Senate Earmark Reforms Quietly Gutted

A three-word rule change quietly made to Congress’s newly-enacted lobby reform package was recently discovered that significantly reduces disclosure requirements for the earmarks each senator requests.

The new ethics bill, which was signed into law in September, purported to require members of both the House and Senate to make public a signed letter that included the name and address of the intended recipient, or location of any requested earmark.

The final bill, however, contained an exception for members of the Senate. Instead, senators who request earmarks are only required to make public a letter that verifies he or she has “no pecuniary interest” their request.

Steve Ellis, vice president of Taxpayers for Common Sense, said he caught the change when he met opposition from Senate Appropriation staff when he tried to obtain the public letters with the earmark information—they weren’t there. Instead, there were only “no pecuniary interest” letters on file. When he protested, he was told the law was being followed.

“So, there was a discrepancy between what the Appropriations committee was saying and what was supposed to be done,” Ellis said in a phone interview. This is what prompted Ellis to investigate.

Ellis later found that the law had been followed, but it wasn’t the law that had been touted to promote transparency in the earmarking process.

The only thing a senator is now required by law to do is to verify he or she has no financial interest in the earmarks he or she seeks. Ellis sarcastically called this an “I’m not a crook” statement.

Upon making this finding, Ellis published a detailed explanation of the rule change on his website on September 25.

Bill Allison, senior fellow of the Sunlight Foundation, said the change was a “disappointment that no one knew about until the last minute.” His organization utilizes the Internet to make government more transparent and has worked with Taxpayers for Common Sense to publish all earmarks in a free online, searchable database at www.Earmarkwatch.org.

Originally, when House and Senate versions of the bill passed from their separate chambers, both contained identical language regarding earmark reform. During negotiations between the House and Senate to work out differences between their bills-- called a “conference report”—a change was made to the Senate disclosure requirements.

“It was such a subtle change with huge ramifications. Just a couple words,” Ellis said. The conference process for this bill was not done in public view. This was largely because earmark-reform champions Republican Sens. Tom Coburn (Okla.) and Jim DeMint (S.C.) refused to participate due to suspicions that their reforms would be gutted.

As a result, differences were worked out and new rules were inserted in a back and forth negotiation process between the House and Senate that staffers call “ping-ponging.” Then the final version was signed by the President on September 14.

A senior Republican staffer said those primarily involved in the negotiations were Democratic Majority Leader Harry Reid (Nev.), House Speaker Rep. Nancy Pelosi (Calif.), Sen. Russ Feingold (D-Wisc.), Sen. Dianne Feinstein (D-Calif.) and other members of the Senate Rules Committee.

DeMint’s press secretary Wesley Denton laid the blame on both parties for letting this change slip by. “Democrats and Republicans alike want to give the appearance of earmark reform, but they don’t want to live by it.”

Senators have even been resistant to submitting the “no pecuniary interest” letters. On October 1, Chairman of the Armed Services Committee Sen. Carl Levin (D-Mich.) and Sen. John McCain (R-Ariz.) issued a joint letter to remind their colleagues there were “certifications” missing for earmark requests made in the defense authorization bill. The original deadline to turn the “no pecuniary interest” statements was September 14. It was extended to October 5.

Coburn’s spokesmen Jon Hart noted the change would also give House members a way to hide their earmarks. It “essentially creates a secret chamber for earmarking,” Hart said. “All the questionable earmarks now can easily be shuttled from the House to the Senate” to escape disclosure requirements.

“You might as well call it the Abramoff Corridor,” Hart joked.

