Obama, Hillary, Dems Take FISA Trial Lawyer Cash

As Congress debates giving immunity to phone companies that assisted the government in tracking terrorist communications, trial lawyers prosecuting those phone companies have poured money into the coffers of Democratic senators, representatives and causes.

Court records and campaign contribution data reveal that 66 trial lawyers representing plaintiffs in lawsuits against these phone companies donated at least $1.5 million to Democrats, including 44 current Democratic senators.

All of the trial lawyers combined only contributed $4,250 to Republicans in comparison. Those contributions were made to: Sen. John Cornyn (Tex.), Rep. Tom Davis (Va.), Sen. Lindsay Graham (S.C.), Sen. Mel Martinez, and Sen. Arlen Specter (Pa.).

One maxed-out lawyer donor, Matthew Bergman of Vashon, Washington, has given more than $400,000 in his name to Democrats. In the 2008 cycle alone he donated $78,300 to various campaigns.

Bergman’s law firm’s website says he also specializes in “identifying viable asbestos defendants, locating evidence and developing legal theories to hold offending companies accountable.” In 2004, his firm split a $4.3 billion payout from Halliburton with seven other law firms. $30 million of that was delivered to their firm's asbestos victim clients.

Another lawyer prosecuting the phone companies is Mikal Watts of Corpus Christi, Texas, who has given more than $200,000 to Democrats. Watts has prosecuted Ford Motors over defective tires and attempted to run against Republican Sen. John Cornyn (Tex.) for the Senate.

Since the New York Times broke a story in late 2005 that found the Bush administration had engaged in surveillance activities with cooperation from phone companies like Verizon, AT&T, and BellSouth, a debate has erupted, largely on party lines, over whether or not to protect those companies from prosecution under the Foreign Intelligence Surveillance Activities Act.

President Bush has aggressively called on Congress to do so, and Homeland Security Secretary Michael Chertoff has testified that FISA “is the radar we have for the 21st century to detect attacks before they happen.”

On Wednesday, the Senate held a critical vote on an amendment to the FISA reauthorization that would grant this immunity. It passed, but 29 Democratic senators voted against it. 24 of them have accepted campaign contributions from trial lawyers who are suing the government over those activities.

Two of them are running for President.

Sen. Barack Obama (D.-Ill.), who is in the running for the Democratic nomination, was given $28,650 from trial lawyers listed as counsel for plaintiffs who are suing those companies becuase they turned over phone records as a part of President Bush’s covert phone surveillance program. $19,150 of that was donated in the last year.

Sen. Hillary Clinton (D.-N.Y), the other main contender for the Democratic presidential bid, also accepted money from trial lawyers on the case. Records show those lawyers have poured $34,800 to her and her husband’s campaigns over the years. $12,150 of those donations were made to her within the last year.

The other 22 senators who opposed the amendment and have taken similar donations are: Joe Biden (Del.), Barbara Boxer (Calif.), Maria Cantwell (Wash.), Ben Cardin (M.D.), Chris Dodd (Conn.), Byron Dorgan (N.D.), Dick Durbin (Ill.), Russ Feingold (Wisc.), Teddy Kennedy (Mass.), John Kerry (Mass.), Amy Klobuchar (Minn.), Frank Lautenberg (N.J.), Patrick Leahy (Vt.), Carl Levin (Mich.) Robert Menendez (N.J.), Patty Murray (Wash.), Jack Reed (R.I.), Harry Reid (Nev.) Charles Schumer (N.Y.), Debbie Stabenow (Mich.), Jon Tester (Mont.) and Ron Wyden (Ore.).

Clinton did not vote Tuesday because she was campaigning. She has, however, voted against granting telephone companies immunity and other FISA reforms in the past.

Since 1997, Senate Majority Leader Sen. Harry Reid (D.-Nev.) accepted donations from three lawyers working the FISA case that amount to $10,000. The No.2 Democrat in the Senate, Dick Durbin, who is charged with whipping votes, has accepted $18,350 from 1996 through 2007 from lawyers listed as counsel against phone companies.

Now that FISA has been reauthorized in the Senate, the bill was sent over to the House where an effort to strip the immunity provision is expected. House Republicans are pressuring House Democrats to pass the Senate version of the bill quickly, as it is scheduled to expire on Saturday.

Records show that House Speaker Nancy Pelosi (D.-Calif.) accepted $3,750 in donations to her campaigns and PACs from these lawyers from 1996-2001.

It's mind boggling to realize that these criminal trial lawyers can get away with bribing our scum bag legislators to the point of endangering our nation to terrorist attacks. All of these sorry snakes should be charged with treason.

