I was the first pundit in America that told you Barack Obama would be President. I predicted Trump wouldn't fire Carrie Prejean. And I told you Adam Lambert would not be the American Idol...

This one I'm not nearly as sure about...

I did tell you that I felt the California Supreme Court would likely take up the measure of the "constitutionality" of a Constitutional Amendment. (Something they have no authority to do.) I also have said repeatedly that if they did, expect them to rule against the people of California. (Especially when their own representation in Jerry Brown sides against them as well...)

Everyone remembers the feces throwing monkeys that were hitting little old ladies going to church last fall, simply because the radical activists wanted to change the definition of marriage that has stood since the beginning of time. Even when the people of California overwhelmingly TWICE voted for the definition of marriage to remain what it had always been, the tree-dwelling bottom feeders couldn't resist in heaving poo at people who didn't agree with them.

Lovely people you've got representing your side Perez.

As the news spread today that the Supreme Court will announce its decision on the "constitutionality" of a piece of the Constitution, large groups of the poo-flingers are gathering critical mass to, as one hyperventilating, gender confused, blogger who despises his own Hispanic heritage put it, the radicals will "rally all over the country, regardless of the outcome!"

Meaning, if they lose look for mob action and lots of flying poo.

These are the least rational, most hyperbolic, overly emotional, drama queens in history.

But the people of America need to understand what the court will be saying in ruling on such a matter. For in fact it doesn't matter nearly as much which way the ruling turns out on Tuesday, as it does that the court decided it had a say in the matter to begin with.

The Constitution of a nation, company, or church is a sacred document. In our nation nothing is allowed to infringe upon the words--particularly direct words--that state specific ideas, concepts, or legal principles.

The Constitution trumps the courts, the legislature, and the executive.

But not now, at least not in California...

The California Supreme Court has now placed itself, not under the direction of the state constitution, but in sovereignty above it. The California Supreme Court in doing so is willing to literally shred the only authority that the people of California ultimately are sworn to obey.

So today the Court believes it has the right to override one part of the Constitution, next week they could believe they have the right to override all of it. And the precedent would already be in place to give themselves permission too.

The Constitutional process for the people of California to adjust their own Constitution is arduous. There are specific thresholds that have to be met, every step of the way, in order for an amendment to be ratified and for it to be "constitutional" in its authority over the people. For that very reason the designers of California's constitutional republic specifically prevented the courts from being allowed to change it randomly, especially once the people had spoken.

By reaching in their desk drawer, taking out a pair of scissors and deciding to snip out the amendment that defines marriage--yet had been arrived at in a just and appropriate manner, as so defined by that same constitution--the justices are making themselves the most powerful authorities in the state.

In addition, and most importantly, they have now completely invalidated ALL constitutional authority in the area of the State of California's jurisdiction.

In fact a sound argument could be made that for the court to invalidate the constitutional text, that had been arrived at in a constitutional means, that essentially there is no more governing authority for the state.

It is the constitution after all that establishes the rules for the government, the process of taxation, the enforcement of the laws, and protection of the people.

In tearing that document up... which they did the moment they undertook the hearing of the case, they have initiated anarchy. The tyrants in black robes will now be using their bully powers to manipulate the residents of California en masse.

It is a Constitutional crisis, and one that effects the entire nation.

Even if their ruling on Tuesday reinforces the will of the people (and on that point I'm exceedingly skeptical) the justices of the California Supreme Court should be replaced. They are exceeding their governing authority, and thereby jeopardizing the rule of law for all Californians.

Of course that's what The Perez Doughboy wanted from the beginning...

BUT if he would use force under "moral obligation" (i.e. humanitarian/genocide/etc.), then we would have STILL gone into Iraq - to LIBERATE 27 million people from the thumb of a dictator. Therefore it is fair to discern that Barack Obama does not think the liberation of oppressed people is a "moral" issue. Which tells you why he so devalues the HISTORIC liberty achieved by the founding fathers and the history of the nation that gave him the freedom to stand up and say this utter nonsense.

Thoughts going into this PATHETIC debate...

It would be sad enough to realize going into tonight's debate that the mere coverage of the Vice Presidential candidates has been so entirely lopsided in the run-up that fair observers of the process would laugh at the thought of "bias free" press. But the attack mechanisms unlocked against Sarah Palin in recent days pale in comparison to the many sadly horrible realities going into tonight...

