-- Hermann Goering in 1934 when told that a favorite Munich art dealer was Jewish.

WASHINGTON -- Under legislation that the House of Representatives has voted 261-153 to foist on Hawaii, Goering's role would be played by a panel empowered to decide who is a "Native Hawaiian" and entitled to special privileges and immunities. Because there are perhaps only 7,000 "pure" Native Hawaiians, "Hawaiian blood" will inevitably be the criterion and the "one-drop rule" likely will prevail. Goering would have approved of this racialist sorting-out.

Those designated Native Hawaiians would be members of a new "tribe" conjured into existence by Congress. But it cannot legitimately do that.

In 1959, 94 percent of Hawaiians, including a large majority of Native Hawaiians, voted for statehood. Opposition was strongest among Southern Democrats in Congress, who, with the civil rights revolution simmering, were wary of Hawaii's example of multiracial harmony.

Today, the Native Hawaiian Government Reorganization Act, when accurately described, is opposed by a large majority of Hawaiians and supported by only a bare majority of the approximately 240,000 Native Hawaiians in the state. The legislation, sponsored by Sen. Daniel Akaka, is a genuflection by "progressives," mostly Democrats, to "diversity" and "multiculturalism."

It would foment racial disharmony by creating a permanent caste entitled to its own government -- the Native Hawaiian Governing Entity -- within the United States. The NHGE presumably would be exempt, as Indian tribes are, from the Constitution's First, Fifth and 14th amendments. It would, Akaka says, negotiate with the state of Hawaii and the United States concerning "lands, natural resources, assets, criminal and civil jurisdiction, and historical grievances."

Reparations? We shall see. Independence -- secession? "That could be," Akaka, 83, has said, depending on "my grandchildren and great-grandchildren."

The seeds of this weed were sown in 1993, when Congress passed a tendentious apology for supposed U.S. complicity -- which was neither clear nor essential -- in the peaceful 1893 overthrow of Queen Liliuokalani's monarchy by Hawaiian residents. The novelty of America apologizing for a monarch's fall was followed in 2000 by a Supreme Court ruling overturning a Hawaiian law that excluded everyone except Native Hawaiians from voting in a statewide election for trustees of a state agency. This, the court said, violated the Constitution's guarantee of equal protection of the laws and proscription of racial discrimination in voting.

This ruling raised doubts about the constitutionality of the racial spoils system administered by that agency, the Office of Hawaiian Affairs. Which is perhaps why Akaka decided the Reorganization Act was necessary despite what he has called, with weird defensiveness, his state's "perceived harmony."

There are 400,000 Native Hawaiians nationwide, who will be eligible to participate in creating the NHGE. Native Hawaiians are 20 percent of the state's population. They are defined as direct lineal descendants of indigenous peoples who lived on the islands before 1893 and who exercised sovereignty then -- an unintelligible provision because the queen monopolized sovereignty. She, however, was more enlightened than Akaka. She did not distinguish between Native Hawaiians and immigrants, who served in her government.

Under President Washington, the U.S. government's Indian policy was a facet of foreign policy because tribes were considered foreign nations. The Constitution speaks not of native "peoples" but only of "Indian tribes." Akaka's legislation would create a Native Hawaiian "tribe" as a nation within the nation.

Unlike Indians, however, Native Hawaiians' land was not taken by force. They are not a compact community -- they are woven into the fabric of one of America's most polyglot states. They chose to bring themselves under the Constitution by embracing statehood.

Congress does not create tribes, it recognizes them according to settled criteria: Tribes were nations when the Constitution was written and are geographically separate and culturally distinct communities whose governments have long continuous histories. As the state of Hawaii has said, "The tribal concept simply has no place in the context of Hawaiian history."

Virtually all Democrats and a few inexplicable Republicans support this legislation, which will further inflame the ethnic grievance industry. Imagine the lesson that some descendants of Hispanics who lived in the Southwest prior to 1848 would learn from it. A Republican president would veto it. A Democratic president would sign it -- Sens. Biden, Clinton, Dodd and Obama support it -- but the Supreme Court would shred the plan for different laws for different races. Still, the legislation is an important symptom of Democrats' constitutional flippancy and itch for social engineering.

"One nation, indivisible"? Not for the House majority or the Senate committee that have approved Akaka's mockery of the Pledge of Allegiance.

Court wrong on equal protection
Equal protection of the laws is a import of the Magna Carta's "We will sell to no man, we will not deny or delay to any man right or justice." It has nothing to do with voter qualifications or discrimination according to the man who coined the words, John Bingham.


To the loser go the spoils
Democrats are knee-jerk underdog worshipers.

Native Hawaiians voted to join the U.S. because it's rich, free and full of tourists, not pineapples. But they neglected to realize that along with freedom comes competition, and they couldn't compete. Now they want their stuff back, and Democrats want to help.

