Beware Abhorrent Hate Crime Legislation

Homosexual activists aren't easily deterred. Unable to persuade even the people of California to change the definition of marriage to legitimize their lifestyle, they're resorting to a backdoor approach to accomplish the same thing: pushing federal hate crime legislation while few are paying attention.

Well, people better wake up, because the House Judiciary Committee has already approved Barney Frank's bill, H.R. 1913, the Local Law Enforcement Hate Crimes Prevention Act. The full House is expected to vote on the bill April 29, and various liberal groups, from gay activists to liberal religious organizations, are engaged in a full-court press to get this bill passed.

The bill would make it a federal crime to willfully cause bodily injury to someone (or to attempt to do so with firearms or explosives) because of his or her actual or perceived race, color, religion, national origin, gender, sexual orientation, gender identity or disability.

If states want to pass their own hate crime legislation, they are free to exercise such poor judgment. But they don't need the long arm of the federal government cramming it down their throats.

Not only is there little constitutional justification for the federal government to legislate in this area but also the bill further impinges on state sovereignty by subjecting people to criminal liability for acts for which they've already been acquitted under state criminal systems.

As others have noted, the bill also violates the constitutional guarantee of equal protection by codifying the notion that certain groups of citizens, such as homosexuals, are entitled to greater legal protection than others, such as, say, older ladies.

The bill attempts to justify itself and its broad sweeping federal jurisdiction by reciting dubious "findings," such as, "The movement of members of targeted groups is impeded, and members of such groups are forced to move across State lines to escape the incidence or risk of such violence," and, "Perpetrators cross State lines to commit such violence."

Let me ask you sincerely: Do you really believe these assertions? Have you ever heard of such phenomena? Color me oblivious, but I don't and I haven't.

Color me, also, alarmist, but I think the main purpose of this bill is to demonize and criminalize thought, especially the politically incorrect belief that homosexual behavior is either abnormal or sinful. It is to make an emphatic societal statement that this belief constitutes "hate" and possibly to lay the groundwork for outlawing speech expressing this belief, including from the pulpit.

I hardly think I'm being hysterical here. The practice of criminalizing peaceful expression of this belief has already occurred in other nations -- including Sweden, Canada and Great Britain -- and even in our own Philadelphia.

New York City authorities ordered the removal of billboards -- citing an anti-harassment ordinance -- that displayed various biblical versions of Leviticus 18:22, such as the New International Version's rendering, "Do not lie with a man as one lies with a woman; that is detestable." Staten Island Borough President Guy Molinari reportedly publicly condemned the language in the displayed verse as "mean-spirited" and "hate speech."

Irrespective of your opinion on homosexual behavior, it is a distortion of the English language to say that it is hateful to believe it is somehow abnormal or even sinful. One can disapprove of behavior without hating those engaging in it; indeed, the Bible exhorts Christians to love, not hate. One can oppose hate crime legislation or same-sex marriage without being a homophobe -- another distortion of the language to paint the opposition as irrationally and immorally fearful of homosexuals.

If you want to witness a clinic in "hate," watch the YouTube video of homosexual celebrity blogger Perez Hilton excoriating Miss California, Carrie Prejean, for courageously offering her opinion under loaded questioning that marriage should be between a man and a woman, a belief shared by a clear majority of people in her state. This man proudly called Prejean vile names and might have single-handedly caused her to lose the Miss USA title. Now that's an example of direct harm inflicted on one because of her beliefs. It is often not opinionated heterosexuals doing the hating, harassing, thought-control intimidation, and speech chilling these days, but militant homosexual activists.

Lovers of free speech and free exercise of religion should awaken to the relentless effort of radical homosexual activists to validate their lifestyle by demonizing, criminalizing and silencing those who disagree with them.

Far too many people, including certain well-meaning Christians laboring under the belief that Christians must eschew politics, are failing to stand up to this intimidation. This failure could eventually lead to the unintended consequence of their loss of the very freedom to evangelize.

From passing such as a law.
it is null and void upon the very day it is signed as law.

It is not a law in America and cannot become law.

Not to say a criminal gang running Congress cannot defy the law and try and force this abomination on this nation.

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech,.........

The Law has told the US Congress to shut up about speech and religious freedom, for or against.

All hate crime legislation
is patenly evil and unconstitutional because it makes opinion illegal. It is already against the law to cause someone bodily harm except in the case of self defense, so why is it more of a crime to do it because the victim is a homosexual and the perp is not?

Homosexuals should read a biology book. They might find out that their behavior is unnatural. Penalizing people for what they think is absurd. All adults are free to do whatever they want (with mutual consent) in their bedrooms.

I oppose hate crimes legislation for anyone. Why is it worse for a white person to kill a black than vice versa? Why is it worse for a Christian to kill a Muslim than vice versa? Under the 14th amendment, we have equal protection in Section 1. Putting someone in prison for 20 years for killing a certain protected class whereas he/she might get 10 years for the unfavored class is blatantly unconstitutional.

