The Big Chill: Islamists Inted to Muzzle Americans' Free Speech

Freedom of speech is under attack. Let us count the ways.

The first and most obvious: Those who criticize militant Islamists – from novelist Salman Rushdie to Danish cartoonists to memoirist Ayaan Hirsi Ali – are routinely threatened with deadly violence. It would be black humor to say this is having a chilling effect.

The second is “political correctness.” On campuses and within Western governments it is increasingly taboo to label terrorists who slaughter in the name of Islam “Islamist terrorists.” In Canada, “human rights commissions” attempt to enforce this taboo by putting such writers as Mark Steyn and Ezra Levant on trial for the “crime” of expressing opinions that offend Islamic grievance groups — and also for quoting Islamists accurately and thereby casting them in an unfavorable light. If that’s not Orwellian, what is?

But it is the third approach that could be most consequential for Americans. It’s known as “libel tourism” and here’s how it works: A book published in the United States names an individual abroad who supports terrorist groups. That individual – for the sake of discussion, let’s say he’s a Saudi petro-billionaire with a home in London -- goes online and orders a few copies which arrive in the mail. He takes those books to a British attorney who files a lawsuit complaining that his client has been libeled.

The billionaire knows it will be much easier to prevail in the U.K. than it would be in an American court where the First Amendment and decades of case law provide free speech protections. (Under English law, by contrast, the burden in a libel case is on the defendant to prove his innocence – which can be impossible if he’s been using confidential sources or even just sources who don’t want to cross an ocean and take part in a courtroom battle.)

The legal costs are chump change for the billionaire, while few non-fiction writers command similar resources. If the writer chooses not to spend months living in a hotel and fighting it out in court, the case will be forfeit and he will be hit with a “default judgment.” If he doesn’t pay, he’ll never again be able to set foot in the U.K. and other countries that enforce British court judgments.

But more important is this: The message gets sent, loud and clear, to journalists, scholars and publishers, that researching and writing about terrorists and those who enable them is verboten -- even in America.

Publisher Roger Kimball has noted that when he was about to publish Andy McCarthy’s Willful Blindness: A Memoir of the Jihad, he received a message from a distributor working in the U.K. and Canada asking if there were “any references to Saudis and terrorist[s] in the book” as that “could potentially create libel lawsuits as it could offend Saudis living in England and this has happened with many other US publications and we do not want to be jeopardized in selling this book.” No, no – we wouldn’t want that, would we?

Kimball was not intimidated but some writers no doubt have been, and other publishers have not just turned down “risky” books but pulled volumes from shelves and destroyed them following threats of legal action.

What can be done to protect Americans from having our speech restricted by foreign terrorist financiers, foreign lawyers, foreign judges and their toadies?

Representatives Peter King (R-NY) and Anthony Weiner (D-NY) have introduced the Free Speech Protection Act of 2008, which would give Americans who find themselves in the situation described above a “federal cause of action” to sue right back – and to claim legal fees, costs and significant damage awards as well if a U.S. court concludes that the foreign suit was “a scheme to suppress First Amendment rights.”

What’s more, the bill would provide “expedited discovery”: The plaintiff would be compelled to disclose information and documents relevant to the charges – something few investors in terrorist enterprises are eager to do.

On the Senate side, the bill is being shepherded by Senators Joseph Lieberman, (DI –CT), Arlen Specter (R-PA), and Charles Schumer (D-NY). What obstacles are preventing this bill from being passed into law? Let us count them.

First, though there is bipartisan support for this approach, not enough backers -- so far at least -- are from the majority party: Of ten sponsors on the House side, only one is a Democrat. Second, we’re deep into the presidential campaign season, a time when very little moves on Capitol Hill. Third, never underestimate the ability of the Saudis, their lobbyists, their allies and their courtiers, to kill that which interferes with their interests.

However, these Saudi billionaires would just do the same thing for fiction writers. Publishers have many buisness ties in Europe, and the EU has shown itself to be enthralled if not terrorfied of thier vocal, and at times violent Islamic Minority.

It Would Be Easy to Stop...
these Saudi billionaires. Let us assume that a few of them died under mysterious circumstances.

After a few instances of this occurring, I would be willing to bet that the others would get the not so gentle hint.

