Race-Baiting Dem Candidates Twist Court Decision

Based on their consistent behavior in recent years, and specifically again in their presidential debate last Thursday, it is fair to ask whether there is any race-sensitive situation Democrats will not exploit for political purposes.

The Supreme Court's decision last week involving the public schools' use of race to achieve diversity was just too tempting to pass up. The respective candidates' reactions spawned a grotesque competition among them to see which was the best demagogue.

These candidates surely understand that the Court's ruling in Parents Involved in Community Schools v. Seattle School District No. 1 et al, did not -- let me repeat -- did not overrule the Court's landmark 1954 ruling in Brown v. Board of Education.

In Brown, the Court held that forced segregation of the races in public schools violated the equal protection clause of the Fourteenth Amendment. In the Parents case, the Supreme Court did not reverse itself on the issue of segregation, which was not even at issue.

The Parents case involved two separate school districts, in Seattle, Wash., and Jefferson County, Ky., both of which voluntarily adopted student assignment plans that allocated children to different public schools based solely on their race. The Supreme Court held that such plans violated the Fourteenth Amendment's equal protection guarantee.

Unfortunately, current Supreme Court precedent permits governmental discrimination on the basis of race in exceptional circumstances. But is only in those cases where the government can demonstrate a compelling interest and that the discrimination -- as in the use of racial classifications -- is "narrowly tailored" to achieve that compelling state interest.

Thus, the Court has permitted the use of racial classifications to remedy past discrimination, since the government is deemed to have a compelling interest in "remedying the effects of past discrimination." This is one rationale for race-based preferences in college admissions, for example.

But there was no past discrimination to remedy in either the Seattle or Kentucky school districts. The Court found that "the Seattle schools were never segregated by law nor subject to court-ordered desegregation, and the desegregation to which the Jefferson County (Kentucky) schools were previously subject has been dissolved."

The Court's ruling should please all interested in moving toward a color-blind society. As Justice Thomas noted in his concurring opinion, the school districts' approach disfavors "a color-blind interpretation of the Constitution," and "would give school boards a free hand to make decisions on the basis of race -- an approach reminiscent of that advocated by the segregationists in Brown v. Board of Education."

Of course, this politically incorrect reference to Brown v. Board of Education, rendered by a member of one of the most politically incorrect groups of people: black conservatives, incensed liberals and their water carriers at the highest reaches of the Democratic Party. So did Chief Justice Roberts' pronouncement, in his majority opinion, "The way to stop discrimination on the basis of race is to stop discriminating on the basis of race." Continued...

As soon as the ASIAN race is added into any debate about minorities needing programes or special help or anything else that takes race into play.. Then the left just goes away..

The ASIAN race in this country is doing better than any other including Whitey...
Why is it that a corner market store in any major city surrounded by blacks (with generations there longer) is 9 times out of 10 owned by a KOREAN, PAKISTANI, INDIAN, etc and most likely charging the locals higher prices for products???(covers the cost of doing business in high risk "riot" areas)
I lived in LONDON for a time and they all repeated a joke there that got a point across.

Why did the ROMANS build thier roads so strait in ENGLAND? So the PAKI's could'nt build a corner market on it... Who repeated this joke Black, Asian, Whites, Paki's you name it.
Why is it funny (or not funny if you think it's racist)? because for everyone in the real world they can relate, even if you think it's racist you also can relate.

For everybody out there living in the real world,,why is not the same "supposed discrimination" of the black people also holding back these other minorities?

Why don't these minorities also require leaders to represent and protect thier races such as Al and Jessie? Surely someone is giving them a hand as they are doing so well.

You want to know the biggest threat to the NAACP and other racist pushers,,,
The success of other MINORITIES in EDUCATION, $, fortune 500 CEO's, housing,,,,
Successful groups that get ahead in this country "DESTROY" the left and all the other race hustlers out there.

The US justices that no longer look to race as meaning anything are correct. All those that continue to ignore the overwhelming evidence of successful minorities in this market driven economy,, are shown for what they are RACISTS.

Again for all those that cling to race based specials,,,(B'rob) Please give us your theories on the success of some minorities and not others.

Why is not the NAACP not sueing the NFL, NBA, Track and Field or any other sports association that has an overwhelming majority of black athletes for OVERREPRESENTATION...? Why is the fact that black athletes in sports is just the MARKET WORKING

I beg to disagree. One of the reasons the respondant lost is that they did not in fact could not argue that the use of race was being used to address racism. In fact they went out of their way duing to argue that the reason for the programs was the "educational benefits of diversity." Had they been able toargue as you suggest that they were addressing a problem of discrimination the court would have found that a narrow use of race was appropriate.

As for all black schools...well the seattle school system has an all black acadamy so they are not all that opposed to segregated schools. Neither am I. Or let me put it more accurately: I do not oppose schools that are not integrated providing there is nothing preventing students from attending the school of their choice. You see I do not believe that black students need to sit next to white in order to be successful.
As for the educational benefits of diversity...You fail to demostrate one example of black students doing better in math or white students having higher reading scores by sharing desks. Your passion is appreciated, but passion does not make you correct.