Nature discriminates
Even in the eyes of nature homosexual relationships are not equal to heterosexual relationships. Is there anyone out there reading this that is the natural born CHILD of a homosexual relationship? I rest my case! Humanity would become extinct with only homosexual activity; survival of the human race is dependant on heterosexual activity. Is there anyone out there that cares to dispute that fact? Therefore, just as nature discriminates against homosexual activity, I see a very logical reason for mankind to discriminate in how it recognizes homosexual activity versus heterosexual activity. Marriage is the long standing recognition that heterosexual activity is superior to homosexual activity, and it should remain that way. Redefining marriage will not eliminate nature's law. Creating a Hate law does not change nature's law. Is that not science?

Yes, NO ONE would know if the crime was a hate crime unless words were spoken. What you say is true. At any point in the accused's life he or she may have stated that homosexual behavior in wrong. I have heard of Pastors being arrested because someone in their church committed a hate crime sometime after a Pastor's teaching on homosexuality. I could see this becoming a litmus test for judges. Homosexuals are trying to silence God's Word.

The problem
The problem with this bill, other than the utter foolishness of believing a crime is somehow more violent if it is a "hate" crime, is that it puts the federal government in the middle of local jurisdiction.

Hmmm, isn't that a common theme from DC...?

It is also an end run around the prohibition against double jeopardy. If the feds don't like the local verdict, they'll try the case again in federal court under the hate crimes bill.

As far as I know, in almost every part of the country, except maybe Chicago and DC, it is already illegal to attack and murder people, whether you hate them or not.

This bill is not about outlawing any action. It's about nationalizing criminal prosecutions.

'Hate Crimes' to a Liberal Subjective

Hate-crime - same as ‘normal’ crime as far as victims are concerned - but much more distressing for Liberals.

The usual 'Feelings' by Liberals, is absolutely NO 'Empathy' for the victims but great 'Sympathy' for the criminal.

When someone kills a Policeman, Liberals have 'Great Sympathy' the killer and little or 'NO Empathy' for the policeman.

When someone is a member of a 'Liberal Collective', e.g. Homosexual, the 'Liberals Feelings' reverse and they have 'Great Sympathy' for the victim and 'NO Empathy' for the criminal.

As I see it
Religious people and institutions who belief that homosexuality is morally wrong have a choice, and are going to have to accept the consequences of that choice.

With respect to the last four areas left to ensure gay equality: marriage, the military, anti-discrimination law, and hate crimes, you may:

1. Vigorously and stridently oppose gay equality on religious grounds that homosexuality is a perversion and homosexuals are less human than you are; or

2. Get out of the way, taking a stance on homosexuality similar to the Catholic church's stance on marriage, recognizing that if you are Catholic, you abide by it, but that the law provides for those who aren't Catholic and have different beliefs.

Alternative one is now being pursued by most of the religious right. It is inflammatory, a losing proposition, and the cost of taking this position and losing is that you will be placed by those who disagree with you in the same category as racists and sexists. People see you and your religion as intolerant and yes, hateful.

Alternative two is the wise course. A majority of Americans don't agree with the Catholic church's stance on marriage. But they view it as a theological difference, not as a threat to their own beliefs, or even as a moral judgment on their own second marriage. In the years since no-fault divorce has become the norm, the church's ability to speak out against it and maintain its own principles have not been comprmised. No one is burning down cathedrals or beating up Catholics or even suing them for mental distress.

I have seen a lot of whining over the past few years from the religious right because they don't like being called bigots. Unfortunately for you, while you no longer call the police to have gay kids arrested for coming onto your playground, you have been trying your darndest to keep them off the merry-go-round and jungle gym and swings. It just doesn't seem fair and it doesn't seem nice.

Definition of Hate Speech

Any opinion that is 'Contrary' to Liberal feelings and objectives, is 'Hate Speech'.

Any opinion by a Liberal, is 'Free Speech'.

IOW, Conservative opinion is 'Hate Speech', Liberal opinion is 'Free Speech'.

Burning, spitting at and walking on the American flag. the symbol of the United States, is “free speech” to be praised, but placing a Koran, the symbol of Islam, in a disreputable place is “hate speech” that must be criminalized.

Liberals feel that Painting Jesus in urine and Mary in feces = free speech; Cartoon where Muhammad is shown as being followed by extremists = hate speech.

Liberal, feel that anyone opposed to Government Funding of 'Anti-Christian Art' is a 'Religious Nut', but when the Government mandates no Christian Symbols at Christmas - that is righteous and a duty of the Government.

If a person says to another person "I hate you", that is NOT considered 'Hate Speech'.

If a person says to another person "I hate you because You are White", that is NOT considered 'Hate Speech'.

If a person says to another person "I hate you because You are Black", that IS considered 'Hate Speech'.

If a person says to another person "I hate you because You are Heterosexual", that is NOT considered 'Hate Speech'.

