The Senate Commerce Committee plans to hold confirmation hearings on June 16 for Julius Genachowski, President Obama's nominee to head the Federal Communications Commission (FCC). He is not a controversial figure, in part because he seems like a blank slate. His positions on many regulatory issues are yet to be revealed. But passionate advocates will want answers dragged out of him.

The Obama team is placing its emphasis on the wishes of its liberal base, like expanding access to the Internet and broadband service. But conservatives want senators to press on the fervent desire of Obama's Democratic supporters for a reimposed Fairness Doctrine (or, as conservatives are warning, a "Censorship Doctrine"). The White House has suggested the fury is overblown. They remind us that the president has come out against the Fairness Doctrine. But there are many evolving ways to try and intimidate radio stations to alter their content, including initiatives for diversity in broadcast ownership.

Last year, the Obama campaign's Technology page, which reflected Genachowski's role as a technology adviser to the campaign, offered nebulous verbiage that could be interpreted with ominous overtones. "As president, Obama will encourage diversity in the ownership of broadcast media, promote the development of new media outlets for expression of diverse viewpoints and clarify the public interest obligations of broadcasters who occupy the nation's spectrum."

This could be empty campaign blather. Or it could signal a real effort to use "diversity" as a political and legal weapon to crack up the nationally syndicated domains of conservative radio stars.

But what about broadcast indecency? In George W. Bush's second term, FCC chairman Kevin Martin ushered in the most energetic regime of indecency fines (and resulting litigation) in the history of the agency. And still over 1.2 million complaints remain unresolved. That's 1,200,000 times the FCC has been contacted -- and nothing. Will the new FCC chairman be more responsible?

A read of that Obama campaign page is not encouraging: "Obama values our First Amendment freedoms and our right to artistic expression and does not view regulation as the answer to these concerns. An Obama administration will give parents the tools and information they need to control what their children see on television and the Internet in ways fully consistent with the First Amendment."

That sounds almost exactly like the broadcasters and the cable industry, who want to put all the responsibility and all of the blame for sleazy TV on parents who haven't utilized all the supposed "tools" that have been put in their hands to monitor and block the gunk that Hollywood makes.

Sen. Obama spoke out at a Kaiser Foundation forum on Nov. 9, 2005, asking, "What do we do when bad television becomes the enemy of good parenting?" He spoke for most Americans when he said, "You can talk to the most liberal Democratic parent and First Amendment absolutist, and they will still cringe when they see some of the programming that's on television today."

If Obama is as smart as the adoring media constantly says he is, then he knows full well that the current V-chip and the self-selected content ratings used to block programming have been proven to be wildly inaccurate and ineffective.

The closest Obama came to frustrating the TV programmers in this Kaiser address was insisting that the cable companies could develop technology to "make it possible for parents to create their own family tier just by programming their television (to block entire channels, or genres of channels) ... There's no reason the industry can't make it as easy to find family-friendly television as it is to program TiVo. But if the industry fails to act -- if it fails to give parents advanced controls and new choices -- Congress will."

Congress did act in 2006 to pass the Broadcast Decency Enforcement Act, which increased the maximum fine for indecency tenfold. That wasn't a technological fix, but a bigger hammer for the FCC -- if, and only if, it decided to enforce indecency violations. We don't know whether Obama favored it, since it cleared the Senate without a roll-call vote, but it passed the House by a whopping 379 to 35, so one might expect a senator aspiring to be president would have voted Yes.

Senators need to ask Mr. Genachowski if he will genuinely and publicly pressure broadcasters and cable chieftains to shape up, since even Obama knows almost everyone is disgusted to sit in front of the TV with their children? Will he at least give the public the ability to stop funding wretched channels if they want? And will he enforce indecency with fines -- as he has been mandated by law to do -- or remove all the watchdog's teeth and let it sleep on the porch?

If you believe that, then you might as well stop arguing that all big businesses can do no wrong. A business is motivated by the profit motive and produces products that their customers consume. And there are customers who patronize the TV networks because they aren't disgusted. They love it. Why do you think they went all out to get digital TV converters if you think they are manufacturing a negative product?

Just another example how Congress turns its responsibility over to regulatory agencies then blames the regulatory agency when things go wrong.

Un-elected regulatory agencies should follow the law not make law.

FCC Vs Hollywood...

Well, If the FCC starts to clamp down on Hollywood's right to make films or T.V. Shows, with the freedom of speech/expression as granted
by the constitution, we may start seeing a shift
to the right by the hollywood elite that feel the Demo-Communist are infringing on their rights (including the right to make oodles of money, that corperate CEO's are having taken away from them, even tho they do more in a day then some actors....but then, these "Beutiful People" have "Stroke" in the Demo-Communist Party). So all I expect to see is a little lip sevice by either side and it'll Go away...
The problem with the V-Chip, is No one wants to Configure them Properly (The term is LAZY). it does work, it's just need to be set up right, Maybe instead of having the default setting on these thing as OFF, they should be defaulted to TV-G, then when it blocks their favorite Soap Opera or Movie, they'll dig out the manual and set it up right....I admit their
is room for improvement in the V-Chip Protocol, and I would like to see a feature where I can block shows that I don't deem appropriate for my kids (Like some digital Cable Converters).
Until then, I'll stick to watching what my kids watch and the Judicious use of the OFF Switch.

First Amendment
Most of you apparently believe this right is without limits.

Given Obama's record,
of seeking to control everything, who but the most niaeve, would think Genaschowski is on the up and up?

Everybody,
says they want freedom of speech, but when a lot of people see something they deem "offensive" what do they do? Dial up the FCC Decency Squad. I swear that some people have them on speed dial.