1. Fair Scrutiny: While Palin has been pounded by Katie Couric, Charlie Gibson, David Letterman, and anyone and everyone else in mainstream entertainment and "journalism" circles, the question awaiting the MAJORITY of Americans (and not the circus animals that live to french kiss Andrew Sullivan's navel) is - "when do Obama and Biden get 'equal time'?" Obama's got more legitimate skeletons that deserve invesitigation, vetting, and explanation than ANYTHING we've come close to learning about Palin, and unlike Palin he IS the head of the ticket.

2. Conflict of Interest: Gwen Ifill should be removed by the commission on presidential debates. SHE HAS A legitimate "interests" in seeing Obama do well tonight. (Heck the press she has received on the last few days alone has her "pre-order" Amazon numbers cracking her into the top 100.) Understanding this - the commission needs to recognize that not only is she not an unbiased moderator - but that she will likely be unable to prevent herself from posturing questions, responses, looks on her face that will BENEFIT her PERSONALLY, and FINANCIALLY. Gwen is a scallywag for not bringing the issue to the commission's attention, but now that she has - it is imperative that she be removed or the commission itself will lose its own brand and credibility.

3. Biding Biden: The main reason that this debate will be worse than inane is that Joe Biden is a tempest. He's impetulant, he's inarticulate, he also makes crap up. A LOT. And what he doesn't he mostly just plagerizes. Couric wanted to pounce on Palin for not being able to give her a litany of Supreme Court cases, but if it had been Biden the cases likely would've been imaginary. One can only hope that he - as was the case with his ticketmate - will lose his cool and further insult "six-pack" America by ridiculously ridiculing the closest thing the working class of this country has had to the executive office in generations.

LOVELY:  McCain pretty much schooled Obama on every subject that was covered--Obama was even agreeing with him on many points. Obama kept trying to distinguish himself from Bush instead of McCain, which was pointless. He also kept falling on his campaign platform that Iraq was a mistake, which was pointless since we are there and the focus should be on how to get out successfully. McCain had Obama on the defense for much of the debate and managed to get a few zingers in as well.

Who knows the tax code?
Obama: "Republican's do what's good for Wall Street not for Main Street"

WAIT, is this the same man who doesn't believe in tax cuts? YOU HAVE TO PAY TAXES IN ORDER TO RECEIVE A TAX BREAK. The TOP ONE PERCENT of wage earners pay 39 PERCENT OF TAXES. The lower 50% pay only THREE PERCENT of taxes.

Obama said he doesn't believe that if we give the wealthy tax breaks that prosperity will trickle down...can we get the kid in a basic economics class? If you tax the wealthy (who create the jobs the middle class have) they will be forced to increase the price of products that all of us use.

Who's a downer?
Obama whines and complains and cries about all the poor people in America...
McCain has a fundamental belief in America and recognizes that no matter what, we are still the greatest producers in the world...

And it's a very good week for Stephen - he gets to direct the "commercial."

Last Dance in Iowa

First Read gives us a dewy retrospective on the far-too-many debates we've endured this year, in case you had forgotten the details:
DES MOINES, IA -- The last GOP debate until IA: The seemingly endless debate parade of 2007 began -- on the Republican side -- at the Reagan Library in California, underneath Reagan's own Air Force One. It took us to Columbia, SC (where the GOP candidates sparred for the first time), to Manchester, NH (where audio/lightning troubles allowed Rudy to joke, after receiving a question on abortion and Catholic faith, that perhaps God was trying to punish him), and then to here in Des Moines (where Brownback -- remember him? -- targeted Romney on abortion). It continued on to the economic debate in Dearborn, MI (where Thompson made his first appearance), to Orlando, FL, then to St. Petersburg, FL for the YouTube debate, and then the Spanish-language one on Univision last Sunday. Now it's come to this: the final Republican debate before the Iowa caucuses; the Democrats have theirs here tomorrow. And with all of the cable news networks carrying this debate live, what would have been an under-watched afternoon affair in Iowa is perhaps turning into the most important debate of the cycle.

You Tube - HUCK WINS: Tell us now... right here...

Believe it or not I think HUCK had the best night of all the candidates... largely for two reasons. He wasn't really directly attacked all that vociferously - and he used his humor, calm, and yes even biblical knowledge to quiet the antics nearly every time he spoke.

Sure the sexy story is all the attacks back and forth between Rudy and Mitt - but as someone who has not watched these debates all that seriously until now (as have most Americans) Huck came across very very very well!

Rudy had to answer the questions that hurt him.

