The Conservative Case For Cars

The Obama administration's arguably unconstitutional and potentially illegal makeover/takeover of General Motors and Chrysler hit a legal road block on June 8, when Supreme Court justice Ruth Bader Ginsburg issued a stay preventing Team Obama's plan to sell Chrysler to the Italian automaker Fiat. This speed bump was a great opportunity for the media to pay attention to objections to the White House's reckless executive-branch manipulation of the auto business.

Or not.

President Bush and his team were regularly savaged by the media elite if they so much as sniffed a hint of evasion over the rule of law and the bounds of constitutional authority in fighting terrorism. So why is President Obama's unprecedented intervention in the auto industry, including a TARP-fund bailout expressly ruled out by Congress, all but ignored?

Even with the Supreme Court order, the nightly news shows of CBS and NBC gave the decision just a few seconds of air time, the equivalent of a stifled yawn, and never went anywhere near describing the strange bankruptcy proceedings the Obama administration has cooked up to manipulate the industry to its liking.

Only ABC acknowledged the Chrysler deal was "encouraged and engineered" by the Obama folks, and noticed that lawyers for the pension funds of "Indiana police, teachers and taxpayers" were stopping the sale. But even ABC suggested that these state government employees were the bad guys, like vultures hoping that they'd make more money by taking Chrysler apart.

When Enron flat-lined in 2002, these same networks laid the blame all over the Bush administration while breaking out the violins for the people whose retirement funds were ruined. With the car companies and Obama, the song sheet is reversed. No one will go to the home of a retired Indiana cop and wonder why President Obama wants to deny him money for food and pills to sell off Chrysler to a bunch of Italians.

Then there's the GM deal. Here are some of the anti-Obama arguments from plaintiff lawyers and conservatives that are going ignored on the nightly news.

1. Nationalization. Obama proposes the government will own 60 percent of General Motors. Not only will the taxpayer be on the hook for tens of billions in capital keeping GM afloat, but the taxpayer will be doing this after Congress ruled out such an action. Conservatives insisted during the fall campaign that Obama would govern as a "socialist." The media reacted with disgust. How does this massive intervention not underline the S-word in heavy red ink?

2. Politicization. Once the Obama administration is running GM, shouldn't a skeptical journalist wonder if common business sense is going to lose to a political agenda? Who is GM going to satisfy -- the consumer or Obama? Already, Obama is pledging more GM cars will be made in America, and they'll make more fuel-efficient cars. They're handing large chunks of ownership to the United Auto Workers, which is surely a sleazy payoff for UAW campaign contributions.

Do we really want an auto company run like other government-run transportation concerns like Amtrak? Every decision -- from closing dealerships or plants, to selecting suppliers or which vehicles to build, to collective bargaining with the UAW -- will have to pass the Washington tests of political and environmental correctness.

3. Usurpation. The Obama Administration acted in complete disregard of the rule of law. The bailout was accomplished without congressional approval, and the money used was appropriated for failing banks, not carmakers. They trampled right over where the Constitution places limits on the president's ability to spend public money, stating "No money shall be drawn from the treasury, but in consequence of appropriations made by law."

When Dennis Hastert was the Republican speaker, he was so jealous of congressional prerogatives that he expressed outrage in 2006 at the FBI searching the office of corrupt Congressman William "Cold Cash" Jefferson, D-La., who was caught with $90,000 in FBI money in his freezer at home. Speaker Nancy Pelosi thinks the powers of Congress are whatever Barack Obama decides they are. "If and when the Administration thinks that there should be legislation [on the auto companies], then we will take that up," Pelosi said in May. "We have not heard, I have not personally heard from the executive branch that they need any legislative remedies."

This massive Obama end-around of Congress and the Constitution should at the very least be a matter of controversy and debate. Instead, the national media are ignoring or downplaying the complaints of Obama opponents, as if any whiff of controversy over Obama's increasingly ruthless management of the economy would wreck a recovery. Barack Obama thinks he is America's car czar, and the media are not a check or a balance. They are merely the czar's enthusiastic servants.

Nah, GM is doomed.
The company that built much of the machinery used to defeat the enemies of freedom is now being run by a man that promised to force the Marines to surrender.

