A Movement to Break the Silence of Churches in Political Campaigns

In the summer of 1954, an ambitious senator from Texas running for re-election became afraid that he might not win re-election because several large churches in the state were speaking out against his liberal politics. So what did he do? Powerful Sen. Lyndon Baines Johnson rammed through Congress legislation that stripped these churches of their free-speech rights.

Fifty-four years after this travesty of justice became law; a courageous group of voices is breaking the silence.

Johnson manipulated the process and his fellow Senators who were anxious to leave for summer recess in 1954. No hearings, testimony or comments by any tax-exempt organizations occurred before this prohibition entered the Internal Revenue Tax Code. His amendment to the IRS Code bans intervention in political campaigns by organizations, including churches, which receive federal tax-exempt status. If a pastor speaks too loudly, the entire church can lose their tax-exemption. It worked like a charm for Johnson, and it stopped all criticism of him in Texas churches.

On September 28, a heroic group of pastors challenged the ban by testing their First Amendment rights. They are speaking out in their pulpits on politics.

But the question that begs to be answered is: has this prohibition contributed to moral decay in America? The moral decline of the nation accelerated after the ban was instituted. Abortion, sexual crimes, rape and pornography have all increased dramatically since Johnson's gag order was passed.

"I believe the church has been silent too long, which is why we have so much corruption in the world now," said one of those courageous ministers, Rev. Mike Gonzalez of Columbia, S.C.

The First Amendment of the Constitution provides that "Congress shall make no law respecting an establishment of religion or prohibiting the free exercise thereof." Erik Stanley, legal counsel for Alliance Defense Fund, the organization that sponsored the Pulpit Freedom Sunday, argues, "IRS rules don't trump the Constitution-and the First Amendment trumps the Johnson Amendment."

A cloud of intimidation has been hanging over churches since 1954. "Pastors have a right to speak about biblical values from the pulpit without fear of punishment," Stanley said. "No one should be able to use the government to intimidate pastors into giving up their constitutional rights.Groups like Americans United intentionally trigger IRS investigations that will silence churches through fear, intimidation, and disinformation."

"They use that to keep religion out of morals," says another pastor, Rev. Phil Ellsworth, who points out the church has historically always been involved in politics, using as examples the abolition of slavery, child labor laws and civil rights. "What some people call social issues, I call Bible. It's our job to be involved."

That's why Rev. Gonzalez said to his congregation on Pulpit Freedom Sunday, "I urge you not to vote for Barack Obama or any candidate that stands in the same positions and activities that the Lord condemns."

"The intimidation of churches by leftist groups using the IRS has grown to a point that ADF has no choice but to respond," Stanley said, explaining why ADF felt the need to sponsor the "Pulpit Freedom Sunday" campaign to challenge the Johnson Amendment. "The number of threats being reported to ADF is growing because of the aggressive campaign to unlawfully silence the church. "

This ban on pastors "has always troubled me" said Rev. John W. Yates, a clergyman in the shadows of Washington from nearby Falls Church VA. "I'm skeptical about the government's authority to dictate to the church in this way," he said. "There is a cultural elitism in America that would like to keep religion privately comforting but publicly irrelevant! But if our biblical faith does not inform and shape our thinking on public policy and guide us in whom to vote for, we are simply failing in our responsibility as followers of Christ. We won't always agree with one another, but it is unthinkable that followers of Christ wouldn't evaluate candidates' policies in light of the Word of God."

Prior to the ADF designated Sunday encouraging pastors to defy the ban on political endorsements by churches, Yates said he did not plan to break the law. "But I could envision a time arising when I would feel that I would be disobeying God not to speak .about some political issue or election."

Now we await the government's next move, will they persecute the pastors that had the courage to stand up to this tyranny? America is watching.

Pastors have been finding ways to communicate their political views without breaking the law for a long time. What people need to do is stop listening to the fear mongering preachers who want everybody to follow their particular brand of "Christianity" and vote for leaders who know how to reason and keep the best interest of the United States of America and the World in mind rather than the misinformed ideals sprung from a twisted and warped mythology.

TV Athiests don't have this problem
Bill Maher and his TV Pulpits are vilifying church & religion for years. That is okay because of his lefty game plan though.

Churches in Political Campaigns
Christians must vote! Only 20 -25% of Evangelicals vote, giving up a real privilege and neglecting a Christian duty. If Christians turnout and vote according to Biblical principles, McCain/Palin will win. If Christians sit this election out or vote without Biblical considerations, Obama/Biden will win. Christians wake-up! We are the ones responsible for the moral decline in America - we can't even bother to vote!

