEAR and their mass production in the lasr 30 years.

Lawsuit idea
We switched over to daylight savings time a month early this year to conserve energy. Since increased energy use = increased greenhouse gases = more danger for polar bears, maybe the Federal and state governments should be enjoined against switching back to standard time this fall.

Follow the link, and you see that the only basis they used for the decision was the "climate models." The bear population is healthy as best as can be determined and has only one group is in decline, but there are about 14-15 other groups and sub-groups. The biggest threat, in the past, was hunting and since restrictions have been put in place, they have thrived.

It is Capitalism that's under the threat and the polar bear is just a means to an end. I doubt most of these people give a flying fig about the bears.

CAP and Trade
Figure out how much electrity the average home and family uses and cap it at that. You can't have any more than the set limit. Wonder if Mr. Gore would agree to this since he uses 12 times the electricity of a normal household.

You couldn't use average electricity or even average total energy use. Most homes in the South or all electric. Most homes in the North use fuel oil for heat and don't have airconditioning.

Most homes on the California coast have gas heat and no airconditioning. They use little electricity because summers are cool and winters are mild.

That is where all the eco-idiots live and if you used national averages you would be rewarding them and punishing the South.

Of course when limits are set, this is what the politicians will do. However, in keeping with every Washington decree, the politicians will be exempt from the law.

Polar bears headed SOUTH
I live in Alaska where it is fun local news that for the last 2 or 3 summers polar bears, usually young males, have been seen ambling SOUTH! Now, if they really need the polar ice, why are they headed inland? Nobody knows and polar bears are too grumpy to ask.

What's really weird is -- Alaskan winters around population centers like Anchorage and Fairbanks are getting warmer while staying about the same in rural areas. Interior Alaska summers are cooler and wetter than when I was a kid. This spring it snowed until May 1st. The polar ice cap has rebounded something like 60 percent in one year. So ... what does that all mean? I don't know know, but the polar bears seem to be looking for a WARMER environment. I think this shows us that we humans really don't know much at all and maybe we should just stick to observing and recording the wildlife and let the wildlife take care of itself.

Wait a minute...
I think I see how to play this game! Which way to go, here? Start some kind of animal think tank, monitor new additions to the endangered species list, and immediately apply for million dollar government grants to study the situation?

Or maybe get a large government subsidized loan to start a polar bear bordello and crank out little polar bears?

How about some kind or polar bear road show to educate people about the wonders of the polar bear? Any government money in that?

Do the polar bears themselves know that they are endangered?

Ruling Reversed!

In a surprise annnouncement today at a Washington news conference, government spokesman Dimmitt Bucknutt disclosed that the polar bears have been removed from the endangered species list. The move amounted to a reversal of a ruling only recently issued.

Under questioning by reporters, Mr. Bucknutt sheepishly conceded that the whole thing was a "false alarm". "It seems that the reduced numbers of polar bears observed in the Artic regions was the result of a large number of the creatures having stowed away in the cargo hold of a Carnival Cruise Line vessel and migrating to the Yucatan peninsula of Mexico, where they were discovered lounging on the beaches and raiding the local fish markets".

"We regret any inconvenience this may have caused to anyone", Mr. Bucknutt stated, "and are pleased that our quick government response has averted the crisis".

In a related development, Democratic congressional leaders have today called for new federal funding for a program to corral the vacationing bears and return them to the northern ice floes they must inhabit in order to survive.

Nothing New
Radical Environmental groups have been using and abusing ESA to practice on smaller industries and recreational groups for decades. They have hammered industries from mining, housing development, lumber, to recreational activities ranging from equestrian and mountain biking, rockhounding, hunting and fishing to the exploding activity of motorized recreation and exploration. They have closed over 97% of public lands in California to motorized and mechanized access, while perserving 14 million acres as official Wilderness. Federal Agencies are now in the business of closing public lands to public access just because of a THREATENED lawsuit from CBD. They are no longer in the business of managing federal lands. They are in the business of closing them to public access. This is nuts!

Richard Pombo attempted to reform ESA. Not repeal it, reform it. Look what it got him. Environmental groups poured tens of millions toward his outster from the House and the Resources Committee.

This law is an absolute license for leftists to steal away our liberties, and our livelihoods. Eventually, it affects each and every one of us who depends upon our employment, and who pays taxes and premiums that support unemployment insurance.

If our economy and our Republic are to survive, ESA has got to have severe limitations.

