The latest myth touted on liberal blogs that’s bubbled its way into mainstream news headlines is the one where Sarah Palin ordered rape victims to pay for their own rape kits.

“Palin’s Town Used to Bill Victims for Rape Kits” was headline on a Thursday USA Today news story. Reporters Ken Dilanian and Matt Kelley used a 2000 quote from former Wasilla Police Chief to blame Palin for an outdated, now illegal policy she never supported.

“In the past, we’ve charged the cost of exams to victim’s insurance companies when possible,” former chief Charlie Fannon told the Mat-Su Valley Frontiersman in 2000 as then-Democratic Governor Tony Knowles was signing legislation to make local police branches cover the costs of the kits.

“I just don’t want to see any more burden on the taxpayer,” Fannon said at the time, which was reprinted in the USA Today.

Fannon went on to say that he believed the criminal should be held responsible for the costs, which run from $5,000-$14,000 per year for all assault cases. USA Today did not reprint those quotes from the interview, though. “The forensic exam is just one part of the equation,” Fannon said at the time “I’d like to see the courts make these people pay restitution for these things.”

Liberal blogs like HuffingtonPost, DailyKos and Salon.com are using this interview the Frontier conducted with Fannon to accuse Palin, who was mayor of Wasilla from 1996-2002, of supporting making rape victims pay for their rape kits-- a charge vehemently denied by her aides.

“It would appear that Sarah Palin has a problem with Rape,” blogger Steven R wrote on the DailyKos. “In addition to not supporting the availability of Abortion for victims of Rape, Mayor Sarah Palin, Maverick, Fiscal Conservative, also had citizens of Wasilla pick up the bill for their own forensics tests.”

Palin spokeswoman Maria Cornella told USA Today that Palin, “does not believe, nor has ever believed, that rape victims should have to pay for an evidence-gathering test.”

“Gov. Palin’s position could not be more clear,” Cornella said. “To suggest otherwise is a deliberate misrepresentation of her commitment to supporting victims and bringing violent criminals to justice.”

Democratic presidential candidate Barack Obama’s campaign advisers organized a conference call Tuesday with former Alaskan Governor Knowles and Ketchikan Mayor Bob Weinstein to do just that.

Knowles told reporters, “There was one town in Alaska that was charging victims for this, and that was Wasilla, and the -- the original police chief had been fired by Mayor Palin, and her replacement for that police chief was protesting it, and even when I signed the bill.”

Weinstein added, “Wasilla under Sarah Palin's administration chose to charge sexual assault victims for the forensic kits, and that's the choice they made. They easily could have made the other choice.”

Palin appointed Fannon as police chief in 1997. His predecessor was fired by Palin over his willingness to limit the town’s bar operating hours. Fannon was one of three candidates considered for the job and the City Council confirmed him in a 5-0 vote.

Palin later tangled with Fannon when he ran for Wasilla’s mayoral office during her gubernatorial race. Fannon created campaign ads containing a false endorsement from Palin. Palin did not support Fannon for mayor. She supported his rival, Curt Menard.

This campaign season is such a joke, and the joke unfortunately is on us. We have two men, one who is 72 years old, and another who voted 143 times as present trying to win our vote. Is this really America's best?

So she wants the victims to pay for the kit then go after the perpetrator, right? How is that a lie? A victim shouldn't have to pay at all. Ever. Period. What's your point?

I am not sure why this is a myth. Either that was the policy while Palin was mayor or it wasn't.

I am more interested why she fired the police chief because he was willing to curtail bar hours. What's the story there?

Palin showed no responsibility
in her position as mayor to question the bill or change it. Not exactly a friendly stance towards women, eh?

This column "debunks" nothing, but it does show just how willing the Rightwing continues to be to protect the interests of keeping the Bush administration viable for another four years.

