Another Day, Another Scary Nomination

As usual, President Barack Obama is multi-tasking the dismantling of the American system on so many fronts that not all of the outrages can be properly monitored. So while you should be mortified by his dictatorial power grab with General Motors, please don't miss his recent nomination of former Yale Law School Dean Harold Koh as legal adviser for the State Department.

In his new position, Koh not only would represent the United States before international bodies, such as the U.N. and the International Court of Justice, but also would influence the degree to which laws of other countries should influence American jurisprudence.

After reading an alarming piece by Meghan Clyne in the New York Post concerning the Koh nomination and the degree to which Koh believes it's appropriate for courts to consider other nations' laws in interpreting our Constitution, I read a number of Koh's legal writings and speeches.

Clyne reported that New York lawyer Steven Stein said that Koh, in addressing the Yale Club of Greenwich in 2007, claimed that "in an appropriate case, he didn't see any reason why sharia law would not be applied to govern a case in the United States."

It turns out that on March 21, 2007, Carol Iannone, on Phi Beta Cons blog, published a letter from Stein to Dean Koh about his Yale Club remarks. Stein wrote, in part, "In your discussion of 'global law' I recall at least one favorable reference to 'Sharia', among other foreign laws that could, in an appropriate instance (according to you) govern a controversy in a federal or state court in the US."

Whether or not Koh ever responded to Stein's letter, Stein's representations of Koh's remarks are certainly consistent with Koh's writings that I reviewed.

In Fordham Law Review, Koh asserted that the U.S. "Supreme Court is divided between two judicial camps: the transnationalists and the nationalists." Koh considers himself a transnationalist and justices Roberts, Scalia and Alito nationalists.

Koh explained the differences between these two judicial philosophies. According to Koh, transnationalist judges look to U.S. interdependence, whereas nationalists tend to look to U.S. autonomy. Transnationalists think about how U.S. law fits into a framework of transnational law, while nationalists see a rigid foreign and domestic divide. Transnationalists think that courts can "domesticate" international law (make it part of our law), whereas nationalists think that only the political branches can. Transnationalists favor the development of a global legal system, while nationalists prefer a national legal system.

In other words, nationalists don't believe that it's appropriate to look to foreign law in interpreting our Constitution. They believe that only the political branches, not the courts, can adopt provisions of international law, and they don't believe in slavish deference to global legal authorities, such as the International Criminal Court.

Transnationalists clearly believe in an ever-changing, living Constitution and reject originalism (interpreting the Constitution according to its original understanding). They are obviously globalists, not overly concerned with American's national sovereignty. They see the international community, in the words of Koh, as a "community of reason" and believe that American judges, in interpreting our Constitution, can resort to this "community of reason" (foreign laws) to choose between two "plausible" legal positions. Indeed, Koh wrote approvingly of United States Supreme Court decisions acknowledging "evolving standards of decency" and that we may look to this global community of reason to determine what those standards are.

If any of this is too legalistic, let me quote from Koh's "Jefferson Memorial Lecture on Transnational Legal Process After September 11," published in the Berkeley Journal of International Law.

In his introductory remarks, Koh said the United States, along with North Korea and Iran, form "the axis of disobedience," that is, those nations "whose disobedience with international law has attracted global attention after Sept. 11." Are you beginning to see the picture here?

If not, try his testimony before the Senate Judiciary Committee on Sept. 16, 2008, in which he lamented that the Bush administration forfeited the "universal sympathy" America enjoyed as a victim of the 9/11 attacks with a "series of unnecessary, self-inflicted wounds, which have gravely diminished our global standing and damaged our reputation for respecting the rule of law," including Abu Ghraib, Guantanamo, torture, indefinite detention of enemy combatants, military commissions, warrantless wiretaps, evasion of the Geneva Conventions and international human rights treaties, excessive government secrecy, attacks on the United Nations, and others.

It's no surprise to me that President Obama seeks to install as assistant State Department legal counsel a man who, like George Soros and a host of ultra-left-wing bloggers, believes America is always the bad guy and that we should rehabilitate ourselves through following the wisdom of foreign nations and international bodies.

Proof or speculation?
The point being raised isn't whether or not there's definitive proof that Koh is a transnationalist who believes US courts should consider adopting foreign court rulings and laws in their own decisions. It's a settled fact Koh believes in such an approach. The question is whether or not there are grounds to inquire into how far his views go when he comes up for his appointment hearings and whether or not they disqualify him. If you disagree then you're saying a president has an absolute right to appoint whomever he wants without the advice and consent of the Senate and that his appointments should be acted upon without delay. Neither viewpoint can be sustained by the Constitution.

However, I doubt one Democrat or liberal among you felt that way with regard to Pres. Bush's appointments and as a conservative I would have supported you in that regard. Unfortunately many liberal Democrat Senators openly applied ideological litmus tests to Bush's nominations and also resorted to refusing to even give nominees an up or down vote leaving many vacancies unfilled for years so that a hoped for Democrat president could fill them, particularly lifetime Federal judgeships. So don't be hypocritical now unless you're willing to admit you believe THE ONE is sacrosanct and above reproach.

You in fact didn't. Every source I can find stems from this one article by Meghan Clyne where she quotes half a sentence as told to her by someone else. That's the definition of hearsay.

Can we not agree that unless there's a complete sentence (preferably within a complete paragraph) from Koh regarding his opinion of Sharia law, there is nothing we can say about his opinion of Sharia law?