I say, let's give it to them, but for a price - no more statehood. America can't exist as a nation of nations, each pilfering the other and the whole on the basis of race, class, religion/anti-religion and cultural heritage. When Oklahoma claims a right to reparations from Florida for the Trail of Tears, and SoCal votes to cede from the Union and rejoin Mexico, perhaps Americans will finally wake up and see where knee-jerk underdog worship (AKA "diversity" and "multiculturalism") ultimately leads.

I was aware that this legislation was
out there but I thought it had little chance of passing because it is obviously unconstitutional. How can any lawmaker vote for this bill? I guess it will be up to the Senate to squash it now.

That is the democratic modus operandi as we all know here. They have their own little statue of liberty inscribed: bring us your grievances all victims however slight, we will pretend to advance your cause and seek justice from the great oppressors of the other party. It would be comical if they did not get so many darn votes every election. Alas, without an opposition, the other party would quickly break down into a far worse situation. How do we stop this roller coaster Mr Will? You're a smart guy. Perhaps the democratic party will become the compassionate conservatives if they ever grow up and the repubs will form around the true conservatives and libertarians. Do you think education can ever be ripped away from the bureaucrats and returned to the people in our lifetimes?

Alaska delegation supports this
I find that frustrating because most Alaskans don't support it. It's simply that the Native lobby does. Those few inexplicable Republicans are very likely all three from Alaska.

You see, the handwriting for this legislation was on the wall in about 1971 when Congress passed the Alaska Native Land Claims Act (ANILCA). It was deemed necessary so that we could build the TransAlaska Pipeline. It essentially took Alaskan Natives who had never really been organized in tribes like stateside Indians and organized them into "corporations". Natives had always had village affiliations before, but now they were given lots of money and lots of land that they really hadn't acted as though they owned before so that white people in New Jersey wouldn't feel guilty about "stealing Native land." They got rich off it, but still expect the urban-dwellers who have jobs to provide them with free schools, indoor plumbing and better health care coverage than most working people can afford. And the NJ folks still feel guilty

It was a mistake in Alaska. It will be a mistake in Hawaii. And, it will likely pass because -- well, white people are supposed to feel guilty whenever non-whites (other than Asians anyway) say they've been discriminated against regardless of whether they can produce any real proof of that. Otherwise, you know, we're racists.

Abolish the federal government
I'd like to see the federal government dissolved, much as the former Soviet Union was. Then there could be self-sorting into states by ideology. All the underdog- and multicultural-worshipping Lefties could surround themselves with the underdogs that they are sure are so wonderful but for evil racist whites. And all of us evil racist whites could be left alone to have peaceful neighborhoods, respect for laws, high-brow arts and entertainment...in short, we'd be free to be, by Leftist standards, quite boring.

Tip of the Iceberg
As America quickly balkanizes thanks to our suicidal immigration policy, legislation such as Will describes will explode in geometric proportions. With an increasingly smaller, older, and wealthier "establishment" feebly handing out more and more goodies, benefits, and preferences whites will vainly attempt to satisfy the increasingly numerous and hostile ethnic greivance groups. At what point it eventually and completely breaks down our society nobody knows.

Perhaps....
Pat Buchannon is correct in his new book. He predicts that the US will in the near future dissolve due to myriad social, political, and economic fissures. This legislation seems a good way to further that process. Doesn't anybody in Congress pay any attention when they take the oath of office?

I see we continue to pay for
Bill Clinton's time in office.

Islamic Law
How about letting mulims live under islamic law? What is the difference between that and this law? America is coming apart at the seams and everyone is worried about dancing with the stars or Paris Hilton. When Rome collapsed a chronicler wrote "It is as if the mother of the world had died". When America does implode all of those thirdworlders who rely on American prosperity and charity to survive will lament the day they cheered for America's destruction. God help our grandchildren.

Ethnic Grievance Industry
Mr. Will, I am awe struck to read how successfully our constitutional form of government is being further deconstructed by whinny little minded reprobates. While our culture gleefully watches debased frivolity in the video playground, not many seem interested in watching for snakes in the wood pile.

You used the best phrase I’ve read to date, depicting all these sycophant de jour, temper tantrum throwing children, unaware of what actually gives them any rights at all: “ethnic grievance industry”. Beautifully succinct!

I’m not going to cower. There is a war on. I support your taking the flag and charging into the line against “constitutional flippancy and itch for social engineering.” I am behind you. I will not sit quietly as La Raza musters its forces, expecting us to yield back anything.

It Ain't Gonna Happen
So Senator Akaka thinks secession is in the cards. Snowball's chance in hell. THAT issue was conclusively resolved with a little fight called the 1861-65 Civil War/War for the Southern Confederacy. The rule that came out of that conflict was this: Once you're in, you're in. Period. No negotiation. So, let the ethnic grievance types dream all they want. When, and if, they try to secede, a Marine assault group will end such nonsense once and for all.

A house divided
It's amazing how some lessons are never learned -- Balkanization has always been, and always will be, a poison striking at the very roots of a democratic society. That the islands of Hawai'i', which have always modeled such a beautiful example of racial harmony, should fall to this influence is particularly sad.

Do you hear laughter?
God doesn't need earthquakes and pestilence to punish a nation. He can leave you to your own devices. We are a nation who mocks God. Do you hear laughter?

