WASHINGTON -- Sen. Barack Obama recently told some Iowa farmers that prices of their crops are not high enough, considering what grocers are charging for other stuff: "Anybody gone into Whole Foods lately and see what they charge for arugula?" Living near the University of Chicago, Obama has perhaps experienced this outrage, but Iowans, who have no Whole Foods stores, might remember 1987, when Massachusetts Gov. Michael Dukakis urged Iowa farmers to diversify by raising endive. Said a farmer to a Boston reporter, "Your governor scared me just a hair."

Obama is not scary, just disappointing. Regarding a matter more serious than vegetables -- a judicial confirmation -- he looks like just another liberal on a leash. His candidacy kindled hope that he might bring down the curtain on the long-running and intensely boring melodrama "Forever Selma," starring Jesse Jackson and Al Sharpton. It was hoped Obama would be impatient with the ritualized choreography of synthetic indignation that degrades racial discourse. He is, however, unoriginal and unjust regarding the nomination of Leslie Southwick to the 5th U.S. Circuit Court of Appeals, whose jurisdiction is Louisiana, Mississippi and Texas.

Southwick, currently a law professor, joined the Army Reserve in 1992 at age 42 and in 2003 transferred to a National Guard combat unit heading to Iraq, where he served 17 months. He is now 57 and until last December was a member of a Mississippi appellate court. The American Bar Association, not a nest of conservatives, has given him its highest rating ("well qualified") for the 5th Circuit.

But because he is a white Mississippian, many liberals consider him fair game for unfairness. Many say his defect is "insensitivity," an accusation invariably made when specific grievances are few and flimsy.

Obama, touching all the Democratic nominating electorate's erogenous zones, concocts a tortured statistic about Southwick's "disappointing record on cases involving consumers, employees, racial minorities, women and gays and lesbians. After reviewing his 7,000 opinions, Judge Southwick could not find one case in which he sided with a civil rights plaintiff in a non-unanimous verdict." Surely the pertinent question is whether Southwick sided with the law.

To some of Southwick's opponents, his merits are irrelevant. They simply say that it is unacceptable that only one of the 17 seats on the 5th Circuit is filled with an African-American, although 37 percent of Mississippians are black. This "diversity" argument suggests that courts should be considered representative institutions, like legislatures, and that the theory of categorical representation is valid: People of a particular race, ethnicity or gender can only be understood and properly represented by people of the same category.

Southwick's Senate opponents, having failed to find ammunition in any of his 985 opinions (Obama's figure of 7,000 opinions is interestingly imprecise), cite two cases in which he joined (BEG ITAL)other judges'(END ITAL) opinions. Both cases concerned the proper parameters of government agencies' discretion.

In 1998, Southwick was in the majority in a 5-4 ruling that upheld a state administrative agency's action in overturning a punishment imposed on a state employee. A white female social worker had been fired after referring in a meeting to a colleague, who was not there, as "a good ol' n-----." The court on which Southwick served ruled that the agency given broad latitude to review such discipline had not abused its discretion in deciding that the firing was disproportionate punishment, given that the woman had a hitherto unblemished record and the man, although offended, said the woman's words had caused no workplace problem. By law, the court could not overturn the agency's actions without finding legal error or "arbitrary and capricious" judgment.

In 2001, Southwick was in the majority in an 8-2 ruling finding no legal fault with an official's decision to transfer a child from the custody of a bisexual mother to the father. Southwick's opponents note that the opinion and a concurrence he joined contained "troubling" words like "homosexuals" and "homosexual lifestyle." Troubling, presumably, because not using the word "gay" was insensitive. But Bill Clinton, announcing his 1993 "don't ask, don't tell" policy regarding gays in the military, used the term "homosexual lifestyles," and the U.S. Supreme Court, in its landmark 2003 decision that anti-sodomy laws are unconstitutional, spoke of "homosexual lifestyle."

Why does Obama think Southwick should have ruled differently in the two Mississippi cases? Because he thinks Southwick applied the law inappropriately? Or because he does not like the result? Obama is seeking the office from which federal judges are nominated. Southwick has explained himself, in writings and in testimony to the Senate. Now Obama has explaining to do.