There is a difference -
Dogjudge - there is a difference between Conservatives (Note I did NOT say republicans) and Democrats/Progressives/Liberals/Socialists (all the same). Conservatives marginalize, shun, discipline and ultimately dismiss members who break the law. Or they themselves resign - remember Richard Nixon?? DPLS's get promoted to leadership positions. Tell me, which conservative in the Senate should be guilty of manslaughter (at least?) hmmmmmm? Stevens is a bum - but he is not NEARLY as bad as Murtha (remember Abscam?). Craig is a bum too - but what about Jefferson? The cold cash crook? Don't compare jaywalking to carjacking - they aren't the same things. There is an entire BOOK about how these bums are universe-class hypocrites, and most of the ones who hold on to the positions have "D"s next to their names.
Hell, somebody want to refresh my memory about which crime Tom Delay was convicted of? Oh, that's right - there IS no conviction and the prosecuter all of a sudden is delaying all proceedings. A little different than a politician being credibly accused of rape and then obstructing justice.
For someone with a "judge" in the supposed name you do not show much "judgement".

You are exactly correct. It think that stomachs are still too full for a revolution. We have the odd combination of those happily government dependent and those working too hard to have time to fight back.

I think the revolution should begin with those who work and produce to collectively stop for a period of time in order to remind the parasites where the picnic comes from. Despite being a government employee, I would happily welcome a movement that derails the socialist direction we are moving in now.

Soon, our only option will be a revolution of the sort Thomas Jefferson spoke of: "The spirit of resistance to government is so valuable on certain occasions, that I wish it to be always kept alive. It will often be exercised when wrong, but better so than not to be exercised at all. I like a little rebellion now and then. It is like a storm in the atmosphere."

Much Like Their Resolutions of Late
The house has been more of one-sided party funded political research propaganda arm than what it is supposed to be, a LEGISLATIVE BODY.

Resolutions condeming political ads, 100 year wars and talk show hosts are typical in today's House day to day business agenda. Why is it not surprising to find that we just found their escape tunnel on their language about earmarks changed in the wee hours of the final printing of the legislation???!!!

Even Ms. Carpenter attributes the change in this legislation to factors from BOTH parties changing the legislation.

Then you get the typical dead heads here who put all of the blame on the Democrats. The corrupt Democrats, etc.

Until you partisan nitwits WAKE UP and admit that it is coming from both sides of the aisle, you are going to continue to be manipulated by the Republicans who tell you that they're going to cut the budget and then pass one, earmarked, piece of legislation after another. Yeah. There are bad Democrats. Now you want to tell me about Ted Stevens? Loses his bride to nowhere and tries to replace it with a ferry to nowhere.

This just proves
that both sides are in it together. The whole lot of them. It's just another example of the corrupt two party system in this country. Guys like Coburn, Demint, Campbell, and Flake continually are shouted down and their counterparts just figure out new and improved ways to steal our money. I can't believe the above mentioned haven't just quit!

Ms. Peolsi has tried to get out ahead of the abysmal approval ratings of congress by saying "it's because we haven't ended the war". What spin! What hogwash!
No dear, it's because you haven't done anything except squeal about the war, when there was plenty else to be done. Instead, passing meaningless resolutions and calling for meaningless investigations of non-crimes.
Leave the war alone, and do something meaningful legislatively. It would take real courage to fix the earmark problem. Not gonna happen.

Im still waiting to see my 100 day programmm kick in. They (DEMS) are no better than the REPS when it comes to spending. Just think we voted the REPS out for too much spending to elect their BUDDIES(DEMS) who are no better than the REST. I bet this want fly this election. I Quote, We are going to clean out the swamp, the only problem is they filled it back up with more SCUM than was there before. So you say we can trust the DIMBOCRAPS to take care of business LOL. Just wait until they want to raise your taxes to cover-up their plight. The more money the more they spend, so dont give me this crap about LIBS cleaning up any messes because they are in deeper than the REPS were.

EARMARKS AND TRUST

As I've said before, if Tom Coburn were running for President, I would vote for him in a heartbeat.

As a conservative, it is difficult to watch the shenanigans on C-SPAN and C-SPAN-2 without a dangerous rise in blood pressure.

They believe we're dumber than a pile of rocks. If we keep letting them get away with this stuff, we are.

But boehner who has been telling us he supports real change but still allowed jerry lewis, the repub in the house with the most egregious record for pork to retain his seniority position on some committee. So much for boehner's word on this issue. But perhaps boehner was afraid that lewis would let out that famous aaaaahhhh that his namesake made noteworthy