If a person says to another person "I hate you because You are Homosexual", that IS considered 'Hate Speech'.

Would you Liberals explain these 'Liberal Feelings' to the rest of us?

I think you meant speech didn't you, not thought. Nevertheless, if your problem is with the criminalization of religious speech, then that is where you might focus your concern, rather than demonize people who are trying to protect themselves and their children from harrassment and physical danger.

My Opinion on Homosexuality

My opinion on Homosexuality is that Homosexuality is dangerous to the health and well being of the individual.

Common sexual practices among Homosexual men lead to numerous STDs and physical injuries, some of which are virtually unknown in the heterosexual population.

Lesbians are also at higher risk for STDs.

In addition to diseases that may be transmitted during lesbian sex, a study at an Australian STD clinic found that lesbians were three to four times more likely than heterosexual women to have sex with men who were high-risk for HIV.

It is well established that there are high rates of psychiatric illnesses, including depression, drug abuse, and suicide attempts, among Homosexuals and lesbians.

This is true even in the Netherlands, where gay, lesbian and bisexual (GLB) relationships are far more socially acceptable than in the U.S.

Depression and drug abuse are strongly associated with risky sexual practices that lead to serious medical problems.

The only epidemiological study to date on the life span of gay men concluded that gay and bisexual men lose up to 20 years of life expectancy.

A Homosexual tax would help defray the costs the rest of us have to pay because of their 'Chosen Lifestyle'.

This money should be escrowed to help poor families buy health insurance and life insurance which has skyrocketed because of the poor decisions made by those 'Choosing a Homosexual' lifestyle.

I named the specific bill and explained how it was unconstitutional (Free speech and free exercise of religion) how it is double jeopardy and violated equal protections laws (a white person killing a black person or straight killing a gay person was not treated equally as same race or same sexual orientation killing). I also explained it was not necessary since assult, murder, attempted murder all have adequate penalties. This bill is purely an attempt to silence free speech and free thought, both un-American. I will not vote for anyone who supports this bill.

The problem with your argument is that HR1913 - if you would bother to actually read the thing - has absolutely NOTHING to do with speech. It applies only to violent crime and, indeed, reaffirms 1st Amendment rights in the text.

I am of the belief that hate crimes legislation is rediculous because, as pointed out by others posting here, it seeks to cause harsher penalties based on a persons beliefs. However, can someone out there please help me to understand how this is different from a court attempting to discern intent? Whether or not intent can be determined can drastically change the degree of the crime and sentence imposed.

To Donovan, it is my understanding the some countries (Australi?) have gone after ministers when they preach homosexuality is a sin. Some have considered that to be hate speech.

I think the reason we are afraid that hate speech legislation protecting homosexuals will be made a crime and used to fine or jail people who speak against homosexuality is that other countries that have such legislation have used it in exactly that way. It is all well and good to say that we are protected against such use, but with an activist base hostile to Christianity and Orthodox Judaism and a sympathetic court, it is hard to make any guarantees that this would remain so. And it is no good saying that if someone brought suit against you for doing this, they still have to win in court. If someone sued me for this I would convert my holdings to cash and skip town. I can't afford to defend the suit.

Our worries aren't based on paranoia. They're based on lack of faith in a judicial system that has been far too creative in finding ways to enforce acts of Congress.

I have mixed feelings about hate crime legislation. I certainly don't object to people who want no hate crime legislation whatsoever. I object to this: people who object to hate crime legislation only now that it's being extended to gays, but never complained about its inclusion of religion as a protected class. It makes it hard for me to take seriously the people here who claim to oppose it on principle.

The closest thing I've gotten to a reply on that so far is talent scout calling me a liar without bothering to specify a lie I've told.

These are valid questions. There are also some assumptions about hate crimes that need to be corrected. The intent of the law is to have a "backup" means to carry out justice in case the local trial is somehow tainted, unfair, or justice gets miscarried.

The usual allegorical example is the rural town where gay person is killed, yet, because the murderer is so well known, is described by little old ladies as a "good boy who could never do these things", and where the local population is somewhat sympathetic to the accused, justice gets tainted. Capital murder is dropped in favor of lesser charges, or worse, somehow the defendant gets acquitted (twinkie defense).

This happened time and time again in the civil rights era in the South. Justice is supposed to be blind, yet, it rarely is. To punish those who walk free or get reduced sentences, the hate crimes bill is needed. Opponents of the hate crimes bill claim that the system works perfectly as is. Wake up and look around...it doesn't when the guilty go free.

I'm going to say something obvious.

17,000 cases of HIV in Washington DC.

Does that mean Washington DC has a large homosexual population?

Does this mean there is a huge homosexual lobbying group in Washington DC that insists on normalizing sexual deviant behavior?

Another thing if the government schools teach my child that sexually deviant behavior is moral and good for her and my child tries the behavior and becomes ill will my child have the right to take a case to court over it?