And before anybody says that I am advocating violence, I am not.

But if a criminal comes at me to harm me, US Law says I have the right to defend myself.

A billionaire, using the courts in another country to take away my living, is trying to do me more harm than a criminal who is only trying to steal my wallet.

The Dems will crawl all over
it if the bill contains a provision for punitive damages and lawyer fee recovery. The only problem is that you can only sue in the U.S.

One other thing, we should make SURE that the bill only does what it is intended to do via the title. Most of what passes for bills now do the opposite of the title.

Also, beware of the omminous ...."and other purposes".

Europe going Muslim
One of the biggest problems in Europe, in all countries, is their liberal look at nannyism. In Sweden, the last I heard, over ninty percent of a paycheck went to taxes. The government then provides things like free medical and free child care.

The problem there is that the Muslims know this. They move to these countries to get the care, many illegally as others do here. While we are near Mexico, Europe is closer to the Mid East. Because of the large taxes, many couples in Europe cannot afford to have more than a single kid. So they have less taxpayers each year.

As a result, the Muslim population is growing while the European population is shrinking. As neighborhoods become more and more Muslim, more and more people are aware of the danger and keep their mouths shut.

What are we coming to here?

Because of the direction our courts have gone. As you recall, the Supreme Court just gave Habeus Corpus rights to terrorists. How is that for concern?

Any government laws...
... that free restrict speech, whether in the name of preventing racism, religious affronts, antisemitism, sexism or any other -ism, should be opposed by all people of conscience. I suggest that the US congress pass a law not only negating any libel judgments against US citizens that would not be libel under US standards, but establish a cause of action allowing US defendents to countersue the plaintiffs for damages.

Counter Suing
Means that the billionnaire in the UK would either have to defend his claims (hard to do when the law requires you prove your claim) or receive a judgment against him. If he refused to pay up, default would result, meaning any American assets could be seized -- like oil companies, perhaps.

Sounds like a Saudi billionnaire terrorism supporter who filed a libel suit against an American in British courts would have just instigated his own financial mugging American-style.

The Bill
A check of the actual bill shows that it does include provisions for punitive damages (treble recovery). Ordinarily that should be enough to make lawyers wish to jump all over this bill to get it passed, however, since this will require them to get money from foreign turnips I would say that unless said turnips have assets in the U.S. that can be attached there will be little incentive to go after them.

In addition, as it stands now, the bill is clean. It does exactly what it is labeled to do (how refreshing). I am sure that after all the crooks and dabblers get their turn at amendments it will change a lot. A link to the actual bill is below.

Let's Rethink
Before we get too carried away blasting the “Rich Saudi Millionaires” who are suing in foreign courts for libel we should remember one thing. The U.S. courts went overboard back in the 60s in protecting newspapers from libel suits. They have made it where it is virtually impossible to sue. Not only do you have to prove that some “author” lied about you, you have to prove that they knew it was a lie when the wrote it AND that they intended to do you harm when they wrote it. Proving all of that in court is virtually impossible. We are the only country in the world that has made it so difficult to recover under the libel statutes.

This started with out good buddy the N.Y. Times and a suit in Alabama. Bad cases make bad law and that’s how this turned out. At that time the defense in a libel action was to show that the printed (or spoken) word was true. In this case there were errors in the printed account, therefore the defendants could not prevail. SCOTUS had to find a way to make them prevail (outcome vs law) so they came up with the “Absence of Malice” defense. This was another case of manufacture law found nowhere in the Constitution. Hindsight shows that we would have been much better off letting the Slimes lose that case.

So if the congress really is serious about limiting use of foreign courts perhaps they need to revamp our own laws so that the courts can not twist them into a newspaper protection racket. If they did that, just maybe that rich Saudi may do his suing in the U.S. courts.

So, perhaps we need an amendment to this bill to “fix” SCOTUS meddling.