If there is no evidence
Just either make it up or use only what makes your case. Billing the insurance company is not the same as billing the victim. How many times has the statement "that's why you have insurance" been used? I would change that to "if I could know that the party responsible is going to pay, I wouldn't need insurance".
If this country would only decide that the criminal should be held totally responsible for his actions then situations like this probably would not occur. I would be willing to bet that those who hold the law in contempt would change their tunes if they knew that they are going to pay the total cost(cost of the damage caused, any medical cost incurred by the victim, cost of catching and prosecuting them, even the cost of incarcerating them) of their crime when caught. So what if they had a rough time growing up, or circumstances have been less than ideal, they are still responsible for their actions. It is not the taxpayer's job to pay for the damage cause by the lawless, it certainly shouldn't fall on the victim or the insurance company of the victim.
Let's stop feeling sorry for the criminal. Let's stop making laws that bail the criminal out at society's expense, both financially and in repeat offenses. Let's really hold people responsible for what they do.
I say all this because our current philosophy of respecting the "rights" of the lawless has led to this point. When someone decides to violate the rights of another, that someone has forfeited whatever rights he feels he has.

What is false? That was the town's policy during her tenure. Either she liked the policy, or didn't have the wherewithal as mayor to do something about it. Neither reflect well on her.

Whether she had victims of assualts pay for their rape kits or not, Sarah Palin is very clear on this:

She would OUTLAW abortions for vistims of rape and incest.

Common sense
If the cost of laboratory or investigational tools or tests--is related to the medical complaint of a patient--then perhaps this should be be reimbursed via their healthcare plan. Of course if you have no insurance--it would be a write-off. But if the rape victim has healthcare coverage--why not bill the insurance company to offset the states costs?

This is the kind of thinking out of the box change we've all been seeking.

She's a class act and agent of change--but her vision of change is realistic, practical, and based on a reasonable ROI.

Rape kit Lies?or Not?
Simple case, did Wasilla AK charge women for the rape kits or not? I know if my mom, wife, sister, daughter, or any female in my community was raped I would be outraged. In Saudi Arabia they just throw rocks at the rapist until dead, in public.

Did you know that if you have a heart attack and need an ambulance ride to the hopsital, you are sent a bill for that??...where is all the outrage over that?!
listen: ANYTIME an individual walks into a hospital, uses ambulatory services, walks into a medical center, etc, and takes a test, uses a kit, or gets any medical service performed at all, there is a bill associated with that, period - a rape kit is no different.
Whenever any bill is produced for any medical procedure, used kit, consultation, etc. it is either:
a) sent to the insurance company, copying the individual, or
b) sent to the individual, copying the insurance company, or
c) sent to the individual and then that person forwards it to the insurance company for payment...
this is the same procedure whether it is a rape kit, blood test, emergency office visit for a broken bone, etc.
Anyway you cut it, the rape victim simply forwards the bill to the insurance company, or if they don't have insurance, then it is written off.
Sure, in a perfect world (complete with world peace, unicorns, and perpetual kumbaya) a rape victim would not see the bill, but that is not the reality of the world we live in - especially when it comes to medical billing. This is not any different in Alaska (under Palin) than it is anywhere else in the US.

If a policy is in affect when a person takes office as a city council person or mayor, or if the policy remains in affect for any period of time after that person takes office, than that person automatically supports that particular policy.

It appears that most people who read this article and are defending Palin did not actually read the USAToday article that is being criticized.

Carpenter claims that the article does not include the comments by Fannon about his preference for charging the victim, but they do as paraphrases. "He said he would rather force rapists to pay for the tests, not taxpayers." But in actual cases it is not likely that that will happen.

And the article does mention that the victims would be responsible for deductibles. So having ones rape investigated in Wasilia did cost the victim money. If the victim was uninsured, then presumably even more money.

Also before 2000 towns could charge rape victims for the tests, but they never had to. And the reason there was no law seems to be that it had not occurred to the state that towns actually would do something so indecent. Wasilia was apparently one of the towns that led to the need for the law.

And so, the MSM breaks right through
absolute rock bottom.

It is less clear what Palin's relation to the procedure was. This was policy while she was mayor, and it was either enforced or put in place by the police chief she appointed. And it seems pretty clear it was not the reason that she turned on him. (I suspect that reason was that he was unwilling to limit the town bar's operating hours rather than he was willing to. It is odd to be upset about someone's willingness to do something if they are not doing it. And if he was doing it that is presumably what the line would say. So it is just a guess, but I suspect Carpenter accidentally got that backwards. Not that that point seems important either way).

