As The Senate Votes Tonight

Something to remember is that bills that get cloture votes are passed 98% of the time. Breaking filibuster on a cloture vote requires 2/3 of the Senate. Passing a bill requires a simple majority.

This is the biggest legislation that most Senators will ever see in their lifetime. Of course the impossible may be possible. But it's not likely.

ObamaCare By the Numbers

5.5 million — Number of jobs that could be lost as a result of taxes on businesses that cannot afford to provide health insurance coverage, according to a model developed by Council of Economic Advisors Chair Christina Romer

$729.5 billion — Total new taxes on small businesses, individuals who cannot afford health coverage, and employers who cannot afford to provide coverage that meet federal bureaucrats’ standards

$1.055 trillion — New federal spending on expanded health insurance coverage over the next ten years, according to a Congressional Budget Office preliminary score of the bill

0.7% — Percentage of all that new spending occurring in the bill’s first three years-representing a debt and tax “time bomb” in the program’s later years set to explode on future generations

$88,200 — Definition of “low-income” family of four for purposes of health insurance subsidies

60 Vote Threshold Met; Things Not Looking Good For Republicans

Sen. Blanche Lincoln was the 60th Senator to say she'll vote in favor of cloture on the health care bill at 8pm. In other words, the Senate is giving their "ay" vote in favor of Obamacare tonight.

Lincoln and Mary Landrieu, the 59th vote, tried to insist that this was merely a referendum for beginning debate. Because the bill can be changed after cloture is invoked, they claimed that they weren't actually voting for the bill. Here's Landrieu:
I've decided that there are enough significant reforms and safeguards in this bill to move forward, but much more work needs to be done.
In other words, Landrieu voted for cloture on the bill because of the bill's potential. But she's wrong. The ball has dropped. No matter what is cooked up after the sham "official debate" begins (after cloture is invoked) the basic framework of Obamacare is not waiting to be debated. Insurers are now going to be more rigorously regulated than ever before. "Exchange" marketplaces will be installed with a very poor likelihood for success. And the public option will be in the bill some way, some how — though exactly how is yet to be determined.

Other issues will be left for future, crucial 60-vote tests, like abortion coverage, business-based health insurance, and how much (read, not if, but how much) of a percentage Americans will see their taxes increased by this bill.
But the most controversial options, at this point, have received the blessing of our Senate Members.

What next?

Senators will break for recess, and then the sham "debate" session begins. The House bill that was already passed requires medium and large businesses to cover their employees or pay a fine; the Senate bill requires them to simply pay a fee if the business doesn't cover them. Either way, businesses have to pay.

Some form of the public-option — perhaps a watered-down form — is a part of both bills, no matter what happens from here on out.

After the details are hammered out, Senators will begin to see the results of their decision trickle out on campaign polls. More importantly, Americans will begin to see the effects of federal officials wielding influence over their personal health.

Today's Senate Health Care Debate

Sen. Landrieu made her floor speech earlier this afternoon and suggested she will be voting to proceed on the measure this evening.  This leaves just one moderate Dem to watch: Sen. Blanche Lincoln.  Reid will need Lincoln's vote tonight to proceed in passing the bill.  If you live in Arkansas, now is the time for action!

Meanwhile, Sen. Minority Leader Mitch McConnell warns that Senators who vote for this measure will "have a lot of explaining to do":

Absurdity of the Day

Today's absurdity comes from (surprise) the New York Times which claims that there's a "new consensus" in America that Obama's stimulus package was "a worthy step" and perhaps the country should be considering a second stimulus package.

That's funny.  The last poll I saw actually said that the majority actually prefers to halt spending from the first stimulus because it would be better for the economy...

The Only Two People That Matter Today

Arkansas Sen. Blanche Lincoln, and Louisiana Sen. Mary Landrieu. They're the only two "undecideds" on a cloture vote on the health care bill, or a vote affirming that the Senate will vote on the bill, which will take place at 8pm tonight. 

A cloture vote is as good as a vote "in favor" of the bill.
Certainly, adjustments will be made as the bill is re-worked in the House and Senate, but the basic framework of a government take-over of health care has been laid. Issues like abortion coverage, state's ability to opt-out of the public option, and which Members of Congress will get their pockets lined with pork are still up in the air. But fact that government is getting its hands really sticky with America's health is already laid out in full glory and is un-changeable. The basic bill itself ain't goin' nowhere.

How Lincoln and Landrieu are still undecided despite the cloture vote being taken at 8pm tonight is a study in political pandering. Yesterday, reports broke that Landrieu was getting $100 million in Medicare subsidies for her state in exchange for her vote. That's right — her state alone would receive $100 million more than the rest of us, just so she'll vote "yes."

This is why earmarks need to be eliminated in their entirety.

Blanche Lincoln is staying mum. Some reports have her as an already-decided, "yes," but it's probably too early to tell; it's clear these waffley Senators are going to leave us in suspense until right before the vote is taken. If there was ever a time to call two Senators offices, now would be it. Landrieu can be reached at (202) 224-5824 and Lincoln (202) 224-4843.

Stupak-Pitts Amendment Speaks Truth to Power

There is much gnashing of teeth by abortion supporters over the inclusion of the Stupak-Pitts Amendment in the Speaker Nancy Pelosi health care bill – H.R. 3962.  Bart Stupak, Michigan Democrat, and Joe Pitts, Pennsylvania Republican, succeeded in amending H.R. 3962 so that no government funds can be used to pay for abortion.  Claims that Stupak-Pitts is out of line with current law or that it is unconstitutional are simply false.