What is his position on Santa Claus?
Recall "Miracle on 34th Street." The climax was a court hearing in which it had to be decided whether there really was a Santa Claus. R. H. Macy was terrified by the thought renouncing Santa Claus on record, because of the repercussions it would have on his business during the Christmas shopping season. The judge was equally worried that the resulting economic downturn would ruin him politically.

My connection here is that reality and the law were only peripheral considerations. What mattered was how it would play in the press and among the public. Is that what we want? Has anyone actually subjected Southwick's opinions to legal scrutiny?

Overs and unders
Obama wants proportional representation on the bench for blacks. When one group is short changed, another has to have extras. The group most represented over its percentage of the population is Jews. May I assume that Obama will be putting holds on all Jewish nominees until no more than 2% of federal judges are Jews? Or is there a double standard in his calculus?

I wonder when black folks are going to get it? They are their own worst enemy.

The real reason he is against
this nomination is that none of Bush's appointments will get a hearing for the rest of his term. The Dems have decided to hold all vacancies open until after the 08 election in which they hope to have a president.

The spin machine is in full throttle and is aided and abetted by the liars in the MSM. This is what the judiciary has come to. When politics replaces the law as a source for rulings by the courts then politics is the method of appointment.

The fix? Remove appointments from Washington entirely. Let each State have it's own appelate court and the State Legislators appoint the judges and have the ability to remove them. At least that way the people will have a more representative arrangement and some redress.

let's be honest about Southwick
What liberals were complaining about in the Southwick case of the bisexual mom, was more than just the "couple of words" that George Will mentions. Southwick's concurring opinion had suggested:

a) that the "principle of federalism" allows Mississippi to pass state laws that treats gay parents more harshly than they would be treated elsewhere;

b) homosexuality is a choice (you know how gays and their supporters feel about that one); and that such choices can involve "consequences" (like in this case, losing your child).

With the civil rights movement, we decided long ago that federalism did NOT give states the right to discriminate against individual citizens (such as state laws for racial segregation), because that violates those citizens' rights.

For Southwick to claim that Mississippi can treat gay parents any way it wishes in the name of federalism is inconsistent with the fact that Mississippi is no longer allowed to treat its black citizens any way it wishes.

So I could see why Obama would be disturbed by what Southwick was implying. When you start implying that federalism trumps individual civil rights and equality, you awaken some very ancient memories of Bull Connor and George Wallace and all that.

the 5th US Circuit Court covers Louisiana, Mississippi, and Texas, and if we are going to embrace the Obama nomination by "Stats" instead of judicial competence/qualification/public service in filling the 17 seats of this US Court, then:
52% should be white, 17% Black, 27% "non-White" Hispanic, 3% asian, and 1% other, as well as, 76% drawn from Texas nominees, 10% from MS, and 14% from LA. I don't know how this breaks out given currently seated jurists in this US Circuit, but I'd venture to guess that an Hispanic would be due more than a Black.

Any Politician
Any politician will say anything to get elected. Unfortunately, history of the last 65 years suggest communistic attitude by the power brokers. They believe, correctly, that most don't have brains enough to get out of the rain. They depend on religion to keep us in line. Just because people are good does not mean their leaders can only be good.

In my view, politicians come from the very bottom of the barrel and if they open their mouths, they are either lying or 'they have cards they ain't showing.'

Obama is showing himself
Obama was the president of Harvard Law Review, the highest honor you can garner as a law student. The fact that he can't get the number of the judge's opinions right, the fact that he thinks there ought to be proportional representation on the bench by race, and the fact that he obviously thinks any white judge from Mississipi is unacceptable, not only shows what a poll driven empty suit he is, but that he does not give any respect to his chosen profession, the law. These are huge red flags that people should be talking about constantly. This man is not fit to be POTUS. It's time to shut down this comedy of errors. However, he is at least doing that for us. The longer he talks, the more ridiculous he shows himself to be. Bomb Pakistan, and ask Iowa farmers to go into a Whole Foods. What a burke.