An Exercise in Futility
To attempt to debate this issue is moot. The mere fact that the Polar Bear was classified "threatened" by a Republican Administration cabinet member, in spite of data both real and scientific to the contrary, makes a bold statement.

Nothing that our "government" does of late, makes any sense on its face. Never has the term "good ol' boys" been more apparent. It says that the degree of underlying corruption, graft, special interest influence and backroom political posturing is the primary problem.

What to do? Send a letter, fax, phone message and email today to your Congressman and Senator and politely inform them that "they're fired." It won't immediately get their attention until elections roll around but when they find that their name has been removed from the ballot, it may have a minuscule chance of sinking in.

The obvious thing to do is to attack oil imports. Let Canada, Mexico, Venezuela, The Saudis etc. pay to overthrow the act.

Sue home builders. Auto companies. Lumber companies. Steel mills. UPS. FedEx. Al Gore for living at home. In fact bring as many actions as possible.

Baseball Doc - Libertarians
Yikes! That would send a statement alright! Like, we want the Democrats to be in charge of all areas of our government. Libertarian candidates have few changes to win even if all disenfranchised voters voted for them and in some states even if they won the election would be set aside because they aren't considered "real" candidates under the rules. The goal is NOT to allow the Democrats to gain anymore control of the government, not to hand it to them on a silver platter of not very communicative protest votes. Hopefully, many of us learned that lesson with Perot. Unfortunately, the only hope for keeping the Democrats from controlling the government completely is a Republican win in November. Anything else will give us 4-8 more years of disaster in this country.

Also, I don't know about the Libertarians in other states, but the ones in my state favor getting rid of ALL laws that protect the environment, any special group like children or women, or any laws restricting the free and unrestrained use of our bodies -- like drug laws, abortion, marriage, prescription limits, etc.

They may be fiscal conservatives and they may be political conservatives (whatever that means), but they are very definitely not social conservatives and I happen to think that government does have a certain responsibility to maintain laws that protect public health and safety. So, while I have voted Libertarian once or twice in the past, I would not do so now. The Libertarian Party appears to have become the Party of the Libertines and, as a social conservative, I'm not in favor of that.

I hate to say it, but that's why we have to elect McCain. He has plainly said he would appoint Supreme Court Justices in the mold of Alito and Roberts. (Even though he voted for Ruth Bader Ginsburg)!

Polar bears
Should we kill all Polar Bears in protest? That way we will be able to properly count them. Maybe we could stack them outside the White House so can count them. 1 2 3 4 5 1002 2003 and so forth.

Target list
This may the the straw that breaks the proverbial camel's back. It's time businesses and sane people who are truly concerned about out world and society to turn the Lib's and Eco Freak's tactics on them and bury the courts with 60 day notices and legal actions of their own. And starting with Gore, Travolta, etc. and any project, activity or new facility construction undertaken by those who pushed this polar bear posting through would be a very good place to start. Just think, Travolta with five or six turbine powered winged paperweights, and federally funded pork barrel projects, sponsored from both sides of the isle, stopped dead in their tracks. Perhaps we could even shut down Congress due to it’s carbon footprint, too. Talk about progress!

But seriously, if businesses and intelligent individuals and action groups do not act soon and with conviction, we may never bring this terroristic Eco-lunacy to an end.

Declining Numbers
I would think that before a species of anything could be placed on a threatened listing that it should be proven that there are declining numbers of that species due to the problem listed.

At last count, there were twice as many polar bears as there were fifty years ago.

Therefore, since they have doubled in population, they are not threatened. Further, their habitat is not restricted to ice. Many stay on land for the entire year. Therefore a loss of ice will not endanger them.

Finally, what is an acceptable number of polar bears? How will we know when they are no longer threatened unless we have some measure to judge by? There is nothing of this nature set up. According to some, the entire north should be turned over to the bears (and other animals there) and all people should leave. Since many people there have been there about as long as the bears have, I do not consider that acceptable either.

Finally, if the bears do begin to starve, will it be because they can't get to the seals? Or will it be due to the fact that there are so many bears that they have exhausted their food resources? In that case, feed them the environmentals. We certainly have far too many of those. I suspect Big Al could keep a family of bears fed for a week all by himself.

File a lawsuit to prove MMGW exists
Go to the global warming petition project and educate yourself. If they cannot prove without a doubt that carbon emmissions causes global warming, then they cannot legislate action against anyone emmitting it. The MMGW models are continuously modified because it is a failed model. It's the sun stupid! Lower solar flare activity this spring has given us lower than average temperatures.
