Sotomayor Stands Alone

“Personal experiences affect the facts that judges choose to see. My hope is that I will take the good from my experiences and extrapolate them further into areas with which I am unfamiliar. I simply do not know exactly what that difference will be in my judging. But I accept there will be some based on my gender and my Latina heritage.” — Judge Sonia Sotomayor, October 26, 2001 speech at the University of California–Berkley.

Really? So now judges are supposed to ignore facts because they don’t comport with their heritage? As a Hispanic, I can proudly say Judge Sotomayor’s views do not represent my views or those of the Hispanic community in which I participate. Do you want to know what we believe in? We believe in justice, fairness, freedom, and equality. I have never met a Latino who thinks he is wiser than a white person because he is a Latino. Sotomayor stands alone on that one.

Although I proudly join her in celebrating her heritage, I strongly disagree with her judicial philosophy. I believe judges must look away from personal heritage and look to the rule of law. Judge Sotomayor’s own words indicate that she is incapable of doing this. Therefore, senators should not confirm her to the Supreme Court.

The idea that personal experience instead of facts and law should determine the outcome of cases runs counter to the underlying premise upon which our judicial system is founded: Equal Justice Under the Law. President Obama and Judge Sotomayor have apparently proposed a new system: Justice According to Race, Gender or Sexual Preference. They propose we rip the blindfold from Lady Justice, destroying the very foundation of the ideals we strive for.

One need look no further than the Ricci and Maloney opinions to understand why everyone, including Latinos, should be concerned about Judge Sotomayor’s judicial philosophy.

Sotomayor’s opinion in Ricci is just the latest example of her judicial philosophy in which she chooses to ignore facts to advance a cause in which she believes. Apparently discrimination against certain kinds of people is okay with Sotomayor, no matter what the law says. Reversing her decision, the very Supreme Court to which she aspires was clear in its disagreement with such a stance, stating, “[t]he City made its employment decision because of race. [It] rejected the test results solely because the higher scoring candidates were white. … [A]fter the tests were completed, the raw racial results became the predominant rationale for the City’s refusal to certify the results.”

In Maloney, Judge Sotomayor ruled that “[i]t is settled law … the Second Amendment applies only to limitations the federal government seeks to impose on this right.” She based her ruling on a case that dated back to 1886, before the Supreme Court ruled that the Bill of Rights applies to the states. In Judge Sotomayor’s view, every amendment in the Bill of Rights, except the Second Amendment, represents a fundamental right. Why? Because she says so.

Ironically, while Judge Sotomayor believes that gun ownership is not a fundamental right, she believes that the right to have an abortion is fundamental.

No matter your heritage, Americans should be concerned about a judge who believes that the “court of appeals is where policy is made.” The bench is not the place to create, make, or advance personal preferences on public policy and impose them on the American people.

An activist ruling by the Supreme Court comes with dire consequences. In examining Judge Sotomayor’s record, senators must look past her Latina heritage and directly at her judicial philosophy. A Justice of the Supreme Court, regardless of his or her heritage, must be able to uphold Constitutional principles for all people, not just the ones that look like me.

What an outrage! Liberals lie consistently with no consequences whatsoever... We must let the sleeping public know about this, most people are NOT paying attention. We've got to work harder to get this people out!!!

An honest approach...
at this topic is to be admired. No doubt, a white man would have been crucified for saying "he would hope a white man reach better conclusions than a minority woman." No doubt Mr. Diaz will be vilified (like some have tried to do here) for going against the grain, being that he says he is a Hispanic himself.

She lacks discernment because it has nothing to do with her ever imperial feelings. She has not risen above her life experiences and cannot see them as beneficial or she would never have made such a stupid comment. She is up for this appointment precisely because she is ill equipped, irrational and ignorant. If she was a white man and made such stupid comments she would never have gotten into college, much less onto the bench and she certainly would not be up for SCOTUS.