Church is belief
I've always wondered what the big deal is having opinions from the pulpit; afterall, they shape every other part of our lives. Why not politically? That affects most parts of our life too.

I applaud the group of churches who are making a stand. I hope the law gets changed.

What These Pastors Are Doing Is EVIL...
Pure, unadulterated evil. That is what these churches are committing by fighting against this very necessary law. The notion that moral decay began with the passage of the Johnson law is pure BS. What it did was free filmmakers, comic book makers and publishers from the shackles of the evil Catholic Church's draconian censorship laws. It stopped pastors from burning comic books in vast bonfires, it stopped the banning of movies that broke the rules about many subjects.

God bless Lyndon B. Johnson for doing the one thing in his political career that was actually worth something (Yes, I'm implying that he was a lousy president.) And shame on these evildoer pastors who would try to take away the freedoms of speech we as a society have worked so hard to fight for. These pieces of human filth are bent on wrecking the job security of thousands of comic book makers, writers and publishers just like they did in the 1950s before the Johnson law could be passed. These pathetic pieces of scum will reap what they sow if they try to destroy the balance between church and state.

Freedom of Speach

I think when a partor speaks as a pastor and NOT as an American Citizen it is like a journalist who speaks partisanly without the distinction.

The job of my church is to hold service and talk to me about God, Jesus and His teachings. That is ALL the churches job is. This is what permits the Catholic church to correct Pelosi and other politicians when they misinterpret doctrine, usurping the Churches role.

You need to be CAREFUL not to imperil my church because you haven't thought deeply enough about this. This still allows you to speak what you believe but as a citizen NOT as a church except in the exception I mentioned above.


Let them eat cake
Well, if you want to preach politics, that's fine; tax exemption, however, is then a privilege that the church will need to relinquish.

You can't have your cake and eat it, too.

If a church wants to preach politics, then it should lose its tax exempt status.

All I can say is that those who are so gung-ho with churches being able to be political without reprise should be careful. Laws you advocate have a tendency to bite you in the behind.

It's WAY PAST TIME
that churches be allowed to utilize their first amendment right. The silent MAJORITY has been silent for far too long and in my opinion our country has been circling the drain because of it. Our founding fathers were ardant supporters of religion and our constitution and bill of rights were inspired by those judeo-christian beliefs. While they're at it, prayers in schools should also be brought back. We've all seen the "progress" we've made in school since that piece of freedom of speech was stripped away. The federal government has consistantly overstepped the constitutional limitations of government at every turn and we have a been directed by that same constitution to correct these mis-steps. The states have been stripped of their constitutional powers at the federal level. This was never intended by the founders of this country. People need to read and teach their children the U.S. constitution and bill of rights. No one will find in the BOR any garuanteed "RIGHT" to success, abortion, home ownership. What you WILL find is the right to LIFE (read ALL life), LIBERTY and the PURSUIT of (not the garaunteed right to..)Happiness. ALso, it is freedom OF, not freedom FROM, religion. NOW GET BACK TO WORK. Millions of illegal immigrants on entitlement programs are depending on YOU!

Our own worst enemies
People have a general misunderstanding about "religion and politics". As tax-exempt organizations, Churches are NOT prohibited from speaking out for or against non-partisan ISSUES. They are prohibited, however, from supporting or opposing individual CANDIDATES and/or political PARTIES. This rule gets simplified in the average person's mind as "no religion in politics" because that's easier to understand than the fine points of the law.

In a sense, church members are their own worst enemies. I've seen and heard them complain when the church teaches about important social issues in a campaign. My thought is, "Why do you belong to this church if you don't believe what it teaches?"

Big picture is the churches do tax exempt work as well as support themselves in their work in helping the less privileged. That work involves feeding the masses physically at Soup Kitchens or Spiritually at the pulpit. That work is tax exempt for a reason so the "Red Herring" doesn't pass the smell test.

Nobody in any church is prevented from speaking out politically in any way they want to. NOBODY!

The only issue at hand is tax exempt status. That's what so funny about these creatures. This isn't about freedom. This isn't about politics. It isn't even about religion. This is about MONEY!

If these folks believe so strongly in their message, why are they not willing to speak it? Because they will lose money, that's why.

Along with the banning of all pork products from the school? And don't forget the head scarfs for the girls (who should be segregated) and the foot-baths.