Unfortunately, Bush started it.
In the waning days of his administration, and I suspect that in concert with the incoming 0bama administration, Bush provided the initial 'bridge loans' to GM and Chrysler, after a legislation for such loans has failed in Congress, primarily because UAW would not agree to some of the conditions. That in effect empowered 0bama, and gives him a 'plausible denial ability'. That of course does not excuse him for rewarding UAW at the expense of the investment class.


Arguably?
Here's the problem with the so-called conservative movement of today: its pundits say things like "The Obama administration's arguably unconstitutional and potentially illegal makeover/takeover of General Motors and Chrysler..."

It's not arguable - it's obvious. This is unconstitutional on multiple grounds, in addition to what Bozell mentioned:

- The constitution does not specifically empower the federal gov't to own the means of production, so those powers "are reserved to the states respectively, or to the people." Oh - my bad - it's racist to mention THAT part of the bill of rights.

- The constitution forbids any "law impairing the obligation of contracts". But that's exactly what happened here, both with the dealers and the bond-holders.


Also, as Peter mentioned, the GOP has no leg to stand on when calling Obama a socialist - it was the GOP that pushed TARP, which was also socialist and unconstitutional for the same reasons.

Looks like the major parties are well on their way to merging to me.

Supreme Court Decision
This morning it was announced that the Supreme Court has decided to let the deal with Fiat move forward. This is very troulesome to me. When Justice Ginsburg said that she wanted to hear the case it seemed that the separation of powers was working.

With this latest news I must wonder if the highest court in the land is now also captive to Obama.

As for the nonsense that Barack Obama is not an American citizen, it is far more likely that 9/11 was an inside job.

Is this situation problematic, or "necessary and proper?" You and your ilk destroyed this country, and radical intervention may well be needed to resurrect her. Let's put it this way: We could have done worse -- which is listening to your counsel.

I am so sick of hearing...
...that "Bush started it!" It's like two little kids fighting. Each one screams, "he started it!" Who gives a rat's behind who started it? Just because I'm a conservative and was a Bush supporter does not mean that I agreed with every move he made. And even if he did start down this path with bailing out the automakers, that is no excuse or justification for the trampling of the constitution by this administration in turning GM into Government Motors!

he won't have to use a law to do so, he can use the taxpayer subsidized GM and Chrysler to drive them into the ground. Too bad no one has the marbles to use the RICO statute against him and his big business co-conspirators. We see what the government monopoly in the northeast has done to train travel. It's what's coming the auto industry as well. We will be dictated what to drive because options will be legislated out of existence.

0bama doesn't have to be in bed with big business, he just owns the whole brothel now.

Worthless GM promises
Putting the screws to GM's SECURED debt-holders is a monumental screw-up. And the gubmint just got started.

Anyone out there going to be willing to buy GM bonds in the future (i.e., loan GM money)? It doesn't take a rocket scientist to do the figuring. Let's see... GM says "in return for your X amount of dollars, we'll pay you 5% interest for Y months, and you'll have your principal back." You'll believe it and hand GM your money? Even if they promise security in return? There will be few takers, or GM will have to pony up jumbo interest to entice the loans.

Basically, a new giant black hole has opened up in the U.S. Treasury, which will be forced to subsidize GM's massive losses to the tune of billions per year, give or take a hundred million or so.

Do your patriotic duty and buy Ford. Help put GM out of our misery.

Where is the Constitutional challenge?
Why won't anyone challege the Constitutionality of the Obama administrations takeovers? There has to be someone out there that can do it.

And, by the way, those of you that say Bush started the auto bailouts, it is because president elect Obama begged him to. Bush should have let them fail, then they would have had to go through a normal bankruptcy and force the unions out. The "structured" bailout by Obama and company were designed to reward the UAW, who made no concessions and also gave them a majority stake in Chrysler and another big chunk of GM. UAW's payback was great for the multimillion dollar investment in Obama. They got moe than their money's worth.

Meanwhile Obama screwed secured bond holders, which included teacher's, police and firefighter's pension funds. So much for his promise to care for the middle class.

His "distribution of wealth" is going, not to the poor and middle class, but his cronies in the unions, his former election staff members and supporters who will stand to make millions. Those in the middle class, and the poor will not get a thing.

What he is doing cannot be legal and someone needs to file a lawsuit challenging it. If that is not done, you will see the Obama administration just take whatever they want under the guise of "it's best for the country."

I guarantee you, I'll NEVER buy either a GM or Chrysler again, nor will I deal with any company that takes taxpayer money.