I think that's a sober and un-hysterical thing we can agree on: that a person should be judged by the actual merits of their words and deeds and not un-cited accusations. Right or wrong?

Why Are These Guys Living Here?

The REAL intellectual, academic, lawyerly reason why courts should be able to consider foreign law is because logic is logic, and reason is reason. Reason like we humans have is a reflection of a divine attribute that transcends cultural boundaries.

When a court faces a question that has no controlling precedent (i.e., no higher court has *ever* ruled on the issue) and is not answerable by the Constitution or the acts of Congress, why on Earth would you limit your legal research to American authorities, when the best of American authority has never decided the issue. It might be a good idea in such situations to occasionally consult the best lawyers of another country, i.e. the judges of their highest court, if their logic greatly clarifies the issues.

Basically, when a U.S. court consults foreign law, it is doing so to steal their best ideas. Our judges have *absolute* immunity in such situations; they should flaunt it by ripping off all the foreign laws they can.

I'd just like to discuss what he said, that's all. And I can't find it anywhere! It's not true that no source would be good enough for me - anything with a complete thought in quotes would work.

I've watched his videos on google; I've read his articles and interviews. I don't find anything about Sharia law. I don't doubt that he mentioned Sharia at the one talk he gave, but to take one salacious sentence out of context is ridiculous.

Here's an example: "Medieval Europe had enormous problems and by our modern standards is unacceptable. For it's time, however, the feudal system did a relatively good job of maintaining social cohesion." Out of context, it seems that I just said we ought to return to the feudal system. In context, of course it is the opposite.

I just can't believe how completely dishonest you can be to accept the hearsay of a mid-20's gossip columnist who wrote about what she heard someone else say Harold Koh said.

You ought to be ashamed of your lack of integrity if you allow this to pass!

We have a genuine fraud happening with the election and circumstance surrounding this man Barry Soetoro.

According to Mr. Limbaugh you will have to read what Mr. Koh has written for yourself.

Obama's New State Dept. Advisor.
Koh believes laws of places like Zimbabwe and Sri Lanka should carry equal weight with the laws of Virginia and South Dakota, and that it's "appropriate for the Supreme Court to construe our Constitution in the light of foreign and international law" in its decisions.

He also believes foreign law trumps U.S. law on issues such as the death penalty. Echoing Ginsburg, he has said: "The evidence strongly suggests that we do not currently pay decent respect to the opinions of humankind in our administration of the death penalty. For that reason (italics added), the death penalty should, in time, be declared in violation of the Eighth Amendment."

In Lawrence v. Texas, which struck down that state's anti-sodomy laws, Justice Anthony Kennedy's majority opinion cited a 1967 British parliamentary vote repealing laws against homosexual acts and a 1981 European Court of Human Rights decision that such laws were in violation of the European Convention on Human Rights.

...does anyone know where we can read/view Koh's comments regarding Sharia law IN CONTEXT?

A smear job in a gossip rag does not count as context. A single sentence in quotes does not count as context.

The NY Post piece is a series of accusations about what the man believes, without a single citation or reference! Oh, and could Meghan Clyne the author of the hit piece have an axe to grind?

"Clyne was in the Class of 2003 at Yale University, and wrote for the Yale Daily News [4]. In her closing "Senior Perspective" column for the student paper, she wrote "I wrote my first column because I was enraged by the lack of patriotism displayed at Yale in the wake of Sept. 11."

It's impossible for intellectually honest people to attack or defend a man for a single sentence, especially like this. He defends Sharia as a valid legal system. Does he mean in a court in Macon, Georgia? Or does he mean in Riyadh?

9/11 had nothing to do with Muslims living here in the US. In fact Muslims have helped our police stop many attacks before and after. The Bin Laden types are thugs and screwed in the head. One guy who studies these criminals, and a favorite at T.H., says that all the 9/11 attackers had bad relationships with their dads. He is well worth reading!

Hawkins is not the sharpest blade in the drawer. He still thinks--it seems--that there are American troops on Taiwan. I sent him an email to ask where were these American troops. I have been on a number of Taiwanese military bases and I never saw any. He didn't respond, perhaps he was "researching" that question.

The last US troops left Taiwan in 1979 and most had left by 1973. The US also pulled its ships from the Taiwan Strait in 1979 where they had been positioned since June 1950. All of this it seems was news to Mr. Hawkins.

Where Roe v Wade became bad law is when they declared a right to privacy that is not found in the Constitution. Some, not most, States have that provision, but nationaly, it doesn't exist.

States regulated abortion with no problems from the time it became a viable option with modern surgical procedures until 1973 when the court stupidly got involved. SOme states abortion was on demand (Oregon) and in others a total ban (Mississippi). If Roe was overturned, this is where the US would be again. If Mississippi votes to ban it again and you disagree, you can (with others of a similar mind) vote out those who voted to ban it. If most of your fellow Mississippians decide they like abortion being illegal, you can move to Oregon.

Do you understand Islamic law at all? They are INTOLERANT of other religions. Common Law will not work in the middle east - ever. It goes against their religion which is their law.

This is why we've seen beheading right here in the US. Muslims have no respect for laws outside their own.

Therefor transnational law is as incompatible, it would be a very violent mistake.

We must enforce our peaceful constitutional law in the US, and not allow international law to conflict.
