The border patrol inquisition

Be a Border Patrol agent, do your job, go to prison. That's how the job must look to agents Ignacio Ramos and Jose Alonso Compean.

In February 2005, the agents tried to stop a van driven by drug smuggler Osvaldo Aldrete-Davila near the Mexico border. After a scuffle with Compean, Aldrete-Davila fled on foot. Ramos says he believes that he saw a gun -- which the smuggler denies. Both agents fired at Aldrete-Davila, who fell, then continued his escape across the border. After he got away, Ramos and Compean filed a report on the 743 pounds of marijuana they found in the van, but not on the gunfire. As it turns out, Ramos had shot Aldrete-Davila in the butt. A Homeland Security agent heard about the episode, went to Mexico and offered Aldrete-Davila immunity, if he testified against Ramos and Compean.

U.S. Attorney Johnny Sutton, a Bush appointee, prosecuted the agents. In March, a jury found them guilty of assault with a dangerous weapon, discharge of a firearm during a violent crime, obstructing justice, lying about the incident and willfully violating Aldrete-Davila's Fourth Amendment right to be free from illegal seizure.

Because there was gunfire, the mandatory-minimum prison sentence the agents will serve is 10 years. The U.S. Probation Office in El Paso, Texas, has recommended 20 years -- 20 years away from their wives and their children, and among the type of people they've put behind bars.

As for Aldrete-Davila, he faces no charges for the 743 pounds of pot. That leaves him free to carry out his plan to sue the Border Patrol -- that is, U.S. taxpayers -- for $5 million because his civil rights were violated. What a country.

Ramos, who was nominated Border Patrol Agent of the year in 2005, told the San Bernardino County Sun, "There's murderers and child rapists that are looking at less time than me."

At the heart of the prosecution is a vehicle-pursuit policy that makes absolutely no sense. As Assistant U.S. Attorney Debra Kanof explained to the Sun, "It is a violation of Border Patrol regulations to go after someone who is fleeing." It's like a no-arrest policy.

No surprise, Border Patrol agents routinely ignore the regs. As Ramos responded to Kanof: "How are we supposed to follow the Border Patrol strategy of apprehending terrorists or drug smugglers if we are not supposed to pursue fleeing people? Everybody who's breaking the law flees from us. What are we supposed to do? Do they want us to catch them or not?"

Maybe the answer is: not. T.J. Bonner, president of the agents' union, the National Border Patrol Council, believes this prosecution will discourage agents from doing their jobs. Worse, the agents go to jail, while the smuggler got immunity -- and an incentive ($5 million) to claim he was unarmed, which can't be verified, because he fled.

Last week, Sen. Dianne Feinstein, D-Calif., called for a Senate Judiciary Committee hearing on the case, as she fears this prosecution may represent "a serious miscarriage of justice." It does.

Sutton's office cannot comment on the case until sentencing, but referred me to a statement, that explains, "They were prosecuted because they had fired their weapons at a man who had attempted to surrender, but, while his open hands were held in the air, Agent Compean attempted to hit the man with the butt of his shotgun." Later, the agents picked up shell casings and failed to file a gunfire report.

Sutton's best point: A jury found the two agents guilty of all charges except attempted murder. As Bonner sees it, the most punishment the agents deserve is a five-day suspension for not reporting the shooting. Say, for argument's sake, that the agents were wrong to shoot at Aldrete-Davila. They were wrong to not file a report. Discipline them. Fire them, even. But don't send them to prison for decades for a bad split-second decision and failure to file a report.

If they were crooks, they would serve shorter time. Last month, a Border Patrol agent, who admitted to smuggling 100 illegal immigrants while he served on the Border Patrol, got five years. (Prosecutors had recommended three years, but in San Diego, U.S. District Judge John Houston hiked the sentence, telling the man: "You violated the sacred trust of your comrades. As a link in the chain, they depended on you.")

Compean's attorney, Maria Ramirez, told me that her client, a first-generation American, served honorably in the U.S. Navy, then worked for the Border Patrol. He had a home, now sold, a wife and two children. Another child is on the way. But in the 15 minutes after the agents saw that van, after one split-second judgment call, his life melted away: "In 15 minutes it's gone, just gone."

