Will the Dems' health care Christmas Present to America be an improvement or detriment to our health care system?


WASHINGTON -- Ugly locutions often crop up in the promotion of ugly politics. Consider the threat of "scrutinization."

It has been made against some residents of Parker North, Colo., who expressed a political opinion without first getting their state government's permission for political activity. Herewith another example of what is being done around the nation in the name of political hygiene, as that is understood by "campaign finance reformers," those irksome improvers whose animating ideology is McCainism.

Parker North is a cluster of about 300 houses close to the town of Parker. When two residents proposed a vote on annexation of their subdivision to Parker, six others began trying to persuade the rest to oppose annexation. They printed lawn signs and fliers, started an online discussion group and canvassed neighbors, little knowing that they were provoking Colorado's speech police.

One proponent of annexation sued them. This tactic -- wielding campaign finance regulations to suppress opponents' speech -- is common in the America of the McCain-Feingold campaign finance law. The complaint did not just threaten the Parker Six for any "illegal activities." It also said that anyone who had contacted them or received a lawn sign might be subjected to "investigation, scrutinization and sanctions for campaign finance violations."

The First Amendment guarantees freedom of association, "the right of the people peaceably to assemble, and to petition the government for a redress of grievances." The exercise of this right often annoys governments, and the Parker Six did not know that Colorado's government, perhaps to discourage annoyances, stipulates that when two or more people associate to advocate a political position, and spend more than $200 in doing so, they become an "issue committee."

As such, they probably should hire a lawyer because even Colorado's secretary of state says the requirements imposed on issue committees are "often complex and unclear." Committees must register with the government; they must fund their activities from a bank account opened solely for that purpose; they must report to the government the names and addresses of all persons who contribute more than $20; they must also report the employers of plutocrats who contribute more than $100; they must report non-cash contributions such as lemons used for lemonade, and magic markers and wooden dowels for yard signs.

An issue committee is defined as one that opposes or supports "a ballot issue or ballot question." Well.

The two real rationales for laws regulating political activity are incumbent protection and the convenience of government -- discouraging the governed from activism. The proclaimed rationale is, however, the prevention of corruption or the appearance thereof. But corruption is understood in terms of quid pro quo transactions -- candidates corrupted by contributions. So, there cannot be corruption in ballot issue elections because there are no candidates to corrupt.

Undeterred by this detail, advocates of political regulation say compulsory disclosure of involvement even in ballot issue campaigns -- meaning compulsory denial of political privacy -- is inherently good because information always is, too. The regulator's motto is "Dirigo, ergo sum" -- I boss people around, therefore I am.

The Parker Six respond: We have secret ballots so government cannot compel voters to disclose how they vote in elections, so why should government compel them to reveal what position they take on ballot issues before voting? As the Supreme Court has said, anonymity is a shield from retaliation for unpopular opinions -- for or against stem cell research, same-sex marriage, etc.

In an experiment by a University of Missouri professor involving 255 participants, almost all of them college graduates, the average participant correctly completed only 41 percent of the reporting requirements on three states' political disclosure forms. Burdensome disclosure requirements and other regulations are, in effect, taxes on political speech. They deter political activism by small groups that are discouraged by the costs -- in money, time, nuisance and potential liabilities -- imposed by regulations.

John McCain bears principal responsibility for legitimizing the idea that government should have broad powers to regulate political activity in the name of combating corruption. If his wanderings take him to Parker North, he can make partial amends by congratulating the Parker Six on defeating annexation, and by endorsing their federal lawsuit, which is supported by the libertarian Institute for Justice, to overturn Colorado's regulations as unconstitutional burdens on the exercise of fundamental rights. That last might be too much straight talk to expect from the perpetrator of McCain-Feingold's restrictions on the quantity, timing and content of political speech.

McCain didn't visit Parker North Six
Sad to say, but John McCain didn't heed George Will's advice to meet with the Parker North Six during his recent visit to Colorado. So, no congratulations on defeating annexation and no endorsement of the federal lawsuit to overturn Colorado's regulations as unconstitutional burdens on the exercise of fundamental rights. One neighbor even fixed a pitcher of lemonade in anticipation of his visit. Oh well.

If your comment re supreme court decision on mccain feingold is intended as a response to the lawsuit against the Colorado secretary of state, they are not directly related.

Colorado and a number of other states have campaign finance laws that regulate ballot issues -- in addition to political candidates. Ballot issues may be proposed amendments to the state constitution or, at least in Colorado, they may be a local issue as small as annexation.

