Secret Ballot Hypocrisy

Will the Dems' health care Christmas Present to America be an improvement or detriment to our health care system?


When three of the top policymakers in Washington voice explicit support for a particular viewpoint, it merits notice.

When that viewpoint is unambiguous support of the sanctity of the secret ballot, it makes news. Particularly this year, when conventional wisdom holds that congressional Democrats are poised to eliminate the secret ballot in unionizing elections, a trio of influential voices advocating for secret ballots ought to make a real splash.

Consider, then, these powerful quotes.

“It’s a secret ballot. Thank the Lord.”

“[T]he increased use of the secret ballot in union recognition elections will help bring real democracy to the … workplace.”

“[W]e need to follow proper rules of procedure and hold a vote by secret ballot. It is important that the integrity … be unquestioned and above reproach.”

Thanking a higher power for privacy at the ballot box? That was New York Rep. Louise Slaughter, the Democratic Chair of the powerful U.S. House Committee on Rules. The panel she chairs has the authority to determine whether or not a bill or a particular amendment will receive a vote on the House floor.

Her quote was not speaking to the importance of secret ballots for working men and women, however; it was simply her appreciation for her own privacy in a hotly contested Democratic leadership election, in which congressional Democrats ousted their longest serving member from his post atop the Energy and Commerce Committee.

No wonder she valued her privacy.

And who extolled the virtues of secret ballot unionizing elections as bringing real democracy to the workplace? That was none other than my good friend and fellow Californian Rep. George Miller, the chairman of the Education and Labor Committee, which sets federal policy for American workplaces.

A word was omitted from Rep. Miller’s quote as printed above; in fairness, the complete statement should be presented. It says that increased use of the secret ballot in union recognition elections will help bring real democracy to the Mexican workplace, and it comes from a letter written in 2001 by Rep. Miller and 15 fellow congressional Democrats to Mexican government officials in support of secret ballots to resolve unionizing drives in their workplaces.

The final quote too is missing words that explain its surprising origin. In unabridged form, it says that “it is important that the integrity of the [Congressional Hispanic Caucus] be unquestioned and above reproach.” It comes from a letter in which four Democratic congressional representatives call for a secret ballot election of the leadership of a party caucus, and one of those signing the letter is Rep. Hilda Solis, the distinguished California congresswoman who today is being considered in the Senate for her nomination to be President-elect Barack Obama’s Secretary of Labor.

While each of these three has offered compelling support for the use of secret ballots, they have also advocated for the misnamed Employee Free Choice Act, a bill that would abolish secret ballot elections for American workers deciding whether they wish to be represented by a particular labor union.

This measure is often referred to as the “card check” proposal, because it replaces the secret ballot with an open sign-up process in which workers are forced to publicly declare their support for a union by signing a card.

Put another way, card check may bring forced unionization through peer pressure, or worse, coercion and outright intimidation.

This anti-worker proposal is hugely unpopular with the public – nearly 80 percent of the American people opposed the bill when it was last brought to a vote in the House – but it’s sacred to organized labor and their allies in the Democratic Congress.

The three top Democrats voicing support for secret ballots outside the American workplace are leaders in their party, and I respect each of them deeply. But their advocacy for basic democratic rights should not stop on the doorstep of America’s workplaces.

I hope they take their own words to heart, and back away from the dangerous and undemocratic card check proposal. To do otherwise would betray the very principles of freedom and democracy that they so eloquently and vociferously defended.

Coercion and outright intimidation will be the first choice of the unions using card check. No "may" about it. People /will/ sign or else.

The ones who go public face death for themselves and their families.

He was just a little ahead on his prediction. This is such a disgusting piece of misdirection by name that it exceeds any doublethink or doublespeak that Orwell ever considered.

What is particularly scary is that everybody and his brother knows that this legislation is an open invitation to fraud and coercion. That will not stop the Democrats, the self-identified champions of workers, from enacting this into law, thereby ensuring a union tyranny worse than management could ever dream.