This was and is a sham.2 Agents doing their duty to uphold the laws of the United States.They get 20 Years and the Drug Pusher may get 5 Million.Has this President of this country completely lost his mind? To completely cause any Police Officer in this country to ignore the crime, to me, is a crime.

Just like the man who tried to stop illegals from crossing his yard - he lost the house he was trying to defend. Lost it to the same ILLEGAL ALIENS he illegally detained. What a crock!

it's gonna get worse
I support President Bush on many of his policies-but not this one! Having been raised in El Paso, Texas, I saw first hand what kind of trash does come across the border. Last October, I watched my mother die thanks to the tb she contracted from those illegals (she was a counselor in the El Paso schools and required to work with illegal immigrant families-illegals do not go through health screenings!). This NAU thing-has our government completely lost touch with reality????? NO real American will stand for this! If the NAU thing does go through, there could be a new revolution. Can you imagine Canada telling Americans they are not ALLOWED to own a gun? Or Mexico demanding more of our tax dollars without contributing to the system? Oh, wait! That last q is already happening. Which brings me to another point:

SINCE WHEN DOES OUR CONSTITUTION, THE CONSTITUION OF THE UNITED STATES OF AMERICA (that IS the full title of that document-not the constitution of north america or any other country), APPLY TO NON-AMERICANS AND AFFORDS CRIMINALS FROM OTHER COUNTRIES MORE PROTECTIONS THAN AMERICANS? This case with the BP agents is a great example of this disastrous policy. Our most supreme law of the land is being twisted out of context, abused and misused by people it does NOT apply to, and we are letting that happen?????

Lydia, you hit the nail on the head. Usurpatious leaders making decisions for us without the consent of the governed...THIS is where we are falling apart. Maybe our leaders should read the Declaration of Independence more carefully!

But let's be fair here: Bush is not the only person in government to abandon his people in this issue. Congress, mostly the Senate and mostly Dems, are giddy with drunken power. Yes, I know some Republicans are just as guilty. My own Senator, Senator Graham R-SC, has consistently voted in favor of illegals. Let me tell you people what this Senator wrote to me personally after I sent a long letter detailing the horror my mother went through thanks to illegals:

The legislation I support would be a (this next part is too disturbing!) PLEA BARGAIN with those who broke our laws.

PLEA BARGAIN? WITH WHOM? ON WHOSE TERMS? Not OURS! WE are being BRIBED, ladies and gentlemen.

ENOUGH IS ENOUGH! If the government does not see the writing on the wall, they may inadvertantly spark a very bloody revolution.

Put a Spotlight on This
Tell everyone you know about this case. Let's shine a light on this. Push the issue at every opportunity. This is just plain wrong. It is indefensible and we should force the people behind this to account for this. How on earth can we enforce the border with rules like this? How can we recruit BP agents with treatment like this?

Alert the Media! BTW, where is the mainstream media on this? Why do we find this out only from talk radio and conservative websites? Is injustice no longer newsworthy? Push for coverage. These honorable men need our help and deserve all we can do for them.

Has Had Enough!
America, this is a sad state of affairs. When did this country get so OUT OF CONTROL that dug dealers, human smugglers and trespassers are rewarded? That illegal aliens, in the act of committing a felonies against this country and its persons, get special treatment under the guise of political correctness and the protection of the US Constitution. When did US Rights extend to illegal aliens?

But I understand, in the era of liberal, over political correctness and not wanting hurt anyone's feelings because they may not like us, we have lost sight of the real problematic situation. Patriotic Americans are getting hurt and we are in serious security danger.

As a Minuteman, I am very concerned about our porous borders, all of them. Any other nation in a time of homeland attack, enemy threats and war, secures and protects its boarders with armed machine guns, walls, barbed fencing, lighting, night vision, motion detectors and savage command dogs. Why, 5 years after 9-11 do we still have an uncontrolled boarder issue?