Not only must individuals for or against a ballot issue comply with rules and regulations, but in Colorado, any Tom, Dick or Harriet can file a lawsuit alleging campaign finance violations.

The person who filed the lawsuit against us is a Parker North neighbor who lives only doors away from one of the six sued by her. The attorney who represented her is another pro-annexation neighbor, only doors away too, so their legal costs were minimal.

They couldn't knock on someone's door or send an anonymous note to warn anyone about campaign finance law because they wanted to take us to court.

That attorney is the one who used that non-word "scrutinization" referenced in George Will's article. The complaint against us included the threat that our neighbors who have had contact with us or received yard signs from us might be subject to "investigation, scrutinization and sanctions for campaign finance violations."

So much for free speech without fear of being sued.

Thanks for answering my questions. This really does sound outrageous - it also makes me wonder where the money is coming from to finance the pro-annexation group, and what you think was really behind the annexation movement (in the face of what they claimed was the motivation). To sue you for opposing it sounds like they really had alot at stake, and if it's costing you money it's costing them money as well.

I was once sued for something that, like you, was an honest mistake. It could have been worked out between me and the other party in about an hour, but they refused, and in the end it cost each of us several thousand dollars to resolve it in exactly the same way, only through lawyers.

America is toast
The constitution has been largely ignored for decades. Neither its concepts nor its text is taught in schools. The portion of this document which limits the power of government has been totally abandoned, so that we now have federal depts of education, housing, urban development, etc., things the founders would find abhorrent. Soon we will see a new bureau for health care.

Politicians don`t even mention the constitution except when speaking of rights. They aren`t yet bold enough to openly ignore those provisions so they take the back route with such things as McCain-Feingold.

Those of us who know and remember the free society that once was America will soon die out. The country is and will be controlled by the clever politician who can best promise and pander to the rabble.

Agree with your early post...except even after a few years of Obama, as things get worse, the prescription will be more and more socialism. The economy is bad so we need "central economic planning". Sound familiar?

Two Parker North neighbors claim they wanted our subdivision annexed into the Town of Parker for "better representation in town government."

Opponents didn't want to pay increased taxes, be subject to more strict ordinances, and never see a snow plow again.

The two who wanted annexation sued their most vocal opponents months before the annexation election, claiming we violated campaign finance law. Until we were sued, we had no clue about campaign finance law application to annexation.

We hired an attorney & registered the No Annexation issue committee. They refused to drop their lawsuit against us even after we registered the committee. Given the language in their complaint & subpoena, and their subsequent annexation campaign materials in which they compared us to terrorists and called us criminals, it was obvious they sued us to shut us up and to intimidate other neighbors into silence. That is why the Institute for Justice defended us in the Administrative Court and why the Institute for Justice represents us in a pending lawsuit against the CO secretary of state claiming that campaign finance law violates our rights to free speech.

It's a sad day when one's "political" speech is regulated by the state when 2 or more people spend $200 or more on personal yard signs, and informative handouts & a post card mailer for neighbors. We shouldn't have to hire an attorney to make sure we comply with complicated rules about issue committee reporting -- including your EMPLOYER's NAME when you contribute $100.

We spent more defending ourselves than we did on the annexation election campaign. We lost more than that -- the right to speak out about annexation without cumbersome state public filings and without the fear of being sued by our opponents.

Thanks for writing down the backstory. It sounds like you are getting sued for a matter that has been resolved.

I'm curious, though, what was the argument for an annexation? Was it to increase revenue? Are the people who are behind the lawsuit residents of Parker or the unannexed place you are writing from?

Everyone told me to calm down.

When McCain-Feingold passed I jumped up and down and screamed that this would lead to an avalanche of First Amendment erosisions.

I was told, "Calm down. It'll be struck down by the Supreme Court." They were dead wrong. The Supreme Court gave McCain-Feingold their blessings and look at where we are now!

This is why I AM NOT VOTING FOR ANYONE and I suggest you do the same thing.

Don't let people tell you that sitting this election out means voting for Obama/Hillary. If you do not vote for anyone, candidates will try to get your vote by pleasing you. If you vote for the lesser of umpteen evils, candidates have no incentive to change their behavior.

Do not vote for anyone who is not an acceptable candidate. They do not have to be perfect -- just acceptable and John McCain is NOT acceptable.