Of course I realize that you want the schools to promote and teach your version of "god" but no one elses. And in your wee little mind you don't see where that should be a problem.

church and state -- keep 'em separate
It's pure poppycock that churches are being "robbed" of their right to formally endorse candidates or parties. These are tax-exempt organizations. If they want to retain their IRS status, they have to play by IRS rules. Conversely, if they want to endorse and sitribute literature to that effect, they should stand ready to pay taxes like other advocacy groups.

In other words, you can't have it both ways. The ban on mixing the two was a good law in 1954; it remains a good one today.


Not a good question for debate
I guess that question isn't good enough to come up for debate for the would-be Presidents or Vice Presidents. I wonder why that is?

The media, who moderate these debates, want to be the sole source of information in America. they want to be the only, or primary, influencers of opinion, because they are the only ones who have good motives. I don't blame them, it's what all business want: a monopoly.

The Church, and protestant groups, shouldn't go along with this arrangement. It's not an arrangement of their making, it doesn't help them, and it does a dis-service to church members and America.

It's time the Church awakens and leads like it has durng the only real reforms America has had: Civil Rights, Slavery, and Prohibition (this one didn't quite work out).

Church to break silence

It is about time the pastors wake up and speak up or our country will be going down the socialist communist way. We have a media that it's very vias and manipulate everything in their sight. Pastors have the first amendment right and there is no time to remain silence when it comes to election of the most important position in government in the United State of America. Elected leaders are fleecing the taxpayers and getting richer as time go on, while the people keep getting poorer. The example is kind of expensive houses most of this "leaders' live, while citizens are struggling to make end meet. It's outrageous and shameful how they waste taxpayers dollars in pleasing their special interest bureaucrats and campaign donors. Example: wooden arrows a bribe pork earmarks just passed in Congress this week included in $700 billion bailout in order to help pass this bill. I wonder what it stand for and where the money is going to be used!

Church Brake silence
Donie your point is well taken. You are right. These pastors with their congregations are doing what the government can't do to help the needy ones. Beside preaching at the temple, are going where there is the need to help and that cost money, time, plenty of love and effort. So, they are entitled to that exemption, so their call can keep going ahead.
Government had no business intervening in God's work by telling the pastors what they should do or say in the temple. they have the 1st. Amendment Rights that is given by the constitution of the U.S. A. By the way it seems that just the Democrapts are the only ones that can go into the temples and campaign during the election time. Bill Clinton did it, but there is a double standards, when it comes to the Republican candidates. That's the real problem on this issue, too.

Conservatives should work for this
Conservatives should be completely behind this proposal. Since conservatives have the lock on God, they might as well be able to say so from the pulpit. Conservatism is simply the political arm of Biblical Christianity. I know this because many TH religious conservatives have said so.

Tax Exemption
People should understand that many tax exempt organizations are free to be political. Labor unions, chambers of commerce, realtor associations, even the National Football League. All of these are tax exempt and free to endorse or oppose candidates. Did you know that 527 Political Action Committees are also tax exempt? Tax exemption for churches existed long before the IRS. If you tax churches you are just trading the current government intervention into the pulpit for another arm of government control. The Supreme Court has said that the power to tax is the power to destroy. Churches must be free from all government control and influence or we will have lost more than we know.

The Double Standard
I'll leave it to the legal scholars and courts as to whether what these pastors are doing is or is not legal but what upsets ME is that the law against pastors and/or churches endorsing and supporting candidates apparently only applies to white right-wing denominations.

It is VERY common for Democratic candidates to go and "preach" in black churches in Texas near an election. I remember one Sunday when George Bush ran against incumbent governor Ann Richards, there was a news report of Richards visiting and speaking at THREE different black churches in the Houston area on a single Sunday. But I have never heard a single threat by the government about taking away THEIR tax exempt status.

If it is going to be illegal for conservative Republicans it should also be illegal for liberal Democrats but so far - at least here in Texas - that has NOT been the case.

Personally, I do NOT go to church to hear about politics and do not want my pastor telling me how to vote. But I also understand the argument that by NOT allowing him that choice, we are taking away his 1st Amendment rights.

The First Amendment of the Constitution provides that "Congress shall make no law respecting an establishment of religion or prohibiting the free exercise thereof."

Congress broke the law in 1954 and enforces the continuation of it....People evidently could not read then or now....

The world was almost sane in 1954..Just think what Barack HUSSEIN Obama will do to Christians legally in today's gone mad world..

Every god fearing pastor in America should speak out against evil regardless of tax status..

Ironic that churches cannot preach what is good or what is evil but the government particularily democrats do and make their evil criteria the law of the land.. I guess like satan promised these are smart(er) than God...That too will pass away..when America is in shambles...
