Sotomayor, Reverse Empathy and the Rule of Law

True to form, President Barack Obama -- in his remarks introducing his Supreme Court nominee, Judge Sonia Sotomayor -- said he was doing one thing while doing the exact opposite. He articulated his criteria for the optimal nominee yet chose someone who falls squarely outside those criteria -- as best we can tell.

But what's all the fuss? A foolish consistency is the hobgoblin of little conservative minds. Obama's mesmerized audiences are not supposed to pay attention to the meaning and context of his words, only to their aesthetic appeal and to the tonal qualities and modulation in his voice.

Obama said a Supreme Court nominee's two most important qualities are her rigorous intellect and mastery of the law and her recognition of the limits of the judicial role -- that a judge's job is to interpret law, not to make it.

Then came the "but," the exception that imperceptibly swallowed the rule. He quoted former Justice Oliver Wendell Holmes as saying, "The life of the law has not been logic; it has been experience." In other words: "Forget what I just said about how judges should interpret, not make, the law. I want my judges to have empathy. And don't tell anyone, but when I say 'empathy,' that's code for bending the law to achieve the results I want based on the selective empathy I have for certain victimized groups."

Before you fall for the upcoming protests that Sotomayor truly is a practitioner of judicial restraint, you might want to examine her record, including the case of Ricci v. DeStefano.

Frank Ricci is a dyslexic Connecticut firefighter who quit a second job in order to study up to 13 hours a day and paid someone to read his textbooks onto tape in preparation for the New Haven Fire Department's exam for promotion to lieutenant or captain. Though he received the sixth-highest score out of 77 applicants vying for eight vacancies, the city decided to deny him (and all other applicants) his earned promotion because no black applicants passed, even though the exam had been carefully constructed to ensure race neutrality.

Ricci was among 18 candidates -- 17 whites and one Hispanic -- who sued the city of New Haven for racial discrimination. The district judge issued summary judgment against the plaintiffs. On appeal to the 2nd U.S. Circuit Court of Appeals, Judge Sotomayor was one of three judges on the panel who issued a per curiam opinion (adopting the full reasoning of the district court without elaboration) affirming the district court's ruling.

The plaintiffs failed to achieve an en banc (entire court) rehearing of the appeal, but not without a strongly critical dissenting opinion from one of Sotomayor's fellow Clinton appointees on the court, Judge Jose Cabranes.

Cabranes noted that it was highly unusual for the panel to have issued a per curiam opinion, because the questions raised on appeal were "indisputably complex and far from well-settled." He wrote, "The core issue presented by this case -- the scope of a municipal employer's authority to disregard examination results based solely on the race of the successful applicants -- is not addressed by any precedent of the Supreme Court or our Circuit. … What is not arguable … is … that this Court has failed to grapple with the questions of exceptional importance raised in this appeal."

Sotomayor and her like-minded colleagues not only highhandedly denied justice to the aggrieved firefighters in this case but also tried to bury their injustice in their summary affirmation of the district court's ruling, something that obviously troubled Judge Cabranes. This is judicial activism at its most egregious and least transparent, when judges disregard the law to achieve the result they prefer and attempt to conceal their actions.

Again, this is what Barack Obama obviously has in mind when he discusses "empathy." In Ricci v. DeStefano, Sotomayor's empathy was for those who weren't aggrieved -- call it "reverse empathy" -- and she just didn't have any left for the poor saps who worked their tails off to earn their promotions -- just as Obama doesn't have any left for mortgage debtors who honor their obligations.

While defenders of Sotomayor will argue that she didn't engage in judicial reverse discrimination in this case, the facts yell otherwise. But if you're still in doubt that she would base her rulings on her personal feelings, be aware that in a speech at Berkeley in 2002, she said it's perfectly acceptable for judges to consider their "experiences as women and people of color" in making their decisions.

Also readily available (on YouTube) is videotape of her saying -- before remembering her comments were being taped and then feigning to backtrack -- that "the Court of Appeals is where policy is made."

Senate Republicans must take a stand and vocally oppose this nomination, not on the basis of partisan politics, but in defense of the rule of law and the proper role of the judiciary, principles the president is only pretending to honor.

Barack Obama's Nonsense

There are two major perspectives that humans hold when it comes to 'Change'.

1) The transformation of self, from darkness of the human soul to light.

2) The transformation of the world, to match the darkness of the human soul.

Many humans hold the view that their morals and emotional nature should be accepted by other humans and their self-esteem, morals, values and personal identity is based on that acceptance.

Many humans believe that they must measure their morals and emotional nature against certain sociatal standards that have proven in history, to bring about their self-esteem, morals, values and personal identity to an acceptable level.

Diversity is nothing more than a 'Code Word' that implies - there is NO standards - there is NO moral codes - there is NO right and wrong - the world must accept everyone as they are.

The notion that a particular race or gender will bring about a 'Correct Perspective' on the way the world should be, is nothing more than the doctrine of "Innate Ideas".

That morals and emotional nature exist from birth, by belonging to a particular race or gender is the determining factor in an individuals morals amd emotional nature - this thinking has been thoroughly refuted by philosophy and science.

The notion that the personal experience of an individual brings 'Empathy' to those who have had similar experiences in life, trumps the Constitution and Bill of Rights which has brought about the greatest Society in humankind - is pure and utter nonsense.

The whole case against this appointee can be summarized in those three words. Any liberal on this thread who can defend her decision in that case is either incredibly brave or incredibly foolish. It shows just how far outside the mainstream she is and how perverse her understanding of civil rights is.