“…the right of the people to keep and bear Arms, shall not be infringed.” The right to bear arms is a “right of the people.” Just like the “right of the people to be secure…, against unreasonable searches and seizures, shall not be violated” is a right of the people, otherwise States could engage in unreasonable searches and seizures. Prior to the 2nd Amendment, Madison discussed the importance of an armed Citizenry to a free people in Federalist 46. “Besides the advantage of being armed, which the Americans possess over the people of almost every other nation …” Being armed was a fundamental and essential right of the individual. The 2nd Amendment simply declares this “right of the people”. Madison explained that if elected officials’ ambitions lead to a tyrannical Federal Government, ...”to these would be opposed a militia amounting to near half a million of citizens with arms in their hands, officered by men chosen from among themselves, fighting for their common liberties.”

But, you might want to read her complete speech of 2001. She is NOT saying her race is superior to any other, and that any individual, whatever race, would have a wiser judgement on their particular past experiences. Thats usually why we like getting older justices, older people are usually wiser for having gone through much.

I think you meant "latina" if you're referring to Sotomayor. And if you haven't heard of her comments in Berkley back in 2001, you're either living under a rock or have selective hearing. As I pointed out to Lon, she has made that reference more than once, so it's not some isolated comment. She believes that she, because of her lifes experience, would make better decisions, as a wise latina, than a white male. That's racism and sexism in the same sentence.

what she said? Apparently YOU are. Any idiot knows that we are products of our environment. We are the sum total of all our lives experiences. Who doesn't understand that?

MY problem with Sotomayor has been what she has said and what she has done. Those things are what lead me to be leave that she is "empathetic" based on race. Her "wise latina" comment was NOT an isolated incident as she has made that comment numerous times. She has NOT been taken out of context at all.

The bottome line is, you and other liberals are all willing to give her a pass on her racist comments and judicial decisions because she leans your direction politically. At least be honest and man-up to it. You're not fooling anybody, you know.

Would you give one example of sexism or racism of this Latino? And, couldn't you say too, that being a Cuban may be more attuned to the injustice done to Cubans and may, perhaps, make a wiser decision concerning a matter where rights might come up. Remember, she plainly stated that white males often do, as in the 60s, make very good decision on rights of minorities as well.

On a off note, my wife and I net to a new Cuban last weekend, it is now our favorite new place. I even had a Mojito.

What Sotomayor said is that every judge is affected by their experience and that she will try to work beyond what she is familiar with. That is pretty much the opposite of what Diaz takes her to have said.

A good example of Sotomayor's point can be found in this article. Diaz comes from the experience of being a right wing hack looking to be offended by what Sotomayor says. And so he ignores what she actually says in favor of what he wants her to have said. He would be a better thinker if he took Sotomayor's admonition to heart.

It's not the record of his class or grades in kindergarten, it's the information that he used to register for school that is pertinent. That information would likely be enough, and yet he stalls. For the life of me, I can't figure out why someone with nothing to hide would go through the time and expense to seal virtually every public record of his lifes existence.

Yeah, as if the press has really done their job to expose the man, his past, his associations, and his beliefs. Never, and I mean NEVER, have I seen so complicit a press corps as I have this past election cycle. There was absolutely NO digging into this man's record. Everything he said, his word was taken as gospel. Have you ever seen that in US political history? I sure haven't.

One other pertinent question asked is, which passport did Obama use when he travelled to Pakistan (by his own admission)? It wasn't a US passport because travel to Pakistan was banned in 1981. I'm not one for conspiracy theories, but there are far too many questions without answers WRT Obama's birth.

A Latina Justice
Why is Obama appointing a 'Latina' at all. Since when were 'Latinas' a dispareged minority in this country?

When is Obama going to do something for African Americans? Why isn't he appointing an African American to the court? The lone African American on the court, Justice what's 'is name, doesn't even share the philosophy of most African Americans. I don't think Obama does either. I think he's embarrased by his skin color, like Michael Jackson was.

