Border Fence Would Slice Private Land

This WaPost story highlights an interesting conundrum for conservatives: Building a border fence means using eminent domain to seize private property from American citizens. What is more, the U.S. would effectively cede thousands of acres to the Mexican side of the fence ...
So which principle is more important? Defending the private ownership rights of private citizens, or keeping illegal immigrants out (assuming a fence would actually do that)?

I know some of you are not concerned about crime and Illegals, after all there are alot of citizens who commit crimes. In my community however, there have been victoms of violent crimes by illegals and they flee to mexico and stay for awhile and then return later and commit them again! It isn't so easy for the average american to commit crimes and flee to Mexico so then they end up in prison where they belong! I think there is a problem. We need to secure the borders at all costs, for these reasons and also if the average Mexican people can figure out how to get here undetected what makes you think a terrorist or several can't figure it out! I guess we will care when people start blowing themselves up in our busy american cities and then everyone will be saying, They should have secured our borders with troops and tall fences with razor wire. They should have done more! |

I wouldn't have thought it. I would have thought that the "conservatives" here on TH would support property rights. I guess I was wrong. They're just a bunch of police-state fascists and socialists who think that no one has private property, but rather the government owns everything and can take your property on a whim.
Silly fascists and socialists: it's not your property. You don't have the right to make such decisions, nor do you have the right to demand of a 3rd party that such land be taken.

Wow! Helloooooo! Matt Lewis are you behind the times or what, ask the people in CT who lost all their homes to a fascist ruling, by the Supreme Court about property rights. I say, bring our troops home from all around the world. Build the fence, put our troops all along it and shoot anyone who tries to enter. Take 100 thousand of em and round up the 20 million illegals and throw em over the fence into Mexico. If the Mexican Army fires a single shot at our troops or border agents (which they do all the time), declare war on Mexico and demolish it. |

What will happen to illegal immigrants and their kids if they are U.S. citizens now that jobs are drying up? This looks like a welfare nightmare with no money to pay for it! Why would they go home when the job problem is worse in their country? This is what happens when trade is based on a race to the bottom for wages to workers?

At the end of the War with Mexico,the 1848 Treaty of Guadalupe Hidalgo section 8 clearly states that all Mexican citizens living on either side of the border would keep and own their property in perpetuity. This means that are hundreds or more heirs to that property.
The Mexico land grant program of 1834 deeded all of California into small parcels to thousands of Mexican families. By International Law If these suposedly illegal are related by blood, they own a small plot of California. There are records of those old land grants in The Archives, so hopefully they will not evict us as illegal aliens. James |

The fence along our southern border isn't just to be racist against Mexicans who don't care about U.S. laws. It is needed for national security, in 2006 people from 77 different countries were caught crossing the border to include: Syria, Iraq, Yemen, Saudi Arabia, China and many other countries who have only our best interest in mind. Terrorist groups are teaching spanish so they can use the southern border to get in this country. Enough with the rascism crap. I have no problem with legal immigration and a guest worker program once the borders are secure. Some cases need to be worked as in the Rio Grande area but most of the border can be fenced physically and vurtually with technology. |

In certain areas it would also prevent ranchers cattle from accessing the Rio Grande River.
But, that's where a virtual fence would come in handy.
Don't get me wrong, I'm all for securing the border, but, do you really want to give the Rio Grande River and land to Mexico? You need to be realistic. If this was your property, mike & red rover, I don't think you would be of the same opinion. |

Let's just enforce the law when it's convenient and only those laws that restrict the rights of law abiding citizens. |

silly argument against a border fence. It's exasperatingly obvious that condemnation of a few hundred miles of ranch land to secure the border is worth it. But, border security is only part of the solution. |

..is the other side of property taking. The comments posted above are valid, especially for the sake of national security ( border enforcement in this case)being a legitimate and constitutional use of eminent domain police powers. As long as the taking agency pays just compensation for the loss of use(income) of someone's land, and the property owner is in agreement to national security, then there has to be a win-win deal that can be accomplished. |

Seems the people on this blog have their Mexico hatred in fine fettle tonight. It blinds them not only to problems with property rights, but to big increases in government power, wasteful spending, invasion of privacy rights. The hysterical loathing for Mexicans trumps everything. I have long since decided this mania is NOT a conservative position; it is a bigoted position. Just read the posts on this thread and try to deny it's bigotry. |

Of Mexico's southern border is Mexico "ceding" to their southern neighbors when they put up the $1.3 Billion fence that the US Taxpayer is footing the bill for?
Now, About OUR Border Fence...Seems to me maybe THIS is EXACTLY what the SCOTUS was thinking about when they ruled the way they did on eminent domain...If Not, then they REALLy screwed up!

I'm going to do the intellectual equivalent of dropping the soap here...but Matt, your breath takelingly complex conundrum has shown me how wrong I am, about everything. How can we build a fence when it might go over someone's property? Why should we secure our border when it might cause Farmer Fred to have to move his cows? Don't build the fence. And don't just legalize 20 million mexicans...I say we legalize every mexican between here, and Tierra del Fuego. Move them into the United States...and then, turn the now abandoned country that is Mexico into ONE GIGANTIC CARBON OFFSET! Just think...if every Mexican lived in the US, their country could go back to nature..it could serve as our gigantic carbon credit. How about it Matt? Let's work together. Empty out Mexico, turn their country into Gaia's Garden..I feel so superior now. Let's do the mantra together, shall we? 'John McCain is the most conservative conservative to ever conservate in the conservatory.' And my new favorite, 'If the answer isn't 20 million illegals becoming citizens, you're not asking the right questions. Vote McCain (or the terrorists will kill you). |

The primary responsibility of the U.S. government is to protect the territorial integrity and people of this country. They have completely abdicated this responsibility. Both parties have been complicit in this. We are being told it is not possible to control our borders, enforce our laws, and thereby control our destiny as a nation. Hogwash. We are being sold out by corporations intent on importing workers for jobs that can't be exported with the taxpayers paying the true costs, financial and human. If we act like sheep and don't stop the inundation across our borders, we will lose our country without a bleat.

One of the few things the federal government SHOULD be doing is securing the national border. Our various levels of government restrict the use of, and seize, private land for all sorts of much less worthy reasons. |

With the stark exception of Lou Dobbs, almost all of the media is in on the sell out of America. Most of what I see on T.V. is designed to manipulate the public. The administration has only recently done enforcement actions with the intent of providing tear jerking pictures of "poor immigrants". The way slanted dishonest polls are being used to sway public opinion and presented as news is stunning. This campaign of disinformation is worthy of Goebbels.
We are being convinced that it would be wrong to insist that people comply with the law.
That it is racist to want foreign nationals to adapt to our language, culture, and laws.
That anyone who can run across the border should be given U.S. citizenship.
That foreign nationals who break our laws sneaking into our country should be entitled to things that citizens cannot get, like in-state tuition.
That citizens who object to abandoning the rule of law are a small minority of restrictionist, racist, bigoted, xenophobic, nativist yahoos.
That citizens who step up to do the job the government won't do are vigilantes.
That we have no choice but to surrender our country.

We are talking about of sovereign border. Your point is idiotic. We are not talking about a new Wal-Mart here. If the government ever has a right of imminent domain, this would fit the bill. As far as Mexico goes, let me quote the old, articulate, maverick Senator, “F$#@ them.” After all, they have no problem sending drugies, murderers, and soldiers across the border.