I must confess personal bias against affirmative action. For eleven years, I had the highest (or briefly second highest) score in my home state on the supervisor's exam. I had the best education, excellent job evaluations, and the recommendations of my supervisors. Every time I applied for a supervisory position, I lost it to a minority. Often, the winner had barely passing scores, less education, and mediocre job recommendations. Finally, I went to a different occupation where promotion was purely on merit and thrived. When you deprive a person of a well deserved promotion solely on the basis of race, you have robbed that person just as if you had put a gun in his face and taken his money and car. The clowns that defend this practice are their pimps and are well paid for it.

The United States Supreme Court is the highest court in the Federal System. When our Founding Fathers created the three branch system, it intentionally placed the Judiciary outside of the election process. Thus, an appointment to the Supreme Court is one for life or until a Justice decides to retire and no sitting Justice ever has to answer to voters.

Why did our Founding Fathers set the Judiciary Branch outside of the election process? They wanted to maintain continuity in the rule of law and respect for our legal process. The tradeoff was that they Supreme Court was to judge a case pursuant to the US Constitution, not act in a political sense, be without bias and to leave one's empathy or sympathy out of the judicial process.

Justitia, Lady Justice:

Is cloaked in a robe, which representing the law.

Is blindfolded so that the court can have blind impartiality.

Is depicted with set weighing scales, which are typically suspended from her left hand, upon which she measures the strengths of a case's support and opposition

Is also often seen carrying a double-edged sword in her right hand, symbolizing the power of Reason and Justice, which may be wielded either for or against any party.

A male or female Justice should be able to arrive at the exact same decision.

The Judiciary Committee in the United States Senate must perform its responsibilities and not try to expedite the confirmation process. It is imperative that the Senators be fully briefed with a nominee's case records, decisions, writings, and the full text of all speeches. This is the responsibility of every member, not just the minority party.

It is a seat for life and the Justice never has to answer to "We the People," but the United State Senate must serve all of us well and fully vet a nominee.


Do your duty and demand that your Senators do theirs.

Sotomayor blew off an appeal by white firemen (and 1 Hispanic) when a written competency test which NO blacks passed (among a number who took the test) was summarily thrown out... the left is not satisfied with just equal opportunity-- it must have equality of results, irrespective of measured standards, even those that THEY engendered, like the fireman's test.

Sotomayor - Unfit for the law
Here is a thought that should scare even the heartiest knee-jerk liberal. This obama nominee could not even get herself seated on a JURY with her attitude toward law. She could not withstand a normal jury duty questionaire nor could she stand up under examination by counsel. Even a liberal should want to disqualify her from a case in which liberal were pitted against liberal. Neither would know which way her EMPATHY would lean. If there is a picture next to the word, UNFIT, in the dictionary, it should be hers.

I would hope that a wise Pennsylvania Dutch man with the richness of rural experience would reach a better conclusion than Latina urbanites who haven't experienced that life.
Where are all the Pennsylvania Dutch Supreme Court judges anyway? When is the last time that Obama said one word about the special needs of his Amish and Mennonite constituents? We're WAY underrepresented in all areas of American life, and were mad as heck. Well, actually we're mildly concerned as heck, but for us that's pretty extreme.

This appointment is actually a non-issue. Sonia will not change the balance of the court as she replaces another solid leftist, activist vote. Why should we have expected anything different? After all the ideology expressed in the late campaign is coming home to roost.
She will however, be foresworn from the moment she takes her oath of office as is the current President. She not only showed empathy for the black men, but then she acted on those emotions or feelings. In Ricci, Sotomayor was applying the applicable precedent for her jurisdiction--that's why the decision was unanimous. If she had overturned precedent, that would be judicial activism. It's the conservatives that want us to tear up about the sob story of the poor dyslexic fireman, and are urging that the court engage in activism to overturn several decades of disparate impact discrimination jurisprudence.
If anything, Ricci demonstrates that Sotomayor is neither empathic nor activist--she's like some kind of machine mechanically applying existing precedent despite the sympathetic facts of the plaintiff.

is confirmed prior to the Ricci case being argued before the Supreme Court she should recuse herself from any consideration of the case. It would be improper for her to sit for a case in which she previously ruled, and there is plenty of precedent for justices recusing themselves from cases. But, being an "empathetic" (I would say "pathetic") liberal she will insist on hearing the case, even though she has already shown she cannot be objective.

This is the responsibility of every member, not just the minority party.

It is a seat for life and the Justice never has to answer to "We the People," but the United State Senate must serve all of us well and fully vet a nominee.

We are supposed to pay for college tuition and benefits for those 50% of taxpayers that only pay 2.3% in federal taxes.

China has indicated that is does not want to loan us any more money, which will result in debt monetization like the failed Weimar Government and Mugabe's Zimbabwe (a depression with hyperinflation).

Obama could seize all income over $75k and never be able to pay for his spending.

I have already said that she will likely get between 70-75 Senators on the floor, but she has to get 1 Republican vote from the Judiciary Committee before the Committee's recommendation to get there. I have watched interviews given by various members of the Judiciary Committee minority and they are very troubled to say, the least.

Without the money, the officers never would have hit the streets. They were to be laid off before their first day of patrol, victims of city budget cuts, until the stimulus money saved the class.

But the White House said the $1.2 million grant only guaranteed their jobs until the end of the year. And facing a growing deficit and a fight to pass an income tax hike, Columbus Police on Tuesday announced massive budget cuts that could mean hundreds of layoffs.

Among those who could lose their jobs if voters reject the increase: the 25 new officers who shook the president's hand.

As for the article,that is why Gov.Sanford of S.C. refused to take stimulus money unless they allowed him to pay it on their debt. He knew when the money ran out,the taxpayers would be left to foot the bill and would have no money to do it.

So. there is no room for EMPATHY in the supreme court. Also, using one's position to attempt to create legislation isn't smart, either.