Buchanan is right
America is divided by ideology, race and religion. I do not see reconciliation, though I predict a literal takeover through sheer numbers by the liberal left. Muslims, gays, Asians, Hispanics, Indians (Eastern), African-Americans, atheists, will politically dominate white Christians. Perhaps life in America will dissolve into to mosaic communities with the first group gathering along the East and West coasts. The US interior and South appears to be the logical gathering area for the exodus of white Christians. This is a sad commentary, yet I paint a scenario that appears to be a distinct possibility. I live in the Washington, DC, metropolitan area. For those of you in the American heartland, I can tell you that "diversity" and "political correctness" is coming your way en masse. The heritage of European-Americans of Christian faith is under daily assault by the liberal left constituency as describer above. I guess physical re-location throughout the US is the only realistic option.

Buchanan is right Part II
Again, I wish to emphasize that my commentary is indeed a sad reflection of my inner belief that today's American society is in jeopardy. I do not wish it so. I absolutely believe that America will revert to a socialist mosaic dedicated to the replacement of America of my youth.

What a joke

I'm a little confused as to what constitutes an "indigenous" Hawaiian. There are no humans indigenous to the Hawaiian islands. Only plants. Maybe we're all confused and the plants are going to get their own tribe.
The islands were originally settled by polynesian people between the 7th and 13th centuries. One group, the Tahitians conquered the Marquesasians and enslaved them. The islands each had kings that constantly fought each other for land and power.
The Hawaiian culture is definitely a melting pot and although non-polynisians are newer to the pot, having only been there since the 1700's, are no less a vital part of the culture. There are families of caucasians, japanese, filipino, etc..that have been there for many generations. Are they really any less "Hawaiian" than the polynesians because their ancestors came later?
I was born and raised on the island of Maui, my name is Pualani. My family traces directly to the Mayflower. I am Scotish and have green eyes. I want my own tribe of green-eyed Scotish Hawaiian born women with special privilages. Why shouldn't I get special treatment too? I'm thinking that I want to open a gambling casino and pay no taxes. Hey, my husband is of German heritage and a combat veteran. Maybe he could have his own tribe too!

The country is...
going to self-destruct! What are we doing to ourselves? Look, we are like cells that are dividing. It is the media's fault for blaming everything on the caucasian male instead of trying to unite all races and genders. Americans, period.

I was born this day in Hawaii 60 years ago when it was a territory. I live in California now. While I agree with most of what Will says, I take issue with Will's statement above:

Who cares how the land was taken? It was taken by sugar and pineapple plantation owners for their own purposes. Sanford B. Dole among others manipulated local politics, forcing Queen Liliuokalani to abdicate the throne. (Look up the exact history yourself.)

The reason the Hawaiians were not a "compact" community was because the plantation owners imported my "peeps" from Asia for labor on the plantations. That's how my grandparents got to Maui in the 1920's. The native Hawaiian population was being diluted without their say.

Anyway, to you crackers out there who didn't want us as a state....Hawaii is the SOUTHERN-most state in the USA and to paraphrase my Southern friends...

I'm American by birth and Hawaiian by the grace of God.

Oh, and another thing...when I was in the 4th grade at Kalihi-uka school, my teacher, Mrs. Abernathy taught us to sing Dixie! I still know the words.

Even if by some chance this bill makes
it through the Senate and doersn't get vetoed the courts will take it down. It is blatently unconstitutional.

Racism is a product of the DNC
This is racism and guess who is the party sponsoring this atrocity. Yep! The Democrats. They are the ones who usually always scream racism attacking anyone and everyone who don't agree with their plans. I bet we won't see the MSM announcing this real issue of RACISM gone awry. Wanna Bet?

100% correct and guess what, I was watching the Rainbow Warriors on ESPN a few weeks ago when they played Fresno State and ESPN spelled it as Hawai'i too--guess ESPN must be part of the great leftist PC conspiracy too. :p

...so was/is McCain-Feingold. And yet...there it sits.

Racist sleaze
Yes indeed, let's call these proponents of racial gerrymandering what they are -- the exact same thing that we would call adherents of the KKK, because both would use govt. power to enforce a racial spoils system. So sleaze, Hitlerian -- come on folks -- aren't you getting sick and tired of keep your mouths shut? I know I am . . . perhaps we should have let the Japanese have Hawaii? On my end, I had relatives fight in those horrific Pacific battles to help protect American and that island. Now I say the hell with them.

Let Hawaii secede
This is not a problem.

Just as ants are sure to arrive at a picnic,"natives" always manage to indignantly surface after the heavy lifting has been done and the prosperity in place. Pack up the feast and keep it inland.

The University Professors are promoting this. Last February USA Today had long article about some who said they hated the USA and the banner "Last In First Out" is flying all over Hawaii now. There was a case where a US Soldier and Wife were beaten by a Hawaiian couple and their son because the soldier parked too close to their car.

Parades take place carrying those same banners.

Hawaii used to be peaceful but it is not anymore.