Mitt had a poor night because of the ganged up attack against him - particularly on immigration and waterboarding.

McCain did not do well enough to gain ground.

Tanc and Dunc added interesting color to the side issues...

Crackpot was his usual self...

But Huck did better than anyone else...and it showed. (And by the way I have not endorsed him nor any other candidate.)

10:00pm - Huckabee "48% of African Americans DID vote for me - because I asked for their vote. And I tried to help them. Our party had better reach out. I don't want to be part of a party that is ever decreasing."

9:58pm - Rudy "We have not done a good enough job in promoting our ideas to the African American community..."

9:56pm - Huckabee "Whether we decide to go to Mars is not a decision I feel like I need to make, but I would expand space exploration. We need to put more money into science and exploration... and if we do send to Mars - perhaps we could put Hillary on the first trip!" Tancredo "We can't afford to go to Mars."

9:55pm - Romney "Time for us to recognize that we MUST take a new path - not with Hillary off the left - but with Ronald Reagan."

9:53pm - Fred "One of the things I would do for Social Security's future generations is to protect them from MY generation. Not merely a fiscal issue but a moral issue."

9:52pm - Huckabee "I need the support of everyone - including the Log Cabin Republicans, but we can disagree on some policy - would I welcome their support, but would not change my position... sticks with convictions, can explain them..."

9:51pm - McCain "I speak to the military leaders all the time. Almost unanimously they say that the present policy is working at that this policy ought to be continued because it works."

9:50pm - The Gay General speech - complete wierdness...

9:48pm - Hunter "Homosexual behavior would be bad for unit cohesion." Huckabee "what Hunter said", Romney "this is not the time to make that change, that policy doesn't make any sense to me".

9:40pm - Fred "I think that the VP has a dual role, he presides over the Senate - but should be chosen on his qualifications to run the United States." McCain "must be able to carry out the responsibilities of the President."

9:38pm - Rudy "I did not Sept 11 use Sept 11 to do anything unusual Sept 11. Haitian immigration Sept 11. I was United States Attorney and prosecute Cicilian mob figures - and Sept 11 - to you!"

9:37pm - Tancredo "Paul lives in crackpot heaven... we would be under threat even if we withdrew..."

9:36pm - Paul "Not losing a battle is irrelevant. Wolfowitz admitted that they came after us because we are occupying their country... and I'm a freakin' crackpot!"

9:35pm - McCain "Shut the heck up CrackPot - America didn't lose a single battle in Vietnam! Read the terrorists idiot - they want to follow us to our shore!"

9:34pm - Paul "Crackpot theory 101 - give the country back to the terrorists... and I'M A TOTAL CRACKPOT - and the North Vietnamese are now in charge of Iraq. Vote CRACKPOT!!!!"

9:32pm - Fred "We should not be there a day longer than necessary (in Iraq) but we should be there as long as we need to be but not a day longer than we need to be but longer than some would say and less than others - and THEN there's Iran.

9:27pm - Romney "I do not believe it is wise to describe what techniques we would use for interrogation - and keep the thugs in Gitmo", McCain "I'm shocked that you could not believe that waterboarding is not torture, and if we're going to get the high ground. How in the world anyone thinks that that kind of treatment could be carried out by Americans is beyond me." McCain "Life is not 24 and Jack Bauer..."

9:24pm - Rudy, "Stay on offense against Islamic terrorism...not one democrat addressed the issue of islamic terrorism", McCain "The most important thing is to win in Iraq, we're gonna fight back the democrats efforts to set a date for surrender", Hunter "When the world was in trouble - it was America that came and helped you. I WILL NEVER APOLOGIZE for the United States of America."  

9:16pm - DO YOU BELIEVE THIS BOOK? Rudy, "Not in every respect, read it frequently, read it in the big crisis in my life", Huckabee "Do I need to help you out Mayor", Romney "I believe the Bible is the Word of God, a guide for my life, I believe in the Bible", Huckabee "I believe the Bible is the word of God to man himself. But the Bible has some messages that are not left up to interpretation, and until we get the real simple things right, we don't need to argue about the things that are more complex". BECAUSE THE BIBLE IS THE REVELATION OF AN INFINITE GOD AND NO HUMAN CAN FULLY UNDERSTAND HIM, AND IF THEY CAN - THEIR GOD IS TOO SMALL!

9:15pm - Tancredo, "I pander to Jesus in the shadow of Huck!"