The surveillance cooperation provided by the telecoms has been working to protect Americans; the phone companies must continue to be granted the immunity they deserve! An additional point.. who do you think those law suit expenses will be passed along to, if not us, the customer..
The fact that B Hussein Obama, former loyya, came back for this reprehensible vote, speaks volumes regarding the type of Commander-in Chief this fringe-radical would be.

Lawyers use the courts to loot companies and while they rake in millions those they represent get pennies and still allows the legal thievery to go on. Oblahma and clinton are both lawyers, receive campaign cash and always vote to favor the rights of lawyers to sue and get rich

Lawyers' contributions
There's nothing wrong with plaintiffs' lawyers making legal contributions to the campaigns of legislators whose policy preferences they prefer. All Americans have the right to do so. Legal, properly disclosed contributions are not "bribes."

I am a lawyer, generally on the civil defense side. I've been an opponent, in litigation, of one of the plaintiffs' lawyers mentioned in Ms. Carpenter's article. I am a conservative Republican, generally opposing litigation-spawning legislation and favoring the FISA immunity provisions that are being opposed by the legislators and plaintiffs' lawyers mentioned in the article.

Not all lawyers are bad. Current examples are Republican Senate leaders Mitch McConnell and Jon Kyl, not to mention Justices Roberts, Scalia, Thomas and Alito. Historical examples include Presidents Adams, Jefferson, Madison, Jackson and Lincoln.

The problem is not lawyers and not campaign contributions. The problem is that voters keep putting Democrats into office.

First, let me say that I am a republican, not a "LIB." That being said, as Americans, you should be opposed not only to warrantless wiretapping, but to giving telecom companies (who knowingly violated federal statutes) immunity.

As to the FISA bill itself, and the warrantless wiretapping. Allowing the government to tap phone lines without having to get a warrant does not make us safer or help prevent terrorist attacks. If you bothered to actually read the current version of the statute, you would see that in order to get a FISA warrant, the government need only have probable cause (i.e., that it is more likely than not) that the person being targeted is a foreign national. That’s it. They do not need probable cause that the person may be “up to no good,” or “engaged in criminal activity,” but merely that he is a foreigner. Allowing the federal government to have unchecked power to tap phone lines without any oversight from the judiciary is crossing a very dangerous line, and as Americans you should be appalled.

Second, telecom immunity. The telecom companies have an army of very smart and well-trained lawyers. The telecom companies knowingly violated federal statutes. They did not violate these laws to “keep Americans safe” or “protect us from terrorism.” How do I know? Because they stopped giving the government the phone records when the government stopped paying them.

Third, being opposed to telecom immunity has nothing to do with democrats accepting campaign money from trial lawyers. The potential benefit that trial lawyers would receive from the lawsuits filed against telecoms is so far removed from the debate about telecom immunity that the charge the author of this column makes is laughable. Democrats oppose telecom immunity because they believe in the bedrock principle that this country was founded on-- the rule of law (i.e., the law applies equally to everyone).

And how about AT&T et al.
Now look at the money donated by the phone companies that could be sued...all I check was Barack Obama and he receives for more from AT&T alone than the "$28,650 from trial lawyers listed as counsel for plaintiffs". I'm sure if I checked, we'd find likewise to the other congressmen you mentioned. Keep digging Amanda! One of these days you might find something.

FISA
Rest comfortably in your homes tonight. There will come a time in the future when you may be able to recall when elected traitors in Congress were ramping up the newest version of FISA (foreign intelligence surveillance act). It protects big telecom from lawsuits when the bill of rights was suspended after 9/11. Notice that the new law protects money, not people.

The average German citizen was horrified when the Reichstag burned down in February of 1933. Under the ruse that communists burned it down, the Nazi party was the true arsonist. This pivotal moment in history led directly to establishment of Adolf Hitler's dictatorship and the murder of millions. By that time, it was too late to stop the Third Reich.

What was the latest budget... how many trillion? Of that budget, over 60% is spent on defense... a staggering amount considering it is more money than all other nations in the world spend on defense combined. One could make the case we are not getting our money's worth. What price glory?
I would well heed what the likely last great Republican President, Eisenhower said. I would venture to say that half of the defense spending, 30% of how many trillion $$, is wasted lining the pockets of the Iron Triangle making us less safe, and less free.
Security measures are infringing on our liberty. Cooperation between multinational corporations, helped by the revolving door of Government service in the legislative branch, other elected and appointed officials or through politically connected military personal have corrupted the system. The idea of endless war only benefits those who see the endless profits.
The money needs to be taken out of politics.

The lead counsel in the telecom suits is the Electronic Frontier Foundation, a donor-funded, non-profit organization. This is the group that represents AT&T whistleblower Mark Klein who attached all of AT&T’s circuits — carrying every phone call, every e-mail, every bit of web browsing by millions of Americans into Room Number 641-A in San Francisco, so the government could look at it, illegally.