But it is not encouraging that all her spokeswoman would say about Palin is that it is clear that she would not support something like that, when all of the available evidence suggests she did, and they are offering no evidence that she didn't. The one thing that is clear is that it is not clear she disapproved of this practice of her town when she was mayor. You would think that if there was an evidence she did not support it, her campaign would bring it forward.

Two other notes: Apparently there was a federal version of this law. It was proposed by Biden and cosponsored by Obama (and over 50 other senators). McCain was not one of them. But maybe that was just because he was campaigning at the time.

McCain is the one whose policies would make getting health insurance more expensive (he wants to raise taxes on people who get their insurance through work) and so the number of people who would have to pay the full cost of their own rape kit under such a policy would likely go up in a McCain/Palin administration.

But then of course the current conservative Christian interpretation is that Bible is to be taken literally only when it can be used in gay bashing or excuse to restrict the reproductive choices of citizens. Basically the rule of thumb is as follows: Bible is to be taken literally if it can be used to attack people who do not share similar belief system.

You know there are a couple of issues here. Sure Palin believes that life begins at conception..and that reflects her personal values--but she has shown she also is a steadfast supporter of the law of the land. Whatever the law is--she has demonstrated coninous support.

But more important on this issue--is who should bear the costs of healthcare. In the past--the state has assumed most of the cost related to rape and violent crime--even when a patient is paying premiums for health insurance coverage.

Doesn't it make since--that health insurer's share in the expense--when medical care is required related to rape or violent crime?

In Alaska...those with no insurance--were not charged for the rape kits--only those who had health insurance.

Sure...the patient may have had a small copayment--or the amount went to a medical deductible--but that's part of our healthcare system.

When a state looks at cutting expenses--it's a macro operation--but in the end reductions in the budget help all citizens--including the victims of rape who may have had to pay a copayment, coinsurance, or deductible.

Thats our system--it works well.

I think if you were to check any municipal hospital in any town in America you'd find that the rape kits are charged to the victim's insurance without a copay. The hospital, the police department, the state victim's fund, etc., pays the copayment. I checked with a friend at Fairbanks Memorial and she said this is standard operating procedure at FMH and at every hospital she has worked in. If the victim doesn't have insurance, the hospital or state or Medicaid in some instances absorbs the costs. Someone has to absorb the costs; it might as well be the insurance company, since in case this is a surprise to anyone, the taxpayers of Alaska/Wasilla/wherever did not rape the woman, the rapist did, but once they're incarcerated, they generally have no means to pay such bills.

Tony Knowles, former and not-very-beloved Dem Governor of Alaska, hopes to run for another two-fer where he can renew his collaboration with the federal government against the residents of Alaska. So, spinning things against his potential opponent is in his best interests.

The state law in question was not a law which allowed municipalities to charge for rape kits, it was a law which PREVENTED municipalities from charging for rape kits. The law effectively overturned the Wasilla practice.

Regzardless, rape kits are NOT medical services. Rape kits are investigative tools for law enforcement. Asking a victim to pay for it in any way, including via insurance is absurd. It's like asking a homeowner to pay for the fingerprint analysis on a stolen Ming Vase. Or how about the family's medical insurance having to pay for an autopsy when junior gets shot?

Ironically, Joe Biden wrote the law that Palin's town was breaking.

You aren't familiar with Alaska, are you? Alaska is a politically conservative state. We've gone Republican on every Presidential election since the 1960s. Republicans outnumber Democrats 3:1 and the third party is the very conservative Alaska Indepedence Party, with about 10 percent of the population. The best opportunity the Democrats had to win the Governor's office back was when Murkowski set himself up as a king -- private jets, deals with oil companies that cut out the Alaskan people from gaining from our natural gas, appointing his daughter to fill his own vacated Senate seat -- Alaskans were really mad at a man who had been a Republican icon in our state. But, Tony Knowles, former Dem governor, ran against Lisa Murkowski for that Senate seat and LOST. It's not that Alaskans were all that enamored with her, but we remember Tony and nobody wants him back. In that same election, Sarah first defeated Frank Murkowski in the primary and then defeated the Dem challenger in the general. Dems can't win in this state above the district level without playing tricks, so Tony and some of his cronies are playing dirty, banking that the every-flowing population of Alaska will change enough by the end of Sarah's first term (or if she becomes the VP) that they won't be remembered for their own records. Tony has a lot to answer for with the Alaskan people. If he'd done what he did to us at the federal level, it would be called TREASON.

