The Power of Free Speech in Berkeley

"I guess they've never heard of free speech," Berkeley City Councilwoman Dona Spring told The Chronicle as she defended the council's 6-3 vote to tell Marine recruiters that they are not welcome in Berkeley -- and that if the Marines stay, they will "do so as uninvited and unwelcome intruders."

The council also voted 8-1 to give the anti-war Code Pink organization a designated parking space directly in front of the U.S. Marine Corps' 64 Shattuck Ave. recruiting office and encouraged Code Pink to "impede" Marine recruitment. It's pretty clear that Spring has heard of free speech, but she has no idea what it is.

It's one thing for Berkeley to pronounce U.S. troops, who put their lives on the line every day to defend America, as unwelcome. That's protected speech -- that signals Berkeley residents' disdain for U.S. troops. It's also the sort of rude, we're-better-than-the-rest-of-America action that invites outsiders to wonder if a city that tries to divorce itself from military recruitment deserves the benefits that the federal government bestows.

Apart from that, the Berkeley vote was the antithesis of free speech. When government officials pass a law to impede the political expression of non-believers, as the Berkeley pols did on Jan. 29, they are wielding the club of government to suppress dissent. They are abusing their authority.

Code Pink does not limit its activities to protesting the war. Code Pink also blocks access to the recruiting office -- members have chained themselves to the door -- which constitutes an attempt to infringe on the rights of those who, despite a barrage of anti-war propaganda, nonetheless want to become Marines.

Code Pink is the anti-war equivalent of anti-abortion protesters barring women from access to abortion clinics -- a crime compounded by the City Council's support of this suppression.

Oh, but it's different, supporters argue, because Berkeley is anti-war. All those high-school lectures about free speech existing to protect unpopular viewpoints evaporate when you're on the popular side. What's the point of having power, after all, if you can't use it as a club to silence those with whom you disagree?

I know many Berkeley residents oppose the war and still are embarrassed that Berzerkely once again has gone over the top. Too bad their reasonable voices are lost in the loud, obnoxious, censorious, lefty cacophony.

"We're not condemning the men and women who serve, we are condemning the U.S. policy that is teaching the Marines and other military people to torture, oust other countries' political leaders and do other evil things," Spring also told The Chronicle. It's typical Berkeley doublespeak: Spring isn't against the troops; she's just accusing them of evil.

When I asked Republican presidential candidate Sen. John McCain what he would do, if elected, about the Berkeley vote, McCain said he would use the bully pulpit to criticize Berkeley, but: "I think Berkeley is Berkeley, a unique place in America."

Sen. Jim DeMint, R-S.C., had a tougher take. "If the city can't show respect for the Marines that have fought, bled and died for their freedom, Berkeley should not be receiving special taxpayer funded handouts," DeMint wrote on his blog. De Mint has found some choice earmarks -- $975,000 for the Cal Matsui Center for Politics and Public Service, $243,000 for the Chez Panisse Foundation -- that, while not city projects, made DeMint's list.

Lest you think the DeMint approach is far-fetched, consider Hillary Clinton and Barack Obama's answer to a question posed by NBC's Tim Russert at a debate last month. "There's a federal statute on the books which says that, if a college or university does not provide space for military recruiters or provide a ROTC program for its students, it can lose its federal funding. Will you enforce that statute?" Russert asked. Both Clinton and Obama answered that they would enforce the Solomon Amendment, which first passed in 1994 when Bill Clinton was president.

The idea was: With federal funding comes responsibility. Except the Berkeley City Council feels it owes the American military nothing but disrespect. You see what free speech has become in Berkeley. It's not the free expression of competing ideas. It's free for lefties only -- and for them, speech without consequences.

Marine Recruiters parking space
Perhaps the Marines, under attack, should park a bradley fighting vehicle in the code pink space and wait around for the city tow truck.