What a pathetic excuse for a hit piece
Come on Will, you're going to have to do better than this if you want to stir up some serious disdain for Obama. Sure, you're going to rile up the knee-jerk Republicans who hate all Democrats anyway (like the ones who've posted so far on this thread); but they were already in the bag anyway man.

First of all, after reading this column I'm tempted to side with Obama.

Will quotes Obama saying:

"After reviewing his 7,000 opinions, Judge Southwick could not find one case in which he sided with a civil rights plaintiff in a non-unanimous verdict."

This is confusing: I think he is saying that Southwick himself couldn't find a single case in which he sided with a civil rights plaintiff in a non-unanimous verdict. And if that's the case, it's just possible that the guy might not be all that interested in civil rights. Indeed, it might show a serious disdain for civil rights. So if I'm a candidate who is in favor of civil rights, I'd probably not vote to confirm him either. What's the problem here, exactly?

Will seems to think that that's irrelevant because "Surely the pertinent question is whether Southwick sided with the law."

But that's a load of bull and he knows it. Everyone knows that laws are open to interpretation; it's never black and white. That's why we have judges making decisions rather than computer programs. I'm sure that every time there is a split-decision, both sides of the decision genuinely believe that they are siding with the law.

This is a joke of a hit piece Will. First of all, it makes it seem like you really have to dig deep to take a shot at Obama. Secondly, your case against Obama's decision making is a weak one. Thirdly, the points you're making are waaaay to subtle to rile up the Republican base. If this is the best you right wing propagandists have to offer... hello President Obama!

The fact that a socialist like Hillary Clinton is beating Obama in the polls speaks volumes regarding Obama's ineptness and lack of presidential qualification.

Democrats, in general, see the American judicial system as a tool for social engineering, not as a venue for justice. I suppose that President Obama would appoint only black attorneys and judges to the federal benches. That policy would be termed "racist" if followed by a white man. What is the term that should be applied to Obama's ideology?

What this means is that half of the people hired to deal with "domestic violence" under VAWA money must be male. What this means is that all of the discrimination folks (state/fed) must be of racial demographics identical to the races in the population, hence 80% of them must be white and half of these must be white males.

They want to live under quotas, let them suffer the consequences of quotas. Lets start seeing entire offices of mid-level bureaucrats laid off because they are of the wrong gender or race - when we start seeing thousands of black females fired so they can be replaced by white males in order to be reflective of demographics, that is when we will see this foolishness end.

And in academa, lets have sports teams that are reflective of demographics. Instead of all-black basketball teams, we will only let 10-20% of the team be black and replace the other qualified players with folks of the right races. We will have to have one player in a wheelchair, another who is gay (or claims he is) and such...

Democrats are Spinning
if they say that they cannot support Bush judges. The Republican congress for 8 years supported Clinton choices, including Ruth Bader Ginzburg and Anthony Breyer.

In fact, Clinton put three judges on the 5th Circuit court; Fortunado, Stewart, and Dennis. Fortunado is listed as Hispanic and Stewart as black. If race is so imbalanced on this court, and it is such an issue, why wasn't a black nominated instead of Dennis?

Point of fact is that Clinton put two additional nominees up for this court in May of 2000, but Republicans did not act on them. With a general election six months away, I can sort of agree, but Bush has people up for 18 months.

The fact is that the Alliance for Justice is out there spinning against Leslie Southwick, who the ABA has found to be highly qualified. And we know that the Democrats take their marching orders from the Left side of the party.

I don't look for the Dems to approve another judge in Bush's tenure unless he throws them a bone of a liberal judge. The problem is that Leahy is playing partisan politics with his "advise and consent" role, and he knows it. Leahy has played the Hispanic and black cards now. Why has he blocked women, who are NOT a minority, but are not fully represented, from the bench?