The lawyers behind these lawsuits are American citizens who are making great financial sacrifices in order to defend the Constitutional rights.

But because people like Cheney, Rich Lowry and their political comrades are incapable of believing in political principles separate from their economic self-interest (Cheney - king war-profiteer). They apparently assume that everyone is driven by the same corrupt motives that plague them: filling their coffers.

Bush has put protecting the telecom giants from the laws ahead of protecting us from the terrorists. Why? Ask yourself this - why did the Bush Administration refuse to honor a Freedom of Information request to disclose documents revealing its lobbying ties with telecoms? Why did it require a court order to force Bush to reveal this information? Answer: immunity as payback - bought and paid for by Verizon and AT&T. He knows very well he broke the law.

Bush’s new Attorney General, Mr. Mukasey has a very personal stake in this. There happens to be a partner in the law firm of Bracewell and Giuliani, named Marc Mukasey. The Attorney General’s son Marc, just happens in the law firm that represents … VERIZON !!! Is the picture beginning to look a little clearer now?

Trial Lawyers
I love how the left always talks about special interest group, big companies, big oil, but has nothing to say about big lawyers. These class action lawsuits net lawyer millions of dollars John Edwards notable recipient. You get in the mail join our class action lawsuit against so and so and get $25 back. How much do the lawyers get 33% to spit between 2, 3, 4 lawyers as opposed to 1000000 plaintiffs. I don't know but someone other than the plaintiffs get the money. I remember in the '80s when there were too many lawyers coming out of college something had to be done. wallah class action lawsuits, money in the bank. Too bad we drove doctors out of business that's not our fault we are fighten for the little guy.

Wait a minute, I heard Obama say
he was going to put a stop to the special interests in Washington, so this must be a phony rumor. Sen. Obama is all about change, he's not going to do the same things every other corrupt politican is doing.

I get it, the vast right wing conspiracy has abandoned Hillary and set their sights on the new champion of the people. That's it! They are against change and they want the big telecoms to make millions. The poor trial lawyers are only working with those defenders of the people, the Democrats, to save us from illegal wiretapping.

Therefore, Obama just had to take that money. Raising a million dollars a day is hard work, and besides, it's for a good cause, electing Obama.

Obama has introduced a bill in Congress that would tax 7/10 of a percent of our GDP and turn it over to the UN to fight poverty world-wide. Over ten years it amounts to almost a trillion dollars. We all know where that money will end up, to wit. the Oil for Food scandal.


Clinton closed files
Hillary jumped on her bandwagon yesterday saying corporate campaign funds should be limited. Why then does Bill say they will release her donation and tax records only after she has been elected president. Five hundred million dollars has been contributed to his foundation alone. I think the American people have the right to know who or more importantly what countries are buying the presidency.

Too dumb to know what is being taken
Of course, authoritarians will either remain blindly ignorant of this issue, or blindly support this abuse of power and these Constitutional violations out of ignorance and fear. Bush uses the same tactic as the terrorists to try and implement an agenda - fear.

Most conservative Bush supporters are just too dumb or ignorant to know what is being taken from them - their Constitutional rights.

This FISA bill - the "Protect America Act" - should be called: "Protect Bush's Illegal Activities and his Telecom Accomplices Act." It's about one thing: immunity from the law and from the Constitution. He knows very well he broke the law and is trying to protect his arse and not reveal his motivations for doing so. It has little to with protecting America, it's all about absolving him from a crime, one of many Constitutional violations that warrant immediate impeachment.

Immunity more important than the law
Wingnuts have the balls to suggest this desire to sue telecoms is a Democrat conspiracy fueled by lawyer funding. Well then, consider the lead plaintiffs’ counsel in the telecom suits is the Electronic Frontier Foundation, a donor-funded, NON-profit organization. If they were motivated by profit, pursuing these extremely time consuming lawsuits would be the last thing they would be doing.

It’s not about suing the telecoms into bankruptcy, either — it’s about having the sword of justice hanging over them so they will reveal how deep the rabbit hole goes — which journalists, legislators, activists, et al, were considered “terrorism suspects by this crooked, lawbreaking administration. I remember when wingers shouted “Rule of Law!” when a guy lied about sex.

Dimocrats believe in the rule of law? That outrageous assertion is EVEN MORE laughable.

There are far too many examples to even begin to illustrate, starting with legislative rule-bending by the Party of NO to thwart even the most basic of processes.

Selective belief in the 'rule of law', at best.

Halliburton, Halliburton, Bush, Bush, FISA, FISA, Iraq, Iraq...will the obsessive drum beat ever stop?

Some things are not meant to be known by average citizens. Or the media.

If one can be prosecuted for merely mentioning the name of a spy who really isn't, then a turncoat in intelligence who reveals how and when what tools are being used, and by whom, such leakers should be prosecuted for treason.
