Unauthorized diplomacy -- Where's the outrage?

I suppose certain puffed-up congressmen are feeling their oats since the election, but that’s no excuse for their unauthorized trips overseas to meet with leaders of foreign nations. This destructive practice must be stopped.

Democratic Sen. Bill Nelson traveled to Syria and met with its president, Bashar Assad, without the authority and contrary to the wishes of the Bush administration, including the State Department.

The well-known policy of the Bush administration is that the United States has limited diplomatic ties with the Syrian government because of its support for terrorist organizations Hezbollah and Hamas, its support of terrorism and ethnic strife in Iraq, and its policy toward Lebanon.

The Constitution firmly places the conduct of U.S. foreign policy in the hands of the executive branch because the Framers understood the pitfalls of conducting foreign policy by committee.

Legislators, no matter how personally popular or professionally respected, and irrespective of the wisdom or foolishness of the policies they are seeking to promote, have no business -- as a matter of Constitutional law, historical practice and common sense -- meeting with foreign leaders without executive permission. (Some would even argue that Nelson’s unilateral junket violates the Logan Act -- which carries criminal penalties -- but there’s insufficient space to address that here.)

It doesn’t matter that the Iraq Study Group recommended that we begin negotiating with the terrorist-sponsoring states of Syria and Iran in contravention of the Bush Doctrine. It doesn’t matter that most Democrats probably support the idea -- even though they just won back both legislative houses. The president is still in office, and this is still his call.

The Democrats have been bellyaching for years about President Bush’s allegedly nefarious efforts “to consolidate power in the executive branch.” This has always been a bogus charge, but it is especially specious coming from Democrats, who are wholly comfortable with routine usurpations of legislative authority by activist federal judges and completely unbothered by Sen. Nelson’s trip.

Just think about it for a minute. A nation can’t effectively conduct foreign policy when it speaks with more than one voice any more than a private business can optimally negotiate a transaction when two of its principals are sending mixed signals to the other side. You must speak with one voice, or you will allow the other side to divide and conquer you. Some may object that Sen. Nelson had every right to go because he is a member of the Senate Armed Services and Foreign Relations committees. To the contrary, such credentials enhance his apparent authority and make his actions more damaging.

Others may defend Nelson’s trip, saying he was not holding himself out as having any actual authority but simply wanted to open up a dialogue between our two nations. But that doesn’t excuse Nelson’s actions. He has no right even to open up a dialogue when it is the official policy of the United States not to initiate such a dialogue.

Of course Nelson was purporting to speak for the U.S. -- at least for Bush’s political opponents. This wasn’t a social trip. He was clearly trying to influence Assad’s policy -- he asked him to do more to stabilize Iraq. If nothing else, Nelson definitely sent a signal to Assad that powerful people in the U.S. disagree with the nation’s official policy and will do everything they can to change it.

And, of course, Assad is going to tell the hapless senator that he’ll cooperate because it makes President Bush look bad -- at least to those who believe we should negotiate with terrorists.

This strengthens Assad’s hand and encourages him to play up the idea that Bush is stubbornly refusing to deal with him. Alternatively, it gives Assad tacit permission to continue to misbehave, with the hope that his actions will go unpunished as long as Democrats accede to the executive branch in 2008.

Sen. Kerry recently took a similar trip to Egypt. Other senators, including Republican Sen. Arlen Specter, are planning such trips in the future. We know about Sen. Kennedy’s dishonorable missions in the past.

But surely reasonable people, even those who disagree with Bush’s posture toward Syria, will understand that their preferred policy end does not justify the means of violating the Constitution and turning our foreign policy into a jumbled mess.

We are talking about vitally important foreign policy during time of war. Where is the outrage? We shouldn’t dismiss these trips so lightly, and the Bush administration must condemn them in stronger terms.

Where is President Bush's backbone?
If President Bush hopes to ever regain more support among the American people, he needs to get a backbone and do everything in his power to stop this kind of political posturing in conravention of the Constitution of the US. He also needs to do more to stop all the leaks from his staff and any other place that he can control. It would also be helpful if he made his case much more strongly to the "members" of his own party who are opposing him at every turn. The voters got rid of some of those RINOs, but some of them weren't up for election this year. IMHO, most Republicans want the President to take a stronger stand against the RINOs and especially against the Dumocrats who as I wrote are dumb, dumb and dumber still.

How many times has jesse jackson and his ilk done essentially the same thing? jimmy carter, movie stars, etc. all do it. And they all do it to make the (republican) administration look bad and the leader of whatever country, Syria in this case, shakes his head in wonderment at the stupidity of these Americans and counting his blessings has his picture taken with the idiot of the month.