Terribly terribly confused
SO conservatives are opposed to government interference in the private sector, and they oppose any effort by Obama to address issues of diversity as to controlling. But they favor stronger interference by governmetn over what people cna and cannot watch, mainly because they are too lazy or incompetent to monitor their own children?

Exactly how does this make any sense at all?


Stop release of the torture photos
Call Speaker Pelosi and protest her taking this provision of NOT releasing the photos out of the current bill for military funding. She did this!! By taking it out she has opened a can of worms that could effect our soldiers lives.

Obscenity
is not what the Founders had in mind when they wrote the Bill of Rights. It was political speech. The right to speak out about controversial ideas. That said, the Amendment applies to CONGRESS not making laws limiting. Therefore, when my TOWN wants to take Hustler off the shelves of the grocery store, if we vote to do so we have that right under the Constitution. Similarly, we ought to have he right to determine locally available broadcasting. Normally the market would do a great job of that but since Congress has refused to allow a la carte programming, I must pay for smut to get the History channel. The solution would be for Congress to get the hell out of the business of cable and satellite companies and let them offer channel by channel purchases. Then anybody who wants smut can have it, but I don't have to pay for it to get the news station I want.

Have some self-confidence in your ability as a parent to teach your children the right thing. Judging by everyone of his columns, Brent apparently believes it is Hollywood/the entertainment industry's responsibility to raise and educate his children. News flash Brent- it isn't. It's yours. Last I checked, there are millions of loving, caring families out there, with millions of great children with bright futures. And- gasp- they been known to watch movies and television. Despite my own bickering, Jessica, I cannot say I disagree at all. The consumer should have the choice. I cannot stand MTV- such trash, so I don't watch it. But I am paying for it, despite that I haven't turned to that station in 15 years.

Yours is a great point that I have never even thought of- because of course, we have never been provided that option, and having to purchase all channels is something that has been a part of buying cable, engrained in us, since day 1.

There is a technological...
...and business reason why we get 8 gazillion channels on cable TV.Of course we don't watch them all ( I watch about six on a dailey basis and a few more periodically).But cable companies cannot exist financially on just the wildley popular networks,and cable allows us to ignore the usual Alphabet networks(The only time I go there is to see football in season.)I was a witness to the dawn of TV and I'll tell you cable is FAR superior.For all the types of shows you do not watch there is an audience for them who do not watch your favorite networks.But the cable companies need the income from all the networks in order to stay in business.

Freedom Of Speech?
You only have freedom of speech if the government and the media agrees with your speech.

Those who oppose anything "politically Correct" as summoned up by the left are treated as if they are little bugs ready to be squashed by the media and government.

The only freedom in the press are those who agree with Obama and the Democrats , all others are touted by the left wing press and the Democrats as "trouble makers" that should be ridiculed and shut down at all cost.

Joel You've covered the bases well. Brent, buddy, old pal, c'mon man. Conservatism is not about further empowerment of the government.
First, as has been pointed out this is not a first amendment issue. The first ensures that the FEDERAL government will not interfere with the people's ability to communicate with each other through the mediums of speech and the written word.
Second, the commerce clause also does not apply, as that was not a grant over private businesses. It was put in place for essentially a free trade zone, that would benefit the states and bring peace as some states were levying such large exactions upon others moving their goods through them.
This means that the FCC is an ILLEGAL entity. It does not mean something like it is not needed, as when state lines are crossed it should be a federal area of authority. This is part of the purpose of the federal government, to mediate, to govern in those areas external to the states and impacting one another. HOWEVER, unless and until an amendment is ratified granting such power to the fed, they cannot legally administer such powers.

Expression is not covered under the first amendment. Again the first is to keep the FEDERAL government from depriving us of the ability to communicate with one another through the written word and speech.
This does not mean in any way that states and thus localities are not allowed to have decency standards. At the time of the US constitution's ratification most states actually had language in their constitutions expressing that virtue was to be a goal of the government.
Expression, such as a lewd t-shirt, or public displays of obscenity is not communication. Communication is two parties willingly interacting, thus speech and press. One does not have a choice when others display or "express" their messages in public settings.

Affirmative Action is A Biased Philosophy. Why should Special Treatment Only Go To People of Color? I think that we whites should demand Affirmative Action too.

It does not matter if you are a person of color and do not qualify to attend a prestigeous university. Affirmative Action said, "to hell with test scores, ability, and intelligence, you have to admit certain students based on gender or race, and after you are forced to accept them, you have to insure that they give the appearance of succeeding by passing them on and graduating them whether or not they could complete the course work." We now have many doctors, lawyers, Especially Politicians, teachers, nurses, and others who are incompetent, but licensed and have prestigeous credentials on their walls that they did not earn, because they were incapable of earning them." Affirmative action has put many incompetents in positions of power, and this is very dangerous.

Sonia Sotomayor, Obama's pick for the Supreme Court of the U.S. was on TV this week bragging about the fact they she got a Yale Law Degree and Undergraduate Degree without having the requisite intelligence and the accompanying test scores, thanks to Affirmative Action. And she said this with Pride.

With Reverse Affirmative Action, I should be Guaranteed a Spot on the LA Laker Team, complete with Multi-Million dollar salary, even though I am only 5 foot 10, I am white, and I cannot Jump, Cannot Shoot, but hey, what does ability, talent and skills have to do with it?

Afterall, the Average White Guy is the most discriminated against group in our society today. Maybe, we will take my case to the Supreme Court, and see how a Wise, Clumsy, Latino, Lesbian broad will rule?? I know an Intelligent White Guy would likely rule in my favor, if he is upholding the Letter of the Law of Affirmative Action, which Says, Ability and Qualification Does Not Matter.