Democrat Hypocrisy
knows no bounds. Nobody should find it suprising these "fine" dems love a secret ballot when it benefits themselves, but want public declarations for the unwashed masses. Just more and more of their elitist "do as I say and not as I do" attitude. And Charles you are 100% correct; I've lived my whole life in Michigan and am very familiar with unions. The one and only reason they are pushing for this law is so they can prop up their declining membership; especially if any of the big 3 go belly-up. The UAW may then have to tap into their 1+ BILLION in assets. Maybe have to sell off some of that lucrative property they own so Gettlefinger and his cronies can continue to live in the lap of luxury while their membership loses jobs, homes and family.

We can only hope
the RINOs in the senate have the gumballs to filibuster this train wreck.

we'll see how many businesses decide to ship their jobs out of the county to avoid having union thugs coercing their workers. I'm guessing quite a few - or the business, such as my husband's small tool & die shop (and yes it's very amazing they are still in business at all up here in Michigan) will simply close their doors rather than deal with the tyranny of which you so rightly speak.

Hey, welcome, fellow Alaskan! How are you doing in the COLD snap of 2009? Since I grew up here, I should be used to it, but after 20 years of mild winters, it's tough to get used to car seats with the cushioning quality of concrete loading docks.

As for the unions, I am in favor of trade unions -- my husband is in one (IBEW) and they do a lot of worthwhile things for their workers -- providing health care and retirement that goes from job to job, for ex., and looking out for worker safety in a state where OSHA doesn't want to leave Anchorage (if they even still have an office there).

However, I am against card-check processes. My dad was a union organizer from the 30s onward, back in the days when unionization really was the workers trying to get paid and stay safe from predatory owners, and they used to use the card-check system to track interest in the union, but there was nothing ever binding. A worker could change their mind in the ballot box and nobody ever knew. We've been through two FAILED union elections here. In the ballot box, we voted down the union and then those who were for it wanted to know why and who. I have no problem myself with telling me and because I didn't think THAT union (Teamsters first, Meat-cutters second) was representative of the job we do. However, most people are a lot more easily intimidated than I am (I grew up in a professional inside agitator's home, I know what I'm facing and I'm not afraid because I know their tricks). Still, I prefer the secret ballot because the check box by itself means nobody is going to stand up for an open workplace. They simply will be too intimated. Plus, secret ballot is how we do elections in this country. Why stop doing it now?

Bitter Clinger
There's some question whether the Senate CAN filibuster this bill. Remember the whole "pocket" filibuster controversy -- McCain and a group of Senators worked a compromise. Well, that procedural rule allows the Senate to simply table discussion of a controversial bill and continue on with other business without difficulty. The Dems used it on the majority Rep Senate numerous times and we let them get away with it. Well, now that it is our turn, they may not allow us to do it and they just changed the rules to prevent Republicans from speaking in committees and to make it more difficult for them to speak on the floor.

We can all pray that our Republican Senators will stand up for liberty even in the workplace, but it will be interesting to see if they can given the red tape the Dems are tying them in.

the problem with a secret ballot is employers delaying the vote 6 months or more and then firing or intimidating employees to not join a union.they also do a lot of hiring in the interim and tell the new hires their job is safe as long as a union doesn't get in.i've personally seen this happen at 2 different companies.i doubt mr.mckeon has unless it was from the management side.the secret ballot is not the problem.the problem is management's delaying tactics.and card check will pass despite gop opposition.it wouldn't have come to this if the process was fair for both sides.

My father did some "extra work" for the Union, then he thought he'd try to move up without permission and they tried to kill him. Crippled for life and they tried to prevent him getting a medical retirement. If you weren't afraid, you did not know how many have been murdered.

