Senate Bailout Bill Unconstitutional

Article 1, Section 7 of the Constitution says: "All bills for raising Revenue shall originate in the House of Representatives;"
That means the $700 billion revenue raising bailout bill needs to originate in the House and that it's unconstitutional for the Senate to try and pass this bill before the House does.
This seems rather simple.
Of course the Senate is essentially taking up the House-version of the bill and making the $700 billion Paulson plan an amendment to, aptly enough, a mental health and addiction bill, H.R. 1424
Let me say that again. The Senate is making the $700 billion Paulson plan an amendment to a mental health and addiction bill. It's crazy and fitting on a few different levels.
The mental health and addiction bill, to be named after the late Sen. Paul Wellstone, is a doozy. Senators have already announced they're going to add earmarks to it for "wooden arrows for use by children," film and television production and handpicked tax protections for Virgin Island and Puerto Rican Rum, the American Samoa, Indian tribes, railroads and auto racing tracks.
Of course, no final bill text has been produced yet. So, no one is going to really have a chance to read this thing before the planned Senate vote this evening.
Typical.
Update: The bill text has just been posted. HERE It's 451 pages.

Since when is this a bill for raising revenue? Given the price tag it surely *entails* raising revenue, but if that's the standard, how can anything originate with the Senate? |

A few people still care about the constitution, but not many. We are about to go whole hog socialist with this financial take-over. But Wall Street will be happy to get all that cash so I guess that's all that matters.
If McCain votes for this, I won't vote for him. Period. This is it for me. |

Dread
The only thing I'd add to your comment is "or the people". |

I cannot believe this is constitutional. The Senate is attaching it to a smaller revenue bill that has already been approved by the House along with mental health and addiction bill. On top of that, the its full of pork and earmarks! Isn't McCain against pork/earmarks? Isn't that what his whole career and election have been about? This is a sneaky was to try and pass the bill. The Senate is trying to put pressure on the House Republicans.
McCain will lose the election due to supporting, promoting and voting for this bill. If he votes for it (which I am sure he will) he will have handed the election over to Obama on a silver platter.
I pray the House members that voted against it the first time will stand together and defeat it again. |

The government gives a rat's behind about the Constitution. |

Soros floats alternative bailout plan with Dems By Alexander Bolton Posted: 09/30/08 11:19 PM [ET] The billionaire financier George Soros, a major Democratic financial backer, is floating his own rescue plan among Democratic lawmakers who are uncertain what to do in the wake of a surprise defeat of a proposed $700 billion rescue package proposed by Treasury Secretary Henry Paulson. Soros has outlined his plan in an opinion editorial in the Financial Times and circulated a concept paper among decision-makers.
Specifically, the liberal philanthropist has proposed that government funds should be used to recapitalize the American banking system by purchasing equity in banks and investment firms.
Democratic Rep. Jim Moran (Va.) scheduled a meeting Tuesday afternoon with Robert Johnson, a former manager of the Soros Fund Management, to discuss the proposal.

I'm from the government... Look out behind you! Liberal zombie! Here, sign this quick!!! Oh, and he's black too!!! |

All I'm hearing is that there WILL be a Banking System Nationalism Bill by tonight. So where are all the "market whisperers" who can channel what the market is telling us today?
All Bush has to do is issue two executive orders and the urgency to surrender free market capitalism to Marxism disappears: raise the FDIC limit to $250,000, suspend mark-to-market accounting until liquidity returns to the market.
Can't do that though. That would be like securing the border BEFORE voting to legalize amnesty/indentured servitude. |

the comic relief in the Senate attaching this to a "mental health and addiction" bill? Subliminal message???? |

The Senate tried to pass the last amnesty bill, unconstitutional on the same basis, last year because they knew they couldn't get it through the House first. Our government does not care about the Constitution at all. It's time for a new government. Vote them all out. |