Meanwhile, Sarah has had a above 80% approval rating the whole time she's been governor, in a state filled with cantankerous, independent-minded, well-educated hard-heads who like to stick their nose into the governor's business. Executives DO set policy. Do you not understand the difference between laws (set by a legislative body) and regulations (promulgated by the legislative branch)? It is a bit absurd to think that every single policy decision has to be made by the City Council.

Yes, a mayor has to act within the limits set by the City Council. But they often have wide latitude. Clearly, she was able to hire and fire at will without approval of the city council.

Also, she was able to set the agenda for the City Council. Why didn't she ask them to change this policy?

Mayors and governors and presidents can submit requests for legislation from town councils and state and federal legislatures, but they do not make laws themselves.

Governors can fire people that they hire. They cannot make up laws like forcing anyone to give birth to a child with disabilities. Governors can decree state emergencies, but they are unlikely to impinge on abortion. Most state emergencies deal with weather and mass accidents. Administrative law, the catergory the covers executive actions, is very limited and rarely used.

Amyone who thinks a mayor can just create the law like a magician produces rabbits out of hats shouldn't be posting anywhere. They merely look birdbrained.

Two aspects of the biblical view:

1) the old testament is generally seen as being superceded or fulfilled in the new testament.

2) the part of the Bible you are quoting is the old Jewish law, which provides guidelines for the punishment of transgressions falling into several categories.

I'm sure you know that at the time of the old testament, women were considered property, first of the father, then of the husband. An unmarriable daughter would be considered an encumbrance similar to a lame or injured ox. Therefore a rapist would have effectively 'stolen' from the father and would now be finacially responsible to the father for the women he had raped. That is why he (the rapist) was required to marry the rape victim. It was not given as a punishment to the woman (she would already be 'damaged goods'); rather it is restitution to the father, the "owner" of the girl.

Finally, most Christians do not recognize ANY of the punishments given in the OT, but the principles are still avalid: rape is wrong. Of course today, women are no longer the property of men, so they rightly are believed to be the victim in the case of rape. Many sins/crimes/transgressions listed in the OT are still recognized as such today, but we do not apply the punishments as supplied. We have a modern court system and rule of law to assume that role today. And certainly you've heard that the focus of the NT is forgiveness.

Every state I know of has a similar set-up. Regulations on a city level are not always encoded, but a mayor quite definitely has latitude.

Palin rally in Fairbanks last night
She spoke in the Alaska Aerofuel hanger after departing from the McCain-Palin private jet. She seemed a little embarrassed by that, but the crowd of 3000 cheered when she reminded us that she sold the Governor's jet. She deviated here and there from the basic speech she's been giving since the convention -- after all, she was on home turf. We were all crowded in the hanger, so she kept things brief. A friend who is very claustrophobic stayed outside and listened on a walkie we brought and he said he saw about a two dozen people standing outside waving OBAMA signs and other signs with derogatory comments directed toward Palin. Most of that crowd were children, probably "encouraged" by their parents to perform this duty.

After the speech, Sarah and Todd walked through the crowd and I do mean, they were in the crowd. No receiving line there. We weren't close enough to engage her, but I'm told she was answering questions briefly as people (not reporters) were asking them. Alaskans prefer their politics up close and personal, so reporters were there, but I think they got elbowed out of being close enough to ask her questions.The person who reported this to me said they weren't really indepth questions, but he found the answers to be acceptable given the crowded circumstances.

