What To Do With The Terrorists?

AP reports on the president-elect's options concerning the Gitmo detainees.

Bringing the terrorists to the U.S. will produce consequences that will begin to roll up immediately, not the least of which will be the cost associated with the merger of the military tribunal system into the criminal justice system.   The safety of the terrorists within the U.S. prison population will also become an issue, as will release issues.

The rhetoric of "closing Gitmo" is just the first instance where the reality of governing will prove much more difficult than that of campaigning.  While aspects of the aftermath of the Boumediene ruling remain to be worked out via the habeas proceedings underway, a rush to close Gitmo laced with rhetoric about " kangaroo courts" is a certain way to launch the new Administration in the wrong direction when it comes to national security.

He teamed with ACLU, and sued the Bush administration over Patriot Act, and GITMO!
Those who voted for Mr. Barr, probably know best his plan.

Please, tell me if your priority was border security, why did you voted for the guy who was against putting fence on our southern border?
You would have my outmost respect, not voting for anyone on the GOP ticket, instead.
Mr. Barr was a mirage of a candidate.
The reality, All who voted for Mr. Barr, voted for Mr. Obama, and from now on will accept all Mr. Obama's policies. And as he is our President, all these problems and whatever else comes down the road are his and the Democrats. The majority of the people over 50% voted them in the office, and theirs' will be the decision making, regardless of whether, we will agree with them or not, they are in charge.

Paradox
For a European it remains a paradox that precisely those US citizens who are worst afflicted by delusions of grandeur on behalf of their country are the ones who oppose everything that this country is (or at least was) admired for abroad. They are the once who support suspension of civil liberties, government spying, unlimited government power, wars of aggression against nations that aren't a threat to them, to name a few causes popular with this segment of society. It's no wonder that the worlds lets out a collective sigh of relief now that the adults seem posed to take the reins in this country again. It was beginning to look a bit too much like the end in The Lord of the Flies.

The obvious
I'm no lawyer, but off the top of my head I can think of a few problems with this debacle:

1. Giving enemy combatants access to criminal courts, with their evidenciary rules has the potential to force the government to make the choice of exposing critical intelligence used in their capture, or not using it and hadncuffing the prosecution.

2. It allows the possibility of a mistrial on procedural grounds.

3. It allows far greater leeway for appeals.

4. It allows for the possibility that if they are found "innocent" for a procedural rule, they could subsequently be allowed to stay in the US due to a number of laws.

You childish thinkers want to lay the mantle of greatness on our country based on the likes of the people in Gitmo? And this is your "solution"?

Perhaps the detainees could have their brain stems cut with scissors and their brains sucked out, the process "opponents call partial-birth abortion" and "proponents call woomen's rights." If 50 million abortions are not a disgrace, what then are a few hundred are so ...detainees? Oh! What? That would be murder? You don't say...

Released enemy combatants from Gitmo return to the middle east and continue to kill innocent civilians and our soldiers. My son is serving in Iraq and I prefer that we don't release killers caught in the act a chance to return and continue their butchery.

Hussein is about to implement his first 'foreign policy agenda' and if this is any indication of where he is going - khalid is proud to have helped him get into Law school. How long before 'sheria' becomes the new 'legal system' Hussein is advocating for these 'boy scouts'? I think he will also advocate for compensation and a vacation to HI. It's all in the spirit of 'gaining our respect back from the world'. In the end of 4 years when we have potential terrorists looming in our backyards - Barak will say 'I did not know they were plotting evil because they were found not guilty of any crimes. My administration is committed to restoring our respect around the world and Guatanamo was one step closer to gaining that respect back. The Bush administration put me in a difficult position. I am sure you all understand'. The crowds will chant 'yes we can' three times and he will call Ayers and say 'we did it!"

The Gitmo detentions have been a disgrace to our country--a filthy disgrace--and those who advocated in it have dishonored our nation. But elections have consequences. Thank goodness the majority of Americans were alarmed at the prospect of the Reeps turning us into a not-great nation.

Boumediene
This has been almost an inevitability since Boumediene. Laborlawyer (claims he's a lawyer) said no way would enemy combatants would gain access to our criminal justice system. What a putz. I'm no lawyer and it was evident to me and many others.

I wish the forces driving this type of decision would simply stop and consider where, long term, they want this to go. Clearly it is nowhere good.

That is a great compromise. If anyone has proven he can rehab criminals, it's Arapaio. The news describes tent city as pink underwear, summers from hell, chain gangs, no A/C, awful food... That would be great.

Sherrif Joe Arapaio from Maricopa County in Arizona just won his 7th term(I think). All Sherrif's should treat criminals like him.

is not the primary concern.

The primary concern should be injecting a number of hardened jihadis into the prison system where they can then prosletyze and possibly recruit US prisoners to their cause.

If they get just one, it's one too many.

Let The Games Begin
Those who voted him in can take credit for the fall-out that will surely follow. Since his election, all I hear on the right are sentiments like, "we hope the best for the new president," "we hope he is successful," "we do not wish ill upon him." Etc. (Hannity comes to mind. JD Hayworth in Arizona, too.)

I do not wish Obama success, because his success means implementing his socialist agenda, all of it, which is certain to happen now that the democrats are running the show. Liberals never granted Bush the same courtesy. No, they dogged him from day one. The republicans should do the same to Obama - take him to task on everything, just like the liberals did to Bush. Just because Obama is black does not mean we need to bend over backwards to make sure he is successful by refusing to hold him accountable for his mistakes.

Another prediction---all the news networks (CNN, MSNBC, etc.) are going to suddenly see their ratings go up, because now that their guy is in the White House, all the news they report will always be positive, regardless. Cris Mathews said last week that it is his job to make sure "this president" is successful. All of the networks, especially Chris Mathews did nothing but tear President Bush down from day one. (That's how liberals operate.) Obama will be treated with Kid Gloves to ensure he gets a second term no matter how much he screws up his first, because we'll never know, will we.

They are all prisoners.
