Will the Dems' health care Christmas Present to America be an improvement or detriment to our health care system?


The Democratic chairman of the Senate Judiciary Committee thought the Caucasian judge Leslie Southwick was suitable to sit on a Mississippi’s district court, but he’d prefer a black man for the higher ranking 5th Circuit Court of Appeals.

Chairman Sen. Patrick Leahy (D.-Vt.) is opposing Southwick for the 5th Circuit post in favor of a black man, Honorable Henry Wingate, because Mississippi has never had a black judge on the circuit court. In a May committee hearing, Leahy said the Bush Administration “continues to renege on a reported commitment to appoint an African-American to the Mississippi federal bench.”

He added, “In six years, President Bush has nominated only 19 African-American judges to the federal bench, compared to 53 African-American judges appointed by President Clinton in his first six years in office.”

Southwick is Bush’s third nomination to fill the Mississippi vacancy. Democrats opposed the first two judges he nominated, Judge Charles Pickering and a lawyer, Mike Wallace, on charges of “racial insensitivity.” To temporarily fill the post amid Democratic objections, Pickering was given a one-year appointment, but now the seat is vacant.

Before he was appointed to fill the 5th Circuit vacancy in June 2006, Southwick was unanimously approved by the Judiciary Committee for a district court judgeship. A September 20, 2006 Gannet news report about Southwick’s confirmation hearing for the U.S. District Court for the Southern District of Mississippi was titled “Judicial Candidate Enjoys Easy Going in Senate Hearing” because Republican senator Sam Brownback (Kans.) was the only one who even attended.

On September 26, the full Judiciary Committee passed on his nomination for a full Senate floor vote. Unfortunately for Southwick, no floor vote was scheduled before the end of the 109th Congress; his nomination was terminated and the Democrats regained control of Congress.

In the months that have passed, civil rights groups like the Alliance for Justice have combed through the more than 8,000 decisions Southwick has signed and the 850 opinions he authored in his career on the bench.

There are two opinions Southwick has signed, but did not author, that civil rights groups find objectionable. In one of the decisions, Southwick agreed that the use of a racial slur is not grounds for firing a state employee although slurs are “always offensive” and “inherently derogatory.” The other decision granted child custody to a heterosexual father instead of a child’s bisexual mother. Both opinions were available before the Judiciary Committee vote.

Senate Minority Leader Mitch McConnell (R.-Ky.) dismissed the importance of those cases on the floor Thursday.

“The only material change in Judge Southwick’s qualifications between last fall and now is the rating of the American Bar Association--The Democrats' gold standard for a judicial nominee,” McConnell said. “The ABA has actually increased its rating of Judge Southwick.”

Tony Perkins, president of the conservative Family Research Council, said in a Thursday news conference to rally support for Southwick that the nominating process reminded him of the children’s game “Mad Libs."

“The opposition, when a nominee [they dislike] gets sent up, they just fill in the blanks,” Perkins said. “If they want to stop somebody, they just throw out the word ‘homophobe’ or ‘racist.’”

After civil rights groups publicized the two opinions that they claim prove Southwick unfit for the job, black Democratic presidential contender Sen. Barack Obama (D.-Ill.) said he would oppose Southwick.p> Sen. Dick Durbin (D.-Ill.) is claiming he didn’t have enough information about Southwick at the time he supported him in the initial vote. Durbin went to the Senate floor Wednesday morning and said that he “came to the Southwick nomination with no advanced knowledge of the man or anything he had done.”

Judiciary member Jeff Sessions (R.-Ala.) said, “It appears--and I’m not going to go into all the details--[Democrats] want to kill this nomination in committee. They only have a slight one vote majority in the Senate.”

The Democrats on the committee also have a slim, one seat advantage over the Republicans.

“This is a really heavy-handed power play, there’s no doubt,” Sessions said.

Leahy has said he will call for a full committee vote on Southwick as soon as Mississippi Republican senators Thad Cochran and Trent Lott indicate they would like one. Republicans have made requests in recent weeks to vote to allow more time to increase other senators’ support of Southwick.

Judge Southwick is a white male from Mississippi. Ergo, he is a racist in the minds of the left-wing senators and their puppet masters.

Mr. Leahy will have to eat crow when opposing her for the nomination. Durbin will waffle and then read the political tea leaves to face he is in the untenable position of denying a black woman to be a Supreme Court Judge. It will be a delicious moment in history. There is nothing like hypocrisy to get the juices stirring.

What Bush Should Tell Leahy
is that you find me a Clarence Thomas sort of guy and I will appoint him. Otherwise, you deal with the appointments I have given you. An up or down vote, not hiding them in committee, and not tying them up with a filibuster. These will be the same rules you give the new President when you and he are all Democrats, so I want them now. Now, DELIVER!!

Senator Leaky seems to suggest that Billy Jeff got it right and in any six year period the president should appoint 53 black federal judges.

Assuming Billy Jeff got it right he appointed 2.6 times as many blacks and has Dubya. Since these appointments are usually made of people of the same party as the president let's look at that. Blacks vote 9-1 democratic. On that basis Dubya should have appointed only 6 blacks federal judges or assuming Dubya got it right Billy Jeff should have appointed 171 black federal judges.

As usual, Leaky wants it both ways.

All of this is nothing
more than foot dragging to delay any appointments until after the 08 election. They are praying for a Demoncrap win in 08. If that happens there will be an immediate flurry of judicial appointments and at least two SC justices will officially retire.

I at least expected them to spend some of their time trying to implement their socialist agenda rather than just pontificate on social issues and call for investigations. Any Excuse
Leahy et al will dig up any excuse to oppose any conservative who GWB nominates to the bench. Remember Bork & Thomas, a pair of highly qualified jurists who the left turned into poster children for the politics of personal destruction. Pay careful attention to the objections to these nominees and you will find nothing other than the same old tired ad hominem attacks. But when Reps voice even mild trepidation over a Dem nomination, they are excoriated as racist, bigot, homophobic, closed minded, hateful idiot.

Federal jurists
Federal jurists have no Constitutional qualification hurddles to surmount; they have always gained their officies through political appointment; therefore, it makes sense for the party which holds the nominating power over Federal jurists to nominate individuals whom it is believed will "tow their politcal line of thought". Blacks, as a population, have been consistently around 90% Democrats, so to say that a Dem Pres nominated more Blacks to the Federal bench only makes sense, but to say that a Federal position must be "reserved" for a Black nominee is ludicrous and smacks of racial discrimination of another sort!
the Us Senate Dems are screaming now about every 61 vote requirement to pass legislation, but they were warned that this tactic of theirs would come back to haunt them when they regained the majority in that body! payback is HELL, Harry!

Is this the same group that fought the nomination of Clarence Thomas back then, or the campaign of Michael Steele?

Is the nomination to judge about qualifications, character or about color of their skin?


Liberal Tactics
The liberals know something; they have control of the judiciary since all the Clinton judges passed, and they have been blocking judges as if they were a junta.

The junta's increasing power grab has shown they are willing to wait for a new liberal President to give them ultimate free passes to pack the courts so they will have control of the judiciary for life.

When a group has controlled the judiciary for over 75 years, they don't want to give up any control, and they are showing what they want. These are the same people who put quotas and establish standards that would move the nation's capital to Bruxelles (Belgique) by declaring laws of this nation are overturned by precedents, feelings, and thoughts of foreign countries.