I'm down in SE. We have not seen the inlets freeze over for a few years, but a bit more of this weather and the glaciers are going to be back.

i just did.oh another thing.the binding arbitration the unions and management goes to when disputes can't be worked out?management wins 90% of the decisions.and mangement can appeal decisions they lose while the union can't.we have 8 years to work on that too.

I'm organizing my fellow employees at my workplace right now (a small group, educators) and we're ready for a card check. Some are supportive, some not. Everybody gets their say.. The big issue is job security. We'll most likely be recognized, but negotiating a contract is a different ballgame.

Anyone that believes
the lies about how this card check will not be coercive is incredibly naive or just plain stupid.

They take these votes with 3 or 4 300 lb dudes with no necks in the room all smiling and nice on the surface, but the intimidation will be palpable.

Card check is just another pay-back to the unions for getting bambi elected, another sellout of the American people.

We have a cancer growing on our liberties with this guy and his dem friends.

Go ahead, Congress, pass this law.
See how quickly employers get rid of employees and replace them with contract workers. They can be hired from any number of staffing firms. They can be hired for any job, ant length of service for a price. No benefits, no worries. If the worker doesn't work out, get a different one.

The lies about card check not being coercive are neither naive or stupid. The boosters of card check don't care about trampling individual freedom. Power and control over people is what they desire. They are on the winning side and will demand Congress and Obama to pass and sign their legislation.

Republicans have no chance of stopping this. The only way it will be stopped is by ordinary Americans who voice disapproval and let their elected representatives know about it with as much emphasis as they did about the illegal immigration issue.

The MSM will not question the abolishment of the secret ballot. They will mouth the same line fed them by organized labor. The power of the Internet will help those trying to blunt this trampling of freedom.

I've been seeing similar sentiments a lot lately on various TH threads. TJ was right, but my reply is the same here as it's been everywhere else: This question was conclusively settled in 1865 at Appomattox. We can only slow Leviathan; not slay it.

Hope and Change
That is dirty pool Mr. McKeon; imagine using someone’s own words to make a point. Who do you think you are pointing out other’s hypocrisy?

Personally I hope the democrats and the unions get their way. Let the people who voted for change find out just how much things will change. Once working stiffs find themselves on the receiving end of an unfettered union membership drive maybe people will wake up from their dream trance.

The secret ballot is sacred for a reason. What’s next? Do the democrats get to watch over our shoulders in the polling booths? Do we have to tolerate thick necked goons making sure we vote the right (or should I say left) way?

Not while I am exercising my 2nd Amendment rights. Be careful whose freedoms you try to trample liberals. Freedom now and always!

One other you can count on it not to do, either: provide coverage of instances of union violence against employees and workplaces resisting unionization.

Legalized Extortion,
Forced unionization is nothing more than legalized extortion.

Requiring union membership in order to get a job is a profound violation of human freedom.

Let those who wish to be represented by a union be represented. But let those who choose to negotiate with their bosses on their own do the same -- with nothing to prevent an employer for offering an independent employee higher pay for greater productivity than the union permits.

is probably not the best of ideas because of coercion. I witnessed this in a local "union officer's election" in the 1970's. At the door to the union hall, you were asked which slate of "candidates" you were supporting. You were then given a bright green "ballot" or a bright orange "ballot". As the intimidation factor was very high, you had better NOT have a bright orange "ballot".
If "card check" passes, couple it with a "national right to work" law.

The downside of "forced unionization"
is that the employee often loses more than he gains. I have experienced the negative side of union "membership". I was (and still am) employed in a highly technical profession and brought "extra value" to my job by learning all I could about the various processes involved and implementing ideas and providing solutions for the various problems that were encountered.
My employer wanted to increase my pay to reward my technical expertise. The union (which I was forced to join because of Michigan NOT being a "right to work" state) emphatically stated NO to the company. They stated that ALL union members would have to get a commensurate raise. This went on for TWO YEARS. Here I am, paying union "dues" for "my union" to "represent" me keeping me from getting my raise. The situation finally changed at our next contract "negotiation" when a new "job description" was inserted into the "contract". By the way, my fellow workers were extremely supportive of me getting the raise.