In this article, George Will correctly refers to McCain as a "perpetrator".

The perpetrators McCain, Feingold and all those who voted for the grand assault on the Constitution should be impeached for dereliction of duty. Every senator swears to uphold the Constitution. McCain-Feingold violates this oath clearly and deliberately.

It is outrageous beyond the pale that ANY party would have McCain as a member. That one would hoist him up as their best offering to serve as president is positively revolting.

Parker North Annexation
Those of us opposing annexation did so because we believed we would be paying more for less: higher sales and property taxes, fewer services (snow plowing). Fortunately, annexation was defeated in a landslide vote in 2007. Unfortunately, six of us were sued by our opponents in an attempt to shut up and punish their most vocal opponents before the election.

Keep in mind this was an election about whether or not this small neighborhood should be annexed to the Town of Parker -- not election of a political candidate. For spending dollars to plant yard signs and talking to neighbors, we were supposed to have registered an issue committee and reported contributions and expenditures for posting on the secretary of state's web site. After learning about the campaign finance law that applies to ballot issues, we registered the issue committee and followed the rules, but our opponents didn't drop their lawsuit against us. What does that tell you about their motive?

Someone, anyone, yes, but I notice that conservative posters don't really seem to mind the defecation part as long as it is conservative defecation.

I actually once watched, from a parked car, a homeless woman in Chicago who walked around a service station pushing a wheelchair and defecating every five minutes or so. I think of her everytime Anne posts.

So, it's really not about the fecal matter, it's more about how it's wrapped up and scented, right?

If we haven't seen by now, after a year of primary campaigning, what the two lesser of evils choices the elites are offering us means to the future of freedom and our beloved country, then truly there is no hope!

For anyone who is actually willing to make a stand and work for a real candidate, we do have a choice. We do not need to do the same thing again.

We do have a viable candidate with a party behind him that will enable us to gain the national ballot access we need. The candidate is Frank McEnulty (FRANKFORPRESIDENT.ORG) and the party is the New American Independent Party, (NEWAMERICANINDEPENDENT.COM).

The NAIP has started up in 2004 and this is the first year they have had a presidential candidate. Frank McEnulty won the nomination of this party in an online primary vote. His background is solid, his postions are as well.

If there was ever a time and an opportunity to take down the elite's control of the power structure in this nation, this is the time! If we will not act now, whenever are we going to do so? We simply cannot afford another elite to gain the Presidency, it will be a disaster for our home.

Please take the time to check out Frank and volunteer to help get him on the ballot. Precious time is being lost if we are going to win this war. Thanks, Joe

I think I meet your criteria for discussion - I know what fascism is, and I don't think the entire left of center in America is plotting a communist overthrow.

That being said, I checked out the town in question over my second cup of coffee, and I'm a little confused - the only thing that seemed relevant to Will's column was an article from the local paper - here is a small part

"At least 18 Franktown residents have repeatedly tried to gain official recognition as an incorporated town by using a territorial statute from the 19th century and arguing that the town once was incorporated.

Douglas County has tried to stop any action in court because officials are concerned that a handful of people could wield taxing and land use powers."

It sounds to me like there is more of a story here than was conducive to Will's rightist agenda.

But, that is usually the case with just about any columnist on either side.

but I suspect that even if that weren't the case, we will be brought down by our own divisiveness, cultural ignorance, emotionalism, fundamentalist mentalities, and arrested development.

I read will's column fairly quickly - did he ever say why the annexation opponents were opposed? I know that isn't the point, but it seems relevant.

If there is anyone else posting here who is rational, and not a coomunist-conspiracy nut, understands what the word fascism truly means, and can get past the childish rhetoric to actually discuss an issue, consider the question addressed to you as well.

Yes, what George Will has to say is only a very tiny party of how how America is truly sending itself down the tube, while most Conservaties enjoy the ride; no different than Mr. Hitler did with all his guns burried with him somewhere where God only seems to know.

Speaking of debts alone, now America foreign Nation Debt, only God knows how many trillions and much to it to Communist China. If McCain is elected then he will vastly increase the power of the government resulting in economic and social disaster. Then Obama, or worse, will coast to easy victory (and unbridled power) under the slogan "Freedom has failed". If we can't find any real free-market, pro-individual politicians under a weak Obama then how much worse will it be when he assumes the kind of power that McCain is after?