In 1970 John Kerry, after having been released from active duty, went to Paris on his honeymoon and while there (during the Paris peace talks) met privately with representatives of the VC. Though he was off active duty he was STILL a member of the armed forces and as such he was STILL subject to the UCMJ and as such he could have (SHOULD) have been arrested and prosecuted for giving aid and comfort to the enemy.

Quite frankly LBJ set the stage for this, and Richard M. Nixon seconded him, by their both not having, then Lt Kerry, introduced at close range to the working end of a gallows as the direct consequence of his hobnobbing with Madame Binh and the other representatives of an enemy this nation was at war with.
It's quite probable that the only people with the guts to fight a war like the Second World War are dying off daily with the passing of each individual WWII veteran. Every other living American with the physical capacity to fight today is too imbued with political correctness to seriously consider such a task were it to become necessary.
Even the French, whom most conservatives hold in contempt, had the nerve to deal effectively with some of the despicables in their midst.
A young SS colonel in the German Army, Joachim Peiper, led an SS Panzer unit during the Battle of the Bulge. Peiper had spent most of his time previously fighting on the Eastern Front against the Russian Armies. During the course of the German Army's charge toward the American fuel dumps located deep in the American rear areas, Peiper's unit came across a column of rear echelon troops, stenographers, typists, cooks, file clerks, and mechanics. Rather than spend the time to process these men as prisoners of war, Peiper surrounded these men with the tanks, and had the tank's machine guns open fire on them. Some eighty seven American soldiers who had peacefully surrendered were killed.
After the war, Peiper was identified as the commander who had ordered their executions, was tried and convicted of war crimes, and sentenced to death for this crime.
As time wore on, the army became concerned about some of the methods use in obtaining the confessions of the men involved, and Peiper was retried, convicted, and sentenced to death again. His death sentence was later commuted and Peiper was eventually released from prison as the politics of the Cold War began to heat up.
Peiper settled down after his release in a secluded area of France during the sixties. One night the local fire and police were called to extinguish a blaze occurring at Peiper's home. The fire was extinguished and Peiper's remains were found in the ruins, still clutching his rifle. The local gendarmes, cognizant of just who the victim was, closed the case quickly, acknowledging only that justice was served.
Meanwhile over here, the good people of Massachussetts, in contrast, managed to elect John Kerry to the Senate.

Outrage isn't the word I would use. Treason is more applicable. Unfortunately, unaccountable is the best word to describe this situation. Kerry, Nelson and others don't have to answer to anybody for undermining America's foreign policy.

Who's going to prosecute them? Who's going to impeach them? Who's going to vote them out of office? Who's going to talk badly about them in public?

These men are unaccountable and free to undermine U.S. interests every day. What would restrain them from going overseas to do the same?

Certainly not their responsibility to Americans the Constitution. They've proven neither of those things matter. Certainly not their self-control. They've already proven they'll do anything in the name of political expediency.

Anybody who is outraged hasn't watched both parties ignore the Constitution and the welfare of the American people for generations. We elect self-serving autocrats to office, then complain when they act like self-serving autocrats.

Supporting either party supports the two party system. Stop the insanity and stop voting for the two parties.

Syria has never attacked us? Um, actually, they have. Do some checking on an obscure little group called Hezbollah. Granted, this will take some digging in arcane tomes, as Hezbollah has never been noticed by anyone in the media in say, the last 30 years, but still, the information is out there.

I guess "Japan" didn't attack us in December of '41, either. Just some rogue elements of an all-Japanese military unit - kind of like the Manchukuo Army in China.

You have a point but you omitted "intentionally," misspelled "Clinton" and accidentally referred to our current president who has not been legally accused or convicted of anything at all.

censure or other consequences
When an ex president or civilian goes to a hostile nation purporting to speak for the President or the US, they can simply be discredited as unauthorized. They should face condemnation, but as they are a part of a free nation, unless they cross a line into sedition, they are allowed to be however foolish they choose to be. But when a member of the congress usurps the authority of the President and meets with a foreign leader in his own authority, this is unacceptable. I believe at the very minimum, any senator or congressman who does this without the permission of the administration should be censured. Foreign policy can only be run by the president and his administration. I would stand by that statement even if the president was one I completely disagreed with.

Censure of that yahoo Nelson is an excellent idea but that would never happen with homer and lulu in charge of the congress now, and it probably wouldn't have occured when the Republicans were there either. They just don't have the cojones.

Why
are these people allowed to get away with traveling to countries that are enemies of this country? From Kerry and Kennedy during the Vietnam era, and ever since, Democrats have been conducting their own foreign policy, and collaborating with the enemy.


What do they know that makes them confident that there will be no sanctions suffered from their treasonous behavior. Bush is still President. He has nothing to lose that I can see by taking action against these people. He has already done his best to cripple the Republican Party with his amnesty garbage.


It is his constitutional duty to defend the United States of America and its citizens. These Democrats endanger America by defying traditional prohibitions, and possibly/probably breaking the law by their actions.