Right from the beginning States set up thier goverments to mirror the Federalist Goverment. States had rights, but they could not appoint Kings, forgo Due Process, or enact artistocracies, or have one person be executor, legislator, or judge. Sheesh, you really do need to brush up on civics. Cities fall under state jurisdiction; thereofore, city and county goverments had to follow suit.

BTW, crafting a regulation is not the same as budgeting. The legislator writes the laws that make it legal for the State to regulate. Only the legislator can control the purse strings.

Why don't you sum up for all of us just how any of this legislation has benefited working class America. Tell me how this relates to his policies and the plan he has to make America safer, more independent, and more economically sound.

You see, I work hard for my money, and as a rule I try to be as charitable as I can. Obama thinks that I should be even more charitable or as he puts it "neighborly" and give up more for the "unfortunate" guy who through no fault of his own has been forced into welfare, at gunpoint one would assume, because as we all know it was just lucky for me that I was born with a desire to work hard and make myself as successful as I want to be.

I do not believe in socialism, nor do I want government to make the decisions that affect my daily life. Obama does not bring change. He brings the same stale ideas of Lyndon Johnson and Jimmy Carter.

I believe everyone in this country has and should have the opportunity to become whatever they want to become, and though you liberals seem to think you corner the market on equality, you attack a successful woman because she is not part of your world. The same thing you tried to do to Clarence Thomas.

When you preach about the civil rights movement and woman's lib you sound wonderful...when you actually have to put into practice though...not so much.

IT WASN'T A LAW. There was no bill from the City Council saying this is how the police department should do it's business. It was a decision made by the police chief. Palin was his boss.

What is it you think Mayor's do if they are utterly unable to change or even influence policy?

Obama is entirely responsible for what happens to his bills, which 99 other people must vote on.

Yet Sarah Palin, as cheif executive of her town, isn't responsible for ANYTHING that happened in the town. Not the policy victimizing women who have been raped, not the $27 million in earmarks, not the $21 million in debt she left the town with, not the ice rink debacle (interesting that Palin thinks the taxpayers should pay millions for an ice rink, but not $5-14,000 a year to investigate rapes).

In Illinois, Senate he voted AGAINST the Born Alive Act in 2004, which would of given babies that survived abortion, medical treatment and rights.Instead he prefers babies born alive as a result of an abortion, to be LEFT to die. Note that same exact bill passed US Senate in 2003 98-0. So that should tell you how extreme LEFT he really is. And by the way in Illinois, he voted PRESENT over 150 times, and the only education bill he passed was to teach sex education in grade school. What an ACCOMPLISHMENT! He also voted against a law that would of given child predators mandatory 25 years.

Thanks for that addition about Committees; good point.

By and large, in many instances you're right; most of those are still live bills. It's not uncommon for hundreds, even thousands of bills, to get squandered by the wayside, but even more common for Congress to just take a really long time to get anything done.

So I wouldn't necessarily say that his bills are dead in the water, perhaps just treading in the meanwhile.

I wish I did have time to type up the substantive issues on how Obama would attack ethics reform in Congress; it's really cool.

Don't get me wrong; no politician is picture perfect. He signed on for retro-active immunity for Telcoms and signed on for the illegal wiretapping program. That to me, even as a compromise, crosses a line in the sand.

But on the vast majority of substantive issues important to middle class America, the guy's right on the money.

Sarah has been clearing up corruption that was put in place by the Tony Knowles administration and the Frank Murkowski administration.

My husband grew up back East, often in NY, and he tells me that you folks there are hardly aware of who you politicians are and have rarely ever met them outside of a political rally. I also note that NY is an extremely LIBERAL state, having (it would seem) about 90% Dem representatives.

One of my best friends is shares a room with Todd Palin at BP. He's been a guest in their Wasilla home. Another friend lives about four doors down from them. Some others played against her in the much-cited State basketball championship. I've met Sarah twice myself -- once in a setting having nothing to do with politics when she would have been mayor of Wasilla. She told me she worked for the City of Wasilla in administration. I only learned later that she was the mayor. So, Alaskans KNOW their politicians in a way NYers do not and probably usually cannot. So, please stop trying to correct me from 4,000 miles away when you don't have a clue of what you're talking about.