It is apparent from the bias of the MSM that free speech in America is already under attack and is being allowed. Money, and I mean big money, is being pumped into attacking free speech here in America. The worst part is that MSM is either a willing participant or cowering in fear of high price lawyers filing suit against them. We do have a law in place, a federal law, that for some reason is being ignored. SEDITION: Title 18,Part 1,Chapter 115,Sec.2385. Particularly the last three paragraphs. I thought no one was above the law.
Politicians and the media that come under this law need to be investigated, NOW! If the Justice Department doesn't want to do it maybe Homeland Security needs to connect the dots. I, for one, will not not allow America to be bought by a bunch of Communist, Socialist, Progressive,Islamist Billionaires and their paid for lackeys that choose the pursuit of money over the Constitution.

Libel Recovery the hard way
One way of recovering from “alleged libel” occurred here in SC in 1903. Jim Tillman, a cousin of the former Governor “Pitchfork” Ben Tillman shot and killed the editor of the liberal newspaper “The State”.

Tillman got off on self-defense even though the editor was unarmed. Such was the juries of the day. The State had printed numerous editorials attacking Tillman prior to the shooting.

So Sue Me
Another law that creates counter suits to law suits by wealthy Muslim nutroots in their expensive suits is meaningless. It simply provides another path to tie up our courts and does little to nothing to deter the intent of Islam to hush our mouths.

What is required is a law that declares any action that infringes on our freedom of speech null and void. You know, dead on arrival, a moot point, nice try but no cigar.

If they issue a fatwa declaring blasphemy and demand our death, well, we may not be welcome in London but then they need to understand the dire consequences of setting foot our American soil as well. Another law just won't cut it. Our law is the very tool they are using to achieve their objective to end all criticism of Islam.

Some Humor
Islam's victories over the West will continue for some time until it's clear to enough Westerners what's happening to them. At the moment, not enough are feeling threatened and won't until it's upon all of us.

By then, Americans will wake up to the fact that they are under assault, not only by Muslims but by their own country and those they thought exist to protect us. We will have laws that give extra special rights to Muslim "victims" and that punish any who offend them. We will see our fellow citizens lose their freedom and their property for "crimes" of intolerance and insensitivity.

We will see our military and especially our law enforcement agencies, by then heavily militarized and armed with severe spy and arrest powers we've given them, terrorizing us at the direction of our Stalinist representatives, in league with the Islamists.

Fiction is better for several reasons
As a non-fiction writer, I hate to say it, but Retro Ranger is right. Fiction is easier, it sells better, the income is much greater and we can say things about the Islamists that we suspect to be true but for which we have no solid proof, or just say whatever we need to make a compelling story.

Fiction can also be made into movies that reach vastly more people in what is obviously a more powerful medium of communication, and it could be done over and over, ad infinitum.

A good fiction writer can write a book in much less time than a non-fiction writer can write a well researched book of fact. We could fill the book world with large numbers of fictional stories of Islamic atrocities, wicked plans for the demise of western civilization and their intentions for world conquest. The world of Islam is the supreme protagonist because it is so thoroughly, intelligently evil.

The cherry atop the chocolate sundae is that we can fight this war for our survival without risking wrongful legal action against us individually.

What you're proposing is a law that says that if a British court makes a decision that a an American doesn't like, the American can countersue in an American court. Now I'm not supporting British libel law, but this is a fine way to treat one's closest ally. Americans fought a revolution to prevent the British government from interfering in their affairs. Now the US government proposes to do the reverse. It is an open secret that the IRA gets a lot of its money from the US. Suppose Her Majesty's government went after those responsible. Americans would be outraged. Britain is a sovereign state and has been for a thousand years. Its courts are not subject to those of a foreign power. If the law passes, the British should start dumping copies of Windows and Works into Liverpool harbor.

The chickens are actually coming home to roost. Free speech, lawsuits, and political correctness are at loggerheads, and the lovers of free speech are found to be haters of free speech when it offends their sensibilities.

The Brittish are seen as more protective of Saudi feelings of offense than their commitment to truth, freedom, and security. Nice job, Brittain.

We needs clarity more than a resolution to this mess right now--which will follow once everyone knows the score.

...even if it's a member of the Saudi royal family. Somebody...ANYBODY... who tries using leverage of THAT sort to shut ME up would soon find themselves in a world of hurt.

This is a WAR, and it's time to show the financiers of terror and all the other "behind-the-scenes" players who think thermselves untouchable by the enemy that they're just as likely to become casualties of war as anybody else.