Why is the American government so hell bent on NOT protecting its people? They know what needs to be done...JUST DO IT! JUST DO IT! No more excuses or attitudes of "well, they may not like us if we do that or act in a way that would secure our citizenry. It could send the wrong message to the world that we are unfriendly and unwelcoming."

All I can say to that is hogwash! Our American history disproves that kind of comment and thinking. Any person with half a brain will know that we are protecting ourselves, just as we do in our own homes protecting our families. The door is not open and welcoming to everyone who comes knocking.

The general populous of America is being duped by our elected government officials from the top to the city and local levels. It is about time the average, concerned, patriotic American who is angry, discouraged and frustrated get together and say in one unified voice..."WE'RE NOT GOING TO TAKE IT ANY MORE. WHEN WE HAVE HAD ENOUGH WE SAY WHEN and WHEN IS NOW!

BORDER PATROL TRAVESTY
This case is an absolute travesty of justice. We have a dope smuggler fleeing from the law and the cops get busted? Something is wrong here.
So, George, listen up and take some notes, I'm going to pull your fat out of the fire here.
1. George, not only do you pardon the heroic Border Patrol Agents but you give them commendations, pay increases, medals, etc. and of course, pay their legal bills and any back wages that might be due them. Hopefully, they won't sue you for false arrest.
2. Now George, lets deal with the dope smuggler, Aldrete Davila. For smuggling 743 lbs of pot, I think a nice long vacation(a minimum of 40 years) in beautiful, scenic Marion, Ill. would be appropriate. Unless of course, all the pot was for his own personal use, then a couple of months in Club Fed would do. One more thing, no more $5 mil either.
3. George, that leaves you with some housekeeping to do. Since this is Texas, Johnny Sutton, the US Attorney is probably a friend of yours. But, he has a fatal flaw, an affinity for dope smugglers over cops doing their jobs. So, George, you need to fire Mr. Sutton. Assistant US Attorney Debra Kanof needs to be fired, too. If you need to give reasons, gross incompetence for both is reason enough.
4. George, now you need to deal with the stupid regulation that Ms. Kanof says they violated. That is the non-pursuit clause. Eliminate it. After all, police every day pursue such dangerous felons as those who fail to use their turn signals for a lane change and those who fail to use their seatbelts. Also, George, you need to find out who came up with such an asinine rule. If they are still employed by the Federal Government in any capacity, they need to go too.
So, George, there you go. I've pulled your fat out of the fire. Now go out and do it.

Rise Up
It is going to be up to the people of this country to change this environment. We are so engorssed in "indivitual" rights that the rights of the average citizen is tromped on by any andividual who gets to the right whinning judge. Where was the Jury in this case. The Judge must have instruted them in such a way that they could not find these men innocent. The case deserves one of those Presidential Pardon's, President Bush. You would make up for a lot of very poor imigration decisions if you would stand up and back the Border Patrol and these two men.

This is mad...
I guess that we shouldn't be surprised. After all, it's only taken just on five years for air marshalls to be allowed to fly on plains in regular clothing rather than suits and grooming that make them stick out like sore thumbs.

The part that confuses me...
...is where in that Homeland Security agent's job description was it written that he should be crossing into Mexico and offering immunity to drug smugglers?

Civil Rights?
At what point does someone caught in the act of illegally entering (while smuggling drugs)the US have constitutional protections & priveledges? I must be missing something. Must be too many lawyers, can we deport some of them?

I believe you misunderstood the cite, there. That Judge was citing a DIFFERENT individual who was caught smuggling illegals across the border when he was a Border Patrol Agent. The author's purpose was to demonstrate that REAL criminals (this smuggler) get LESS time than these two Agents doing their job.

As far as the "comrades", bit. The Judge was right on. Border Patrol Agents, like soldiers and sailors, are, indeed, comrades. As a Border Patrol Agent, the smuggler used his position and knowledge of laws and Border Patrol procedures to violate the very laws he and his comrades were tasked AND trusted to enforce. By doing so, he violated the trust of his comrades (i.e.: compatriots, fellow agents, etcetera).