Correction
Check the WholeFoods store locator. The University of Chicago is on Chicago's South Side in the community of Hyde Park. According to WF's online information, there is no WholeFoods store closer than the South Loop, about 8 miles away. So there is no WholeFoods store near Obama's Hyde Park home, and if Will thought he was showing Obama as out-of-touch with any world but his own, all Will showed us was that his staff doesn't do careful research.

I support Trent Lott for President,since being arbitrary and capricious, are no longer legal grounds for non-affirmative opinions.I am sure that the "MAN" referenced as the N was hurt,if nothing more than his feelings.Having visited the South lately I can tell you it is somewhat disappointing.But I do suppose, so is America.It is 2007;and people are still calling each other names,treating each other unfairly,being prejudiced toward one another,etc.It makes me wonder,if America is worth "SAVING".

Everyday Obama demonstrates
that he is void of substance. Although I chided him for his campaign based on charm and hope, new and fresh, he did better before he opened his mouth and tried to say anything specific. Each time he does, he demonstrates his lack of understanding of the issues.

One of the very frightening things to me, however, is that everytime he demonstrates how little he understand issues with another uninformed statement, thousands of equally or more uninformed supporters rise up in his defense. It is truly looking like the blind leading the blind.

Isn't this Obama the same president candidate who is tired of answering questions about his being black? Hmmm, if it's not a qualification or concern when it comes to a president, then how does it matter when appointing a judge? George Will is right -- he has some explaining to do.

Ease up on Lilly, I that the real issue is not the fact that there's nearby Whole Foods stores in Chicago but the fact that there are NONE in Iowa.

The example used by Obama when speaking to Iowa farmers is his clueless reference to a food chain which doesn't exist in their State, so much for his capacity to know where he is and to whom he's speaking.

And why in the name of good sense would a Presidential candidate be talking about arugula to farmers in Iowa? Where do they grow arugula in Iowa, Barack? Right next to the oranges?

Barack's take on handing out judicial appointments by racial proportionality is just a Hail Mary pass to assert his Blackness, something that continues to be an issue for his campaign. He was born and raised in a State which turns proportionality on it's head and it's a remarkable comment for someone raised in Hawai'i by a kid who attended a school that was started by White Missionaries and is now dominated by Asians while he was being raised by his White grandparents. I think he has a serious identity problem in defining himself.

If you've read his books, he's prone to flights of fantasy to the extent that he creatively asserts scenarios which he claims to have influenced his life. An example of it is his comment in Selma. He also makes reference to being inspired by members of the African National Congress who purportedly visited the campus of Occidental College when the ANC were on the 'no entry' list of our State Department. Then there's the anti-Black grafitti allegedly scrawled all over the walls at Columbia, most vehemently denied by others who were there when he was.......his life is sprinkled with so many of these that there's not room enough to enumerate all of them.

He's already exceeded his quota of flubbed remarks and as time goes on will continue to show his lack of ability to think on his own two feet when attempting to give a spontaneous answer. Notice how many times he's had to use the term........"What I meant to say.......

A President of the most powerful country in the World can't afford to wait until tomorrow to give a proper answer to a question that needs to be answered today.

You argue against Will's statement regarding whether or not Southwick ruled in his case according to law and whether that was relevant. You scoffed at his ignorance in not knowing that laws are subject to interpretation.

You have stated clearly (albeit with name calling and condescension) the difference between the dems and the republicans. You believe that the law can be interpreted according to the judges desires and intent and the republican feel that justice is delivered when the law is interpreted as close to its original intent as possible. The democratic interpretation is archy.

Since when is the law interpreted on
the basis of race? If there is any question concerning the law it shouldn't matter if a judge is black or white, or any of the shades in between. Obviously liberals don't believe this. They believe that superiority in numbers of people of their own persusion will make a difference in how the law is interpreted. Sadly, it is shown in too many cases to be true. When liberals can read into the Constitution and the Bill of Rights that women have a Constitutional right to abortions then they have created, in effect, their own Constitution which the rest of us have to live with.

When liberals cannot obtain what they want legally, they simply create their own 'lawful' means through the Judicial Branch, ignoring totally the written laws enacted by the Legislative Branch. This is why they are so concerned that too many conservatives might populate the Judicial Branch. They have bastardized our entire form of government to attain their ends which is a communist form of government where everyone is entitled to equal outcomes in life and where no one is allowed to stand out from the crowd and excell in anything.