We need to destroy the Republican party because it is preventing the formation of a serious pro-freedom movement. Ron Paul was very close to Barry Goldwater's style of politics. Goldwater actually ran as the Republican nominee. Paul couldn't get out of the gate. This Republican party must be euthanized. There is no other way.

A a Christian I think the only thing that would give this nation more time would be repentance and revival. I am not holding my breath. Read Jeremiah. God warned Israel over and over again and promised to save them if they would turn. There was a point of no return. We may already be there.

Maybe there is no point in taking part in these discussions. There will be one world gov and it is close. Seems like most people prefer denial and think nothing will take down America.

forget about the Political Parities and realize this is a Conservative - Liberal contest. The Liberals have completely out-flanked the Conservatives.

As mentioned above, the juggernaut is in the House of Representatives and the Senate.

George Will is a member of CFR so I think it is HIGHLY ironic to hear him say something is unconstitutional. Of course McCain/Feingold is unconstitutional and it is designed to take power away from the people. That is the EXACT point.

That said, Will belongs to an organization that says the constitution is "inadequate" and our national sovereignty is an "immature concept". The constitution isn't inadequate it is an obstacle to what they want to do. Maybe George is bi-polar?

I wanted to also point out that the results of my totally unscientific "poll" indicates that Ron Paul seems to have had the most support by a wide margin. I did/do not ask people if they are democrat or republican. In fact in most cases no other politics were discussed. I just include it as a casual question during conversation.

It doesn't matter....
...which of them is "elected" as President. They are all on the same team participating in a grand illusion. Try this simple experiment to help you see the truth. Casually ask people you talk to who they supported as a presidential nominee 8 months ago. With my totally unscientific results it seems virtually no one supported ANY of the people the MEDIA claims were the peoples choice.

There is one thing Will forgot to recognize. McCain has reached across the isle and has promoted some liberal ideas. He now says to build the fence, well it will be payback time for Democrats such as Fingold and Kennedy to see that funding is available for the need, something these liberals have not done yet. So maybe there is some wisdom to McCain's actions that no one has thought about. Also, they may not be so anti when it comes to Conservative Judges and actually vote on some. Ever think of this side of the equasion?

Started reading the replies / comments but quickly stopped after about 10. Most of these were unrelated to the articles' topic and where the worst and most hateful comments I have seen on this site. Sure hope these people are not representative of the citizens - voting - of this country. If they are, then we are all in big trouble!

So many posters say how
hard it will be to vote for John McCain. I, too, have qualms about doing so, but realize he is the best of the 3 running and we CAN NOT let our country be led by either Hillary or BHO! One thing I really want to see happen is for John McCain to veto each and every bill with an earmark attached! That, alone, is worth my vote!

My answer to our situation in the near future is to be SURE to elect CONSERVATIVE Congressional representatives and senators. That way, no matter who gets the White House, their feet will be held to the fire by CONSERVATIVES!!! Please remember to vote - don't stay home - elect GOOD Congressmen and women!!!

It is just so sad that all we've got is McCain. My problem with McCain is that he seems like another Teddy Roosevelt, i.e. a politician who is willing to push the limits of the law to achieve some end regardless of whether doing so is wise or not, fully expecting that the law may push back unless it doesn't. The law I'm talking about is the US Constitution.

If one respects the rule of law, then one stays well within its margins and consults the law first before shelling it, and those it protects, to smithereens. But McCain seems to prefer loosing his legislative ordinance on the benighted public willy nilly without reflecting first on the collateral damage he's doing. Here I'm thinking about all of the people who have or will incur hundreds of thousand of dollars in legal expenses overturning his foolish and unconstitutional legislation unlawfully stifling their political speech.

All things considered, though, it is certain that a McCain presidency would be far less damaging to the country I love than an Obama or another Clinton presidency. What a sad testament to America's politics.

The law of unintended consequences
Our congress is constantly rushing off haphazardly to "cure" perceived problems, with no thought of the multitude of problems they cause, every time they interfere with the free-flow of ideas, and the operation of our free enterprise economy. Just look at the great job they did when they mandated ethanol. We now have food shortages, soaring prices, and food riots, world wide, largely due to the planting of corn for ethanol where food crops once grew! Brilliant, simply brilliant! And they just agreed on another "farm bill" containing provisions to reward farmers for "not" growing any crops on part of their land! As a nation, we are much better off when congress is "not" in session - at least then they can't screw things up any more!