Berkley has always been a
cesspool, even in the 70s when I lived in the Bay Area. I don't know if they still do but there used to be a bunch of people living in trashy boats on the water front in Berkley and they would not get rid of them even though they were in violation of numerous health and sanitation codes. The streets also smelled of urine where the hippies (bums) hung out.

We can see that they have not changed. What needs to happen here is not only should all federal money going to Berkley be cut off, but federal marshals should come in and enforce the law at this recruit center. If this was some redneck town in Podunk, Southernstate blocking access to the NAACP offices you can bet the federal marshals would be there in under 5 seconds.

The Bradley is too light...
...as it only weighs about 33 tons(US). An Abrams M1/A1 weighs about 68 tons(US). Let's see them tow THAT.

Actually what I'd like to see would be the pro-military folks use the acceptable forms of vandalizism (Chalk on the sidewalk, red paint images on plastic wrap, etc.) to decorate the street and sidewalk next to where they park and to redecorate the Code Pink-o truck while they are whining outside the recruiting office.

Berkely is too far away for a day trip.

passed through Berkeley a few years back. It hasn’t changed much, filthy, smelly, ugly, dopers who are TOO STUPID and LAZY to move their foot if they were peeing on it.

Isn’t it ironic that it is ALWAYS the Lazy, Gutless, Dopers who wine about FREE SPEECH, but they have NOTHING to say that is worth hearing.

I think we should comply with the request of the leaders of Berkley and pull out the recruiters. Of course we will have to pull all federal money and send a letter to Al Quida and let them know that Berkley requires no I.D and can not ask for proof of citizenship, so it would be a great place to move. They are welcome to apply immediately for public funding with no questions asked, so it won't cost much to live there.
If Berkley runs into any problems with their "visitors", tell them to talk peace and sing kumbaya with them. Berkley will be on their own as the military is not welcomed.

I've never been there, but it has to suck pretty bad for you both to dislike it that much. I see no reason to ever go there-for some reason I have disliked hippies since I was a lad in the 70's. I like to think that it was innate common sense but it probably came from my Dad railing against the war-protesting, pot-smoking, draft-dodging, unemployed losers. (This is the man who told me at age six or seven that I could never return home if I ever shirked my duty--haha)

Following Their Logic
I can't help but wonder how Dona Spring and her ilk would react if other communities adopted Berkley's warped logic towards, for the purpose of discussion, let's say gays. I can only imagine the outrage that would result from those like Ms Spring if a community told gays they were not welcome and that if they stayed, they would "do so as uninvited and unwelcome intruders."

What kind of marines do they actually recruit at Berkley? Wouldn't all of them be in violation of the "Don't ask don't tell" policy?

Free speech will always only be for The Left. They are always right, and The Right is always wrong. Therefore, our thoughts and opinions don't matter, so why should be also be allowed to have free speech?

I agree
with the gist of this article but I did not see Debra's connection between what they did and the "free speech for lefties only" idea. I wish that was better articulated. Is she saying that the protesters somehow inhibited the free speech of the marines? Does the government have a right to free speech? Actually government employees have very limited speech; they can't support a specific religion, teachers cannot say anything they want in schools, and that is good.

I agree that funding should be taken from Berkeley, but I am not sure that there is necessarily a free speech issue here.

Could you see the Berkley Council giving an anti-abortion group this level of access? A dedicated parking place?

"...gays are not welcome to live." How is this demonstrated? Did the respective city/town councils pass resolutions saying gays are unwelcome?

"American Family association sent their hate propaganda to residents warning how gays are going to take over their city." Unconstitutional? No, Free Speech.

Just becuase you disagree with what someone is saying doesn't mean they are violating anyone's rights. The First Amendment is not in place just to protect an expression of popular opinion, but to protect unpopular opinions so they may compete in the marketplace of ideas.

If not the Marines, then why not OBL and his little peace-loving group? They could hold not love-ins but behead-ins. They could even wear pink while getting beheaded.