Apparently the State Dept. is upset by these unauthorized visits to hostile countries. Since State has always seemed at odds with this administration,and others before this one, perhaps they could collaborate with Bush to punish these guys. What a welcome change that would be. Instead of undermining Bush they could join him just long enough to step on these Democrat varmints.


George W. Bush has every right to smack these creeps down. Will he do it? I doubt it. Democrat politicians AND George Bush seem to be actively working to damage this country. Why? Beats me, but it is really scary.

That the President of the United States has inherent authority to restrict the travel of any U.S. national to any foreign polity for the purpose of conducting diplomacy, and the right to revoke passports and travel permissions of such persons if they nevertheless refuse to comply. He has the right and the duty to protect his authority from all who would usurp it, no matter what their title.

You are incorrect - read the Logan Act. Private citizens may not conduct diplomacy on behalf of the United States - it's a crime. In the Republic's timescale, it's a primordial crime.

have been undermining the administration since day one. They hide behind that "don't dare to question my patriotism" garbage and since no one ever really called them on it, they feel now that they are the majority, it's fine to actually visit with the enemy.

One problem with the new tone
is that the President will continue to get walked on and disrespected. Unfortunately this habit of "taking it" has made him look like a wimp.

There should have been major investigations into how the NYT received classified documents, not how the name of a CIA desk officer got out.

This new tone has been totally unilateral with the othe side taking advantage of it. It's like kids on the playground. When the bullies find out who won't fight back it become a feeding frenzy.

The trouble with the Senate is that every Senator thinks HE should be President.

Nelson is simply filling the vacuum
Nelson and co. are hardly usurping Bush II's foreign diplomacy initiatives vis-a-vis Syria. That because, simply put, he doesn't have any. Which is of course ridiculous, because foreign diplomacy is one his administration's (via the State Department) primary jobs.

You intellectually slavish people are so quick to accuse any Dem of treason that you overlook the fact that Bush II has defaulted on one of his primary duties as President - foreign diplomacy. We should be thankful that people like Nelson are taking the initiative to fill yet another area where Bush II and his administration have been derelict in their duty.

It's good for us strategically also in that it shows the world (much like the large anti-war protests we've had on occasion since our invasion of Iraq) that the U.S. isn't a bunch of fanatical warmongering zealots controlled by special interests. In this I think we should applaud actions of this kind by Nelson and others.

I would also point out that Mr. Limbaugh is simply wrong vis-a-vis who sets foreign policy. Read the Constitution people - Congress has a role. Arguably, when the President is derelict in his duty as outlined by this document, Congress should work to fill the vacuum.

It's not surprising that someone who obviously has their position writing here because of the popularity of a famous sibling should make this basic error or understanding. It's even less surprising that the fanatical base that's left supporting these reckless dolts doesn't check him on it.

Senators
can take all the trips they want, Bush is sending in more troops. I am hoping that we carry out some combat ops close, or over the borders of both Iran and Syria after taking down Sadr. It is time to pump up and change direction in Iraq.

As for the Senators I just do not get it, Bush has 2 years left. Are these moes so impatient they are willing to fraternize with the enemy, undermine our pres/country to what? Win an election in 2 years?

You can bet Pelosi knows all about these trips, and it is part of some strategy for the Dems. I am not talking conspiracy, just another way to undermine the GOP/Bush/America by default.

I wonder if Katie Couric or Matt Laur will be digging in to this story to see where the Dems are coming from. I am really just kind of amazed an american politican would do something like this.

I am over 40 but I do not remember Kennedy's trip, or the ensuing media flap, so how much harm can these trips have, OTHER than making us look like a divided country in every way?

There is no excuse for any politician to undermine the current president and the State Department of which he has control. The POTUS is still the final foreign policy official here,not some Sen. who thinks he is. These treasonous acts should not go unpunished, but unfortunately,Mr. Bush's own policy i.e. the "new tone" will preclude that from happening.I agree with those who, for the life of us, can't understand what those in opposition to the WoT don't get about an enemy who has vowed nothing less than total destruction of our society. The reason democrats are going abroad to deal on foreign policy is because their party is week on foreign policy so they want to "idea market" (hello, wake up) and make it easier for voters to swing their way in 2008, hence Hillary the man hater will get some additional votes from males. Key evidence missing.
The interesting claim here is that Nelson's trip was in violation of the Constitution. It is certainly unfortunate that space reason prevented actually making an argument that it does violate the Constitution. Certainly Nelson is in no position to make deals in the name of the US. But there is no evidence that he did.

Fact-finding seems to be a more legitimate part of the oversight function of Congress. I don't know if his trip accomplished anything. But the charge that he violated the constitution is a serious one. The evidence put forth to defend that claim seems much less serious.