9:13pm - Huckabee, "Death Penalty, what would Jesus do... toughest thing I've ever had to do. I read every page of every case of every decision I was asked to decide. I believe there is a place for the death penalty - some crimes are SO heinous. Some crimes are beyond any other capacity for us to fix. 'Jesus was too smart to ever run for public office.'"

9:11pm - Rudy, "Ban on all abortions, Would not sign". Romney, "Would welcome a circumstance to ban all abortion, and I would be delighted to sign that bill".

9:10pm - Fred, "Abortion becoming illegal should be our number one focus, and that means new justices on the bench of the Supreme Court. Most states have laws that prevent abortion after viability - that same pattern should be followed to punish doctors..."

9:08pm - Paul, "Get the federal government OUT of abortion... I don't think that the woman should be charged with a crime. I'm an OBGYN and I never saw a time when an abortion needed to be performed medically speaking..."

9:07pm - Rudy, "Romney has a mixed record... I have reduced crime in Harlem by 80%. The city of New York was one of the most dangerous places in the country."

9:05pm - Romney, "Best thing you can do for a kid is give them a mom and a dad. And it's time to go back into this country to the time of values. Family values... Better education - civil rights issue of our time - education... tough laws related to being touch on crime... violent crime in my state dropped 7%."

9:04pm - Gun collections - Fred "not telling where they are", McCain "I don't own one now", Hunter "Gun just like my Dad's", Romney "I have two guns in my home - owned by my son Josh, chessy laugh included..."

9:02pm - Fred, "The Mayor never found a gun control law that he didn't sign... Hopefully the Supreme Court will uphold the ruling in the DC case..."

8:58pm - Rudy, "We have to be very aggressive about enforcing the gun laws that already exist. We reduced shooting 74%. We went from being one of the most dangerous cities to one of the safest. Government CAN impose reasonable regulations.(BOOOOOOOOOS) New York can have stricter rules than Texas, and the Supreme Court will decide this in the next six months. I will live by that. I'm not going to interfere with that."

8:57pm - Hunter, "You should never throw a gun, you gotta be safe with guns Jay. But the right to bear arms is important to national, home, and personal security!"

8:54pm - Huckabee, "I cut 90 taxes... 'When they're kicking you in the rear, they're just proving that you're still out front!"

8:53pm - Romney, "On Abortion I was wrong... this happened when I was Governor, I could not sign a bill that destroyed life. I'm not going to apologize to people for becoming pro-life."

For Once in My Link (YouTube Debate Preview)

First off, the plus of staying in a cheesy beach hotel instead of whatever fancy digs the rest of the reporters are in ('cause they ain't here!) is I got up and took a run on the beach. I have pictures to prove it, too.

I'm down in St. Petersburg for the debate, and will be catching up with campaigns and debate-goers later in the day. Right now, a couple preview links...

From my preview interview with Anderson Cooper: "Campaign operatives are people, too." Awwww.

The Salt Lake Tribune wonders if YouTubers will be the proxy for asking questions about Romney's faith.

A CNN poll shows that if a primary were held today in the Sunshine State, Rudy'd hit his rivals where the sun don't shine, if you know what I'm sayin'. (And, if not, I just mean he's really ahead.)

Of course, the Huck camp is pumped about the Insider Advantage poll that puts the man from Arkansas at 17 percent to Rudy's 26, with McCain and Mitt trailing.

. If I were a Rudy adviser, my advice would be "more jean shorts."

Yeah, this is pretty much what's going on:

Roaring out of the Thanksgiving break last weekend, both Romney and Giuliani traded shots for two days running on a variety of issues - spending, tax cuts, crime, healthcare, and appointments - as they stumped in New Hampshire, where Giuliani is redoubling his efforts to catch Romney.

Giuliani and Romney have used increasingly harsh language against each other. But in the past five days, Romney and Thompson have also zinged Huckabee for advocating driver's licenses and tuition breaks for illegal immigrants while governor of Arkansas; Huckabee hammered Romney for shifting positions on abortion and gay rights; McCain whacked both Giuliani and Huckabee for their lack of military and foreign policy experience; and Giuliani's campaign issued a release criticizing Thompson's record on taxes while serving as a senator from Tennessee.

Did Mitt say "probably not" to Muslims in the Cabinet? And, since the deadline for YouTube entries was Sunday, will he have to answer questions about it? When I talked to CNN's David Bohrman Monday he said Anderson had lots of "flexibility." I wonder if that's where his limber mind will lead him...