Even better, I believe the City Council of Berkeley and everybody in that City who agrees with them should pack up their things and go live in caves in Afghanistan. Or Iraq. I'll bet they'd love pink in Afghanistan. Especially would they like it on the women of Berkeley.

For the love of Mike, what's the matter with those people? If the enemy (and they are legion) descend upon Berkeley, whom would they like to call? The pink-bloomers? Or maybe the Marines?

Whatever, I wouldn't set foot in Berkeley if they paid me.

Linda meerly asked a hypothetical question. There was nothing there to indicate relegious zealotry.

Free speech demands the ability to rationally discuss unpleasent, unpopulary and most specifically non-politically correct issues. Your desire to shut down such speech by wrongly and falsely deigrating someone, clearly puts you in the camp of those who would censor free speech (Stalin, Mao, Hitler, Casto, Pol Pot to name a few).

You stated "there are several places in USA, filled with religious bigots like you...". I would suggest there are several places in the USA filled with "free-speech" bigots like you where decent Americans (i.e. USMC) would not be welcome.

However, please continue to enjoy your life. After all, it's the US Military which protects your right to be ungrateful.

When Christian cponservatives discuss about gays there is no room for rationality, the only thinkg they're concerned about is thta gays get discriminated against in all levels in society.

Are you saying that city of Berkeley has no right to protest against discriminatory practices? After all it's their right to protest, isn't it? Or does "free speech" mean only freedom to bash gays but demands to silence those who don't approve such discrimination?

US miliatry is free to recruit heterosexuals from prisons in the area, after all every heterosexual criminal has more moral value than any gay person and automatically necomes a better soldier.

Immediate action
The following action should be taken IMMEDIATELY:

1) Cease ALL federal funding to Berkely.

2) Cut off use of all federal, state, city services (ie Police, Fire Department, ambulances, trash removal, free needles, etc.)

3) Notify Berkely, Oakland, and San Francisco that the National Guard will no longer respond in case of emergency.

Can anyone think of anything else?

Berkeley and free speech:
I lived in Berkeley during the late 70's. It was then as it is now, a haven for intolerant, hypocritical and chronically hate filled ingrates.

I remember living in fear: Fear of walking across campus at night because indoctrinated student feminists might blow their "rape whistle" on me, simply because I am a white male. Fear of being shouted down (or physically assaulted) by an angry mob because my political philosophy was not in line with
left-wing ideology. Fear of having my house or car spray painted with scornful lies, all because I have a different opinion.

Free Speech? "The People" of Berkeley do not want free speech! How could a population that adheres to the tenets of communism want anything that is free. Freedom is not an option for these people. No country is as free as our own. We HAVE freedom, and for the past four decades the citizens of Berkeley have made it very clear that they want no part of it.

Actually, the previous posts regarding the streets reeking of urine in Berkeley is accurate.
What an aspiration in life; to have the freedom to take a leak in the street without consequences.

I do not agree with what you say but defend with your life my right to say it. OK, it is a little twisted from the original, but the point is this, The People's Democratic Republic of Berkley want their freedom of speech but not yours. The People's Democratic Republic of Berkley want you to die for their freedom of speech as long as you stay out of sight and are not allowed to speak your mind.

Berkley does not give a damned about the men and women of the military. They never have and they never will.

Thank you for proving DR's point. What is really so offensive about your way of thinking is your rush to judgment and make accusations when you really don't have anything to substantiate them. I'm sorry to say that anyone who knows me would not classify me as a religious conservative, let alone a zealot or bigot. However, I will add that individuals such as you represent, namely those who aggressively play the victim card under any circumstance, have been the topic of any number of discussions I've had with friends who happen to be gay. I've even got them to admit that individuals such as yourself do the "gay cause" a lot of damage by turning off those of us who would probably be sympathetic. I've never had time for those who choose to whine rather than prove themselves worthy of others' respect and support.