Integrity - The U.S. Foundation
Any legislator voting for the "Card Check" proposal should automatically be considered by his/her constituency to be a totally unacceptable representative who is corrupt and in the pocket of unions. They are lower than dirt, and not capable of supporting the best interests of the people.

either your company was blowing smoke or you are.it sounds like they were trying to drive a wedge between the workers.if they really thought you were an exceptional employee and wanted to pay you more all they had to do was create an exempt position and make you part of management.that happens all the time in union shops.most of you folks are under the mistaken impression that corporate america is a meritocracy.not even close.no matter where you work you will always have to carry some people whether union or not.i just made the choice years ago that if i have to carry the boss's idiot son i'd rather do it at the higher union rate.

EFCA Will Restore Worker Freedoms
Current law allows for the foregoing of an election if both the employer and the majority of the workforce so agree. In reality, unions are not asking for anything dramatically different from established law with the exception of foregoing an election outright. This is in effect an emergency measure that is required due to the systematic subversion of national labor laws that have been on the books since 1935. Conservatives see in the card check an abrogation of the basic democratic principle of the secret ballot but they don’t want to acknowledge the very real and vicious campaign to deprive workers of their democratic rights that has been underway since the 1970s and which is a major contributing factor in the decline of unionization in the private sector. While peer pressure in the card check process is real, the need to redress the very serious shortcomings which now beset union efforts to represent workers make it the lesser of two evils. In an environment where workers have no reasonable expectation of having their rights protected there is no other choice. To quote Lafer: “NLRB elections fail to safeguard workers’ right to keep their opinions private; and that, on the contrary, the NLRB system results in workers being forced to revel their political preferences long before they step into the voting booth- thus turning the secret ballot into a mockery of democratic process.”

Dear Mr. McKeon, the legislation from the NFPA for the very falsely descrlbed "Fire-Safe cigarettes" was certainly passed in secrecy in states throughout our country; litteraly poisonong people and putting many in emergency rooms, very, very swiftly. The state governors who signed this situation into law should really come clean as to whether they were aware of the secrets of this, or, simply duped by the guise of "fire safety", in what could be realized as the most insidious hate crime to embarrass those of common sense, throughout the "Land of the Free"...

How ironic that the Left claims to be about fairness and compassion when they're
dee-lighted to trash the constitution whenever it can benefit them politically. Just a few examples:

-Card Check which will eliminate the secret ballot and enable union thugs to intimidate workers into supporting unionization.
-The Fairness Doctrine. A ham-handed attempt to censor free speech. Utterly cyncial too as the Left KNOWS it won't hold up in court...but by the time the court battles play out, conservative Talk Radio will have been bankrupted.
-Political Correctness. Ever expanding effort to use social pressure and ridicule to prevent speech the Left doesn't like. And once they control what you say, they control what you think.
-Character assassination: ever notice how the Left often won't argue the merits of an issue? No, they just destroy the character of the messenger (e.g. Bork, Palin, etc.). That way the message is irrelevant.

If fascism ever comes to america, it will come from the Left.

the former speaker of the house (convicted felon, Tom Finnerman) as a morning talk show host on the talk radio station that features mostly conservative hosts. His show is TANKING, as did Air America! And yet, the left believes THEY should be allowed to have equal voice whether or not anyone wants to listen to them or buy from their advertisers!