The Stupak-Pitts amendment (“Stupak-Pitts”) combines two principles.  First, it contains the core principle of the Hyde Amendment that the government not encourage abortion through direct funding or subsidization of the cost of plans that cover elective abortion.  Second, Stupak-Pitts refuses to accept deceptive schemes in which funds deposited into a common pot are claimed to be separate.  Stupak-Pitts recognizes the obvious truth that money is fungible.  Hence, Stupak does not swallow the deception that government subsidized insurance policies covering abortion do not involve the government in the promotion or encouragement of abortion through subsidies.

Anyone with an ounce of foresight on the Left should have seen this coming.  The current principle in federal law – a la Hyde – is that the United States government does not pay for abortions (with exceptions of mother’s life, rape and incest) or pay for the cost of any plan that covers abortion.  This principle even carries over to the private plans purchased by government employees.  Now, if, as the Democrats want, the government is going to dominate, micro-regulate, and subsidize the nation’s health care system – both government run and privately insured – then the question of how the Hyde principle will apply to these new programs arises immediately.

The answer is that Hyde’s logic runs the gamut of all the new health care expenditures and programs.  Therefore, Stupak-Pitts carries Hyde forward and refuses to buy into the accounting gimmicks that would give the Democrats cover for funding abortions.  Speaker Pelosi had a choice.  She could either allow a vote on Stupak’s amendment, or she could accept the defeat of her health care bill.  She chose to allow a vote on Stupak-Pitts, and her side lost.  To strip Stupak-Pitts from the bill now would be highly dishonest, and, if Stupak-Pitts can count votes, it will lead to the defeat of Obama-Pelosi health care in the House.

As for the claims that Stupak-Pitts is unconstitutional, they are wrong as well.

The major constitutional point here is that the Congress is given wide discretion in deciding how to spend money and fund or not fund certain activities.  This is true even if the activity in question rests on the exercise of a constitutional right.  The old saw is that merely because there is freedom of the press, the government doesn’t have to buy a writer a printing press, paper, and ink.  The abortion-promoting members of Congress need to tell us why the government should buy them their equivalent of a printing press.

The argument that Stupak-Pitts violates Establishment Clause principles is absurd.  Stupak-Pitts establishes no church or a favored religious organization.  It apparently came as a shock to Lynn Woolsey and Diana DeGette that Catholics are allowed to vote and petition their government.  While considering whether to import Guy Fawkes Day to the American calendar, they and their acolytes have issued various threats and slanders against the Papists.  Such claims probably won’t sway Justice Kennedy.  Furthermore, you don’t have to be a Christian to be pro-life.  Even atheists can read ultra-sounds.  Ask Bernard Nathanson, a physician and founder of the modern abortion movement whose viewing of fetal ultrasounds led him to reject abortion.

A series of liberal activist constitutional claims are also made against Stupak-Pitts.  Equal Protection Clause.  Substantive Due Process.  Privacy.  All the usual suspects.  In other words, the gamut of the “We’re liberals and we don’t like this law, so it’s unconstitutional” arguments.  Unfortunately for the Stupak opponents, each of these claims could be made against the Hyde Amendment, and the 1980 decision upholding the Hyde Amendment, Harris v. McRae, has stood for 30 years.  Furthermore, the public has held constant in its disapproval of government endorsement and promotion of abortion since Hyde’s first enactment.

Of course, all these arguments are academic in some sense.  What matters these days is the amount of raw judicial power that can be exercised by the Supreme Court’s judicial activists and policy makers.  Stevens, Breyer, Ginsburg, and Sotomayor will vote to overturn Hyde & Stupak.  It boils down to Justice Kennedy – - again.  Ain’t life grand in a judicial oligarchy?

Do Hacked Emails Show Global Warming Fraud?

The blogosphere is on fire today with reports that a UK climate change advocacy center had its email hacked and thousands of files have been re-posted online which suggest these activists have been playing fast and loose with scientific evidence of global climate change (or the lack thereof). 

The director of the University of East Englia Climate Research Unit has reportedly confirmed the re-posted emails are genuine.  Meanwhile, Australian media--including the Australian Herald-Sun--are reporting that these emails suggest there's an active conspiracy to hide information from the public that could unravel climate change theories.  Via Watt's Up With That:

A 62 megabyte zip file, containing around 160 megabytes of emails, pdfs and other documents, has been confirmed as genuine by the head of the University of East Anglia’s Climate Research Unit, Dr Phil Jones.

In an exclusive interview with Investigate magazine’s TGIF Edition, Jones confirms his organization has been hacked, and the data flying all over the internet appears to have come from his organisation.

“It was a hacker. We were aware of this about three or four days ago that someone had hacked into our system and taken and copied loads of data files and emails.”

Keith Johnson has commented on the Wall Street Journal's blog:

Some of the old emails from scientists made public apparently make references to things like “hid[ing] the decline,” referring to global temperature series and different ways to slice and dice climate data.

In all, it seems there are more than 3,000 files in the hacked folders, which have been reposted in various places on the Internet.

The big Copenhagen summit had lost a lot of its appeal in recent days, as world leaders kept dialing down expectations for the climate talks. Maybe this will spice things up.

Less TV, Not More Money, Easiest Way to Improve School Outcomes

Teachers unions and other left wing pressure groups cite disappointing American educational statistics and call for sharp increases in school spending—ignoring the fact that we already count among world leaders in per pupil expenditures.

The education establishment prefers to ignore the most obvious explanation for poor school performance in the U.S.—irresponsibly high levels of television viewing. According to 2007 figures from the International Telecommunication Union of the OECD, Americans are in front of the tube more than 8 hours a day—by far the highest of any society, and nearly three times the figures for nations such as Norway, South Korea, Switzerland and New Zealand—all of which achieve far better educational outcomes. Rather than wasting more taxpayer money, we need a concerted national effort to reduce TV addiction and the wasted hours that result.