Why are the Democrats crapping all over the promises they made to African Americans in order to win their votes and instead empowering Latinas? I think African Americans have been sold out by the Democrats and by President Not African American. Once again.

Loyalty Is Needed.
Appointing an Hispanic woman to the highest court shows that the president never forgets the underdog. That choice will keep his standings in the polls high. Sotomayor will be loyal and never bite the hand that feeds her. She will call her boss before casting any vote.

If Sotomayor had simply said that, "my experiences will be a boon rather than a hindrance in my judging" that would be a whole different can of worms. She specifically invoked her gender and her ethnicity, and it is this with which some of us have an issue.

Affirmative action has done what it was supposed to do: make sure that folks of other ethnic backgrounds and genders than just Caucasian males have a fair shot. Now, it is swinging into the other side of the divide: giving said persons an unfair advantage over their white male counterparts. Indeed, the fact that you have to back as far as 1890 to find an example to support your position makes it all the more clear that we have achieved an acceptable balance amongst the various groups. Indeed, we have moved from "Jim Crow" to "Jamal Crow" or "Juan Crow."

Furthermore, just because we get rid of it does not mean that we won't be able to keep tabs and make sure that it's nobler goals are still being met. If there be a genuine case of racial discrimination--amongst any race--we are a society that is more than vigilant to such injustice. Indeed, in many ways, we've crossed the line between eternal vigilance and paranoid delusion. It's time we bring the pendulum back to a resting position in race-neutral center. Everyone will be better served by it.

I have never supported "Affirmative Action". But, it is an "Unintended Consequence". It should teach US that "Hate" has unforeseen consequences. Also, being a Supreme Court Justice at one time did not require a Law Degree. In fact, before 1890 only the Wealthy attended Law schools. Proprietary schools were used to train community activist, who served the same function as most Lawyers. Let US never assume, that "Human Beings" are superior to one another. It is this type of "Stupidity" for which we are paying today!

According to attorney Orly Taitz, who is working on multiple cases alleging Obama is a "usurper" because he doesn't meet the constitutional requirement that only a "natural born citizen" can be president, U.S. District Judge David O. Carter ruled in a hearing today that her case will move forward.

Her complaint was filed against the president on Jan. 20, the day of his inauguration, over his actions BEFORE he became president.

Taitz has told WND if her motion for default is granted she immediately would request access to Obama's birth records and other documentation that could determine his eligibility to occupy the Oval Office.

Obama has been granted 60 days to prepare, but Judge Carter said that nothing will be dismissed on procedural issues AND NO EXTENSIONS will be granted.

Though the point of affirmative action was never to hire an unqualified person, that was one of the many unintended consequences it has produced.

Further, whether or not she has accomplished everything by herself is still open to question. She wasn't able to accomplish getting into institutions of higher learning by herself, so it does leave open the question whether or not she was able to graduate from them by herself. After all, I've seen firsthand teachers who give students whom they feel sympathetic towards, and who tell them what they want to hear, better grades than others. Given that her legal superiors have found her to be wrong more often than right, and have questioned her courtroom demeanor and intelligence, it doesn't exactly lend credence to the idea that she is qualified for this position.

I don't care who is in the "vast majority of powerful positions." I don't care what their ethnic heritage or skin color is; I don't care what their gender is; I only care that they are the most qualified to do their respective job. Having so many white men in these positions may not be "fair," but trying to correct one alleged form of racism with another is useless. It will not lead to the hiring of more qualified individuals. What if a white male is the best qualified candidate? Under this logic, he's automatically disqualified in favor of a less qualified candidate. Further, if two candidates are equally qualified--one being a white male and the other not--we need do nothing more than flip a coin, and leave it to chance. This is how it should be done, because to "even it up a bit" is to discriminate along racial lines. You want to make things fair? Abolish affirmative action.

