ACORN Suing Federal Government Over Denied Funds

The suit, which was filed in New York's federal court, claims that the bills passed in both the Senate and the House to cut off funding to the group are unconstitutional:
ACORN claims that the legislation was of “malicious and punitive intent.” The suit also claims Congress violated the Fifth Amendment by skirting due process before doling out the punishment of the funding cut. OMB Director Peter Orszag and Treasury Secretary Timothy Geithner are listed as co-defendants in the suit. ...

The lawsuit, which was brought by the Center for Constitutional Rights, says that ACORN has been subject to “heavily funded and orchestrated political campaigns.”

But this effort represents a complete reversal from ACORN, which emphasized to reporters and the public that the money it received from the federal government was not essential to its existence.

Now the group is taking a bold step to restore its federal funding by accusing Congress of violating the Constitution.

They'll have to open up their books to show that is the case...and where the money goes.

Isnt there some rule of thumb that a criminal will make a number of mistakes in any crime? Somehow I think Bertha has made many...including this one.

So let me get this straight
It is unconstitional for the US government to cut-off an extra-Constitutional organization that is bent on usurping the Constitution from receiving constitutionally collected taxes that were unconstitutionally provided to the extra-Constitutional organization in the first place. What a country.

You summarized the situation better than anyone else. It's Alice in Wonderland stuff. I didn't realize that private groups had a Constitutional right to federal disbursements. In that case, I'm going to start an organization all my own, perhaps fro Samoan orphans. Since there isn't even a word for "orphan" in their language, it'll be all overhead.

I don't see how their claim stands
Getting money from the government isn't a right, and cutting off such funding isn't punishment.

Seems to me that their suit will get dismissed immediately. They have no grounds.
