Shouldn't It Be 14 Counts?

Nidal Hasan has been charged with 13 counts of premeditated murder.

But according to this list of the victims, Private Velez was pregnant.  So shouldn't Hasan be charged with 14 murders?

Last I checked, Laci and Conor's law is still on the books.

That baby was just weeks from birth, it could have survived on it's own with a little help as a preemie. That baby was an American citizen whether Barry wants to accept that or not..that baby was one of America's 'posterity'..so mentioned in our Founding Documents. But to admit that would be anathema to the congregation of the first church of Beelzebub whose rites include the torture and sacrifice of preborn babies..Obama is the High Priest of that church.

Having said that, I agree, where are the charges of Treason? I have a feeling that won't be
coming since we have 'diversity' to protect. The
Gen'l Kissup Casey would never permit his
Military Courts to include that baby..maybe if it's mother been a member of Hasan's faith but not
as another AMERICAN victim..Treason is sooo passe'..The Rosenbergs were the last to pay the

Rule of Law, right? This one happens to be a Military Law.

And the proper term is 'unborn child';

"As used in this section, the term `unborn child' means a child in utero, and the term `child in utero' or `child, who is in utero' means a member of the species homo sapiens, at any stage of development, who is carried in the womb."

No mention of age of unborn child, just that abortion cannot be prosecuted. The Unborn Child was killed and not by consent of the mother. What is it that is so complicated about a clearly defined law Axe? This isnt fuzzy outside world, this is military world without liberal judges.

And the fact is, these military lawyers looked at the law, and realized if they even TRIED to prosecute Hasan under it, they'd be asking for years of appeals.

My guess, however, is that they are going to do a cat scan of Hasan and find out he has a tumor or something nasty like that, and all you twits saying your sky pixie has a bigger sch long than their sky pixie are going to look pretty foolish.

Guess thats where I infer you are talking about the bigger picture that Hasan cannot be prosecuted for the 14th death. But once again, I should realize you are not talking about the big picture, only a small detail to correct another post. (seems like I brought that up the other day as your MO to someone else?).

To be a little more articulate, the law is clear that its a punishable offense unless the mother aborts. And its reffered to as an unborn child, not a fetus. So regardless of other distinctions, its clear that the 14th can be pursued.

Me- I think we need to determine what it is by having an investigation. It is very possible that Hasan is mentally ill. In fact, every story I hear seems to indicate that may be the case. Then shame on the Army for insisting on keeping him in uniform and not honoring his request for a discharge when he was clearly incapable and unwilling to perform his duties as an officer.

The Army screwed up here. And my guess is that they screwed up because they were more interested in filling a position than actually looking out for the overall good.

When I was in the National Guard in the 1980's, we had this bunch called the "Progressive Labor Party", essentially a bunch of hobgoblin radicals spewing mutilated marxism. Still had a few around in the 1980's who didn't realize the party from the 1970's was over. Well, a few of them were in my National Guard unit, the 131st Infantry. Turns out the 131 was so desperate to fill positions, they'd pretty much take anyone.

Well, I reported these guys a few times. "Hey, I've seen these fools at UIC, passing out phamlets calling for the overthrow of the government. Do we REALLY want to give these guys an M16?" I was pretty much blown off. Got to make those attendence numbers.

Long story short, these guys got caught in another state, wearing their uniforms, trying to incite members of the Michigan Guard who were defending a HOrmel factory in a strike to revolt. Somebody started paying attention THEN!

Wrong, the bible mentions God knowing people in the womb, the Constitution doesn't make a distinction to burn or unborn, and there are pleanty of scientists and doctors who say it is a human being. 1. Would that matter even she wasn't pregnant? I doubt he knew who any of the other dead were.

2. I understand she was pretty far along.

3. Yes, a fetus is a human being. It is genetically its own unique human. It has human DNA. It is no less human than you or I.

Justice for all 14 people who were killed, thats why.

The only point you might have is that the UCMJ may not count it as a double count of murder. I say again, the only point.

You regard a whole swath of Americans as inhuman. Such a shame.

Everything I am hearing about Hasan, including the business cards, indicates a guy who is pretty clearly mentally ill. Calling himself a "Soldier of Allah" is hardly indicitive. It's like blaming Christianity for Andrea Yates drowning her kids.

Oh, and I agree, he should have been discharged. Hell's Bells, he WANTED to be discharged. And teh Army insisted on sending him to Afghanistan. "Hey, we got this mentally ill shrink who is passing out Jihadist business cards. What do we do, Sir?"

John Allen Muhammad, one of the Beltway Snipers, was given the Big Sleep last night by my state government; he's dead. He killed at least 10 of the 16 victims, but he was executed for killing only one of them, Dean Meyers.

Is it a horrible miscarriage of justice that he wasn't also executed for the other nine murders? No, the guy is d-e-a-d, dead. That's the Big Picture.

Did Hasan have a screw loose? Yes. So did the Unibomber. That has nothing to do with being 'fit for trial.' If it were the case, every murderer in the country could arguably be deemed crazy.

The reason is we have become too PC. Being back home last month in Switzerland had me realizing it. Thats because the Swiss are known fo rbeing very straight forward and calling it as it is.

I see nothing coming from DC that will improve this PC issue in general. Its heading at speed in the other direction.

I wonder what the hold-up is regarding the 14th count? In legalize, would the death of the unborn be something of a lesser charge since Hasan's attorney could argue that Hasan didn't know he was killing the baby? I just wonder since Scott Peterson's 2 murders were both premeditated. I wonder in this case if Hasan will face something like 13 premeditated charges and 1 manslaughter charge or something. It's not like it will matter. If he's tried in the military courts, he's obviously eligible for the death penalty for the murders alone--plus you could certainly make the case for charges of treason. It will be interesting since I'm pretty sure President Obama would be the one who would sign-off on the death order.

Nonsense. He was also tried for six of the killings in a single trial in Maryland.

They weren't "chosen." If he'd survived the execution or been given clemency by the governor, he would have subject to the sentence handed down by Maryland.

Hasan will probably be given a single trial for his actions, and if found guilty will be given a single death sentence. He'll be just as dead as Muhammed is for the one killing and Timothy McVeigh is for the eight killings (out of 168) that he was convicted of.

Me- Yes, and these women are 'dealing with it', just not the way you want. But the point is, we all make the choices society forces upon us. Having a baby is a major decision. I have a co-worker who is going to have her first next week. Good for her. But she is going to almost definitely lose her job once her 12 weeks are up. (She's already been out for 7 because it was a difficult pregnancy.) Company's already got a temp ready to take her job.

The Unabomber wasn't found crazy because he refused to let his lawyer enter an insanity plea.

Me- The Swiss are also whiter than white bread... It's easy to say that kind of thing when everyone is pretty much the same.

Well, I think the problem is, when the military is having a hard time filling slots in a war that is completely unpopular, they are going to tolerate anything. If they had enough qualified shrinks signing up, you really think they would have kept Hasan?