Please explain to me the overriding concept of the Bill of Rights? Were they not intended as protections AGAINST an over arching government? Obama has lamented this in what he calls negative rights, which are not negative rights at all. They merely spell out the limitations of government.

Why is it that liberals demand an open interpretation of the first amendment and then turn around and wish to constrict the second? Freedom of speech becomes freedom of expression. So actions, not just words, become a first amendment issue.

The establishment clause has been bastardized to the point of lunacy. Not content to let the words speak for themselves, liberals twist church/state statements into prohibiting the mere mention of faith. Your side is losing credibility with the mainstream on this issue. Only a complicit media prevents like-minded people from knowing they are not alone.

If anyone wants my guns, they'll have to take them from me. I ain't givin' em up.

Since only states had militias, The second amendment clearly was referring to the 13 states.

Since Sotomayer stated in her legal opinion that the 2nd amendment does not apply to states, She is an idiot.

Since there is a comma beteen the "Milita Clause" and the "Right to keep and bear arms clause, they are two separate thoughts or concepts.

But while we are on the subject, are there any of parts of the Bill or Rights does Sotomayer think does not apply to the States? Perhaps free speech, perhaps, the right to be secure in our persons, papers, and personal effects, perhaps the protections against self incrimination.

The Senate needs to explore what other parts of the Constituiton Sotomayer does not think applies to the States.

One thing's
certain, we don't have to worry whether or not any of us are going to hell. Obama and the rest of the Socialist/Communist thugs have us on a beeline to hells gate.

Any chance of avoiding ending up in hell, i'm afraid, is going to take a hell of a lot more than mere words.

Liberal "Feelings" As Law Leads to Chaos
What is a Judge Sotomayor going to do when the contending parties are a black American and an Hispanic American? Is she going to rule on the basis of who suffered the most?

In the act of trying to rectify past racism liberals recreate it. When our politicians and judges start making decisions based on personal prejudices and "feelings," instead of age-old principles of the law we begin the descent into chaos and racism grows into a monster that consumes our legal system and our country.

She still obviously accomplished everything for herself... after being given the opportuinty to do so. Isn't that a so called 'conservative' mantra...'teach a man to fish..'. Perfect grades throughout law school, moderate to left leaning decisions. Is there anyone else left arguing that she is not qualified?

It does not seem like too much to assume that if the republicans had won the elections, and nominated a minority for SCOTUS (again), this author would lead us to believe that the person was the best qualified (as if there is actually 1 'best').

Correct me if I am wrong...the vast majority of powerful positions in this country are filled with white men. So here are the inevitable questions...do you actually believe that this accurately portrays the make-up of the broader society, in terms of abilities/qualifications? Some would argue it does not matter. Most minorities and many white people argue it does matter. Seems like the people of America want to see more diversity in power, period. What do you do about this?

Just a difference in opinion with conservative minorities, but I believe their thinking is to ideal. Does Justice Thomas believe he was not a minority pick? Do I? It sure seems like it, but who knows. I know he's black, you can't separate that from your mind. So who do you pick when there are 1,000 qualified people and major racial discrepencies from bench to society? Ehh, wouldn't hurt to even it out a bit. Seems like an easy one.

Sotomayer must have achieved and progress via Affirmative Action.

In the Mahoney case, she stated the 2nd Amendment of the Bill of Rights does not apply to the States.

Well what does the 2nd Amendment say?

It says the following, "...a well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed."

As anyone with a high school diploma knows, at the time the Constitution was written, only the States had a militia. So who does Sotomayer think the authors of the Constituion were referring to?

In the Ricci case, Judge Sotomayer decided it was ok to discriminate based upon race.

Elections have consequences. When you vote for a Liberal, you vote for the lowering of standards.

What goes around, comes around. The abuses of the constitution by groups temporarily in power must be fought by all, including the members of the group benefitting. If affirmative action is condoned today to benefit one group, it may be employed in the future to damage that group. When government confiscates any person's property, rely on it, your property is endangered. Too often has judgment been rendered according to whose ox got gored. Sotomyer, by her own mouth, appears ready to take injustice to new heights.

