DHS Prohibits Border Sheriff from Enforcing Immigration Laws

USA Today is reporting on a story out of Arizona that local Maricopa County Sheriff, Joe Arpaio, has been stripped of his authority to conduct "crime suppression operations"--arresting suspected illegal immigrants "based solely on their immigration status."  The decision comes down from the US Department of Homeland Security:

Arpaio will still have the power to check the immigration status of people booked by his officers, but not the authority to conduct street patrols looking for illegal immigrants.

His “crime suppression operations” are saturation patrols in designated areas where deputies would find illegal immigrants by stopping them for traffic infractions and minor violations...

The department of Justice and other federal agencies are investigating the sheriff’s office on accusations of racial profiling during the operations [according to local news sources].

Arpaio said he will be able to still conduct the crime sweeps under state human smuggling laws and an obscure federal law that allows local police to arrest illegal immigrants.

A spokesman for the Phoenix office of ICE declined to comment until after pending agreements with the country are signed.

"It's all politics," the Sheriff said.  He has vowed to continue his operations to bust illegal immigrants in his community, despite Homeland Security's decision.

Isn't Sheriff Arpaio just trying to keep the homeland safe?  Maybe Homeland Security could learn a thing or two from him...

who would tell the Feds to shove it right up their a$$. I would LOVE to see such a showdown.

Whether he does or whether he doesn't, he seems intent on doing some sort of end run around it. I wish him all the success in the world.

Screw DHS. Screw DC.

been at loggers-head ever since he accused her of not caring about "crime" and especially "crime committed by illegals!" Another triumphant moment for the leadership skills Captain Obumbles surrounds himself with!

Does DHS carry any kind of authority? Nope. ICE can say it's their jurisdiction and lay off, Joe, but then you just get into traditional fed/local wee-wee contests. My money's on Arpaio.

Napolitano is a Fool
Janet Napolitano didn't like Sheriff Joe when she was Governor and surprisingly, still doesn't like him. Perhaps the animosity is because he shows her up. He's done more for border control than she ever has.

Thank Janet for leaving us in Phoenix with a kidnapping rate just short of Mexico City - We're #2 in the world! That was when she was Governor of Arizona. Now, with her heading up homeland security, we might not be shown up by even Mexico City anymore.

Joe will find a way to do what he wants. I really don't like him on a personal level, but love him as a law enforcer.

The news story is that DHS withdrew their granting of authority to Arpaio. If as you contend they had no authority in the first place, then nothing has changed. Your outrage is misplaced.

The Feds are usurping state authority. Can you say "The Brownshirts are coming, the Brownshirts are coming!"

Nope, my outrage is not misplaced. People should follow Arpaio's lead or my local sheriff's, which is to suppress crime and capture the law-breakers. When the Fed steps into something that is none of their business, I smell a Pied Piper.

Quiet amusement would be the better description, Bobby-O. 'Cause it ain't DHS' authority to grant. They can order ICE to do or not do something, but they have no authority over a local sheriff. Let's all remember that, shall we?

Is anyone surprised..

that the dike of dsh, and gang, would work against a real law enforcement & what little border security we have? AFAIC, dsh, etc, doesn't work for the people of the USA, anyway. and don't be surprised when all those non-citizens and the "paraphernalia" which they brought with them across Our border(s) goes off somewhere in our country.. Then we will see just how Feckless & Incompetent the Oweewee Regime is in real time.

Reagan signed the amnesty bill in
1986. Since then, through GOP and Dem presidents, that law has not been enforced much.

When you don't penalize the companies that (a) send jobs overseas, and (b) hire illegals, you're going to get higher unemployment of Americans and hiring of illegals.

American Apparel had to terminate 1800 illegals a couple of weeks back. 1800 workers using bad SS numbers. 1800 Americans should be able to take those jobs. But, frankly, I'd put American Apparel's execs in jail, and let someone else buy the company and hire Americans.

This and arresting illegals should be done concurrently. While their at it, they can lock up the editorial board of the Wall Street Journal for making excuses for these executives and the illegals themselves.

is trying to trump Arizonas' state rights and the people of Arizona should tell them to "go to hell"!

As I tried to warn when this abomination
was first created, the Department of Homeland Security has nothing to do with the safety of American citizens. Their only possible function is to enforce the will of our masters in Washington by whatever means necessary. I must say, though, I did expect them to take a few more years to evolve into their natural role.