I think that it is time to tell the President and the Congress that we are fed up with their stupid actions concerning the Mexican Illegals. If they wont do their jobs according to Law, then we will get rid of them and put in People that will. I am not talking about replaceing the Republican with Democrates, which are all just as crooked togather. All they think of is power, that we are stupid peasents and should let the high and mighty congress do all our thinking for us. If that dose't work then we should all revolt and DUMP THE TEA INTO BOSTON HARBOR AGAIN.I am dammed tired of hearing that the Mexicans have every right in this country, and they are needed. Our CONSTITUTION does not apply to the illegal people that come into this country. In doing that action they are commiting a FELONY and that stops them from getting protection in this country. They are invadeing us, just like and army in a war, should we give them full protection under the law? No normally what we would do is shoot them.

This is absolutely disgraceful
Where was this trial held at? These guys should be given commendations. The only other travesty that could possibly happen is if this dope dealer can actually win his civil suit. I have no doubt the ACLU and the racists at the Southern Poverty Law Center will do everything they can to insure he does.

Foreigners go home...
Sad as this is it has been going on for some time now. Nine times out of ten foreigners in the U.S. appear to have more rights than those who were born and raised here. I know. I'm handicapped and I can't get any help from any one anywhere - government, private, or otherwise. But, if I were a Hispanic, I could get tons of help. Because so many are so terrified of stepping on anyone's toes, there will always be more help for foreigners (or any ethnic group, for that matter).

I am tired of all the foreigners parading through my country taking things away from those who were born here. I'm tired of our government allowing these people into our country. I'm tired of buying a product and leafing through an instruction book the size of a Stephen King novel just to find my language.

What happened to these men, while injust, will continue. Nowadays the bad guys have more rights than the good guys.

It's cases like these that make me think that the "bleeding-heart" pc mentality has done its most harm.

Years of inculcation of "who are you to judge me?," "who are you to judge me?" mars judgement of criminal behavior. Then when "adults" they are asked to serve on a jury and cast "judgement" on a "peer."

What Was The Jury Thinking?
A couple of things come to mind here. It's possible the jury was not allowed to hear the evidence of the existence of the 743 pounds of pot.
It's also possible that the jury was all Latinos.
Other than that, I can't imagine what a bunch of morons the jurors were.
Then again, juries acquited OJ and Michael Jackson.

Two Questions
Two questions that EVERY Federal and State Leaders needs to be asked!

Question no 1: How much do YOU earn as a Senator from this great State that you serve per year? Please all income from your position as an Elected Official?

Question no 2: Do you know of ONE Elected Official in Washington DC, or any Elected Official in any United States of American State, either now in Office or that is running for ANT Office, Federal or State that REALLY cares what the majority of the people they represent desire?

Injustice!!
This injustice is just one of the many reasons we everyday citizens are boiling mad and wanting to take some action to remedy the everday insanity going on in this country.

When will our legislators open their eyes to the fact that we want our borders protected and want the drug smugglers and terrorists dealt with. How can this happen? This CROOK trying to blackmail the U. S. for $5 million. We have to stop the hi-jacking of America. WHERE do we start?

RE: point #1 After pardoning the two officers, require a signed affidavit waiving their future ability to sue in return for the awards and huge bonus $$. Furthermore, make clear that failure to properly report ammunition expenditure will result in reasignment to duties like logistical support.
RE: point #3 The housecleaning should also discover who the hopeless, clueless Homeland Security employee tracked down the perp and offered immunity to him in return for his testimony. This moron should not only be fired, but his/her future should include an annual IRS audit.
Finally, the full and proper pursuit of justice would find action taken to strip the judge who presided over this travesty of all authority to hear cases regarding the Boarder Patrol, illegals, law enforcement, and any thing else requiring analytic thought. Folks, this case should have been thrown out by the judge with a reprimand to prosecutors and a recomendation of MINOR administrative discipline of the two officers for failure to fully report the incident and disclose the discharge of their weapons. Case Closed...

Unbelievable
I find this article disturbing. Two men bring down a drug dealer by shooting him in the butt and they lose their jobs and go to prison for doing their job. Where is the justice in this? No wonder some of us are so pissed over what is going on in this country. It is disgusting.