Sotomyer has previously made no bones about it, she believes judges are entitled to make policy. Now she directly contradicts her previous statement and says she believes judges must only app;y existing law. At which time was she lying? Has to be one or the other. Just what we need, another liar, another plastic person who will say anything to gain power.

Why name Sotomyer and take a chance she might be honest? Alcee Hastings would accept in a heartbeat, and you would have a sure thing.

Spanish folks have been welcome in America long before Sotomayor came on the scene. There have been many Hispanic persons in the legal profession before Sotomayor, and whether or not she gets confirmed, there will be many more after her. Some have gotten to where they have because of their own merits, others have benefited from affirmative action and Sotomayor is of the latter group. She has even alluded to this fact herself.

As far as what any group of folks have contributed in the development of this country, that has nothing to do with whether or not Sotomayor is qualified to be a member of SCOTUS. Further, giving someone a position on the SCOTUS simply due to their ethnic heritage only sends the message that racist politicians can work for Hispanics as easily as they have in the past for Caucasians.

Regarding her education: she has made mention--on more than one occasion I believe--of the fact that she wasn't able to get into any of the institutions of higher learning which she attended without affirmative action. Hence, without affirmative action she wouldn't have been able to get anywhere near the SCOTUS. Given that affirmative action simply gives to some--based on ethnic heritage or skin color--what they can't accomplish on their own, she is nothing more than an affirmative action hire.

Judge Sotomajor is NOT an "Affirmative Action Hire"! She is symbolically a "Statue of Liberty".A welcoming for the "Spanish" population, into the mainstream of America. President Obama 's gesture, is an act of acceptance. The truth of the matter is, people of Latina and Spanish descent, have played major roles in the development of this country. By having a Supreme Court Justice, of Latin heritage, we show every young "Latino" child that education has value. This appointment has more than just judicial value. Plus she is a "Damn Fine Lawyer"!

What worries me is that Mr. Diaz is wrong, that it is not Sotomayor whom stands alone, but men like Mr. Diaz: Hispanic people who want to be judged upon their own merits and accomplishments, not their ethnic heritage or the color of their skin. There was a time when guys like Frederick Douglass actually were listened to; nowadays, he'd just be written off as another Uncle Tom.

Sotomayor is just an affirmative action hire. She hasn't demonstrated any ability to accomplish anything of note without relying on the privileges afforded her based upon her ethnic heritage. She has described by her legal peers as being wrong 60% of the time; as a "bully" whose courtroom demeanor is unprofessional; as not being very smart, and as such has to hector her opponents in order to gloss over her own ineptitude.

Sadly, other than Mr. Diaz, I've yet to see any Hispanic folks come out against this yahoo. In point of fact: the "mainstream" Hispanic opinion seems to be one of solidarity and support for her. I would hope that Hispanic folks wouldn't be so stupid as to support this idiot simply because she comes from their end of the gene pool. However, if they do, they deserve the pathetic consequences such a decision will bring.

Why? I'm an Irishman & I wear green on March 17 & hoist a Guinness once in a while -- but so does half the world. Should I likewise be proud of being 6'2" and having blue eyes -- other traits I was stuck with when the strands of DNA fused?

And what's so wonderful about PR heritage? Hell, even the Irish have done better on their little island than Puerto Ricans have on theirs. And BTW, we made it to the Supreme Court a whole lot faster. Nowhere, however, do I recall some Mick Judge going on about how his blarney made him better & wiser than some WASP. Of course it's obviously true, just never broadcasted.

Were she really wiser, she'd not have mentioned it.

Latins are no more a 'race' than are the Irish. It's all a lot of hooey! What they share, and what influences them the most, is being raised Catholic.

Benjamin Cardozo (Assoc. Justice 1932-38) was the FIRST Hispanic Justice on the SCOTUS and NOT Bloatomayor the hack.