It is a sad state of affairs when the majority of Americans do NOT want Card Check, do NOT want the Fairness Doctrine, do NOT want bailouts for mismanaged companies, and do NOT want ILLEGAL immigration - and yet the ALL-KNOWING Congressional Representatives and Senators have deemed we are TOOOOOO STUPID to think for ourselves, therefore they must cram this poison down our throats!

i always got a kick out of the way non union companies gave out raises.they call you into the office and go over your numbers for the year.they tell you the company believes in "merit" raises.then they show you your raise and warn you never to discuss it with other employees.of course the first thing we did was compare raises.everyone got the same 1 or 2 percent depending on the year.we used to have a pool on when the vp would come strolling through the dept. telling everyone how tough it was and how we had to tighten our belts lol.usually 1 to 2 weeks before raise time.so it had nothing to do with merit just like we suspected.they pigeonholed you into a salary just like a union shop only much lower.thats when i decided union is the only way to go.

What flavor is your cool aid today? I live in IL and have a lot of experience with the unions. I watched a 30+ Million dollar a year business go under in less than a year because the the local told all of the field personnel that they would see all of their dreams come true if they just signed the little card and voted for the union.

Well, the field personnel took the bait- hook, line, and sinker. But, the problem was that the company was forced to "Carry" the 200% increase in labor and fringes. The union made sure that their guys had all of the plumb gigs, while the best employees were forced to sit down at the hall and wait for scraps.

Because our shop was the only union shop in the market, we cound not compete. But, to make things even worse, by the time the company had to pay over a million dollars to the union for the privilage of going out of business.

The only bit of poetic justice is that the union toadies who sold everyone a bill of goods have been unable to get work because everyone in town knows who they are and won't risk hiring them. And the union hasn't done one thing to keep them employed.

So, Roy don't waste your time defending the union! The union only cares about itself and uses dumb union members to scam money from corporate America. I think the term is Parasite!

i'm skeptical of your little story.no actually i don't believe a word of it.sounds to me like the company decided to close down in one location and open back up in another location just to keep the union out.our motto is if the company doesn't make money we don't make money.when i was in construction,90% of the contractors only dealt with union labor.they knew they were getting professionals,and all they had to pay was the hourly wage.the union handled the health care.and no vacation or sick days either.if we didn't work we didn't get paid.all we did was give an honest days work for an honest days pay.but some companies still want to pay third world wages.thats why most drywall in texas is now done by illegal immigrants.there's your right to work state for ya.

The whole story is true. I delivered the checks (totaling nearly 1mil)to the local office to settle all of the claims and so called violations associated with the company becoming insolvant. But since you bring up the "third world". Why do the unions in Chicago keep spouting the "Save American Jobs"-line? While they have gone out of their way to hire hispanic business administrators to recruit hispanics. In the two unions I deal with daily, the only significant area of membership growth is within the mexican population!

Before my company folded, 2/3 of our seasonal field personnel hispanics on temporary work visas (3-5 yrs)! When the company president inquired about the hypocracy of organizing foreigners (Mexicans), the local BA said that the union would take better care of our field personnel than we were! I was there when the conversation happened!

So, you can waste your time on this site spouting off about how the big bad capitalist ate your cookie but, nobody is going to listen! So go tell it to the people at the hall.

yes, secret ballot is a good thing
in union matters, due to the propensity of unions to engage in coersion. but, in political elections, it is time to do away with the secret ballot, due to the tendency of democratic vote counters to cheat. we need elections where every voter is required to be physically present, cast a ballot while totaly alone, and each vote should be known and verifiable, so if there is any real question regarding the intent of the voter, all they have to do is ask the voter, instead of relying on the opinion of election fraud artists.

If Congress has a "Dirty Dozen" your two rank at the top and then add: Pelosi, Reid, Schumer, Murtha, Dodd, Biden, Kucinich, Obama, McCain, and Waters to come to an even dozen. These are the easy ones. At least 10 dozen exist.

Typical of Congress
I remember a Senator once who voted the opposite of what the voters in his state wanted. When asked why, he said, "I'm here in Washington. I know better what is best for the people that I represent than they do. So even if I am voting different than what they want, I have their best interests at heart and must vote that way."

Unfortunately he was reelected five years later.