I once thought that Bush had sense...
... but that was before pushing for laws like Illegal Alliens Amnesty, passing "No Child Left Behind", and lack of support of our border (and our Border Patrol) while supporting Mexico.

I see the three politicos: McCain, Clinton, and Obama, the same. All will sell the USA and its people to get ahead. They all supported Illegal Alliens Amnesty. The Clinton Machine signed a non-treaty "treaty" called NAFTA, made deals with China, and now they are worth $109k in 7 years, I wonder why? Bush never stopped any of it, and I don't see McCain calling to end anything. Obama is new but just more of the same.

I keep hearing you have got to vote Republican or we will get liberal justices and a liberal mess, well we already have it. The present Republican Party elected officials have done nothing to fix anything and the government is a mess. The Democratic Party is worse but not by much. I think it is time not to vote for either Republican or Democrat.

It seems that EVERY law passed on campaign finance has been signed by a liberal Republican president. Bush had promised to veto it earlier but changed his mind when it became apparent that it would benefit him for reelection.

SCOTUS has already ruled on MF and we lost. It has actually been looked at twice. First by the more liberal court which upheld most of it and once by the current court which struct down part of it in a narrow ruling, but left most of it.

Where better for McCain?
Getting McCain out of the Senate may be the best thing for the country -- no more compromises, no more lame excuses, no more stupid legislation. IMHO, he would be a lame duck prez from day one, so he might actually make some wiser decisions (or at lease fewer mistakes) as POTUS.

If all he did in four years was to give us decent SCOTUS nominees, that would be fine with me.

“In 1993 Berkeley residents Joseph Deringer, his wife, Alexandra White, and neighbor Richard Graham [aka, ‘Berkeley Three’] learned of plans to convert the town's Bel Air Hotel into a shelter for homeless people, including alcohol and drug abusers. The shelter abutted their property and was also near several liquor stores.
The news prompted them to write a letter to the developer and set about making leaflets, speaking at town meetings, and generally protesting the construction.

“Unknowingly, however, they had stepped on a Department of Housing and Urban Development (HUD) bylaw, based on the Fair Housing Act, that barred anyone from discriminating against giving people housing for reasons of race or disability.

“The company running the Bel Air conversion filed a complaint with HUD alleging that White and the others were impairing their ability to ensure equal housing. The "Berkeley Three" first received a HUD notice that warned them of an impending $50,000 fine. Months of harassment from HUD followed, until the Three were forced to sue in San Francisco federal court to affirm their right to protest government actions.

“The Nine Circuit ruled in favor of the plaintiffs, declaring that no reasonable person would have thought the investigation lawful. The decision avowed that what the Three had been involved in was the ‘essence of First Amendment expression.’ LaVera Gillespie, the director of the area's branch of HUD during the investigation, was found PERSONALLY liable for her breaches of the Berkeley Three's rights, sending a warning to overzealous government officials everywhere.”

I have read all the posts here thus far. They are all anti-McCain for various petty reasons. If Gnome Sane votes against him, he will be helping to finally elect a Marxist, oops, I meant Democrat, to the White House. Is that a risk worth taking because you don't like one law with his name on it? Why not sue and let the case be heard by SCOTUS? It will die a fiery death there.

If for no other reason
the man should be denied the office of POTUS, this is enough.

It displays a mind that, either does not understand the principles of a republican form of democracy, or does not care about them.

Either way, he is unsuited for the job and I, for one, will be voting against him in November.

Bush signed it because he thought it was blatently unconstitutional and the SCOTUS would kill it and he woldn't lose "points" by vetoing. Remember at this stage of his presidency he had not yet found his veto pen.

Besides that he ws now an encumbant and this law was and is an ecumbancy protection racket. It is blatently unconstitutional and SCOTUS erred.

What is really bothersome is that this CO mess would take a $300.00 per hour lawyer to straighten out and the people involved most liekly can noty afford that. Another case of lawyers making laws to drum up buisiness.

Not McCain, Bush is at Fault
Bush stated that he opposed campaign finance reform prior to the 2000 election but quickly signed it when he became president. He could have vetoed it and killed it forever, but, powerluster that he is, Bush signed the bill.

The buck stops at the president, not some "maverick" senator who can only be trusted to do the wrong thing.

Bush destroyed what few principles the Republican party had. McCain's rise is the proof.

In November, we will see the complete disintegration of the Republican Party, which is the best thing that could happen to America. Four years of Obama-esque purgatory and America will be ready for a real limited government, pro-individualist party.