I dont buy your rationalization of liberal objections. Perefection is in heaven and the liberals look for anything and blow it out of proportion.

Comparing homosexual business to racial is hypocritical. Liberal heteresexual do not send their kids to homosexual camps for diversity training or suggest to their children they ought to experiment with homosexuality and see what is is like. It is like liberals being against vouchers and sending their kids to private schools.

Black and white hetersexuals of similar class and backgrounds provide a hetersexual env for their children. A homosexual couple does not, So it would not be unreasonable in a difficult factual situation to err on the side of hetersexuality. The fact that society does that without written opinions and broadcasting such should be taken into consideration, The fact that we have equal rights for homosexuality does not necessarily follow that it is the ideal situation. OF course, one cant say that. Regardless, it is not the same as the black and white situation.

To apply such a standard would elliminate many judges. Justice Holmes revered wrote the marjority opinion upholding sterilizatoin for low IQ people; today, that is looked upon as wrong.
Justice Douglass voted for Roe in a concurring opinion talking all about owning your own body just like property, but at the same earlier told farmers that it is for the Govt to ORDER them under penalty not to grow wheat on their farms, Justice Black was a former member of the KKK.
The liberals are too much of the gottcha business except when it comes to pandering to real whores like Sharpton and Jackson. Southwich is not in that class. And that is why I dont have respect for their nit picking.

The other case which raises hackles is the one in which an employee, white, in anger, called some one the N word, And was fired and firing overturned by hearing officer and the court southwich was on upheld the hearing officer and rightly so. The employee had an unblemished record and the victim was not bothered.
This is PC to the extreme to bring this up, Cheny tells LEahy FU; an employee gets fired for using the word "niggardly"; jesse jackson blackmails businesses to hire on race basis; al sharpton causes the murder of few people by racial remarks and liberals yawn.
For a person to lose his livlihood on the basis or remark in anger with an otherwise unblemished record borders on 1984 and Stalin and Hitler. So how could anyone have any respect for liberals on this. They are assasins in this case with a much worse blemished record. Could you imagine a rep rushing home to participate in the electrocutoin of 80 IQ prisoner and getting away with it. Clinton did. So, please, dont talk about the morality of Dems in their opposition to southwick.

Is Obama the best the Dems can do? When I heard him suggest we pull out of Iraq in order to re-deploy the soliders for a Pakistan invasion, I about doubled over with laughter. And to think people actually took this person seriously.

And pandering to Iowa farmers just after Congress and the President infused thier farmers with massive ethanol subsidies is a riot. Food prices are now seeing double digit inflation due to these corn subsidies -it has never been better to be a farmer.
Obama should retire to some Left Wing Think Tank and get out of politics.

The case of the abuse use of "the n-word" raised a question I always have. Why does the "n-word" get this special treatment, where other slurs for religious and racial groups can be said in their entirety (Jesse Jackson's faux pas was not reported as him using the "h-word", nor do we say skinheads call jews the "k-word", Hispanics are not insulted with the "s-word", Vietnamese are not called the "g-word", Chinese are not called the "c-word", and so on...)

Sorry, but how hurtful can "the N-Word" be if members of the same racial group will shell out many millions of dollars to rappers who sling "the N-word" with glee.

Why can newscasters not say the word itself in a news story, yet when the human interest/entertainment reporter comes on 10 minutes later in the newscast, he will like interview a rapper who uses the "harmful" "n-word" 50 or 60 times in a 3 minute song?

I just don't get why this single word gets such special treatment, especially when it is then used over and over again in popular entertainment, byb the very same group that says it is too hurtful to ever be said...

Not being a liberal, I find Southwick's performance exemplary.

In short, I disagree with your blanket disapproval of the man. I believe he would make a fine appeal's court judge -- our courts currently run a dearth of right-leaning appointees, and his addition would help thwart the left's agenda for our nation.
